On the basis of Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;
Pursuant to Decision No. 41/2003/QĐ-BBCVT dated March 17, 2003 of the Minister of Posts and Telecommunications on the functions, tasks, powers, and organizational structure of the Radio Frequency Administration,
At the proposal of the Director of the Cadre and Civil Servant Department and the Director of the Radio Frequency Administration,
DECISION:
Article 1. The Seventh Regional Frequency Control Center is a unit under the Radio Frequency Administration responsible for inspecting and controlling the use of frequencies and radio transmitting equipment by domestic and foreign agencies, organizations, and individuals within the six provinces: Khanh Hoa, Lam Dong, Dak Lak, Phu Yen, Ninh Thuan, and Binh Thuan.
Article 2. The Seventh Regional Frequency Control Center has the following tasks and powers:
1. To control the transmission of radio waves from domestic broadcasting stations, foreign broadcasting stations transmitting to Vietnam, and other radio wave transmission activities (fixed service, mobile service, maritime service, air navigation service, broadcasting service, positioning service, radiolocation service, satellite service, amateur service, and other radio services), and other radio transmitting devices within its jurisdiction.
2. To measure technical parameters of broadcasting stations and other radio wave transmitters. To compile inspection data and measurement results to serve frequency management work.
3. To detect violations of state regulations on the use of frequencies and radio transmitting equipment and handle them according to the law.
4. To periodically and randomly inspect and guide users of frequencies and radio transmitting equipment within its jurisdiction regarding compliance with laws and related state regulations.
5. To conduct inspections and controls over radio transmitting equipment installed on foreign aircraft, ships, and other transportation means entering, exiting, or staying at Vietnamese airports, seaports, and docks concerning their operations and relevant licenses and certificates for the use of radio communication information according to Vietnamese law.
6. To investigate and determine sources of interference and handle harmful radio interference according to the law; to prepare files for the Radio Frequency Administration to lodge complaints with international bodies regarding foreign-caused interference affecting Vietnam's radio services within its jurisdiction according to international regulations.
7. To participate in international radio transmission control programs and technical activities of the International Telecommunication Union (ITU) and other related international organizations as assigned by the Director of the Radio Frequency Administration.
8. To perform the tasks of the Radio Frequency Administration in coordinating with relevant state management agencies within its jurisdiction in frequency and radio transmitting equipment inspection and control work according to the law.
9. To provide guidance on procedures, accept applications for frequency and radio transmitting equipment usage permits for users within its jurisdiction.
10. To collect frequency radio communication fees and other charges according to the authorization of the Director of the Radio Frequency Administration.
11. To manage the organization, cadres, civil servants, employees, assets, files, and documents of the Center according to the law, the Ministry of Posts and Telecommunications, and the delegation of the Director of the Radio Frequency Administration.
12. To perform other tasks assigned by the Director of the Radio Frequency Administration.
Article 3. The Seventh Regional Frequency Control Center has a Director, Deputy Directors, and a support staff.
The Director of the Seventh Regional Frequency Control Center is responsible to the Director of the Radio Frequency Administration for the results of performing the functions, tasks, and powers stipulated in Article 1 and Article 2 of this Decision. The Deputy Directors assist the Director and are responsible to the Director for the tasks delegated to them.
Article 4. The organizational structure of the Seventh Regional Frequency Control Center includes:
1. The Radio Control Station.
2. The Inspection and Handling Section.
3. The Administrative and General Section.
The functions, tasks, and working relationships of units under the Center shall be established by the Director and submitted to the Director of the Radio Frequency Administration for decision.
The number of civil servants and workers of the Center shall be established by the Director and submitted to the Director for decision based on the cadre quota and contractual labor indicators assigned by the Ministry of Posts and Telecommunications.
Article 5. The Seventh Regional Frequency Control Center has legal personality, its own seal and separate account for transactions according to the law, with headquarters located in Nha Trang City - Khanh Hoa Province.
Article 6. This Decision takes effect fifteen days after its publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.
Article 7. The Director of the Radio Frequency Administration, the Head of the Office, the Director of the Cadre and Civil Servant Department, the Heads of units under the Ministry, and the Director of the Seventh Regional Frequency Control Center are responsible for implementing this Decision./.
