The Law on Government Organization dated June 19, 2015;
On the basis of The Law on Archives dated November 11, 2011;
On the basis of The Law on Issuance of Legal Normative Documents dated June 22, 2015;
On the basis of The Law on Issuance of Legal Normative Documents in 2015;
Decree No. Decision No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures Decision No. 99/2016/NĐ-CP dated July 1, 2016 of the Government on management and use of stamps;
Decree No. The Prime Minister issues this Decision on retaining the stamps of expired value of some state organizations and positions for storage and historical research.

Article 1. This Decision stipulates the retention of stamps of expired value of some state organizations and positions for storage and historical research.
Article 1. Scope of Regulation and Applicability
Article 2. This Decision applies to agencies registering stamp models and Central and provincial Historical Archives.
Stamps of expired value referred to in this Decision are wet stamps of state organizations and positions retained when state organizations change their names, split, separate, merge, consolidate, dissolve, cease operations, or complete their tasks.
Article 2. Interpretation of Terms
Article 3. Principles of managing stamps of expired value of state organizations and positions retained for storage and historical research
Clause 1. The retention of stamps of expired value of state organizations and positions shall be carried out in accordance with the laws on stamp management.
Clause 2. The management and provision of stamps of expired value for historical research shall be conducted at the premises of Historical Archives and must ensure safety and proper purpose.
Article 4. Stamps of expired value of state organizations and positions retained for storage and historical research
Stamps of expired value of the following state organizations and positions shall be retained for storage and historical research:
Point 1. President of the State, Chairman of the National Assembly, Prime Minister, Secretary-General of the National Assembly.
Point 2. National Assembly, Standing Committee of the National Assembly, National Election Council, National Ethnic Council, Committees of the National Assembly, Office of the National Assembly, State Audit Agency, Delegation of the National Assembly of provinces and centrally-administered cities.
Point 3. Government, ministries; ministerial-level agencies, government-affiliated agencies; General Departments (except those under the Ministry of National Defense).
Point 4. Office of the President of the State.
Point 5. Supreme People's Court, High People's Courts, Provincial People's Courts, People's Courts of centrally-administered cities, District People's Courts, County People's Courts, Town People's Courts, and equivalent courts.
Point 6. Supreme People's Procuracy, High People's Procuracies, Provincial People's Procuracies, People's Procuracies of centrally-administered cities, District People's Procuracies, County People's Procuracies, Town People's Procuracies, and equivalent procuracies.
Point 7. People's Councils and People's Committees at all levels.
Article 5. Responsibilities of agencies registering stamp models and Historical Archives in managing stamps of expired value of state organizations and positions
Clause 1. Responsibilities of agencies registering stamp models
Sub-clause a. To recover stamps of expired value of state organizations and positions as specified in Article 4 of this Decision in accordance with regulations.
Sub-clause b. To notify and hand over stamps of expired value to Historical Archives within fifteen days from the date of recovering the stamps. The handover of stamps of expired value shall be recorded in a Handover Protocol (in the attached Appendix to this Decision).
Clause 2. Responsibilities of Historical Archives
Sub-clause a. To accept stamps of expired value from agencies registering stamp models.
Sub-clause b. To clean and safely store stamps of expired value.
Sub-clause c. To compile statistics and build a database on stamps of expired value.
Sub-clause d. To provide stamps of expired value for historical research at the Reading Room of Historical Archives in accordance with regulations and record issuance, receipt, and return in full books.
d) Provide seals that have ceased to be used for historical research at the Reading Room of the Historical Archive in accordance with regulations and keep records of their provision, transfer, and receipt in full detail.
Article 6. Competence to manage and authorize the provision of state agency, organization, and official position seals that have reached the end of their useful life for historical research purposes.
1. Central historical archives manage seals that have reached the end of their useful life from central agencies, organizations, and official positions. Provincial historical archives manage seals that have reached the end of their useful life from local agencies and organizations.
2. The head of central and provincial historical archives authorizes the provision of seals that have reached the end of their useful life, which are stored under their management, for historical research purposes.
Article 7. Procedure for reviewing the provision of state agency, organization, and official position seals that have reached the end of their useful life for historical research purposes.
1. Agencies and organizations requiring research on seals that have reached the end of their useful life of state agencies, organizations, and official positions must submit a written request to the historical archives, specifying the duration, purpose, and content of the research. Individuals requiring research on seals that have reached the end of their useful life at the historical archives must present one of the following documents: Citizen Identity Card, National Identity Card, or Passport. Representatives of agencies, organizations, and individuals conducting research on seals that have reached the end of their useful life must register their research requests according to regulations at the Reading Room of the historical archives.
2. The head of the historical archives reviews the research requests of agencies, organizations, and individuals and decides to authorize the provision of seals that have reached the end of their useful life. The review period and notification of the review result shall be within one working day from the date of receipt of the request.
Article 8. Effective Date
This Decision takes effect from July 1, 2019.
Article 9. Implementation Organization
1. The Ministry of Home Affairs, in collaboration with the Ministry of Public Security and relevant agencies, assists the Prime Minister in directing, guiding, and organizing the implementation of this Decision.
2. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees, municipal People's Committees directly under the central government, and related agencies, organizations, units, and individuals are responsible for implementing this Decision.
