Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation
2. This Circular does not apply to the issuance, renewal, replacement of certificates for weapon usage, management certificates for weapons and auxiliary tools, and training for subjects under the management of the Ministry of National Defense.
1. Agencies, organizations, units equipped with, managing, and using weapons and auxiliary tools.
Article 2. Applicability
2. Individuals assigned to use and store weapons and auxiliary tools.
2. Individuals entrusted with the use and storage of warehouses or places storing weapons, auxiliary tools.
Clause 3. Units and local public security agencies.
4. Officers and non-commissioned officers (hereinafter referred to as cadres) engaged in training, issuing, renewing, replacing certificates for weapon usage, management certificates for weapons and auxiliary tools.
5. Agencies, organizations, and individuals related to training, issuing, renewing, replacing certificates for weapon usage, management certificates for weapons and auxiliary tools.
Article 3. Principles for issuing, renewing, replacing certificates for weapon usage, management certificates for weapons and auxiliary tools, and training on managing and using weapons and auxiliary tools
1. Adhere to the provisions of the Ordinance on the management and use of weapons, explosives, and auxiliary tools, the provisions of this Circular, and other relevant laws.
2. Strictly prohibit the abuse of assigned tasks to harass, cause inconvenience, or infringe upon the interests of the State, the rights, and legitimate interests of agencies, organizations, and individuals.
Article 4. Requirements and standards for cadres training on managing and using weapons and auxiliary tools
1. Cadres assigned theoretical training tasks must have a bachelor's degree or higher in public security administration from a university, specializing in social order management, possessing appropriate legal and professional knowledge corresponding to the training content. In cases where they are trained in a different specialty or graduated from a non-public security university, they must be further trained in administrative management of social order according to the content and program of the General Department of Police.
2. Cadres assigned practical training tasks on skills in using weapons and auxiliary tools, methods of managing, storing, and maintaining weapons and auxiliary tools must hold certificates for weapon usage and management certificates for weapons and auxiliary tools that correspond to the training content.
Article 5. Forms of certificates for weapon usage and management certificates
1. The forms of certificates for weapon usage and management certificates include:
a) Certificate for using military weapons (code CN1);
b) Certificate for using sports weapons (code CN2);
c) Certificate for using primitive weapons (code CN3);
d) Certificate for using support tools (code CN4);
đ) Management certificate for weapons (code CC1);
e) Management certificate for support tools (code CC2).
2. Size, material, color of the forms
a) Forms CN1, CN2, CN3, CN4 have dimensions of 14cm x 10cm; forms CC1, CC2 have dimensions of 19cm x 13cm;
b) The forms specified in Clause 1 of this Article shall be made of white paper; the front side has a red background with the Police emblem in the center; the back side has a light blue background with patterns and anti-counterfeiting techniques.
Article 6. Printing, issuing, managing and using forms of certificates for weapon usage and management certificates
1. The General Police Department organizes the printing and issuance of the forms prescribed in Clause 1 of Article 5 of this Circular.
2. The management and use of these forms shall be carried out according to the police business file system.
3. The printing costs of the forms are allocated in the annual state budget estimate of the Ministry of Public Security. Each year, the Social Order Administrative Police Department of the provincial public security agency prepares an estimate of the number of forms needed for use and sends it to the General Police Department (through the Administrative Police Management Department). The General Police Department is responsible for compiling the number of forms needed and the printing cost estimate and sending it to the Ministry of Public Security's Finance Department for consolidation and preparation of the printing cost estimate for review and decision by the leadership of the Ministry of Public Security.
Chapter II
SPECIFIC PROVISIONS
Article 7. Subjects for training, issuing, exchanging, reissuing certificates for weapon usage and management certificates
1. Individuals assigned to use military weapons, sports weapons, primitive weapons, and support tools must meet the standards set forth in Clause 1 of Article 14 of the Ordinance on the Management and Usage of Weapons, Explosives, and Support Tools and the following standards:
a) Be a Vietnamese citizen;
b) At least 18 years old;
c) Have a clear record, without criminal records;
d) Working at agencies, organizations, units equipped and managing weapons and support tools.
