THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Government Decree No. 178/2007/NĐ-CP dated December 3, 2007, stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,
DECREE:
Article 1. Amending and supplementing Points c, d, g, h, and i, Clause 5, Article 2 of the Government Decree No. 25/2008/NĐ-CP dated March 4, 2008, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment.
1. Amend and supplement point c as follows:
“c) To take the lead in coordinating with relevant ministries and sectors in drafting and submitting to the Government for promulgation and adjustment of the framework of land prices; guiding methods for determining land prices; directing, guiding, and inspecting the establishment and adjustment of land price lists, and guiding the resolution of issues related to the establishment, adjustment, and application of land price lists upon the proposal of provincial People's Committees; guiding the provision of information related to land prices for financial authorities to check, audit, and resolve complaints and denunciations regarding specific land valuation; compiling and providing data and information on the framework of land prices and land price lists;”
2. Amend Point d as follows:
“d) To guide and inspect the surveying, measurement, and creation of cadastral maps, current land use status maps, and land use planning maps; the preparation and adjustment of land use plans and land allocation plans; the granting of land use rights, leasing of land, recovery of land, change of land use purposes; the registration of land use rights and ownership and use rights of attached assets; the establishment and management of cadastral records; the issuance of certificates of land use rights, ownership of houses, and other attached assets; the implementation of rights and obligations of land users as prescribed by law;”
3. Amending and supplementing Point g as follows:
“g) To guide and inspect the implementation of legal provisions on compensation, support, and resettlement; to take the lead in coordinating with relevant ministries and sectors in guiding the resolution of issues related to compensation, support, and resettlement policies upon the proposal of provincial People's Committees; to guide the determination of land users eligible for compensation, support, or non-compensation, non-support; to guide the issuance of certificates of land use rights, ownership of houses, and other attached assets for resettled persons; to stipulate and guide the management of land in resettlement areas;”
4. Amending Point h as follows:
“h) To take the lead in coordinating with relevant ministries and sectors in directing, guiding, and inspecting the recovery of land, development of land funds, auctioning of land use rights, and tendering of projects using land;”
5. Amending Point i as follows:
“i) To issue and manage the use of blank certificates of land use rights, ownership of houses, and other attached assets;”
Article 2. Effective Date
This Decree takes effect from May 1, 2010.
Article 3. Responsibility for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree.
