CIRCULARAMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF CIRCULAR NO. 16/2025/TT-BCT DATED FEBRUARY 1, 2025 OF THE MINISTER OF INDUSTRY AND TRADE ON THE OPERATION OF THE COMPETITIVE WHOLESALE ELECTRICITY MARKET

Regulations on the Collection, Treatment, and Utilization of Crop By-products

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government pursuant to the Law on Forestry dated November 15, 2017;

Based on the Cultivation Law dated November 19, 2018;

At the proposal of the Director of the Cultivation Department;

amending and supplementing certain provisions of Circular No. 22/2019/TT-BNNPTNT dated November 30, 2019 of the Minister of Agriculture and Rural Development guiding certain provisions of the Livestock Law on the management of breeds and breeding products of livestock. these regulations stipulate the collection, treatment, and utilization of crop by-products.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

These regulations apply to the collection, treatment, and utilization of crop by-products in agricultural cultivation areas, ornamental plants, and edible mushrooms.

Article 2. Applicability

These regulations apply to organizations, households, and individuals involved in activities related to the contents specified in Article 1 of this Circular.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Crop by-products are secondary products generated during the process of caring for, harvesting, and preliminary processing of crop products in the cultivation area.

2. Treating crop by-products involves applying technological solutions or technical measures that increase efficiency of use without causing environmental pollution or spreading harmful organisms.

Chapter II

REGULATIONS ON THE COLLECTION, TREATMENT, AND UTILIZATION OF CROP BY-PRODUCTS

Article 4. Collection of Crop By-products

1. Crop by-products shall be collected and sorted according to their intended use; they shall not be mixed with chemicals, packaging materials, containers for plant protection products, fertilizers, or other inorganic impurities during the collection and transportation processes.

2. The collection and transportation of crop by-products shall not affect agricultural production activities in the cultivation area or traffic; they shall not cause environmental pollution or spread harmful organisms.

3. Encouragement is given to the use of advanced techniques in harvesting and collecting crop by-products; encouragement is also given to the use of pressing and compacting techniques before transportation.

4. Residues and by-products from areas affected by plant pests shall be handled in accordance with laws on plant protection and quarantine.

Article 5. Treatment of Crop By-products

1. Crop by-products shall be treated as follows:

a) Plowing and burying or grinding;

b) Green manuring along furrows or covering ridges;

c) Burying in multifunctional pits or covering the base of plants; covering soil;

d) Composting for traditional organic fertilizer;

đ) Drying;

e) Other treatment methods and measures.

2. Encouragement is given to the use of biological preparations and the application of technological and technical advancements in the treatment of crop by-products.

3. The treatment of crop by-products must ensure no environmental pollution or spread of harmful organisms.

Article 6. Utilization of Crop By-products

1. Encouragement is given to the use of crop by-products as raw material for mushroom production; animal feed production, fertilizer production, or as raw material for other manufacturing industries.

2. Crop by-products used as raw material for mushroom production; animal feed production, fertilizer production, and product manufacturing must meet the requirements of manufacturers and relevant laws.

Chapter III

IMPLEMENTATION

Article 7. Responsibilities of the Cultivation Department

1. Organizing propaganda and guidance on the effective collection, treatment, and utilization of crop by-products.

2. Organizing the development of guidelines for the collection and treatment of crop by-products.

3. Leading and coordinating with provincial Departments of Agriculture and Rural Development to update information on the collection, treatment, and utilization of crop by-products nationwide.

Article 8. Responsibilities of Provincial Departments of Agriculture and Rural Development

1. Organizing propaganda and implementation of regulations on the collection, treatment, and utilization of crop by-products within their jurisdiction.

2. Coordinating with the Cultivation Department to develop guidelines for the collection and treatment of crop by-products; guiding organizations, households, and individuals in the collection, treatment, and utilization of crop by-products.

3. Leading and coordinating with district People's Committees, commune People's Committees, and related units to inspect and supervise the implementation of regulations on the collection, treatment, and utilization of crop by-products within their jurisdiction.

4. Providing information on the collection, treatment, and utilization of crop by-products within their jurisdiction upon request of the Ministry of Agriculture and Rural Development (Cultivation Department).

Article 9. Responsibilities of organizations, households, and individuals collecting, processing, and utilizing crop residues

1. Comply with regulations on collecting, processing, and utilizing crop residues to ensure that they do not cause environmental pollution or spread harmful organisms.

2. Bear responsibility for the quality of crop residues in accordance with the requirements of manufacturers and other relevant laws.

Article 10. Effective Date

1. This Circular takes effect from January 1, 2020.

2. During implementation, if there are any difficulties, agencies, organizations, households, and individuals shall promptly report them to the Ministry of Agriculture and Rural Development for review and amendment./.
