Guidelines on the functions, tasks, and powers of specialized agencies

regarding Agriculture and Rural Development under the People's Committees of provinces and centrally governed cities and People's Committees of communes, wards, and special administrative-economic zones under provinces and centrally governed cities

directly under the central government and People's Committees of communes, wards, and special administrative-economic zones under provinces and centrally governed cities

belonging to a province or centrally governed city

Decree No. 35/2025/NĐ-CP dated February 25, 2025, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Decree No. Decision No. 150/2025/NĐ-CP dated June 12, 2025 of the Government on the organization of specialized agencies under the People's Committees of provinces and centrally governed cities and People's Committees of communes, wards, and special administrative-economic zones under provinces and centrally governed cities;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Agriculture and Rural Development issues this Circular to guide the functions, tasks, powers of specialized agencies on Agriculture and Rural Development under the People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as provincial-level People's Committee) and People's Committees of communes, wards, and special administrative-economic zones under provinces and centrally governed cities (hereinafter referred to collectively as commune-level People's Committee).

PART I
DEPARTMENT OF AGRICULTURE AND RURAL DEVELOPMENT

Article 1. Position and Functions

1. The Department of Agriculture and Rural Development is a specialized agency under the provincial-level People's Committee, performing the function of advising and assisting the provincial-level People's Committee in state management over: agriculture; forestry; salt industry; fisheries; water resources; disaster prevention and control; poverty reduction; rural development; land; water resources; mineral resources, geology; environment; meteorology and hydrology; climate change; surveying and mapping; comprehensive management of natural resources and environmental protection of the sea and islands (for units with coastal and island areas); remote sensing; state management of public services in fields within its jurisdiction as prescribed by law.

2. The Department of Agriculture and Rural Development (hereinafter referred to as the Department) has legal personality, has its own seal and separate account according to the provisions of law; it is subject to the direction and management of the provincial-level People's Committee, while also being subject to professional guidance, inspection, and supervision by the Ministry of Agriculture and Rural Development.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Department of Agriculture and Rural Development performs the tasks and powers stipulated in the Government's Decree No. 150/2025/NĐ-CP dated June 12, 2025 on the organization of specialized agencies under the People's Committees of provinces and centrally governed cities and People's Committees of communes, wards, and special administrative-economic zones under provinces and centrally governed cities, and the following tasks and powers:

1. Submit to the provincial-level People's Committee

a) Draft resolutions of the Provincial People's Council, draft decisions of the provincial-level People's Committee related to fields within the Department’s jurisdiction and other documents assigned by the provincial-level People's Committee;

b) Draft plans for sectoral development, programs, measures to organize the implementation of sectoral tasks on the provincial level within the Department’s jurisdiction;

c) Draft decisions specifying the functions, tasks, powers, and organizational structure of the Department; draft decisions specifying the functions, tasks, powers, and organizational structure of the branch offices and public service units (except where otherwise provided by specific laws) under the Department (if applicable);

d) Draft decisions implementing socialization of activities providing public services in sectors and fields within the authority of the provincial-level People's Committee.

2. Submit to the Chairman of the provincial-level People's Committee draft documents within the authority of the Chairman of the provincial-level People's Committee as assigned.

3. Implement legal regulations, strategies, plans, programs, projects, national standards, national technical regulations, economic and technical norms in the field of Agriculture and Rural Development decided and approved by competent authorities; provide information, communication, dissemination, education on law, enhance community awareness, guide, inspect, monitor the enforcement of laws in fields under the assigned state management.

4. On Crop Production and Plant Protection

a) Advise and submit to the provincial-level People's Committee for issuance within its authority or submit to competent authorities for issuance and implementation: plans for crop structure adjustment on rice cultivation land; local crop production plans; policies supporting production, trade, and use of crop seeds, fertilizers, plant protection chemicals, high-tech agriculture development, digital transformation in agriculture; plans for pest prevention and control, domestic plant quarantine;

b) Advise and assist the provincial-level People's Committee in directing the implementation of crop structure, seed varieties, cultivation techniques, harvesting, storage, processing of agricultural products; establish and implement non-infested plant pest zones within the province; organize pest control, implement measures to protect production when pest outbreaks occur; tally and assess losses caused by pests; implement policies to stabilize livelihoods and restore production; direct and guide the collection and disposal of used plant protection chemicals, enforce state management measures for plant variety rights at the local level;

c) Advise and assist the provincial-level People's Committee in directing, guiding, and inspecting crop production activities; developing crop production regions, safe food production; implementing land use plans, protecting and improving soil fertility, preventing erosion, desertification, and land collapse within the Department’s tasks and legal provisions; low-emission crop production, circular economy, climate change adaptation; organic crop production; plant protection and quarantine activities; implement the issuance of planting area codes and packaging facility codes within the province according to legal provisions;

d) Advise and submit to the Chairman of the provincial-level People's Committee for decision on declaring plant pest outbreaks; deciding on recognition, revocation, or cancellation of recognition decisions, licenses, certificates, and professional qualifications in crop production and plant protection within the authority of the Chairman of the provincial-level People's Committee as prescribed;

đ) Guide and organize the implementation of domestic plant quarantine within the province according to legal provisions;

e) Organize the implementation of work on collecting, storing, preserving, utilizing germplasm of crop seeds; implement state management over crop seeds, fertilizers, plant protection chemicals, and other materials serving agricultural production according to legal provisions;

g) Manage and utilize local reserves of crop seeds, plant protection chemicals, and other goods and materials in the field of crop cultivation within the province after being approved by the Provincial People's Committee;

h) Guide and organize the construction of good agricultural practices (GAP) models in agriculture.

5. Regarding animal husbandry and veterinary services

a) Advise and submit to the Provincial People's Committee for issuance within its authority, or submit to competent authorities for issuance and organize implementation: strategies, plans for developing animal husbandry, density regulations for animal husbandry in the locality; resolutions of the Provincial People's Council on areas not permitted for animal husbandry; decisions on bird nest farming zones and support policies when relocating animal husbandry facilities out of prohibited areas; production, trade, and use of veterinary drugs support policies; regulations, policies, and guidelines on slaughtering activities, slaughter inspection, and veterinary hygiene inspections; plans for preventing and controlling animal diseases; programs for monitoring, controlling, and eradicating animal diseases, building disease-free zones and facilities;

b) Advise and assist the Provincial People's Committee in directing the construction and organization of implementation of disease-free zones and facilities for animal husbandry, production, and processing of livestock feed; concentrated animal husbandry and slaughtering, preliminary processing, and industrial processing of animal products with traceability of origin; implementation of prevention and control of terrestrial animal diseases; statistics and evaluation of losses caused by terrestrial animal diseases; establishment and updating of databases on animal husbandry; databases on disease surveillance and information forecasting and warning of terrestrial animal diseases at the local level; implementation of support policies to stabilize livelihoods and restore animal husbandry after terrestrial animal diseases;

c) Advise and submit to the Chairman of the Provincial People's Committee for decision-making on declaring and announcing the end of terrestrial animal diseases according to regulations; deciding recognition, revocation, or cancellation of recognition, issuance, extension, revocation of permits, certificates, and practice licenses in the field of animal husbandry and veterinary services within the authority of the Chairman of the Provincial People's Committee according to regulations;

d) Guide and inspect the implementation of animal husbandry and veterinary activities in the province according to the law;

đ) Guide and organize the implementation of quarantine of animals and animal products transported out of the provincial territory; quarantine of exported, imported, temporarily imported re-exported, temporarily exported re-imported, transshipped through Vietnam's customs checkpoints, bonded warehouses, and transit goods according to the law when authorized;

e) Organize the implementation of work related to collecting, storing, preserving, utilizing genetic resources of livestock breeds; managing livestock breeds; managing livestock feed and other materials in the field of animal husbandry and veterinary services according to the law;

g) Manage and utilize local reserves of veterinary drugs, materials, and goods in the field of animal husbandry and veterinary services within the province after being approved by the Provincial People's Committee;

h) Organize the implementation of tasks related to management, inspection, and supervision of animal slaughter processes and veterinary hygiene monitoring at slaughterhouses, preliminary processing, and preservation facilities for animals and animal products; veterinary hygiene inspections; veterinary practice; management of veterinary drugs according to the law;

i) Implement state management over livestock feed according to the law;

