CIRCULAR
REGULATIONS ON THE ORGANIZATION AND OPERATIONS OF THE SCREENPLAY REVIEW BOARD FOR FILMS USING STATE BUDGET FUNDS
Pursuant to the Cinema Law dated June 15, 2022;
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director of the Cinema Department;
The Minister of Culture, Sports and Tourism promulgates this Circular on the organization and operations of the Review Board for Screenplays of films using state budget funds.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the organization and operations of the Review Board for Screenplays of films using state budget funds (hereinafter referred to as the Board).
Article 2. Applicability
1. The project investor for film production using state budget funds (hereinafter referred to as the investor).
2. The agency or unit managing the project for film production using state budget funds (hereinafter referred to as the project management agency).
3. Members of the Review Board for Screenplays of films using state budget funds (hereinafter referred to as members of the Board).
4. Film bases with screenplay proposals for review to produce films using state budget funds (hereinafter referred to as film bases).
5. Organizations and individuals related to the review of screenplays for films using state budget funds.
Chapter II
ORGANIZATION AND OPERATIONS OF THE BOARD
Article 3. Functions and duties of the Council
1. The Board has the function of advising the investor in the activity of reviewing screenplays for films using state budget funds as provided for in Article 14 of the Cinema Law.
2. The Board has the task of reviewing to assess the quality of the content, ideological, artistic aspects, and classify screenplays for films using state budget funds.
Article 4. Establishment of the Board
1. The Board shall be established by the investor upon the proposal of the project management agency. The investor has the right to terminate, remove, or replace Board members under one of the circumstances specified in Article 8 of this Circular.
2. Based on the type of film screenplay, the investor decides to establish the Board, including:
a) The Board for Reviewing Feature Film Screenplays;
b) The Board for Reviewing Documentary and Scientific Film Screenplays;
c) The Board for Reviewing Animation Film Screenplays.
3. Composition of the Board
a) Members of the Board:
The Board shall have at least five members (an odd number), including the Chairman, Vice-Chairman, and members, comprising representatives from state management agencies for cinema, scriptwriters, directors, experts in each type of film, with professional reputation, and other appropriate positions selected by the investor;
In case of necessity, the investor may invite additional experts for consultation.
b) The Standing Committee of the Board includes the Chairman, Vice-Chairman, and Secretary.
c) Chairman of the Board:
- For the Board established by the Ministry of Culture, Sports and Tourism, the Chairman of the Board is the Director of the Cinema Department;
- For the Board established by a ministry, an agency equivalent to a ministry, a government agency, or a central agency of a political organization, political-social organization, or political-social-professional organization, the Chairman of the Board is the head of the project management agency;
- For the Board established by a provincial People's Committee, the Chairman of the Board is the leader of the Department of Culture, Sports and Tourism or the Department of Culture and Sports.
d) Secretary of the Board:
The Secretary of the Board is appointed by the project management agency, working for the term of the Board. The Secretary of the Board may be a member of the Board.
4. The term of operation of the Board is two years.
Article 5. Principles of Operation of the Council
1. The Board operates based on the principle of collective work, open and democratic discussion, and decision-making by majority.
2. Board members work impartially, objectively, and truthfully, having the right to reserve their own opinions but must comply with the conclusions of the Board.
3. Board members and the Secretary must keep confidential the content of the screenplay, discussions, and conclusions of the Board.
4. Board members and the Secretary cannot be the authors of the screenplay proposed for review by the Board.
5. The Board convenes an annual meeting to evaluate its activities at least once a year.
Article 6. Activities of the Council
1. Within five (5) working days from the date of receiving the script proposed for review by the film production facility, the Council's Standing Body shall send the script and the Script Review Form to the members of the Council.
The Script Review Form shall be implemented according to Appendix 1 issued together with this Circular.
2. Within ten (10) working days from the date of receipt of the script sent by the Council's Standing Body, the Council member shall be responsible for reviewing the script and sending the Script Review Form back to the Council's Standing Body.
In case a Council member has already submitted the Script Review Form to the Council's Standing Body but later, before the Council meeting, provides different opinions compared to those previously submitted, they may resubmit the form to the Council's Standing Body for consolidation at the meeting as the basis for the Council's conclusion.
3. The Council meeting shall be organized based on the actual number of scripts proposed for review.
4. At least two-thirds of the total number of Council members must attend the Council meeting.
5. The Council's conclusion must be approved by at least two-thirds of the total number of review opinions of the Council members. The Council's conclusion must be recorded in the Council Meeting Minutes.
6. The Script Review Forms and opinions during the meeting of the Council members, as well as the Council's conclusion, serve as the basis for the project management agency to draft the script review document.
7. Within fifteen (15) working days from the end of the Council meeting, the project management agency shall send the script review document to the film production facilities that have proposed scripts for review.
