Amending and supplementing some Articles of Circular No. 20/2010/TT-BXD dated October 27, 2010 of the Ministry of Construction guiding the pilot construction and publication of certain indices to evaluate the real estate market

BASED ON Decree No. 62/2013/ND-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 153/2007/NĐ-CP dated October 15, 2007 of the Government detailing and guiding the implementation of the Law on Real Estate Business;
At the proposal of the Director of the Institute of Construction Economics and the Director General of the Department of Housing Management and Real Estate Market;
The Minister of Construction hereby promulgates this Circular amending and supplementing some Articles of Circular No. 20/2010/TT-BXD dated October 27, 2010 of the Ministry of Construction guiding the pilot construction and publication of certain indices to evaluate the real estate market (hereinafter referred to as Circular No. 20/2010/TT-BXD).
Article 1. Amending and supplementing some provisions and replacing and supplementing some annexes of Circular No. 20/2010/TT-BXD as follows:
1. Amending and supplementing Clause 2 of Article 1 as follows:
"2. The indices published according to the guidance of this Circular serve as a basis for relevant agencies, organizations, and individuals to refer to and use in managing the real estate market at the local level; to refer to in the valuation of real estate."
2. Amending and supplementing Clause 1 of Article 3 as follows:
"1. Apartment buildings are classified into types including affordable, mid-range, and high-end. The provincial Construction Department shall carry out the classification of apartment buildings in accordance with the situation and characteristics of the locality based on criteria such as location, architecture, quality of completion, and price."
3. Amend and supplement Clause 1 of Article 5 as follows:
"1. The base period selected is the first quarter of 2011. In cases where data for the base period in the first quarter of 2011 cannot be collected for certain types of real estate, the base period may be chosen from subsequent years but not later than 2013."
4. Supplement Clause 3 Article 8 as follows:
"3. The content of the publication is specified according to the form in Annex 4 of this Circular."
5. Amend and supplement Clause 2 of Article 9 as follows:
"2. Publication time
a) For indices published quarterly: the publication shall be carried out before the first day of the first month of the quarter following the quarter to be published.
b) For indices published annually: the publication shall be carried out before January 30 of the following year."
"Article 10. Collateral for Loans
"Quarterly and annually, the agency entrusted to organize the construction of the indices in the cities designated for the pilot program shall be responsible for publishing the indices on the electronic information website or portal of the provincial Construction Department, the People's Committee of the city, and other mass media."
7. Supplement Clause 3 of Article 11 as follows:
"3. Organize training and guide business practices regarding the construction of indices as required."
8. Amend and supplement Article 12 as follows:
Article 12. The People's Committees of the cities implementing the pilot program shall be responsible for
1. Directing the organization of the implementation of the provisions of this Circular.
2. Issuing regulations on coordination to implement the construction and publication of indices evaluating the real estate market among relevant departments and units.
3. Entrusting the Construction Department:
a) To take the lead and coordinate with related units to establish a database on transaction prices of real estate, the number of real estate transactions, and to construct and publish the indices as prescribed in this Circular. The initial publication of the indices shall be conducted from the third quarter of 2011. In cases where the base period is selected after the first quarter of 2011 for certain types of real estate, the initial publication of the indices shall be conducted from the next quarter after the base period.
b) To develop plans and prepare budgets for approval by the People's Committee of the city to organize the construction and publication of indices evaluating the real estate market.
c) To compile and report periodically on the publication of indices to the People's Committee of the city and the Ministry of Construction for monitoring and inspection.
4. Entrusting the following agencies and units to provide information; to aggregate and store relevant transaction data; to submit results to the Construction Department before the 30th of the third month of each quarter. Specifically as follows:
a) Department of Natural Resources and Environment: to provide information and data related to land prices through surveys, assessments, and the establishment of land price tables (according to Form 1 of Annex 2); the number of certificates of land use rights and ownership certificates of houses issued through transactions reported in the quarter (according to Form 2 of Annex 2);
b) Department of Justice: to provide information and data on the number of real estate transactions and their value in the reported quarter through notarized contracts of notary offices (according to Forms 3, 4, and 5 of Annex 2); to conduct statistics on real estate transaction prices from notarized contracts (according to Form 6 of Annex 2);
c) City Tax Department: to provide information and data related to the number of transactions of each type of real estate, rental values of office space through tax declarations (according to Forms 7 and 8 of Annex 2); information on budget revenue from stamp duty on houses and land of districts and counties in the reported quarter (according to Form 9 of Annex 2);
5. To allocate financial resources to organize the construction and publication of indices."
9. Replacing the annexes of Circular No. 20/2010/TT-BXD as follows:
a) Replacing Annex 1 of Circular No. 20/2010/TT-BXD with Annex 1 attached hereto.
b) Replacing Annex 2 of Circular No. 20/2010/TT-BXD with Annex 2 attached hereto.
c) Replacing Annex 3 of Circular No. 20/2010/TT-BXD with Annex 3 attached hereto.
10. Supplementing Annex 4 attached hereto.
Article 2. Implementation clause
1. This Circular takes effect from February 1, 2015.
2. During the implementation process, if there are difficulties, please send comments to the Ministry of Construction for study and resolution./.