6. Regarding forestry

a) Advise and submit to the Provincial People's Committee for issuance within its authority, or submit to competent authorities for issuance and organize implementation: sustainable forestry development programs and projects at the local level; delineation of forest boundaries; decisions on allocating forests, leasing forests, changing forest types, changing forest land use purposes to other purposes, reclaiming forests; replacement forest planting plans when changing forest land use purposes to other purposes; decisions on local forest price ranges; decisions on establishing special-use forests and protective forests at the local level; decisions on opening and closing natural forests at the local level according to regulations; reports on the management and use of the Forest Protection and Development Fund at the provincial level;

b) Advise and assist the Provincial People's Committee in directing, guiding, and inspecting the implementation of forest environmental service payment policies at the local level; directing, guiding, and inspecting the implementation of afforestation, protecting special-use forests, protective forests, and public forests where the State has not allocated or leased; scattered tree plantation development according to regulations;

c) Advise and assist the Provincial People's Committee in organizing the implementation of forest surveys, forest inventories, and forest condition monitoring according to regulations; updating local forest management database and files; forest protection; conservation of natural resources and biodiversity in various types of forests; forest fire prevention and firefighting; pest control in forests; forest development; forest utilization; logging; organizing forest production linked with wood processing and trade at the local level;

d) Advise and submit to the Chairman of the Provincial People's Committee for plans on mobilizing, coordinating, and assigning forces, equipment, tools, materials, and resources for forest firefighting; ensuring conditions for forest firefighting; issuing and reissuing permits in the forestry sector within the authority of the Chairman of the Provincial People's Committee according to regulations;

đ) Fully perform the functions, tasks, and powers of forest rangers at the local level according to the law;

e) Guide and inspect the implementation of combined forest, agricultural, and aquaculture production, medicinal herb cultivation in forests according to the law;

g) Guide and inspect the implementation of national standards and technical regulations on forestry; develop plans, measures, direct, and inspect the production of forestry crop seeds and the use of forestry materials; compile, update, and publicly announce lists of recognized or de-recognized forestry crop seed sources; forest planting; forest nurturing; forest enrichment; natural forest improvement and regeneration; wood processing and trade; prevention and control of forest pests and diseases; forest fire prevention and firefighting;

h) Organize the appraisal and submit to the competent authority for approval the management plan for sustainable forests, eco-tourism projects, resort and entertainment activities within special-use forests, protective forests, and production forests under local management, design and budget estimates for forestry works in accordance with the provisions of the law;

i) Guide and inspect the implementation of regulations regarding the responsibilities of the People's Committee at the commune level and forest owners in managing, protecting, developing, using forests, preventing and fighting forest fires, allocating land and forests at the local level; coordinate and mobilize forces and means from organizations and individuals on the local area in protecting forests, preventing and fighting forest fires, managing forest products, conserving natural resources and biodiversity in various types of forests.

7. Regarding salt industry

a) Advise and submit to the provincial People's Committee for issuance within its competence or submit to the competent authority for issuance and organize the implementation of mechanisms, policies, plans, programs, projects for the development of salt production in the locality;

b) Assist the provincial People's Committee in directing and organizing salt production and processing at the local level;

c) Guide and inspect salt production, processing, and storage, and salt-based products at the local level; implement national standards and technical regulations concerning quality, food safety, labor safety, and environmental protection of salt production, processing, and trading facilities (excluding salt used in the medical field);

8. Regarding fisheries

a) Advise and submit to the provincial People's Committee for issuance within its competence or submit to the competent authority for issuance and organization of implementation of plans for the protection and development of aquatic resources in the province in accordance with the regulations; decide recognition and grant management rights in the protection of aquatic resources in areas belonging to two or more communes; issue the List of Prohibited Fishing Gear and Fishing Methods, and the List of Restricted Fishing Areas with time limits in the province;

b) Advise and assist the provincial People's Committee in directing and organizing the management of fishery activities in the province; organize fishery production and harvesting; manage marine protected areas and aquatic resource conservation zones; organize the implementation of surveys and assessments of aquatic resources and living environments of aquatic species in specialized topics and commercial fishing industries in the province; organize the implementation of activities to restore aquatic resources and recover the living environment of aquatic species, combat illegal, unreported, and unregulated fishing; survey and supplementarily determine aquatic resource conservation zones; guide and inspect the management of aquatic resources and aquatic ecosystems in special-use forests, protective forests, and wetland conservation areas; aquaculture and fishery activities;

c) Advise and submit to the Chairman of the provincial People's Committee for decisions on establishing national-level marine protected areas within the managed area; the list of aquatic resource conservation zones in the province; establish the Provincial Aquatic Resource Protection and Development Fund; announce the opening and closing of Class I fish ports; issue, reissue, and revoke decisions recognizing, permits, certificates of approval in the field of fisheries and fishery inspection within the competence of the Chairman of the provincial People's Committee according to regulations;

d) Manage fish seed, fish feed, and products for treating aquaculture environments; monitor the testing activities of fish feed and aquaculture environment treatment products; monitor the participation of organizations and individuals registered for importation by the Chairman of the provincial People's Committee in fairs and exhibitions, scientific research, and handling of fish seed, fish feed, and aquaculture environment treatment products after the fair or exhibition ends (in cases of importation for display at fairs and exhibitions); implement administrative procedures for recognizing the results of fish seed testing; recognizing the results of fish feed testing and aquaculture environment treatment product testing; monitoring and warning of aquaculture environment conditions; prevent and control fish diseases according to the law;

đ) Submit to the provincial People's Committee on the organization and operation of local fishery inspection forces, equipping patrol boats and vessels, weapons, support tools, specialized equipment, uniforms, insignia, flags for fishery inspectors according to the law; organize the implementation of patrols, inspections, detection, and handling of violations of fisheries laws within the managed area according to regulations;

e) Fully perform the functions and tasks of fishery inspection at the local level according to the law;

g) Manage fishing vessels, fishery service vessels, fish ports, anchorage areas for fishing vessels to avoid storms according to classification and legal regulations; carry out inspections and controls over compliance with laws on fishing, protection of aquatic resources, food safety on fishing vessels, at fish ports, environmental protection, fire prevention and explosion prevention at fish ports; manage, exploit, and use data from fishing vessel surveillance systems of the province, process surveillance data for fishing vessels with a maximum length of 15 meters up to less than 24 meters; collect and compile reports on fishery statistics through fish ports according to regulations;

h) Manage fishing activities in coastal waters, estuarine areas, and inland fisheries within the province according to regulations;

i) Organize the implementation of food safety control at major fish markets in the province; manage purchasing, selling, preliminary processing, processing, storage, export, and import of fish and fish products in the province according to regulations.

