Article 1
1. The fee for reissuing a health insurance card is a charge levied on individuals participating in health insurance after having received a health insurance card from the health insurance management agency and losing it, now being reissued.
2. The fee for replacing a health insurance card is a charge levied on individuals participating in health insurance after having received a health insurance card from the health insurance management agency and damaging or rendering it unusable, now being replaced.
3. No fee shall be charged in cases where the card is replaced due to changes in the initial healthcare registration place or errors in the information recorded on the card caused by the establishment of the list of health insurance participants by the relevant unit.
Article 2
The level of fees for reissuing and replacing health insurance cards is regulated as follows:
1. Fee for reissuing a health insurance card: VND 4,000/card;
2. Fee for replacing a health insurance card: VND 2,000/card.
Article 3
The agency with the function and duty of issuing, reissuing, and replacing health insurance cards is the agency collecting the fee for reissuing and replacing health insurance cards as stipulated in this Circular (hereinafter referred to as the collecting agency).
Article 4
The revenue from the fee for reissuing and replacing health insurance cards is a state budget revenue, managed and used as follows:
1. The collecting agency is entitled to retain 90% (ninety percent) of the collected fee revenue to cover costs for the verification, examination, and collection of fees as specified below:
a) Payment to individuals directly responsible for verification, examination, and collection of fees: salary, wages, allowances, contributions according to regulations based on salary (excluding salary expenses for officials and civil servants already receiving state budget salaries under prescribed regulations), overtime bonuses according to laws for officials and employees of the collecting agency;
b) Costs for verification, inspection, and cross-checking of reissuance and replacement of health insurance cards.
c) Direct service costs for verification and collection such as data search, office supplies, office materials, communication, electricity, water, updating health insurance card database according to current standards and norms;
d) Purchase of materials, raw materials, and other direct costs related to verification, examination, and collection;
đ) Rewards and welfare for staff directly involved in verification, examination, and collection work within the unit, following the principle of an average of up to three months' actual salary if the annual revenue exceeds the previous year, and up to two months' actual salary if the annual revenue is lower or equal to the previous year, after ensuring the costs specified in points a, b, c, and d of this clause.
e) Annually, the collecting agency must settle accounts based on actual figures. After settling accounts according to regulations, any unspent fee revenue may be carried over to the next year for continued expenditure according to prescribed regulations. The fee revenue allocated to the collecting agency for covering costs for verification, examination, and collection does not reflect in the state budget.
2. The total actual fee revenue, after deducting the amount retained according to the ratio stipulated in Clause 1 of this Article, the remaining amount (10%) must be paid into the state budget according to the corresponding chapter, type, item, sub-item of the current State Budget Classification.
Article 5
Other contents related to registration, declaration, collection, payment, management, use, and public disclosure of the fee collection system for reissuing and replacing health insurance cards not mentioned in this Circular shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002; Circular No. 45/2006/TT-BTC dated May 25, 2006 amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal provisions on fees and charges; and Circular No. 60/2007/TT-BTC dated June 14, 2007 guiding the implementation of certain articles of the Tax Administration Law and guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 of the Government detailing the implementation of certain articles of the Tax Administration Law.
Article 6
This Circular takes effect forty-five days from the date of signature.
In the course of implementation, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance./.
