Decision No. 19/2004/QĐ-BBCVT on international telecommunications circuit leasing service rates for Internet Exchange Points (IXPs) to be used for international Internet connections provided by enterprises.

DECISION OF THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Issuing the rates for international telecommunication channel leasing services of Vietnam Post and Telecommunications Corporation Male applicable to service providers Considering the proposal of Vietnam Post and Telecommunications Corporation at Circular No. 27/GCTT-HĐQT dated January 28, 2005 regarding the plan to reduce channel leasing rates;

THE MINISTER OF POSTS AND TELECOMMUNICATIONS

Pursuant to Decree No. 90/2002/ND-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on managing service charge prices for postal and telecommunications services;

Considering the proposal of Vietnam Post and Telecommunications Corporation at Document No. 287/GCTT dated January 19, 2004 regarding the rates for leasing dedicated channels;

At the proposal of the Director of the Department of Planning and Finance,

DECISION:

Article 1. Issuing the rates for leasing international telecommunication channels of Vietnam Post and Telecommunications Corporation applicable to Internet Exchange Points (IXPs) leasing to connect to international Internet as follows:

1. Connection and initial installation costs shall be stipulated by Vietnam Post and Telecommunications Corporation.

2. Monthly rates for segmented international channel leasing:

2.1. In cases where IXPs connect at coastal stations of submarine cables (Ba Ria-Vung Tau province, Da Nang city) or at satellite ground stations (Ha Tay province, Binh Duong province):

Unit of measurement: USD/half-channel/month

2.2. In cases where IXPs connect at the International Transmission Center of the Corporation (in Hanoi city, Ho Chi Minh city):  2.3. In cases where IXPs connect from other provinces/cities to coastal stations of submarine cables, satellite ground stations, or connect to the International Transmission Center of the Corporation: The channel leasing rates shall be calculated as follows:

Unit of measurement: USD/half-channel/month

2.3.1- Half-channel international leasing rates as stipulated at point 2.1 or 2.2, section 2, Article 1 above, depending on the transmission method and connection point used by the IXPs.

2.3.2- Rates for inter-provincial telecommunication channel leasing (if any) to connect from the province/city where the IXP's channel ends to the nearest coastal station of submarine cables, satellite ground station, or International Transmission Center of the Corporation: To be implemented according to the current inter-provincial telecommunication channel leasing rate table (floor rate).

2.3.3- Provincial channel leasing rates (including intra-district transmission):

2.3.3.1. For Hanoi, Ho Chi Minh City, and Da Nang cities, divided into two levels:

2.3.3.1.1. Not exceeding 85% of the rate of the same speed (level 1) in the table of rates for leasing dedicated intra-city channels for cases where the customer's end point is within the inner city districts;

2.3.3.1.2. Not exceeding 85% of the rate of the same speed (level 2) in the table of rates for leasing dedicated intra-city channels

for cases where the customer's end point is located in suburban counties.  2.3.3.2. For the remaining provinces/cities, divided into two levels:

2.3.3.2.1. Not exceeding 50% of the rate of the same speed (level 1) in the table of rates for leasing dedicated inter-provincial channels for cases where the end point is within the urban area, district town of the province, or inner city districts of centrally-administered municipalities;

2.3.3.2.2. Not exceeding 50% of the rate of the same speed (level 2) in the table of rates for leasing dedicated inter-provincial channels for all other cases.

3. The aforementioned rates do not include Value Added Tax (VAT).

This Decision takes effect from May 1, 2004. All previous regulations contrary to this Decision are abolished.

Article 2. The Head of the Office, Director of the Planning and Finance Department, General Director of Vietnam Post and Telecommunications Corporation, and related units are responsible for implementing this Decision./.

Article 3. The Director of the Office, the Head of the Planning and Finance Department, the General Director of Vietnam Post and Telecommunications Corporation, and relevant units shall be responsible for implementing this Decision./.
