THE MINISTER OF TRANSPORTATION
Considering the proposal of the Head of the Cadre and Civil Service Department,
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Considering the proposal of the Director of the Vietnam Railway Administration and the Head of the Cadre and Civil Servant Department,
DECISION:
Article 1: Position and functions:
The Vietnam Railway Administration is under the Ministry of Transport, performing state management functions in the railway transport sector throughout the country.
The Vietnam Railway Administration has legal personality, its own seal, receives funding from the state budget, can open accounts at the State Treasury, and has its headquarters in Hanoi city.
Name in English: Vietnam Railway Administration, abbreviated as VNRA.
Article 2: Tasks and powers:
1. Develop and submit to the Minister strategies, planning for long-term development, five-year plans, annual plans, national programs, projects, and proposals on developing railway transport throughout the country.
2. Participate in drafting laws and ordinances on railways; take the lead in drafting other regulatory legal documents concerning the railway sector according to the Minister's assignment.
3. Develop and submit to the Minister for issuance standards, procedures, regulations, economic-technical norms, policies, and rules for specialized state management in railway transport.
4. Organize and inspect the implementation of strategies, plans, regulatory legal documents, and specialized economic-technical standards, procedures, and norms after approval and issuance.
5. Take the lead or coordinate in disseminating information, promoting, and educating the law on railway transport.
6. Regarding railway transport infrastructure:
a. Manage investment and construction for infrastructure projects within the railway transport sector according to the Minister's classification;
b. Organize technical design reviews, approve total budgets, and project budgets for major repair works of railway infrastructure funded by the economic business funds submitted by the Vietnam Railway Corporation;
c. Implement permits for closing and opening dedicated railway lines, stations, and first and second-class crossings on national railway lines according to the Minister's classification;
d. Review and propose the Minister to approve plans for repairing and maintaining railway infrastructure systems funded by the economic business funds submitted by the Vietnam Railway Corporation; allocate plans for repairing and maintaining railway infrastructure systems to the Vietnam Railway Corporation according to the Minister's authorization;
đ. Organize inspections and supervision of the implementation of annual economic business fund plans by the Vietnam Railway Corporation;
e. Participate in reviewing final reports on annual economic business funds by the Vietnam Railway Corporation;
f. Monitor and coordinate directives on disaster prevention and aftermath mitigation work in the railway sector.
7. Regarding railway transport vehicles and specialized loading and construction equipment:
a. Organize registration and issuance of license plates for railway transport vehicles, loading and construction equipment according to legal provisions;
b. Coordinate with the Vietnam Vehicle Inspection Agency in establishing technical standards for locomotives, carriages, rail cars, and other transport means and specialized loading and construction equipment in the railway sector.
8. Develop and submit to the Minister for issuance regulations on:
a. Conditions, capabilities, professional and vocational training standards required for personnel operating transport vehicles and specialized equipment in the railway sector;
b. Management of training, issuing certificates, licenses, and qualifications for personnel operating transport vehicles and specialized equipment in the railway sector;
c. Conditions and standards for establishing and operating training institutions and examination centers for personnel operating transport vehicles and specialized equipment in the railway sector;
d. Conditions and standards for trainers, examiners, and issuers of licenses for personnel operating railway transport vehicles.
9. Regarding railway transport operations:
a. Develop and submit to the Minister for issuance mechanisms and policies for developing transport and related services in railway transport;
b. Develop and submit to the Minister for publication railway public transport routes and networks; fare rules, regulations, standards, and operational procedures for railway transport;
c. Approve annual train schedules for passenger services in the railway sector;
d. Participate in formulating regulations on single-mode and multimodal transport to meet cargo and passenger transportation needs between regions and international transport.
10. Participate in formulating freight rates or fares for exclusive transport services and services subsidized by the state or assigned to enterprises.
11. Advise the Minister on coordinating with local authorities and relevant agencies to protect railway transport infrastructure and ensure railway transport safety; guide and inspect the coordination of the Vietnam Railway Corporation with local authorities and relevant agencies in protecting railway transport infrastructure and ensuring railway transport safety; direct traffic inspection activities within the Vietnam Railway Corporation.
12. Develop and submit to the Minister plans for international cooperation in railways; participate in drafting, negotiating, and signing international treaties and organizations concerning railways according to the Minister's assignment; organize the implementation of international cooperation activities according to the management hierarchy.
13. Implement scientific research and application of advanced science and technology in the railway transport sector using state budget funds.
14. Develop and implement a reform program for the Administration in accordance with the objectives and content of the state administrative reform program and the Ministry of Transport.
15. Inspect, investigate complaints, accusations, anti-corruption, and handle violations of railway transport laws within the scope of the Administration's authority.
16. Establish and submit to the Minister for decision the organizational structure, civil servant structure, and staffing of the Bureau; manage the organizational apparatus, use the approved staffing according to regulations; implement salary systems and incentive policies, rewards, and disciplinary measures for state officials, civil servants, and public employees under the Bureau's jurisdiction.
17. Manage financial resources and assets assigned, and organize the implementation of the budget allocated according to regulations.
18. Performing other tasks assigned by the Minister.
Article 3: Organizational Structure:
1. Departments assisting the Director in performing State management functions:
a. Planning and Finance Department;
b. Infrastructure Department;
c. Transport and Legal Affairs Department;
d. Traffic Inspection Department;
đ. Office.
2. The Director and Deputy Directors:
a. The Director of the Vietnam Railway Administration is responsible to the Minister of Transport for performing tasks and exercising State management powers in the specialized field of railway transport;
b. The Director of the Vietnam Railway Administration is appointed and relieved from duty by the Minister of Transport for a term of five years.
c. The Deputy Directors of the Vietnam Railway Administration are appointed and relieved from duty by the Minister of Transport upon the recommendation of the Director for a term of five years.
Article 4: Effective Date:
THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.
Article 5: Responsibility for Implementation:
The Heads of the Ministry’s Office, the Director of the Vietnam Railway Administration, the Heads of Departments, the Chairpersons of People's Committees of provinces and centrally governed cities, the Directors of Transportation Departments (Transport and Public Works Departments), and the Heads of units under the Ministry are responsible for implementing this Decision./.