9. Regarding water conservancy

a) Advise and submit to the People's Committee of the province for issuance within its authority or submit to the competent authority for issuance and organize implementation: decisions approving and announcing the results of basic investigations on irrigation, operation procedures for water conservancy works under its management within the provincial territory; decisions assigning organizations to manage or decentralizing the management of water conservancy works (including water conservancy works where exploitation and protection involve two provinces or more according to the List of Assignment of Management of Water Conservancy Works issued by the Minister of Agriculture and Rural Development), rural clean water supply works within the provincial territory in accordance with the provisions of the law; specific regulations on the scope of adjacent areas, demarcation plans for the protection zones of water conservancy works; approval of emergency response plans during construction, emergency response plans for urgent situations involving dams and reservoirs; mobilization plans for forces, materials, and equipment to protect water conservancy works when accidents occur or there is a risk of occurrence; scale of intra-field irrigation; investment costs for construction, management, exploitation, and protection of water conservancy works and rural clean water supply works managed by localities;

b) Advise and submit to the Chairman of the People's Committee of the province for approval or decentralize approval of protection plans for dams and reservoirs (including dams and reservoirs managed by the Ministry of Agriculture and Rural Development), other water conservancy works within the province's jurisdiction; issue, reissue, extend, adjust, suspend, and revoke permits for activities in the field of water conservancy within the Chairman of the People's Committee of the province's authority in accordance with the provisions;

c) Take the lead and coordinate with relevant agencies and units at the local level to advise and submit to the People's Committee of the province for setting specific prices for public utility products and services in the field of water conservancy; other water conservancy products and services in accordance with the provisions;

d) Take the lead in developing plans for the development of water conservancy networks and rural clean water supply systems in accordance with the law; contents related to water conservancy and rural clean water supply in provincial planning, water conservancy planning, and national sectoral planning in accordance with the provisions;

đ) Guide and inspect the implementation of legal provisions and the People's Committee of the province's regulations on decentralizing the management of reservoirs, water conservancy works, and rural clean water supply works within the provincial territory; guide and inspect the construction, exploitation, use, and protection of reservoirs, water conservancy works, and rural clean water supply works within the provincial territory under the responsibility of the People's Committee of the province; organize the implementation of the National Strategy on Rural Clean Water Supply and Sanitation at the provincial level in accordance with the delegation of the People's Committee of the province;

e) Receive and manage files and permits for activities within the protected area of water conservancy works under the management authority of the People's Committee of the province within the provincial territory; organize the implementation of asset management for water conservancy infrastructure and rural clean water supply; statistics, establishment, and management of databases on water conservancy in accordance with the law and the assignment of the People's Committee of the province;

g) Guide and inspect the implementation of state management regulations on the management, exploitation, and protection, ensuring the safety of water conservancy works and rural clean water supply works;

h) Guide and inspect the irrigation, drainage, and flood control work serving agricultural production within the provincial territory in accordance with the provisions;

i) Monitor, supervise, and observe sedimentation and erosion of water conservancy works; guide and manage the organization of exploitation and comprehensive, economical, safe, and effective use of water from water conservancy works; guide and inspect the management and operation, regulation of water resources of water conservancy systems; ensure the provision of clean water for daily use in implementing drought prevention, mitigation, and aftermath recovery, saline intrusion, desertification, flooding, and waterlogging on the provincial territory; organize observation, forecasting, and warning about droughts, saline intrusion, flooding, waterlogging, quantity, and quality of water in the water conservancy system within the provincial territory;

k) Take the lead in building and submitting to the People's Committee of the province for mechanisms, policies, and guidance on the development of small-scale irrigation, intra-field irrigation, advanced and water-saving irrigation; rural clean water supply within the provincial territory in accordance with the law;

10. On dyke and flood control and disaster prevention and mitigation

a) Advise and submit to the People's Committee of the province for issuance within its authority or submit to the competent authority for issuance and organize implementation: plans for disaster prevention and mitigation; planning and investment plans for construction of disaster prevention and mitigation works of the locality according to the division of labor; standards and norms for the use of materials, equipment, and specialized devices for disaster prevention and mitigation; criteria ensuring disaster prevention and mitigation requirements for works and houses owned by households and individuals within the provincial territory; decisions on the organization of construction, management, exploitation, and use of specialized databases, monitoring, and surveillance systems for disaster prevention and mitigation; decisions approving and announcing the results of basic investigations on disaster prevention and mitigation within the provincial territory; decisions on dedicated forces managing dykes, people's dyke management forces; systems and policies for people's dyke management forces, patrol and guard forces; permits for activities related to dykes; use of river beaches, floating islands, and islands related to flood discharge and dyke management; approval of construction and improvement of transportation works related to dykes; decisions approving dike protection plans;

b) Advise and assist the People's Committee of the province in integrating disaster prevention and mitigation content into the planning and development plans for socio-economic development of the locality; manage the implementation of planning in accordance with the law on urban and rural planning for urban areas, rural residential points, technical infrastructure works, and production planning adaptable to the characteristics of disasters in the locality, ensuring sustainable development; organize standing command and control of disaster response operations; inspect, compile, statistics, evaluate, report, and announce damage data caused by disasters; implement measures to protect production when disasters occur to reduce losses and quickly restore production;

c) Advise and submit to the Chairman of the Provincial People's Committee for approval of the emergency response plan for natural disasters; decide on declaring a state of emergency regarding natural disasters within the assigned scope; decide on flood diversion and delaying floods to protect embankments within the authorized scope;

d) Guide and inspect the implementation of flood prevention and control planning for river sections with embankments, embankment regulation planning, and flood prevention and control plans for river sections with embankments, development plans for embankment systems within provincial planning, investment in construction, repair, upgrading, and reinforcement of embankments, management and ensuring the safety of embankments according to the laws and assignments of the Provincial People's Committee;

đ) Guide and organize the assessment of the current status of embankments, identify critical weak points of embankments; inspect the construction and implementation of flood protection plans, flood protection work, and ensure the safety of embankments; compile and manage information and data on embankments within the province;

e) Guide and inspect the investment in construction, maintenance, operation, and protection of disaster prevention and control works within the province according to the laws and assignments of the Provincial People's Committee;

g) Promote and disseminate contents ensuring requirements for disaster prevention and control in the management, operation, and use of mineral extraction areas and other natural resource extraction areas; urban areas; tourist sites, tourist zones; industrial zones; historical relic zones; rural residential areas, and works;

h) Implement tasks as prescribed by the law regarding the establishment of boundary markers for protected areas of embankment works; develop plans and measures to relocate works and residences related to the protected areas of embankment works and riverbeds as prescribed;

11. Regarding rural development

a) Advise and submit to the Provincial People's Committee for issuance within its authority or submit to the competent authority for issuance and organization of implementation: mechanisms, policies, and measures to encourage rural development, poverty reduction, and social security; development of farm household economies, collective economy, cooperatives, and production linkages in agricultural product sales; plans for economic restructuring and rural development programs; policies for agricultural electromechanical development; organization of production to develop concentrated raw material areas for agriculture, forestry, aquaculture, and salt industries; resettlement of residents and relocation of displaced persons due to water conservancy and hydropower projects; mechanization and synchronized mechanization in agricultural production and processing; conservation and development of traditional craft villages, recognition and development of skilled artisans in rural trades; development of rural handicraft industries; training and dissemination of public policy in agriculture; vocational training for rural laborers; occupational safety in the use of agricultural machinery and equipment;

b) Guide, inspect, and organize the implementation of regulations on the division of responsibilities for assessing programs and projects related to household economies, farm household economies, cooperative economies, cooperative groups, cooperatives, and cooperative unions in agriculture; production and sales linkages in agricultural, forestry, aquaculture, and salt products; development of concentrated raw material areas for agricultural, forestry, aquaculture, and salt products; implementation of standards and specifications for agricultural machinery and equipment; mechanization and synchronized mechanization in agricultural production and processing; development of rural trades; agricultural insurance; conservation and development of traditional craft villages; recognition and development of skilled artisans in rural trades; vocational training for rural laborers according to regulations; monitor and report to the Provincial People's Committee on rural development within the province;

c) Guide and inspect the implementation of work to eliminate drug-containing plants; mechanization; resettlement of residents and relocation in rural areas;

d) Organize the implementation of social welfare programs and projects or components thereof in rural areas; hunger eradication action programs; agricultural insurance; construction of residential areas; rural infrastructure construction according to the assignment or delegation of the Provincial People's Committee;

đ) Guide and inspect programs and projects for the construction of technical infrastructure works in rural areas within the assigned scope and according to specialized laws;

12. Regarding agricultural, forestry, aquaculture, and salt product processing and market development

a) Guide and inspect the implementation of planning, programs, mechanisms, and policies for the development of processing sectors linked to production and markets for goods under the management of the Department;

b) Guide, inspect, and evaluate the development of processing and preservation for agricultural, forestry, aquaculture, and salt products;

c) Carry out information collection, analysis, and forecasting of market conditions, market development programs, and promotion of trade for agricultural, forestry, aquaculture, and salt products within the Department's jurisdiction;

d) Lead and coordinate with relevant agencies to organize trade promotion activities for agricultural, forestry, aquaculture, and salt products;

13. Regarding food quality and safety for agricultural, forestry, aquaculture, and salt products

a) Advise and submit to the Chairman of the Provincial People's Committee for issuing, revoking food safety certification for establishments producing, pre-processing, processing, and trading agricultural, forestry, aquaculture, and salt products within the assigned scope within the province; issue, supplement, amend, reissue, and revoke Free Sale Certificates (FSC) for exported goods according to the delegated level;

b) Guide and inspect food quality and safety for agricultural, forestry, aquaculture, and salt products within the province according to the law;

c) Appraise, assess, and classify the conditions for ensuring food safety of establishments producing, pre-processing, processing, and trading agricultural, forestry, aquaculture, and salt products;

d) Implement monitoring programs, risk assessments, and traceability of origins, and investigate causes of food safety incidents within the assigned scope within the province according to the regulations.

