Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

Pursuant to the Environmental Protection Law dated November 17, 2020;

At the proposal of the Minister of Transport;

The Prime Minister issues this Decision to regulate the implementation timeline for emission standards for imported and domestically produced and assembled motor vehicles.

Article 1. Scope of Regulation

1. This Decision regulates the implementation timeline for emission standards for imported and domestically produced and assembled internal combustion engine motor vehicles in Vietnam.

Article 2. This Decision does not apply to:

a) Motor vehicles under the management of the Ministry of National Defense and the Ministry of Public Security for national defense and security purposes;

b) Motor vehicles imported or produced and assembled in Vietnam for scientific research; production-related research; display and introduction at trade fairs and exhibitions;

c) Motor vehicles produced and assembled for export;

d) Motor vehicles imported according to international treaties to which Vietnam is a party and which provide different regulations shall be implemented in accordance with those treaties;

e) Motor vehicles designed with special structures not intended for road traffic; three-wheeled motorcycles and three-wheeled motorized tricycles for disabled persons;

f) Passenger cars produced and assembled from passenger car chassis (from semi-knocked-down kits or complete passenger cars) that have been certified for technical safety and environmental protection quality.

Article 2. Applicability

This Decision applies to organizations and individuals related to the importation and production and assembly of internal combustion engine motor vehicles.

Article 3. Explanation of Terms

1. The emission standards (Level 2, Level 3, Level 4, and Level 5) for new imported and domestically produced and assembled vehicles specified in this Decision correspond to the emission standards (Euro 2, Euro 3, Euro 4, and Euro 5) set by the United Nations Economic Commission for Europe (UNECE) and the European Union Directive (EC) on type approval of motor vehicles.

2. The emission standards (Level 1, Level 2, Level 3, and Level 4) for used imported vehicles specified in this Decision are the limits for pollutant components in exhaust emissions as prescribed in the National Technical Regulation TCVN 6438:2018 and its amendment 01:2021 TCVN 6438:2018 - Road Transport Vehicles - Maximum Allowable Limits for Exhaust Emissions.

3. The emission standard of "0" specified in this Decision represents exhaust emissions from the engines of motor vehicles without pollutants limited in the emission standards set out in Clauses 1 and 2 of this Article.

Article 4. Implementation Timeline for Emission Standards

1. Implementation Timeline for Emission Standards for New Imported and Domestically Produced and Assembled Motor Vehicles

a) New imported and domestically produced and assembled passenger cars continue to apply the emission standard Level 5 as stipulated in Clause 1, Article 3 of this Decision from January 1, 2025;

b) New imported and domestically produced and assembled two-wheeled motorcycles continue to apply the emission standard Level 2 as stipulated in Clause 1, Article 3 of this Decision from January 1, 2025 to June 30, 2027;

c) New imported and domestically produced and assembled two-wheeled motorcycles continue to apply the emission standard Level 3 as stipulated in Clause 1, Article 3 of this Decision from January 1, 2025 to June 30, 2026;

d) New imported and domestically produced and assembled two-wheeled motorcycles apply the emission standard Level 4 as stipulated in Clause 1, Article 3 of this Decision from July 1, 2027;

e) New imported and domestically produced and assembled two-wheeled motorcycles apply the emission standard Level 4 as stipulated in Clause 1, Article 3 of this Decision from July 1, 2026;

f) New imported and domestically produced and assembled four-wheeled passenger cars and four-wheeled cargo vehicles with engines apply the emission standard of "0" as stipulated in Clause 3, Article 3 of this Decision from January 1, 2026;

g) New imported and domestically produced and assembled three-wheeled motorcycles and three-wheeled motorized tricycles apply the emission standard of "0" as stipulated in Clause 3, Article 3 of this Decision from January 1, 2026.

