Pursuant to the Law on Technical Standards and Regulations No. 68/2006/QH11 dated June 29, 2006 of the National Assembly of the Socialist Republic of Vietnam;

Pursuant to the National Reserve Ordinance No. 17/2004/PL-UBTVQH11 dated April 29, 2004 of the Standing Committee of the National Assembly;

Pursuant to the Government Decree No. 196/2004/NĐ-CP dated December 2, 2004 detailing the implementation of the National Reserve Ordinance;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance.

The Ministry of Finance hereby stipulates the standard fees for importing and exporting national food reserves at state reserve warehouses directly managed by the National Reserve General Department as follows:

Article 1. Scope of Regulation

This Circular stipulates the standard fees for importing and exporting national food reserves at state reserve warehouses directly managed by the National Reserve General Department (annexed).

Article 2. Usage and adjustment of standard fees for importing and exporting national food reserves

Clause 1. The standard fees for importing and exporting national food reserves stipulated in this Circular shall be used as a basis for building and implementing plans for importing and exporting national food reserves from the 2012 fiscal year. From 2013 to 2014, if the average price increase index reaches 5% or more, the storage fee standard for the planning year will be adjusted accordingly based on the average price increase index of the reporting year for products, goods, and services published by the General Statistics Office.

Clause 2. The Director of the National Reserve General Department shall guide and organize the implementation of these standard fees for importing and exporting according to this Circular and the provisions of Decision No. 21/2006/QĐ-BTC dated April 3, 2006 of the Minister of Finance on the issuance of regulations on the construction, issuance, and management of storage fee standards for national reserve goods, but not exceeding the prescribed standards.

Article 3. Implementation Organization

Clause 1. This Circular takes effect from February 2, 2012, and replaces Circular No. 196/2009/TT-BTC dated October 5, 2009 on the issuance of standard fees for importing and exporting national food reserves at state reserve warehouses.

Clause 2. Heads of units related to the management of national reserve goods are responsible for organizing the implementation thereof./.