đ) Inspect, retrieve, recall, and handle food that does not ensure safety according to the guidance of specialized management agencies and the provisions of the law;

e) Manage certification conformity activities, declaration of conformity within the scope of management as prescribed by the law;

g) Manage testing activities, organize the provision of public services related to quality and safety of agricultural, forestry, fishery products, and salt according to the division or delegation of authority from the Chairman of the Provincial People's Committee.

14. Advise and assist the Provincial People's Committee in implementing state management over agricultural extension activities within the province as prescribed by the law.

15. Advise and assist the Provincial People's Committee in implementing state management over organic agriculture, circular agriculture, ecological agriculture, smart agriculture, high-tech agriculture, agro-industrial integration, agro-service integration, green growth, and shared economy within the province as prescribed by the law.

16. Regarding land

a) Advise and assist the Provincial People's Committee in setting land allocation limits, recognizing land use rights, minimum conditions and area for subdividing plots; special policies on compensation, support, resettlement, and other matters within the tasks of the Provincial People's Committee as prescribed by the law on land;

b) Advise and assist the Provincial People's Committee in establishing, adjusting, and announcing provincial land use plans and provincial land use plans for central cities that do not need to establish provincial land use plans; develop content on land use orientation at each commune administrative unit in the provincial plan;

c) Organize the review of land use plans and land use plans submitted by communes for approval by the Provincial People's Committee; consolidate, monitor, and inspect the implementation of approved land use plans and plans;

d) Advise and submit to the Chairman of the Provincial People's Committee files on land allocation, land leasing, land recovery, change of land use purpose; cases of land allocation and leasing without auctioning land use rights, without bidding to select investors for projects using land, and other matters within the decision-making authority of the Chairman of the Provincial People's Committee as prescribed by the law on land;

đ) Organize the implementation of land registration and registration of property attached to land, issuance of certificates of land use rights and ownership of property attached to land according to the authorized level;

e) Organize the implementation and guide inspections of land investigation, evaluation, protection, improvement, and restoration; land survey, measurement, establishment, adjustment, and management of cadastral maps; statistics, inventory, establishment of current land use maps; construction, operation of systems for monitoring and evaluating land management and use;

g) Take the lead in organizing the establishment, adjustment, amendment, and supplementation of land price lists, submit to the Provincial People's Committee for decision as prescribed;

h) Take the lead in organizing the determination of specific land prices as the basis for calculating land use fees, land lease fees, the value of land use rights when state-owned enterprises are equitized, compensation money when the State recovers land, and other cases as prescribed by the law, submit to the Chairman of the Provincial People's Committee for decision as prescribed by the law;

i) Organize the construction, management, operation, exploitation, and use of local land databases and integrate, update them into the national land database;

k) Take the lead and coordinate with relevant agencies in guiding, inspecting, and organizing the implementation of compensation, support, and resettlement for cases where land is recovered as prescribed by the law;

l) Inspect the organization and implementation of land development, management, and exploitation; perform tasks related to arranging land for bidding to select investors for projects using land as prescribed;

m) Monitor, evaluate, and inspect the management and use of land in the locality as prescribed by the law;

n) Take the lead in organizing reviews, handling, and publicly announcing investment projects that have not put land into use for a continuous period of 12 months or delayed land use for 24 months compared to the schedule stated in the investment project; projects granted extensions; projects delayed in land use due to force majeure as prescribed;

17. Regarding water resources

a) Advise and submit to the Provincial People's Committee for determining and announcing the protected areas around water intake zones for works with protected areas around water intake zones; establish, announce, and adjust lists of lakes, ponds, swamps, and reservoirs that cannot be filled in;

b) Advise and submit to the Provincial People's Committee for approval and adjustment of lists of surface water sources within the province; lists of water sources requiring establishment of protective corridors on the territory; lists of prohibited and restricted areas for groundwater extraction; lists of dams and reservoirs requiring establishment of operational coordination regulations; plans for artificial groundwater replenishment; zoning functions for surface water sources within the province; announce minimum flows on rivers and streams within the province and minimum flows downstream of dams and reservoirs within the jurisdiction;

c) Advise and submit to the Provincial People's Committee for approval and organize the implementation of plans for water resource exploitation, use, and protection, prevention, and mitigation of adverse effects caused by water in the provincial plan; plans for water resource exploitation and use; plans for setting up boundaries of protective corridors for water sources; plans for protecting groundwater; operational coordination regulations between dams and reservoirs on rivers and streams;

d) Receive, review, and submit to the Chairman of the Provincial People's Committee for issuance, renewal, adjustment, reissue, approval of return, suspension, cessation, and revocation of water resource exploitation permits, groundwater exploration permits, groundwater drilling permits; approve, adjust, and recover fees for granting water resource exploitation rights; approve plans for transferring water from river basins;

d) Implementing plans for water resource regulation and distribution; supervising activities related to water resource exploitation, utilization, protection, prevention, and mitigation of water-related harm; organizing responses and remediation of water source pollution incidents; monitoring, detecting, and participating in resolving cross-border water source pollution incidents within jurisdiction; implementing measures to prevent and control riverbed and bank erosion; conducting investigations, assessments, and monitoring of river flow, sedimentation, erosion, and bank conditions; implementing measures to prevent and control saline intrusion; conducting basic water resource surveys according to分级权限; inventorying, statistically analyzing, and storing water resource data within the jurisdiction; identifying depleted, deteriorated, and polluted water sources.

e) Determining and updating the boundaries of water source protection zones on land use maps or current land use maps and incorporating them into land use plans; receiving and reviewing proposals for setting up boundary markers for water source protection zones of hydropower reservoirs; guiding, monitoring, and inspecting the sealing of unused wells in accordance with the law.

g) Organizing the management and implementation of water resource monitoring for local water resource monitoring networks and systems overseeing water resource exploitation and utilization activities, local information systems, and databases (if applicable); providing, sharing, and updating water resource information and other relevant data within the scope of management into the national water resource information system and database.

h) Registering surface water and seawater exploitation; registering the use of surface water, excavation of lakes, ponds, rivers, streams, canals, ditches; guiding the declaration and registration of water resource exploitation and utilization; issuing, renewing, amending, reissuing, approving return, suspending, and revoking underground water drilling operation licenses according to authority.

i) Organizing public opinion solicitation from community representatives, organizations, and individuals regarding the impact of water exploitation projects as stipulated by law.

k) Organizing the determination of the boundaries of sanitary protection zones for drinking water supply areas on-site as prescribed.

l) Reviewing and accepting the results of basic water resource investigation activities for projects organized and implemented by the provincial People's Committee according to regulations.

