THE MINISTER OF POSTS AND TELECOMMUNICATIONS

On the basis of Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 41/2003/QĐ-BBCVT dated March 17, 2003 of the Minister of Posts and Telecommunications on the functions, tasks, powers, and organizational structure of the Radio Frequency Administration,

At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Radio Frequency Administration,

DECISION:

Article 1. The Radio Frequency Control Center in Region V is a unit subordinate to the Radio Frequency Administration responsible for inspecting and supervising the use of radio frequencies and radio transmitting equipment by domestic and foreign organizations and individuals within the territory of six provinces and cities: Hai Phong, Quang Ninh, Hai Duong, Hung Yen, Thai Binh, and Nam Dinh.

Article 2. The Radio Frequency Control Center in Region V has the following tasks and powers:

1. Supervise the transmission of radio waves from domestic broadcasting stations, foreign broadcasting stations transmitting to Vietnam in various radio services (fixed, mobile, maritime, air, broadcasting and television, positioning, navigation, satellite, amateur, and other radio services), and other radio transmitting devices within the Center's jurisdiction.

2. Measure technical parameters of broadcasting stations in various radio services and other sources of radio wave emissions. Compile inspection data and measurement results to serve frequency management work.

3. Detect violations of state regulations on the use of radio frequencies and radio transmitting equipment and handle them according to the law.

4. Conduct regular and spot checks, and guide users of radio frequencies and radio transmitting equipment within the Center's jurisdiction on compliance with laws and relevant state regulations.

5. Carry out inspections and supervision over radio transmitting equipment installed on aircraft, ships, and other foreign transportation means entering, staying, or docking at Vietnamese airports, seaports, and wharfs regarding their operations and related licenses and certificates concerning the use of radio information according to Vietnamese law.

6. Investigate and determine interference sources and handle harmful radio interference according to the law; prepare files for the Radio Frequency Administration to file complaints with international bodies regarding interference caused by foreign entities affecting Vietnam’s radio services within the Center's jurisdiction according to international regulations.

7. Participate in international radio frequency emission control programs and technical activities of the International Telecommunication Union (ITU) and other related international organizations as assigned by the Director of the Radio Frequency Administration.

8. Fulfill the tasks of the Radio Frequency Administration in coordinating with relevant state management agencies within the Center's jurisdiction in frequency and radio transmitting equipment inspection and supervision work according to the law.

9. Guide procedures, accept applications for frequency usage permits and radio transmitting equipment for frequency users within the Center's jurisdiction.

10. Collect radio frequency fees and other charges according to the authorization of the Director of the Radio Frequency Administration.

11. Manage the organization, cadres, civil servants, staff, assets, and documents of the Center according to the law, the Ministry of Posts and Telecommunications, and the delegation of the Director of the Radio Frequency Administration.

12. Perform other tasks assigned by the Director of the Radio Frequency Administration.

Article 3. The Radio Frequency Control Center in Region V has a Director, Deputy Directors, and a supporting administrative apparatus.

The Director of the Radio Frequency Control Center in Region V is responsible to the Director of the Radio Frequency Administration for the results of implementing the functions, tasks, and powers stipulated in Articles 1 and 2 of this Decision.

The Deputy Director assists the Director and is responsible before the Director for the assigned tasks.

Article 4. The organizational structure of the Radio Frequency Control Center in Region V includes:

1. The Radio Control Station.

2. The Inspection and Handling Section.

3. The Administrative and General Affairs Section.

The functions, tasks, and working relationships of units under the Center shall be established by the Director and submitted to the Director of the Radio Frequency Administration for decision.

The number of civil servants and workers of the Center shall be established by the Director and submitted to the Director for decision based on the cadre quota and contractual labor indicators assigned by the Ministry of Posts and Telecommunications.

Article 5. The Radio Frequency Control Center in Region V has legal personality, its own seal, and separate accounts for transactions according to the law, with headquarters located in Hai Phong City.

Article 6. This Decision takes effect fifteen days after its publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.

Article 7. The Director of the Radio Frequency Administration, the Head of the Office, the Director of the Cadre and Civil Servant Department, the Heads of units under the Ministry, and the Director of the Radio Frequency Control Center in Region V are responsible for implementing this Decision.
