Regulations on Conditions for Operating Sports Facilities Organizing Paragliding and Motorized Kite Flying Activities

Pursuant to the Law on Physical Education and Sports No. 77/2006/QH11 dated November 29, 2006;
“1. Position
Article 1. Other types of artistic performances
Pursuant to Decree No. 36/2008/NĐ-CP dated March 28, 2008 of the Government on the management of unmanned aircraft and ultralight aircraft;
Pursuant to Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies encouraging socialization in education, vocational training, healthcare, culture, sports, and environmental activities;
Pursuant to Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Civilian Militia and Self-Defense;
The Ministry of Culture, Sports and Tourism hereby stipulates conditions for operating sports facilities organizing paragliding, motorized paragliding (hereinafter referred to collectively as paragliding), and motorized kite flying activities as follows:
Article 1. Scope of Regulation
This Circular specifies requirements for fields, training equipment, and specialized staff at sports facilities organizing paragliding and motorized kite flying activities. Traditional kite flying activities are not subject to the provisions of this Circular.
Article 2. Applicability
This Circular applies to organizations and individuals organizing paragliding and motorized kite flying activities in Vietnam.
Article 3. Explanation of Terms
In this Circular, the following terms shall be understood as follows:
1. Paragliding (Paragliding) is an aviation sport where the pilot sits in a harness suspended beneath a wing-shaped glider, controls it with two steering lines, and takes off by running.
2. Motorized Paragliding (Paramotor) is an aviation sport where the pilot wears a motor on their back that provides enough thrust for takeoff and flight using a paraglider wing.
3. Motorized Kite Flying is an aviation sport using a triangular wing and a motor to provide thrust for flight. Motorized kites are often equipped with wheel or float systems to allow takeoff and landing similar to airplanes on land or water.
Article 4. Issuance of Certificate of Eligibility for Operation
1. A sports facility organizing paragliding and motorized kite flying activities must be a sports enterprise and must obtain a business eligibility certificate according to the procedures specified in Clause 5, Article 55 of the Law on Physical Education and Sports when conducting such activities.
2. When organizing training and competition activities in high-performance paragliding and motorized kite flying, sports facilities must meet the conditions stipulated in Article 43 of the Law on Physical Education and Sports, the Law on Paragliding Competition, and the Law on Motorized Kite Flying Competition.
Article 5. Training and Competition Equipment for Non-Motorized Paragliding
1. A sports facility organizing non-motorized paragliding training and competitions must be equipped with necessary safety devices: main parachute, seat harness, reserve parachute, altitude measuring device, global positioning system, walkie-talkie, helmet.
2. The form of non-motorized paragliding must comply with local customs, traditions, and cultural heritage.
Article 6. Training and Competition Equipment for Motorized Paragliding and Motorized Kite Flying
1. A sports facility organizing motorized paragliding and motorized kite flying training and competitions must have helmets, safety harnesses, reserve parachutes, and communication equipment.
2. A sports facility organizing motorized paragliding and motorized kite flying training and competitions must undergo quality and technical safety inspections.
3. The form of motorized paragliding and motorized kite flying must comply with local customs, traditions, and cultural heritage.
4. A sports facility organizing motorized paragliding and motorized kite flying activities must have fire prevention and firefighting systems, and sufficient first aid supplies and equipment.
Article 7. Take-off area, landing area, and airspace
1. The take-off area, landing area, and airspace for paragliding and motorized kite flying are areas of land, water, and sky (hereinafter referred to collectively as the flight activity area) that are granted by competent state authorities.
2. The flight activity area for paragliding and motorized kite flying must have a permit issued by the Operations Directorate of the General Staff Department.
Article 8. Signage in the take-off area and landing area
1. Signage placed in the take-off area and landing area must be located in suitable positions that are easily noticeable.
2. Signage for individuals participating in paragliding and motorized kite flying sports activities must include the following contents: ensuring safety; not consuming alcohol or beer and using stimulants; not operating aircraft outside the permitted flight activity area.
3. Signage for individuals not participating in paragliding and motorized kite flying sports activities when entering the take-off area and landing area must comply with security, public order, social safety regulations, respect and maintain natural scenery and the environment, follow flight area regulations; refrain from actions that obstruct or cause difficulties for paragliding and motorized kite flying activities.
4. Sports organizations organizing paragliding and motorized kite flying activities must clearly indicate on the signage the contact number of the person responsible for air management, radio frequency, and communication procedures when necessary.
Article 9. Instructors and guides for non-motorized paragliding
1. Instructors and guides must have professional qualifications recognized by the General Department of Sports and Physical Training or national professional associations for paragliding.
2. Instructors and guides specified in Clause 1 of this Article must have a valid health certificate issued by a health authority at the district level or higher before flying, which is valid for a maximum period of up to 12 months.
Article 10. Instructors and athletes for motorized paragliding and motorized kite flying
1. Instructors training athletes for motorized paragliding and motorized kite flying must have professional qualifications obtained through training and certification by the Air Defense-Air Force Military Service of the Ministry of National Defense or training institutions of domestic and international paragliding and kite flying associations recognized by the General Department of Sports and Physical Training.
2. Instructors and athletes specified in Clause 1 of this Article must have a valid health certificate issued by a health authority at the district level or higher before participating in flight activities and must undergo periodic health checks at least once every 12 months.
3. Athletes for motorized paragliding and motorized kite flying must be trained according to curricula and training programs approved by authorized bodies.
Article 11. Conditions for communication information and rescue safety
1. Communication Information: Sports organizations organizing motorized paragliding and motorized kite flying activities must equip a communication system to ensure requirements for communication from the control center to the paragliding and motorized kite flying activity areas within their management responsibility and relevant competent authorities.
2. Safety, search, and rescue:
a) Sports organizations organizing motorized paragliding and motorized kite flying activities must have a plan clearly outlining safety measures, search, and rescue plans in the flight activity area within their management responsibility and must regularly review and update this plan.
b) Sports organizations organizing motorized paragliding and motorized kite flying activities must disseminate and guide participants to understand the communication methods and steps for search and rescue operations.
Article 12. Implementation Organization
1. The General Department of Sports and Physical Training is responsible for disseminating, monitoring, and inspecting the implementation of this Circular.
2. Cultural, Sports, and Tourism Inspectors will conduct inspections and handle violations of professional conditions when organizing motorized paragliding and motorized kite flying activities according to their authority.
3. Provincial Departments of Culture, Sports and Tourism under the central government are responsible for implementing this Circular.
Article 13. Effective Date
This Circular takes effect from January 20, 2012.
During the implementation process, if any issues arise, agencies and individuals should report them to the Ministry of Culture, Sports, and Tourism for timely research and supplementation./.