18. Regarding Geology and Mineral Resources

a) Organizing the preparation and submission to the provincial People's Committee of management plans for geology and mineral resources integrated into environmental protection, resource exploitation and utilization, biodiversity conservation, disaster prevention, and climate change response plans at the provincial level.

b) Advising and assisting the provincial People's Committee in implementing basic geological surveys according to approved projects, programs, or tasks by competent state management authorities; organizing the assessment of potential mineral resources for Group II, III, and IV minerals.

c) Organizing reviews and submitting to the Chairman of the provincial People's Committee for approval of project reports on basic geological surveys for approved projects, programs, or tasks; reviewing and approving project reports on the assessment of potential mineral resources for Group II, III, and IV minerals.

d) Advising and assisting the Chairman of the provincial People's Committee in approving prohibited mining activity zones, temporarily prohibited mining activity zones within the province; approving exploration and mining activities in prohibited and temporarily prohibited mining zones for Group II, III, and IV minerals; delineating areas where mining rights will not be auctioned within the licensing authority of the provincial People's Committee Chairman.

d) Submitting to the Chairman of the provincial People's Committee for recognition of exploration results and supplementary exploration results for Group I minerals (areas designated and announced as scattered and small mineral areas), Group II, III, and IV minerals.

e) Advising and assisting the Chairman of the provincial People's Committee in managing Group I minerals (designated and announced as scattered and small mineral areas), Group II, III, and IV minerals, including: issuing, reissuing, renewing, amending, revoking, and returning mineral exploration permits, mining permits; approving the transfer of mineral exploration rights and mining rights; approving mine closure plans, amending mine closure plans, approving mine closure methods, deciding on mine closures; organizing mine closures when mining enterprises dissolve, go bankrupt, or fail to close mines as required.

g) Advising and assisting the Chairman of the provincial People's Committee in approving fees for granting mining rights; approving costs for mineral resource potential assessments and exploration costs that must be refunded for mines under the provincial People's Committee's licensing authority; preparing and organizing auctions for mining rights under the provincial People's Committee Chairman's licensing authority after auction plans are approved; submitting to the provincial People's Committee Chairman for recognition or cancellation of auction results for mining rights.

h) Advising and assisting the Chairman of the provincial People's Committee in approving general information surveys and evaluations and confirming survey and evaluation results for Group IV minerals.

i) Advising and assisting the provincial People's Committee in preparing applications for the Ministry of Agriculture and Environment to designate and announce scattered and small mineral areas; compiling and inventorying approved and licensed mineral reserves within the provincial People's Committee's authority; storing geological and mineral resource information and data at the provincial level; organizing supervision and monitoring of all mineral activities, recovery of minerals within the jurisdiction; implementing measures to protect the environment, unexploited geological resources, and unexploited minerals; managing and protecting safety facilities in accordance with the law.

19. Regarding the Environment

a) Advise and present to the Provincial People's Committee for the construction and issuance of plans to handle, rehabilitate, and restore particularly severe soil pollution; set economic and technical standards for the collection, transportation, and treatment of household solid waste within the province; contents on environmental protection in provincial planning; plans for managing the quality of surface water in rivers, lakes, and other surface water sources within the province that play an important role in socio-economic development and environmental protection; provincial air quality management plans; schemes for protecting traditional craft village environments as prescribed;

b) Advise and assist the Provincial People's Committee in investing in the construction of infrastructure for environmental protection in industrial clusters when there is no investor constructing and operating industrial cluster infrastructure as prescribed; demand compensation for damages and organize the collection, examination, and evaluation of data and evidence to determine damage to the environment caused by pollution and degradation on the territory of two or more communes; organize the collection and examination of data and evidence to determine damage to the environment caused by pollution and degradation as requested by the commune people's committees; manage dredged sludge from canals, ditches, and water conservancy works under their jurisdiction;

c) Advise and present to the Provincial People's Committee for reporting to the Provincial People's Council to issue plans and implement plans to transition and eliminate fossil fuel-powered vehicles and environmentally polluting vehicles; specifically allocate budgetary expenditures for environmental protection at various levels of local government budgets;

d) Present to the Chairman of the Provincial People's Committee for approval of the results of the review of environmental impact assessment reports; issue, amend, adjust, revoke environmental permits for investment projects and facilities within their jurisdiction as prescribed;

đ) Direct, guide, inspect, and organize the implementation of control over pollution sources, waste management, environmental quality, environmental rehabilitation, prevention, and response to environmental emergencies; implement provisions and criteria for rural environmental protection according to the law;

e) Organize the establishment, management, and operation of the environmental monitoring network within the province; build, submit for approval by competent authorities, and implement local environmental monitoring programs; provide information and warnings about environmental pollution according to the law;

g) Organize the establishment, management, exploitation, operation, and deployment of the provincial environmental information system and database, ensuring synchronization, integration, connection, and interoperability with the national environmental information system and database; organize the preparation and publication of provincial environmental status reports and specialized environmental reports of the locality; guide and organize the preparation of local environmental protection work reports according to the law;

h) Organize the implementation of strategic environmental assessments for provincial planning;

i) Provide professional guidance on key activities of local environmental protection; compile and propose budgets for environmental protection expenses for local environmental protection activities within their responsibility;

k) Propose tax, fee policies for environmental protection, green bond issuance, and other economic tools to mobilize and utilize resources for environmental protection according to the law; guide the determination of environmental damage and claims for compensation for environmental damage within the province;

l) Organize the implementation of environmental protection work in fields under local management according to the law;

m) Organize the management of the provincial environmental protection fund according to regulations;

20. On nature conservation and biodiversity

a) Advise and assist the Provincial People's Committee in organizing the implementation of state management of biodiversity, conservation, and sustainable use of wetland areas within the territory; conduct surveys, statistics, inventories, and evaluations of current biodiversity status, establish sustainable development regimes for natural ecosystems as prescribed; organize surveys to establish the list of invasive alien species within the territory; organize inspections and evaluations of the invasion potential of alien species from outside to have preventive and control measures; investigate, identify distribution areas, develop isolation and eradication plans for alien invasive species in the locality; publicly announce the list of invasive alien species, information on distribution areas, and the degree of harm caused by invasive alien species according to regulations;

b) Present to the Chairman of the Provincial People's Committee for decisions to establish national-level nature reserves with all areas within the territory; decide to establish national-level wetland reserves with all areas within the territory; recognize national-level natural heritage sites with all areas within the territory; rules for coordinating management of important wetlands outside protected areas within the territory;

c) Organize investigations, evaluations, listings, and project proposals for provincial-level nature reserves, biodiversity corridors, high-biodiversity areas, important wetlands, significant ecological landscapes, and biodiversity conservation facilities according to approved plans and legal provisions; conserve endangered, precious, and rare species prioritized for protection, conserve native species' genetic resources, and valuable species at the local level; manage and supervise access to genetic resources and associated traditional knowledge according to the law; control invasive alien species, genetically modified organisms, and products derived from genetically modified organisms; organize the implementation of provincial-level payments for biodiversity-related ecosystem services; rules for coordinating management of important wetlands outside protected areas within the territory; prepare nomination files for recognition and implement management systems for international conservation titles (Ramsar Sites, ASEAN Heritage Parks, World Biosphere Reserves); organize inventories, monitoring, and reporting on biodiversity, building and operating databases on biodiversity;

d) Organize investigations and assessments of the current biodiversity status at the proposed site for establishing a national nature reserve, prepare a project to establish a national nature reserve with the entire area under management jurisdiction; seek opinions from communities legally residing within the proposed reserve area or adjacent to it; investigate and assess areas intended to establish other natural heritage sites; develop a project to establish natural heritage sites, organize public consultations and community participation, complete the project establishment dossier; investigate and assess the current biodiversity, environmental, economic, cultural, and social conditions of the wetland area intended for establishing a national wetland nature reserve; prepare a project to establish a national wetland nature reserve; seek opinions from communities legally residing within or adjacent to the wetland area intended for establishing a national wetland nature reserve; prepare a proposal dossier for establishing a national wetland nature reserve.

