Issuing National Technical Regulations

on construction materials products and goods

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006; qJune 1, 2007 Government Decree detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

BASED ON the Government's Decree No. 81/2017/NĐ-CP dated July 17, 2017, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;July yearTHE MINISTER OF CONSTRUCTION ISSUES this Circular on National Technical Regulations for construction materials products and goods.

ATTACHED TO this Circular are the National Technical Regulations for construction materials products and goods, code QCVN 16:2019/BXD.

Article 1. This Circular shall take effect from July 1, 2020, and replace Circular No. 10/2017/TT-BXD dated September 29, 2017, issued by the Minister of Construction on the issuance of National Technical Regulations for construction materials products and goods and guidance on conformity assessment and declaration of conformity.

Article 2. For organizations and individuals producing and importing construction materials goods that have been granted Conformity Assessment Certificates in accordance with QCVN 16:2014/BXD, QCVN 16:2017/BXD, and such certificates are still valid, they may continue to use the Conformity Assessment Certificate and Conformity Mark until the expiration date of the certificate.

Article 3. Transitional Provisions

1. In the case where construction materials products and goods have been granted Conformity Assessment Certificates which become invalid during the period between the issuance of these regulations and their coming into force, if such products and goods are not included in the list of QCVN 16:2019/BXD, the organizations and individuals producing and importing them are not required to conduct conformity assessment and declaration of conformity.
   If construction materials goods imported to Vietnam after the issuance of these regulations but before they come into force: If the date of issuance of the Conformity Assessment Certificate is prior to the effective date of these regulations, conformity assessment and issuance of a suitable certificate shall be conducted according to QCVN 16:2017/BXD; if the date of issuance of the Conformity Assessment Certificate is after the effective date of these regulations, conformity assessment and issuance of a suitable certificate shall be conducted according to QCVN 16:2019/BXD.
   Organizations designated to conduct conformity assessment and testing for construction materials products and goods under QCVN 16:2017/BXD are permitted to continue conducting conformity assessment and testing for those products and goods within the term specified in the designation decision.
   In the case where the designation decision expires during the period between the issuance of these regulations and their coming into force, the organizations are allowed to extend their conformity assessment and testing activities until the effective date of these regulations.
2. If the designation decision expires after the effective date of this Circular, and construction materials products and goods no longer fall within the scope of QCVN 16:2019/BXD, the list of designated conformity assessment and testing for those products will automatically become invalid.

Organizations conducting conformity assessment and testing for construction materials products and goods under QCVN 16:2017/BXD shall determine their needs and capabilities to meet the requirements of QCVN 16:2019/BXD, prepare relevant documentation, and submit it to the Ministry of Construction for consideration and designation.

IMPLEMENTATION

The Director of the Science, Technology, and Environment Department shall be responsible for guiding and implementing this Circular.

The Minister, Heads of Ministries equivalent to Ministries, Agencies under the Government, Chairpersons of Provincial People's Committees directly under the Central Government, and related organizations and individuals are responsible for implementing this Circular.

During the implementation process, if any difficulties arise, agencies, organizations, and individuals should promptly report in writing to the Ministry of Construction for guidance or research and amendment to suit the situation./.

Article 4.Organization and implementation

1. The Director of the Science, Technology and Environment Department shall be responsible for guiding and implementing this Circular.
2. The Minister, the Heads of ministerial-level agencies, central government agencies, Chairpersons of provincial People's Committees under the direct control of the Central Government, and related organizations and individuals shall be responsible for implementing this Circular.

3. In the course of implementation, if any difficulties arise, the agencies, organizations, and individuals concerned shall report in writing to the Ministry of Construction for guidance or research on amendments and supplements to make it appropriate./.