2. Individuals assigned to manage warehouses or places storing weapons and support tools must meet the following standards:
a) Have good character and morality;
b) Have suitable health;
c) Meet the standards stipulated in points a, b, c, and d of Clause 1 of this Article.
3. People's Public Security officers who have been trained at People's Public Security schools do not need to obtain certificates for weapon usage and management certificates. In cases where People's Public Security officers are recruited from outside the sector, they shall follow the provisions of Clauses 1 and 2 of this Article.
4. For individuals recognized as coaches or high-performance athletes in competitions involving sports weapons, they are exempted from theoretical and practical training and only participate in examinations to obtain certificates for using sports weapons as prescribed in Article 11 of this Circular.
Article 8. Competence to train, issue, renew, reissue certificates for weapon usage and management certificates
1. The following units have competence to train on weapon management and usage:
a) Administrative Management Police Department under the General Police Department;
b) Equipment and Technical Supply Management Department under the Logistics and Technical General Department;
c) Provincial Public Security Administrative Management Police Department (hereinafter referred to as Provincial Administrative Management Police Department).
Point d) Police Academies, People's Public Security Schools, and People's Public Security Training and Professional Development Centers.
2. Competence to issue, renew, reissue certificates for weapon usage and management certificates
a) Administrative Management Police Department under the General Police Department has the authority to issue, renew, and reissue certificates for weapon usage and management certificates for individuals belonging to agencies, organizations, and units of central ministries and sectors and businesses permitted to train security personnel;
b) Provincial Administrative Management Police Department has the authority to issue, renew, and reissue certificates for weapon usage and management certificates for individuals belonging to local agencies, organizations, and units.
Article 9. Documents for requesting training on weapon management and usage
1. Agencies, organizations, and units equipped with weapons and support tools submit one set of documents to the unit specified in Clause 1 of Article 8 of this Circular to request training on weapon management and usage for individuals within their managing agencies, organizations, and units; the documents include:
a) Request letter;
b) List of individuals registering for training (name, date of birth, place of origin, working agency, organization, unit, professional level, position);
c) Photos of individuals registering for training: three color photos (2cm x 3cm) for individuals registering for training on military weapon usage, sports weapons, crude weapons, and support tools; three color photos (3cm x 4cm) for individuals registering for training on weapon management and support tool management. The photos must be full face portraits, wearing uniforms according to regulations of each force (if applicable); the photos must not be more than six months old from the date of submission. The person submitting the documents must present an introduction letter from the agency, organization, or unit and show one of the following identification documents to the police unit: Citizen Identity Card, Identity Card, Passport, People's Public Security Certificate.
2. The police unit responsible for receiving the documents shall accept, check the documents, issue a receipt after receiving complete valid documents and perform the following tasks:
a) Compile a list of agencies, organizations, and units requesting training along with the list of individuals registering for training;
b) Develop a training plan;
c) Select staff meeting the requirements and standards stipulated to organize training;
d) Within three working days from the date of issuing the decision to open the training class, send the decision to open the training class and the training plan to the requesting agency, organization, or unit. In case training cannot be organized, a written response must be provided, clearly stating the reasons.
Article 10. Requirements, contents, duration, location, and funding for training on weapon management and usage
1. Training requirements Individuals must be trained both theoretically and practically in accordance with the type of weapons and support tools registered for training.
Clause 2. Instruction content
a) Theory - Legal provisions on weapon management and usage; structure, features, and effects of weapons and support tools; record-keeping work for tracking and managing weapons and support tools; other contents in accordance with legal regulations and practical requirements in weapon management and usage work.
b) Practical training: Skills and techniques for using weapons and support tools; methods for managing, storing, and maintaining weapons and support tools.