21. On meteorology and hydrology

a) Advise and submit to the People's Committee of the province for issuance, extension, amendment, supplementation, suspension, termination of validity, revocation, and reissuance of permits for meteorological and hydrological forecasting and warning activities for organizations and individuals within the permit issuance authority of the provincial People's Committee;

b) Advise and submit to the People's Committee of the province for promulgation of regulations on water levels corresponding to flood warning levels at locations within the management jurisdiction;

c) Advise and assist the Chairman of the People's Committee of the province in organizing monitoring and supervision of weather modification activities within the provincial administrative boundaries; take the lead and coordinate with military, police agencies at the same level, the Department of Science and Technology, and related agencies to organize reviews of weather modification plans within the provincial administrative boundaries for cases permitted by regulation;

d) Advise and assist the Chairman of the People's Committee of the province in organizing reviews and supervising information and data exchange on meteorology and hydrology, climate change monitoring with international organizations, foreign organizations, and individuals not covered by international treaties to which the Socialist Republic of Vietnam is a party, concerning meteorology and hydrology information and data, climate change monitoring within the provincial administrative boundaries;

đ) Take the lead in reviewing investment projects for construction, renovation, and upgrading of dedicated meteorological and hydrological facilities;

e) Review technical standards of construction and measuring equipment of dedicated meteorological and hydrological facilities, lightning detection equipment built by localities using state budget funds in accordance with the law;

g) Organize the protection of meteorological and hydrological facilities under its management jurisdiction; coordinate with central and local agencies in protecting and resolving violations of technical corridor facilities of central meteorological and hydrological facilities within the locality;

h) Take the lead and coordinate with relevant units to develop plans for developing specialized meteorological and hydrological observation station networks to serve the exploitation and utilization of meteorological and hydrological information and data for socio-economic development and disaster prevention and control at the local level; organize implementation of the plan, monitor the establishment, relocation, and dissolution of specialized meteorological and hydrological stations;

i) Organize inspections of the implementation of reception and transmission of meteorological and hydrological forecasting and warning information within the management jurisdiction;

k) Urge and inspect the implementation of regulations on meteorological and hydrological observations and provision of meteorological and hydrological information related to the operation of facilities required to conduct meteorological and hydrological observations according to the law;

l) Monitor and evaluate the exploitation and utilization of meteorological and hydrological forecasting and warning information for socio-economic development and disaster prevention and control within the jurisdiction; review, audit, and evaluate the exploitation and utilization of meteorological and hydrological information and data in projects, programs, plans, and development projects;

m) Take the lead and coordinate with related agencies to organize inspections and urging of meteorological and hydrological observation, forecasting, warning activities, and implementation of measures to develop meteorological and hydrological activities within the jurisdiction according to authority;

22. On climate change

a) Develop, update, and implement the Action Plan to respond to climate change and the Implementation Plan of the Paris Agreement on climate change at the local level;

b) Implement tasks in strategies, plans, programs, projects, and proposals on climate change within the management jurisdiction;

c) Integrate climate change content into strategies, plans, and programs within the management jurisdiction;

d) Organize adaptation activities to climate change; assess impacts, vulnerability, risks, losses, and damages caused by climate change; develop response measures to climate change within the management jurisdiction;

đ) Organize monitoring, evaluation of local adaptation activities to climate change and reduction of greenhouse gas emissions within the management authority;

e) Monitor carbon trading activities within the management jurisdiction; control production, export, import, consumption of ozone-depleting substances and greenhouse gases in accordance with the law and international agreements to which Vietnam is a party;

g) Organize surveys, collect information and data to serve national greenhouse gas inventory and update the national database;

h) Take the lead and coordinate with related agencies annually to compile reports on responding to climate change in the province to be submitted to the Ministry of Agriculture and Environment for the compilation of the national report on responding to climate change;

i) Advise on the development and implementation of the Plan to reduce greenhouse gas emissions in the agricultural and environmental sector at the local level;

k) Organize monitoring and supervision of agricultural and environmental facilities listed in the national greenhouse gas emission sources directory issued by the Prime Minister; responsible for conducting greenhouse gas inventories of these facilities; develop plans to reduce greenhouse gas emissions.

l) Implement fully the information and reporting system on greenhouse gas emissions and mitigation of greenhouse gas emissions in the agricultural and environmental sectors in accordance with current regulations;

m) Participate in implementing international commitments on climate change and ozone layer protection according to the division of labor by the provincial People's Committee;

23. Regarding surveying, mapping, and geographic information

a) Review the content of surveys and maps in programs, projects, tasks, and assignments using state budget funds carried out by departments, sectors, and local People's Committees at various levels;

b) Organize the investment, construction, operation, management, maintenance, protection, relocation, demolition of surveying infrastructure within the scope of management;

c) Organize the establishment, management, updating of national spatial data infrastructure and surveying and mapping databases within the scope of management;

d) Organize the establishment, updating, operation of the national geographic base database and national topographic map within the scope of management;

đ) Organize the implementation of surveys and the creation of maps for establishing administrative boundary records at all levels; establish and update provincial and commune administrative maps within the scope of management when there are changes related to administrative units;

e) Manage the quality of surveying products and maps; manage the storage, confidentiality, provision, exchange, exploitation, and use of information, data, and surveying products and maps within the scope of management;

g) Review the application files and propose relevant specialized agencies under the Ministry of Agriculture and Rural Development to issue, extend, supplement surveying and mapping business licenses in accordance with the law;

h) Organize examinations, issuance, extension, reissuance, replacement, revocation of Class II surveying and mapping practice certificates; store records of surveying and mapping practice certificate issuance, publish information of individuals holding such certificates in accordance with the law;

i) Monitor the publication and distribution of maps within the jurisdiction and recommend competent authorities to suspend publication, distribution, and recall prohibited map publications in accordance with the law;

k) Monitor the enforcement of laws on surveying and mapping, manage organizations and individuals engaged in surveying and mapping activities within the jurisdiction; prepare annual reports on surveying and mapping activities within the scope of management of the provincial People's Committee and submit them to the Ministry of Agriculture and Rural Development for consolidation and reporting to the Government;

24. Regarding integrated resource management and marine and island environmental protection (for provinces and cities with sea and islands)

a) Coordinate the organization of implementation of sustainable marine economic development strategies within the jurisdiction;

b) Organize the implementation of strategies for sustainable exploitation and utilization of marine resources, protection of marine and island environments; national maritime space planning, marine use plans; overall planning for sustainable exploitation and utilization of coastal resources; establish and submit to the provincial People's Committee for approval and organize the implementation of comprehensive management programs for coastal resources and environment within the jurisdiction;

c) Review and submit to the Chairman of the provincial People's Committee for decisions on issuing, reissuing, extending, amending, supplementing, allowing return, and revoking Marine Disposal Permits; manage marine disposal activities within the authority of the provincial People's Committee;

d) Review and submit to the Chairman of the provincial People's Committee for decisions on granting, recognizing, allowing return of marine areas; extending, amending, supplementing marine area allocation decisions; recovering marine areas; manage the use of marine areas within the authority of the provincial People's Committee;

đ) Organize the establishment and management of coastal protection zones; establish and manage marine island resources in accordance with regulations;

e) Carry out activities to control marine and island environmental pollution, emergency response to oil spills and toxic chemicals in the sea, report on the comprehensive management of marine and island resources and environmental protection in accordance with regulations;

g) Organize the implementation of basic investigations, statistics on marine and island resources in accordance with regulations;

25. Regarding remote sensing

a) Organize the implementation of projects and programs on the application of remote sensing in basic investigations, monitoring, supervision of agriculture, natural resources, environmental protection, and climate change adaptation within the jurisdiction;

b) Determine the demand for local remote sensing image data, send it to the Ministry of Agriculture and Rural Development for consolidation and unified acquisition; implement the acquisition, storage, processing of remote sensing image data; build, update, and publish local remote sensing metadata; send copies of purchased foreign remote sensing data and metadata using state budget funds to the Ministry of Agriculture and Rural Development for integration into the national remote sensing image database in accordance with the law;

c) Review and manage the quality of remote sensing products in accordance with the law;

d) Implement activities to ensure technical safety corridors and protect remote sensing data acquisition infrastructure within the jurisdiction in accordance with the law;

đ) Implement the relocation of remote sensing data acquisition infrastructure within the jurisdiction;

e) Review the content of remote sensing in programs, projects, tasks, and assignments using state budget funds carried out by departments, sectors, and local People's Committees at various levels;