2. Implementation Timeline for Emission Standards for Used Imported Motor Vehicles

a) Used imported passenger cars apply the emission standard Level 4 as stipulated in Clause 2, Article 3 of this Decision from January 1, 2025;

b) Used imported four-wheeled passenger cars and four-wheeled cargo vehicles with engines apply the emission standard of "0" as stipulated in Clause 3, Article 3 of this Decision from January 1, 2026.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Ministry of Transport

a) Lead the implementation of this Decision; serve as the lead agency for inspecting and supervising compliance with emission standards for imported and domestically produced and assembled motor vehicles as stipulated in this Decision;

b) Develop and promulgate national technical regulations in accordance with its functions and duties and legal provisions on emission standards consistent with the timelines set forth in this Decision;

c) Based on Decision No. 876/QĐ-TTg dated July 22, 2022 of the Prime Minister approving the action program on green energy transition, carbon emission reduction, and methane emission reduction in the transportation sector, and actual conditions, continue to study and develop additional regulations to enhance emission standards for motor vehicles, submit to the Prime Minister for consideration and decision; ensure consistency and synchronization in implementing policies on green energy transition and applying emission standards for motor vehicles.

2. The Ministry of Science and Technology

Study and review national technical regulations on gasoline, diesel fuel, and biofuels to amend and supplement them in line with the timelines for applying emission standards set forth in this Decision.

3. The Ministry of Industry and Trade

a) Lead and coordinate with relevant ministries and sectors to ensure the production, import, and supply of fuels for motor vehicles meet the national technical regulations on gasoline, diesel fuel, and biofuels;

b) Coordinate with the Ministry of Transport in inspecting and supervising compliance with emission standards for motor vehicle manufacturing and assembly facilities as stipulated in this Decision.

4. The Ministry of Finance

Coordinate with the Ministry of Transport in inspecting and supervising compliance with emission standards for imported motor vehicles as stipulated in this Decision.

5. Ministries, People's Committees of provinces and centrally governed cities

a) Coordinate with the Ministry of Transport to organize information dissemination regarding the implementation schedule for vehicle emission standards;

b) Direct specialized units under their jurisdiction to cooperate with the Ministry of Science and Technology and the Ministry of Industry and Trade to monitor fuel quality circulating in the market;

c) Based on economic and social conditions and environmental protection requirements at the local level, People's Committees of provinces and centrally governed cities may stipulate a stricter implementation schedule for local emission standards than those specified in this Decision, in accordance with the provisions of the Environmental Protection Law and the Law on Technical Regulations and Standards.

Article 6. Transitional Provisions

1. For types and models of motor vehicles produced and assembled

a) Types and models of motor vehicles that have been certified for technical safety and environmental protection before the effective date of the emission standards as prescribed in points a, b, and c, Clause 1, Article 4 of this Decision shall continue to be produced and assembled within the validity period of the issued certificate;

b) Types and models of motor vehicles that have been certified for technical safety and environmental protection before the effective date of the emission standards as prescribed in points d, đ, e, and g, Clause 1, Article 4 of this Decision shall continue to be produced and assembled within the validity period of the issued certificate or twelve months from the date the emission standards become effective, whichever comes first.

2. Imported motor vehicles that have declared customs clearance; docked at port or arrived at a border gate of Vietnam before the effective date of the emission standards as prescribed in the implementation schedule of this Decision shall continue to apply the emission standards in effect at the time of declaration of customs clearance; docking at port or arrival at a border gate of Vietnam.

Article 7. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from January 1, 2025.

2. The following regulations are abolished:

a) Decision No. 249/2005/QĐ-TTg dated October 10, 2005 of the Prime Minister on the implementation schedule for emission standards for road motor vehicles;

b) Decision No. 49/2011/QĐ-TTg dated September 1, 2011 of the Prime Minister on the implementation schedule for emission standards for newly manufactured and assembled passenger cars and two-wheeled motorcycles;

c) Article 5 of Decision No. 16/2019/QĐ-TTg dated March 28, 2019 of the Prime Minister on the implementation schedule for emission standards for passenger cars participating in traffic and imported used passenger cars.

3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, and related organizations and individuals are responsible for implementing this Decision./.