3. The General Police Department is responsible for organizing and coordinating with the Political General Department of the People's Public Security, the Logistics and Technical General Department, and related units to compile the training program content as stipulated in Clause 2 of this Article.
4. Duration of training
a) For military weapon usage: From seven to ten days;
b) For sports weapons, crude weapons, and support tool usage: From five to seven days;
c) For warehouse storage management: From five to seven days.
5. Location of training The location for training on weapon management and usage must have appropriate facilities, equipment, and tools suitable for training activities; ensuring safety, security, order, fire prevention, and explosion prevention. In cases where shooting training and testing are conducted, they must be organized at shooting ranges as prescribed.
6. Agencies, organizations, and units requesting training are responsible for the funding for organizing the training.
Article 11. Inspection for Issuing Certificates of Weapon Usage and Management Certificates
1. After completing theoretical and practical training, the police unit specified in Points b and d Clause 1 Article 8 of this Circular must send a letter along with a list of individuals participating in the training to request the police unit specified in Clause 2 Article 8 of this Circular to organize inspections and evaluations of the training results to issue certificates of weapon usage and management certificates.
Within three working days from the date of receiving the request letter from the police unit specified in Points b and d Clause 1 Article 8 of this Circular or within three working days from the end of the training, the police unit specified in Clause 2 Article 8 of this Circular must establish an inspection board to evaluate the training results to issue certificates of weapon usage and management certificates.
The inspection of the training results must be consistent with the training content prescribed in Points a and b Clause 2 Article 10 of this Circular.
2. Agencies, organizations, units directly managing individuals specified in Clause 4 Article 7 of this Circular shall submit one set of application files, including the application form and the individual's photograph specified in Point c Clause 1 Article 9 of this Circular to request inspections and issuance of certificates of sports weapon usage for individuals under their management.
3. The General Police Department shall be responsible for guiding the format of inspections, passing and failing criteria.
Article 12. Issuance, Replacement, Reissuance, and Revocation of Certificates of Weapon Usage and Management Certificates
1. Issuance of Certificates of Weapon Usage and Management Certificates
a) Within three working days from the date of completing the inspection, the police unit specified in Clause 2 Article 8 of this Circular must notify the inspection results and issue certificates of weapon usage and management certificates to individuals who have passed the requirements.
In cases where certificates are not issued, the reasons must be clearly stated in a reply letter.
b) Certificates of weapon usage and management certificates are valid for a period of three years from the date of issuance. Upon expiration, retraining is required to obtain new certificates.
2. Replacement and Reissuance of Certificates of Weapon Usage and Management Certificates
a) Damaged certificates can be replaced; lost certificates can be reissued;
b) Application procedures for replacement and reissuance: Agencies, organizations, units directly managing individuals who have been issued certificates of weapon usage and management certificates must send a request letter to the police unit that previously issued the certificates, specifying the reasons and attaching a list and photographs of individuals requesting replacement or reissuance according to Points b and c Clause 1 Article 9 of this Circular. In cases of certificate replacement, the previously issued certificates must be returned.
Individuals making contact must present identification documents as stipulated in Point c Clause 1 Article 9 of this Circular to the competent police unit for replacement or reissuance.
c) The competent police unit for replacement or reissuance has the responsibility to accept the request letters, check accompanying documents, and issue a receipt upon receiving all valid documents.
Within three working days from the date of receiving the request letter, the police unit that previously issued the certificates must consider and process the replacement or reissuance; if not approved, a reply letter stating the reasons must be provided.
3. Revocation of Certificates of Weapon Usage and Management Certificates
a) Individuals who have been issued certificates of weapon usage and management certificates must return the certificates when they no longer work for agencies, organizations, or units equipped with weapons and support tools;
b) Agencies, organizations, or units managing individuals subject to certificate revocation must inform the police unit that previously issued the certificates through a letter, detailing the circumstances and attaching the previously issued certificates.