26. Regarding the application of information technology and digital transformation

a) Organize the collection, construction, operation, updating, and regular use of provincial agricultural and environmental databases; integrate, synchronize, share with national databases and databases of other agricultural and environmental fields; connect, provide, and share open data on agriculture and environment in accordance with regulations;

b) Build, manage, and operate digital infrastructure, platforms, applications, specialized databases/information systems on agriculture and environment within the jurisdiction;

c) Implement online public services within the jurisdiction; connect with the National Public Service Portal, the Ministry of Agriculture and Rural Development's Administrative Procedure Information System in accordance with regulations;

d) Ensure information security, network security, data confidentiality in accordance with regulations; prevent harmful software; prevent cyber attacks within the jurisdiction;

d) Organize the analysis, processing of data and information, compilation of statistical figures on Agriculture and Environment to serve state management, professional tasks, and socio-economic development within its jurisdiction.

e) Participate in developing Digital Government towards Digital Administration, Digital Economy, Digital Society, and Smart Cities as assigned; implement traceability of origin, smart agriculture, rural digitalization, and farmer digitalization; guide and train on digital transformation and digital skills within its jurisdiction.

g) Manage and preserve documents and materials; provide information and data on Agriculture and Environment within its jurisdiction as prescribed.

27. Implement the task of investment construction management and quality control of specialized works, and act as the specialized agency for construction of specialized works of the Provincial People's Committee in accordance with the law; review the contents of reports proposing investment policies, preliminary feasibility studies, feasibility studies, and design after basic design according to its authority; guide, inspect, supervise, and evaluate overall investment implementation of projects and develop models for agricultural, forestry, fishery, water conservancy, rural clean water supply, dyke, disaster prevention and mitigation, salt industry, rural development projects within the province; be responsible for implementing programs and projects assigned.

28. Implement the role of the permanent office, advise, assist the Provincial People's Committee, and the Provincial Steering Committee for National Target Programs to organize and implement the National Target Program on New Rural Development and the National Target Program on Sustainable Poverty Reduction; the permanent office for natural disaster prevention and control; forest protection and development; rural clean water supply and environmental sanitation; combating desertification; management of trade in wild flora and fauna species at risk of extinction, rare, and precious species; prevention and control of diseases in agriculture, forestry, and fisheries within the province; and other permanent tasks as assigned by the Provincial People's Committee and stipulated by law.

29. Organize the implementation and bear responsibility for inspection, registration, issuance, reissuance, extension, revocation of permits, certificates, confirmation decisions, and professional qualification certificates within the jurisdiction of the Department in accordance with the law, assignments, and delegations from the Provincial People's Committee, and guidance from the Ministry of Agriculture and Rural Development; take the lead in advising and submitting to the Provincial People's Committee or the Chairman of the Provincial People's Committee for the delegation of authority and authorization of the Minister of Agriculture and Rural Development to the Provincial People's Committee, Chairman of the Provincial People's Committee in the fields of Agriculture and Rural Development.

Organize research, application of scientific and technological progress and innovation into production in the field of Agriculture and Rural Development within the province; submit to the Provincial People's Committee proposals and orders for scientific and technological tasks within the jurisdiction of the Department in accordance with the law.

35. Inspect organizations and individuals in the implementation of laws on Agriculture and Rural Development; receive citizens, handle complaints, denunciations, anti-corruption, thrift, and negativity in accordance with the law.

36. Specify the specific functions, tasks, and powers of the department's office; specialized departments, professional units, and public service units under the bureau (if any) in accordance with the functions, tasks, and powers of the Department.

37. Manage organizational structure, civil servant quota, civil servant grade, job positions, staff structure by occupational titles, and number of workers in public service units; implement salary systems and incentive policies, training, commendation, and disciplinary measures for civil servants, staff, and employees within its jurisdiction in accordance with the law.

Chapter II
SPECIALIZED AGENCY FOR AGRICULTURE AND RURAL DEVELOPMENT UNDER THE PEOPLE'S COMMITTEE AT THE COMMUNE LEVEL

Article 3. Position and Functions

1. The specialized agency for Agriculture and Rural Development at the commune level (including the Economic Office for communes or special administrative zones, or the Economic, Infrastructure, and Urban Office for wards and the special administrative zone of Phú Quốc) has the function of advising and assisting the Commune People's Committee in performing state management functions at the local level regarding land; water resources; mineral resources; environment; sea and islands (for units with coastal and island areas); agriculture; forestry; salt industry; water conservancy; fisheries; rural development; disaster prevention and mitigation; poverty reduction; food safety and quality for agricultural, forestry, fishery, and salt products; household economy, rural farmstead economy, collective economy, agricultural, forestry, fishery, and salt industry linked to occupations and rural craft villages; and other duties and powers as prescribed.

2. The specialized agency for Agriculture and Rural Development at the commune level is subject to the direction and management of the Commune People's Committee in accordance with the law; it is also subject to professional guidance, supervision, and inspection by the Department of Agriculture and Rural Development.

Article 4. Tasks and Powers

1. Submit to the People's Committee of the commune the draft resolution of the People's Council of the commune (if any), draft decisions, plans, long-term, medium-term, annual development plans, and other contents of tasks, programs, measures on Agriculture and Environment within the authority of the People's Committee of the commune as prescribed and other documents assigned by the People's Committee of the commune.

2. Submit to the Chairman of the People's Committee of the commune draft documents on the fields and specialized sectors of Agriculture and Environment within the authority of the Chairman of the People's Committee of the commune.

3. Organize the implementation of legal normative documents, strategies, plans, programs, projects, national standards, national technical regulations, economic-technical norms of specialized sectors after approval by competent authorities; disseminate and publicize laws, monitor law enforcement in areas under the assigned management.

4. On Crop Production and Plant Protection

a) Advise and assist the People's Committee of the commune in performing state management tasks regarding crop cultivation and plant protection activities within their authority; implement management contents and measures in crop cultivation and plant protection activities on the territory according to the law; announce plant pests and announce the end of plant pest outbreaks on the territory according to their authority;

a) Advise and assist the People's Committee of the commune in organizing management and development of animal husbandry at the local level; organize the declaration of animal husbandry activities, statistics of animal husbandry establishments, households, feed production establishments; statistics, evaluation, and support for losses suffered by animal raisers after terrestrial animal diseases;

b) Advise and assist the People's Committee of the commune in directing and organizing supervision, forecasting, warning, announcing diseases, and announcing the end of terrestrial animal diseases occurring on the commune territory; manage the activities of centralized animal slaughterhouses; processing, transportation, trading of animals and animal products, and veterinary hygiene; support allocation of land funds for building animal husbandry establishments for relocated entities according to regulations;

c) Advise and submit to the Chairman of the People's Committee of the commune for submission to the Chairman of the Provincial People's Committee to decide on financial support, materials, and resources when disease prevention and control exceeds local capacity;

d) Advise and submit to the Chairman of the People's Committee of the commune for land allocation, land lease, creation of land funds within their authority for animal husbandry development and planting of feed crops; announce diseases and announce the end of terrestrial animal diseases occurring within the commune according to regulations; implement support policies for disease prevention and control, recovery from damage caused by animal diseases, and restoration of animal husbandry and aquaculture on the territory; support costs for materials, training and retraining expenses, equipment costs for service providers according to regulations;

a) Advise and submit to the People's Committee of the commune for issuance within their authority or to higher competent authorities: programs and projects for sustainable forestry development at the local level; classification of forests, demarcation of forest boundaries; implementation of regulations on the responsibilities of the People's Committee of the commune and forest owners in forest management, protection, development, and utilization, fire prevention and firefighting in the locality;

b) Advise and submit to the Chairman of the People's Committee of the commune for decision on forest allocation, forest leasing, forest type conversion; decisions on changing forest use purposes to other purposes, forest recovery, land leasing for productive forest planting; replanting plans when changing forest use purposes;

c) Assist the People's Committee of the commune in organizing forest management and protection; forest investigation, inventory, monitoring forest changes; forest management, protection, conservation of natural resources and biodiversity in various types of forests; fire prevention and firefighting; forest development and utilization; forestry programs and projects decided by the People's Committee of the commune; confirmation of forest allocation and leasing applications according to legal provisions.