Article 7. Rights and Responsibilities of the Chairman, Vice-Chairman, Member, Standing Body, and Secretary of the Council
1. Chairman of the Council:
a) Is responsible for the overall activities of the Council;
b) Chairs and concludes the Council meetings;
c) Is the spokesperson of the Council;
d) Delegates the Vice-Chairman of the Council to chair the Council meetings and assigns specific tasks of the meeting in his absence;
e) Implements the provisions stipulated in Clause 3 of this Article.
2. Vice-Chairman of the Council:
a) Implements the provisions stipulated in points a, b, and c of Clause 1 of this Article when authorized by the Chairman of the Council;
b) Fully participates in all Council meetings, and in case of absence, must report to the Chairman of the Council;
c) Implements the provisions stipulated in Clause 3 of this Article.
3. Member of the Council:
a) Fully participates in all Council meetings, and in case of absence, must report to the Chairman or the person authorized;
b) Conducts script reviews and sends the Script Review Form in accordance with Clause 2 of Article 6 of this Circular.
4. Standing Body of the Council:
a) Organizes Council meetings and ensures necessary conditions for the Council's operation;
b) Implements the Council's conclusions assigned to the Standing Body (if any) at the full Council meeting.
5. Secretary of the Council:
a) Assists the Council and the Standing Body of the Council;
b) Sends scripts proposed for review and the Script Review Form to the Council members as assigned by the Standing Body of the Council;
c) Reads scripts, records the Council Meeting Minutes, drafts the script review document;
The Council Meeting Minutes shall be implemented according to Appendix 2 issued together with this Circular.
d) Sends the script review document to film production facilities that have proposed scripts for review;
The script review document shall be implemented according to Appendix 3 issued together with this Circular.
Article 8. Resignation, Removal, and Replacement of Council Members
During their term, the project sponsor decides to resign, remove, and replace Council members in the following cases:
1. A Council member submits a personal document requesting to resign from the Council.
2. A Council member is absent without a valid reason for three consecutive meetings of the Council to review scripts.
3. A Council member violates the working principles stipulated in Article 5 and responsibilities set forth in Article 7 of this Circular, as well as other relevant laws.
Article 9. Criteria for Evaluating, Scoring, and Classifying Scripts
1. Each Council member reviews and evaluates each script, records comments on the Script Review Form, scores according to a scale of 10 points with intervals of 0.5 between each point. The evaluation results are scored from highest to lowest, specifically as follows:
a) Excellent Script: Scores from 9.0 to 10 for scripts with profound ideological content, high humanistic value, comprehensive social issues, unique discoveries; not violating provisions of Article 9 of the Cinema Law; scripts with high professional writing techniques, distinctive cinematic language, and creativity;
b) Good Script: Scores from 7.5 to 8.5 for scripts with good ideological content, humanitarian and social values; not violating provisions of Article 9 of the Cinema Law; scripts with good professional writing techniques, cinematic language, and appeal;
c) Satisfactory Script: Scores from 6.0 to 7.0 for scripts with good ideological content, humanitarian and social values; not violating provisions of Article 9 of the Cinema Law; scripts with satisfactory professional writing techniques that can be revised to improve quality;
d) Average Script: Scores below 5.5 for scripts with content and form not meeting requirements.
2. The score given by each Council member for a script serves as the basis for calculating the average score of the script.
3. The average score of the script serves as the basis for the project management agency to advise the project sponsor to select scripts for film production using state budget funds.
4. Classification of scripts is based on the average score given by Council members, specifically:
a) Scripts with an average score from 9.0 to 10 points: classified as Level I - Excellent;
b) Scripts with an average score from 7.5 to 8.5 points: classified as Level II - Good;
c) Scripts with an average score from 6.0 to 7.0 points: classified as Level III - Satisfactory;
d) Scripts with an average score of 5.5 or lower are not classified.
5. The condition for a script to be selected for film production using state budget funds must be a script classified at Level II - Good or higher.
Chapter III
IMPLEMENTING PROVISIONS
Article 10. Implementation Organization
1. The Cinema Department is responsible for guiding, urging, and organizing inspections of the implementation of this Circular.
2. Relevant agencies, organizations, and individuals shall organize the implementation of this Circular based on their assigned functions and tasks.
Article 11. Transitional Provisions
Film literary script review councils established before the effective date of this Circular shall continue to operate until the end of their term as specified in Circular No. 15/2016/TT-BVHTTDL dated December 27, 2016, issued by the Minister of Culture, Sports and Tourism regarding the organization and operation of film literary script review councils using state budget funds.
Article 12. Effective Date
1. This Circular takes effect from February 20, 2023.
2. Circular No. 15/2016/TT-BVHTTDL dated December 27, 2016, issued by the Minister of Culture, Sports and Tourism regarding the organization and operation of film literary script review councils using state budget funds ceases to be effective from the date this Circular becomes effective.
3. In the course of implementation, if any difficulties arise, the relevant agencies, units, and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism (through the Cinema Department) for research and appropriate amendments and supplements.