Individuals making contact must present identification documents as stipulated in Point c Clause 1 Article 9 of this Circular to the police unit that previously issued the certificates;
c) Upon receiving the notification letter, the police unit must check accompanying documents and issue a receipt upon receiving all valid documents.
Within three working days from the date of receiving the notification letter, the police unit that previously issued the certificates must issue a decision to revoke the certificates and notify the agency, organization, or unit managing the individual of the revocation.
Article 13. Responsibilities of public security units with authority to train, issue, replace, reissue certificates for weapon use and management certificates for weapons and auxiliary tools
1. Selecting officers who meet the requirements and standards as prescribed to conduct training, issuance, replacement, and reissuance of certificates for weapon use and management certificates for weapons and auxiliary tools.
2. Regularly inspecting the implementation of regulations on training, issuance, replacement, and reissuance of certificates for weapon use and management certificates for weapons and auxiliary tools within their jurisdiction.
3. Organizing training sessions for officers conducting training, issuance, replacement, and reissuance of certificates for weapon use and management certificates for weapons and auxiliary tools within their jurisdiction.
4. Directing, monitoring, and retaining files related to training, issuance, replacement, and reissuance of certificates for weapon use and management certificates for weapons and auxiliary tools according to their authority.
5. Revoking certificates for weapon use and management certificates for weapons and auxiliary tools issued in cases as specified at Point a Clause 3 Article 12 of this Circular.
Article 14. Responsibilities of agencies, organizations, units, and individuals related to the issuance of certificates for weapon use and management certificates for weapons and auxiliary tools
1. Individuals receiving certificates for weapon use and management certificates for weapons and auxiliary tools must manage and use these certificates in accordance with the regulations and present them when requested for inspection by authorized agencies; in case of loss of certificates, they must immediately report to the agency, organization, or unit directly managing them to issue a report to the public security unit that previously issued the certificates; the report must clearly state the reasons for the loss, measures taken, and corrective actions.
2. In cases where they no longer work in the agency, organization, or unit equipped with and managing weapons and auxiliary tools, individuals receiving certificates for weapon use and management certificates for weapons and auxiliary tools have the responsibility to return the certificates to the agency, organization, or unit directly managing them.
Article 15. Statistical and Reporting System
1. Quarterly, every six months, and annually, the public security unit specified in Article 8 of this Circular has the responsibility to report to the General Police Department (through the Administrative Police Management Bureau) on training, issuance, replacement, and reissuance of certificates for weapon use and management certificates for weapons and auxiliary tools within their jurisdiction.
2. The Administrative Police Management Bureau has the responsibility to compile reports on training, issuance, replacement, and reissuance of certificates for weapon use and management certificates for weapons and auxiliary tools within its authority and of the public security unit specified in Clause 1 of this Article and report to the General Police Department.
Chapter III
IMPLEMENTATION
Article 16. Effective Date
1. This Circular takes effect from July 20, 2016.
2. Abolishing Articles 8, 9, and 10 of Circular No. 30/2012/TT-BCA dated May 29, 2012, of the Minister of Public Security detailing the implementation of certain provisions of the Ordinance on the Management and Use of Weapons, Explosives, and Auxiliary Tools and the Decree detailing the implementation of certain provisions of the Ordinance and the VC7, VC8 forms prescribed in Circular No. 34/2012/TT-BCA dated June 12, 2012, of the Minister of Public Security detailing forms used in the management, receipt, collection, classification, storage, disposal, and destruction of weapons, explosives, and auxiliary tools.
Article 17. Responsibility for Implementation
1. The Director of the General Police Department shall be responsible for guiding, inspecting, and urging the implementation of this Circular.
2. Directors of the General Directorates, Heads of units under the Ministry of Public Security, Provincial Police Chiefs, Fire Prevention and Fighting Chiefs of centrally-administered cities and relevant organizations and individuals are responsible for implementing this Circular.
During the implementation of this Circular, if there are difficulties or obstacles, local police units, organizations, and individuals concerned shall report to the Ministry of Public Security (through the General Police Department) for timely guidance.
