Regarding the issuance of conduct rules for inspection officers

GENERAL INSPECTOR

Pursuant to the Inspection Law on June 24, 2004;

Pursuant to the Anti-Corruption Law on November 29, 2005;

Pursuant to the Ordinance on Cadres and Civil Servants;

Pursuant to Decree No. 55/2005/NĐ-CP dated April 25, 2005 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Based on the proposal of the Director of the Cadre and Civil Service Department.

Article 1. Attached herewith are the Conduct Rules for Inspection Officers.

Article 2. Inspectors, civil servants, officials, employees, probationary civil servants, trial officials, and contractual workers currently working in state inspection agencies shall be responsible for implementing these Conduct Rules.

Article 3. Heads of departments and units under the Government Inspectorate, Chief Inspectors of ministries, Chief Inspectors of provinces and centrally governed cities shall be responsible for disseminating, supervising, and ensuring compliance with these Conduct Rules for inspection officers within their jurisdiction.

The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

ETHICAL RULES

CONDUCT OF INSPECTION OFFICERS

(Issued together with Decision No. 1860/QĐ-TTCP dated September 6, 2007 of the General Inspector)

Article 1. Conduct in performing duties and public service

1. Must comply with and set a good example in implementing the Party's guidelines and policies, the State's laws and regulations, continuously study, cultivate, and improve to enhance political capacity, professional ethics, and cultural behavior to fulfill assigned tasks effectively.

2. Perform the responsibilities, tasks, and public services of cadres, civil servants, and officials as prescribed by the Labor Code, the Ordinance on Cadres and Civil Servants, the Inspection Law, the Complaints and Petitions Law, the Anti-Corruption Law, and other relevant legal documents.

Article 2. Conduct in performing inspection tasks

1. Matters that inspection officers must perform:

a) Adhere strictly to principles, authority, procedures, and processes specified in the Inspection Law, the Regulation on Inspection Team Operations, and other relevant legal documents;

b) Maintain a cautious, objective, and comprehensive attitude when examining and evaluating matters; listen to and respect reasonable explanations from inspected entities; guide inspected entities to understand and comply with legal provisions;

c) Interact with inspected entities at the office or inspection site during regular working hours in accordance with principles of objectivity, transparency, and clarity;

d) Report to the decision-making authority and the head of the inspection team if an inspection officer has familial or close relationships with the inspected entity and request removal from the inspection team;

2. Matters that inspection officers must not perform:

a) Exploit the position of an inspection officer to commit illegal acts; accept money, assets, material benefits, or spiritual interests for personal gain, harassment, or causing difficulties and inconvenience to inspected entities; use facilities and assets of the inspected entity for personal needs;

b) Make recommendations, conclusions, or decisions contrary to the law; shield individuals who violate the law; coerce or suggest that inspected entities provide answers or statements according to the inspector's subjective wishes;

c) Obstruct or illegally interfere with inspection activities; disclose information about the inspection content before an official conclusion is made;

Article 3. Conduct in receiving citizens and handling complaints and petitions

1. Matters that inspection officers must perform:

a) Implement the Party's viewpoints and policies, handle citizen reception and complaints and petitions within the scope of authority, following the procedures and processes stipulated in the Complaints and Petitions Law, the Regulation on Citizen Reception, and other relevant legal documents;

b) Behave culturally, listen to, and respect citizens when they come to file complaints or petitions; guide and help complainants and petitioners understand and comply with legal provisions;

c) Be cautious and objective when reviewing, verifying, concluding, and recommending;

d) If violations that may cause damage to national interests or the legitimate rights and interests of citizens are discovered, report to competent authorities to take timely preventive measures;

2. Matters that inspection officers must not perform:

a) Harass, delay, or cause difficulties and inconvenience to complainants or petitioners;

b) Alter case files or results of complaint and petition resolution; coerce or suggest that complainants or petitioners present their cases according to the inspector's subjective wishes;

c) Illegally obstruct or interfere with the handling of complaints and petitions; disclose the names, addresses, signatures, or other information about petitioners;

