Pursuant to the Road Traffic Law dated November 13, 2008:
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality;
Pursuant to Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Commercial Law regarding international trade activities and foreign-related purchasing, selling, manufacturing, and transiting goods;
||| The Minister of Transport and the Minister of Finance jointly issue this Circular guiding the valuation methods and price management of public goods and services in the field of inland waterway management and maintenance carried out under the government procurement method using central budget funds.
The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.
The Minister of Transport promulgates this Circular amending and supplementing certain articles of Circular No. 23/2009/TT-BGTVT dated October 15, 2009 of the Minister of Transport on technical quality and safety inspection and environmental protection for specialized motorcycles (hereinafter referred to as Circular No. 23/2009/TT-BGTVT), Circular No. 44/2012/TT-BGTVT dated October 23, 2012 of the Minister of Transport on technical quality and safety inspection and environmental protection for imported motorcycles and motorbikes and imported engines used to produce and assemble motorcycles and motorbikes (hereinafter referred to as Circular No. 44/2012/TT-BGTVT) and Circular No. 41/2013/TT-BGTVT dated November 5, 2013 of the Minister of Transport on technical quality and safety inspection for electric bicycles (hereinafter referred to as Circular No. 41/2013/TT-BGTVT).
Article 1. Amending and supplementing certain articles and Appendices of Circular No. 23/2009/TT-BGTVT as follows:
1. Amending Clause 3 of Article 5 as follows:
"3. When there is doubt about the condition of the frame number or engine number of specialized motorcycles being erased, altered, or resealed, the quality inspection agency will request an appraisal from a specialized appraisal agency to handle the situation specifically."
2. Supplement Clause 4 of Article 6 as follows:
"4. For used tractor chassis with attached engines (including new chassis with attached used engines or used chassis with new attached engines) imported or specialized motorcycles with frame numbers or engine numbers (except for the engine numbers of electric motors used to move specialized motorcycles) that have been erased, altered, or resealed, the quality inspection agency shall handle as follows:
a) Stop all procedures for inspecting and certifying the technical quality and environmental protection of imported specialized motorcycles;
b) Record the violation status of the specialized motorcycle in accordance with the model specified in Appendix XI issued together with this Circular;
c) Within no more than three working days from the date of the violation conclusion, the quality inspection agency shall notify in writing the importing organization or individual and the Customs Office (where import procedures were handled) to resolve according to regulations."
3. Supplement Appendix XI to Circular No. 23/2009/TT-BGTVT corresponding to Appendix I issued together with this Circular.
Article 2. Amending and supplementing certain articles and Appendices of Circular No. 44/2012/TT-BGTVT as follows:
1. Supplement Point c Clause 3 of Article 6 as follows:
"c) For used vehicles (excluding imported or temporarily imported vehicles not for commercial purposes as stipulated in Clause 5 of Article 5 of this Circular) or vehicles with frame numbers or engine numbers that have been erased, altered, or resealed, the Quality Inspection Agency shall handle as follows: Stop all procedures for inspecting and certifying the technical quality and environmental protection of imported vehicles and record the violation status of the vehicle in accordance with the model specified in Appendix VI issued together with this Circular;
Within no more than three working days from the date of recording the violation, the Quality Inspection Agency shall notify in writing the importing organization or individual and the Customs Office (where import procedures were handled) to resolve according to regulations."
2. Supplement Appendix VI to Circular No. 44/2012/TT-BGTVT corresponding to Appendix II issued together with this Circular.
Article 3. Amend and supplement some articles and the Appendix of Circular No. 41/2013/TT-BGTVT as follows:1. Supplement Point d Clause 2 Article 8 as follows:
“d) In the case where Imported Vehicles are used vehicles, the Management and Control Authority shall handle as follows: suspend all procedures for inspecting, certifying the technical safety and environmental protection quality of imported electric bicycles, and prepare a record noting the violation status of the Imported Vehicle according to the model prescribed in Appendix V issued together with this Circular.
Within no more than 03 (three) working days from the date of the violation record, the Management and Control Authority shall notify in writing the organization or individual importing the vehicle and the Customs Office (where the import procedures were handled) to resolve in accordance with the regulations.”
2. Supplement Appendix V to Circular No. 41/2013/TT-BGTVT corresponding to Appendix III issued together with this Circular.
1. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments under the Ministry, the Director of the Vietnam Motor Vehicle Inspection Agency, and the Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular.
Article 4. Effective date
The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Road Administration, Directors of Provincial Departments of Transport under the Central Government, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Circular./.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
2. During the implementation process, if there are any difficulties, organizations and individuals related to this matter shall promptly reflect them to the Ministry of Transport for consideration and resolution./.