Article 4. Conduct in performing anti-corruption tasks

1. Matters that inspection officers must perform:

a) When participating in anti-corruption inspection teams, follow the provisions of Clause 1, Article 2 of this Conduct Rule;

b) Adhere to principles, authority, procedures, and processes for verification and investigation related to anti-corruption as prescribed by law;

c) Provide truthful information and reports on anti-corruption work to agencies and organizations as prescribed by law;

d) Create conditions for the Vietnam Fatherland Front and its member organizations, enterprises, business associations, media, People's Inspection Committees, and citizens to participate in anti-corruption activities as prescribed by law;

2. Matters that inspection officers must not perform:

a) When participating in anti-corruption inspection teams, inspection officers must not engage in actions prohibited by Clause 2, Article 2 of this Conduct Rule;

b) Engage in actions that alter case files, information, reports, or misrepresent facts about anti-corruption efforts;

c) Take advantage of anti-corruption efforts to cause disturbances, disrupt internal unity, insult the dignity and reputation of individuals, and damage the credibility of agencies and organizations;

d) Exploit asset verification to cause difficulties, inconvenience, or obstruction to the normal operations of the verified individual; disclose information about the verified individual's assets illegally;

đ) Illegally obstruct or interfere with the process of resolving corruption cases.

Article 5. Conduct towards leaders and colleagues

1. Towards leaders and managers: Leaders and managers must build and maintain unity, ethics, and public service culture in the agency; promptly grasp the sentiments, respect, and promote democracy, experience, and creativity of inspection officers when performing tasks; protect the legitimate honor of inspection officers when there are unfounded accusations or complaints;

2. Towards inspection officers:

a) Implement the decisions of leadership and management; be proactive and creative, and take responsibility under the law when performing assigned tasks; if there is evidence that a superior's decision violates the law, report it immediately to the person who made the decision; if the decision must still be implemented, report it to the direct superior of the decision-maker and shall not be held responsible for the consequences caused by implementing the decision.

b) Shall not abuse comments or criticism to harm the reputation of leaders, managers, and colleagues.

3. With colleagues: Behave with cultural propriety, respect, and protect the legitimate honor and reputation of colleagues; cooperate and coordinate with colleagues sincerely, respecting and helping each other to complete assigned tasks effectively.

Article 6. Interacting with residents in the place of residence

1. Actively participate in promoting, disseminating, and educating the public about laws on inspection, complaints, accusations, anti-corruption, and other relevant legal documents.

2. Implement grassroots democracy regulations, participate in community activities, and be subject to supervision by the party organization, local authorities, mass organizations, and residents in the place of residence.

3. Shall not interfere illegally in the activities of agencies, organizations, and individuals in the place of residence; shall not participate, incite, instigate, or cover up illegal acts.

Article 7. Interacting with related agencies, organizations, and media

1. Provide information and materials regarding inspections, complaint resolution, accusation handling, and anti-corruption only to related agencies and organizations when there is a formal conclusion from the competent authority and upon assignment by leadership in accordance with the law.

2. Make statements and provide information and materials regarding inspections, complaint resolution, accusation handling, and anti-corruption to the media when there is a formal conclusion from the competent authority and upon assignment by leadership in accordance with the law.

Article 8. Interacting with foreign organizations and individuals

1. Comply with legal provisions and agency regulations when interacting with foreign agencies, organizations, and individuals.

2. Only provide information and materials and make statements on issues related to inspection work, complaint resolution, accusation handling, and anti-corruption when authorized by the competent authority.

Article 9. Interacting within the family

1. Actively promote, educate, and mobilize family members to strictly adhere to the policies and laws of the Party and the State.

2. Shall not allow parents, spouse, children, or siblings to exploit one’s name for personal or familial gain.

3. Shall not organize extravagant weddings, funerals, birthday celebrations, housewarming parties, or other events for personal or familial gain.

Article 10. Interacting in public places

1. Adhere to legal provisions and public conduct rules.

2. Shall not abuse position and power to create a favorable image when participating in social activities; shall not participate, assist, or cover up illegal acts.

3. Promptly inform competent agencies, organizations, and units about information on illegal acts.