8. On water resources management

a) Advise and assist the People's Committee of the commune to perform state management tasks related to irrigation, rural clean water supply; organize the implementation of irrigation development plans according to approved planning; direct the activities of organizations and individuals managing, operating, and protecting irrigation works and rural clean water supply facilities within the area; organize the performance of tasks of grassroots irrigation organizations in cases where such organizations have not yet been established; mobilize local resources to organize the handling of accidents involving irrigation works in accordance with the provisions of the law; inspect the implementation of permit contents for activities within the protection zone of irrigation works; develop plans and implement the removal or relocation of works in accordance with the provisions;

c) Advise and submit to the Chairman of the People's Committee of the commune for approval and public announcement of the operation procedures for large and medium-sized irrigation works delegated by the provincial People's Committee; approve and publicly announce the operation procedures for irrigation reservoirs within the area; approve the outline and results of dam safety inspections for small irrigation dams and reservoirs within the area in accordance with the provisions; approve protection plans for dams and water storage reservoirs within the area, boundary marker placement plans, and protection plans for irrigation works within the area in accordance with delegation;

d) Advise and assist the People's Committee of the commune to organize standing emergency response teams and command emergency response operations; compile, tally, and assess damage caused by natural disasters; aggregate and manage information and data on dykes and flood prevention within the commune; manage the implementation of urban and rural planning laws for urban areas, rural residential points, technical infrastructure projects, and production planning adapted to local natural disaster characteristics, ensuring sustainable development;

10. Regarding land

a) Advise and assist the People's Committee of the commune to provide opinions on provincial land use planning; organize the establishment and adjustment of commune-level land use planning and five-year land use plans; organize the implementation of local land use planning and plans; manage land recovered in rural areas; direct and organize the implementation of compensation, support, and resettlement tasks; publicly announce commune-level land use planning, five-year land use plans, and other tasks within the authority of the commune People's Committee;

11. Regarding water resources

a) Advise and assist the People's Committee at the commune level to organize responses and remediation of water source pollution incidents; monitor, detect, and participate in resolving water source pollution incidents within their authority; implement measures to prevent, control, and remedy damage caused by water according to regulations; protect the quality of drinking water sources in the area; protect and prevent landslides along riverbeds, banks, and beaches; implement measures to monitor, supervise, and protect water quality and drinking water sources locally; investigate, compile, and classify wells that need to be sealed; review and establish lists of organizations and individuals with underground water extraction projects, surface water extraction and usage projects, sea water usage projects, and water surface usage projects, ponds, lakes, rivers, streams, canals, ditches, and creeks that must be declared and registered in the area; disseminate and promote awareness on water resource protection, efficient and economical water usage; inspect and handle violations of laws on water resources in the area;

b) Advise and assist the People's Committee at the commune level to periodically compile and report to the People's Committee at the provincial level on the extraction of underground water by households for domestic use as prescribed; update data on underground water extraction declarations in the area into the National Water Resources Information System and Database;

c) Advise and assist the People's Committee at the commune level to cooperate with the Department: provide opinions on the establishment and adjustment of the List of water sources requiring protective zones according to regulations; determine the boundaries of protective zones for water sources on cadastral maps and current land use maps as prescribed; establish and publish the List of ponds, lakes, reservoirs, and swamps that cannot be filled in the province and provide opinions on the List according to regulations; approve plans for marking the boundaries of protective zones for water sources in the area; manage protective zones for water sources; determine functional zoning for inland surface water sources; determine and organize the announcement of protected areas for water supply facilities; develop underground water protection plans; supplement artificial underground water;

d) Advise and assist the People's Committee at the commune level to cooperate with organizations managing and operating hydroelectric reservoirs: develop plans for marking the boundaries of protective zones for water sources in reservoirs according to regulations; implement marking of protective zone boundaries for water sources on-site; accept, manage, and protect protective zone boundary markers according to assigned tasks; supervise activities within protective zones for water sources and protected areas for water supply facilities according to regulations;

a) Advise and assist the People's Committee at the commune level to request the People's Council at the same level to allocate funds to implement environmental protection tasks according to current budget classification regulations; report to the People's Council at the same level and the People's Committee at the provincial level on environmental protection work in the area according to regulations;

b) Submit to the People's Committee at the commune level the list of industrial clusters without centralized wastewater collection and treatment systems in the area and report to the People's Committee at the provincial level; compile budget requirements for traditional craft village environmental protection activities; plans for environmental restoration, emergency response plans for environmental incidents in the area, and announce environmental incidents according to regulations;

c) Advise and assist the People's Committee of the commune to direct and implement village craft environmental protection models; invest in building and operating waste collection and treatment models, on-site wastewater treatment systems that meet environmental protection requirements funded by the State or contributions from organizations and individuals as prescribed;

b) Monitor, evaluate, utilize weather and hydrological forecast and warning information to serve economic and social development, disaster prevention, and mitigation within the area;

c) Receive weather and disaster warnings and forecasts from the Provincial People's Committee and the Provincial Civil Defense Command;

d) Participate in protecting meteorological and hydrological facilities within the area;

16. Participate in developing and updating the provincial climate change action plan; organize the implementation of the climate change action plan within the area; organize the implementation of climate change programs, tasks, and projects according to the division of labor by the Provincial People's Committee and the Department;

17. On Surveying, Mapping, and Geographic Information

Inspect the implementation of legal provisions on Agriculture and Environment by organizations and individuals under the management area; handle complaints and denunciations; prevent and combat corruption, waste, and negative practices as prescribed by law and according to the division of work by the People's Committee at the commune level.

24. Implement research, application of science and technology, innovation; application of information technology, digital transformation, deployment of electronic governance, towards digital government, digital economy, digital society, digital rural areas, digital farmers regarding agriculture and environment; participate in building, managing, updating, and regularly using databases; statistical work, provision, storage of data and information on Agriculture and Environment as prescribed by law and according to the division of work by the People's Committee at the commune level.

25. Carry out information and regular and urgent reporting on the implementation of assigned tasks in the fields of Agriculture and Environment as prescribed by the People's Committee at the commune level and the Department.

26. Manage organizational structure, civil servant quota, civil servant rank and classification, job positions, staff structure by profession and number of employees in public service units; implement salary systems and incentive policies, training, rewards, and disciplinary measures for civil servants, officials, and workers under the management scope as prescribed by law and according to the division of work by the People's Committee at the commune level.

27. Manage and be responsible for the financial and asset affairs of the department in accordance with the law.

28. Perform other duties, powers, and responsibilities as delegated, authorized, or determined by competent authorities in accordance with the law.

29. Perform other tasks assigned by the People's Committee and the Chairman of the People's Committee at the commune level and as prescribed by law.

Chapter III
IMPLEMENTATION

Article 5. Effective Date

1. This Circular takes effect from July 1, 2025.

2. Repeal the following Circulars:

a) Circular No. 05/2021/TT-BTNMT dated May 29, 2021, issued by the Minister of Natural Resources and Environment guiding the functions, tasks, and powers of the Department of Natural Resources and Environment under the People's Committee at the provincial level and the Department of Natural Resources and Environment under the People's Committee at the district level;

b) Circular No. 30/2022/TT-BNNPTNT dated December 30, 2022, issued by the Minister of Agriculture and Rural Development guiding the functions, tasks, powers, and organizational structure of the specialized agencies on agriculture and rural development under the People's Committee at the provincial and district levels.

Article 6. Responsibility for Implementation

1. The People's Committee at the provincial level shall be responsible for specifically defining the functions, tasks, and powers of the Department of Agriculture and Environment; deciding the organizational structure of the Department of Agriculture and Environment in accordance with management requirements, local characteristics, and criteria for establishing organizations as prescribed by law.

2. The People's Committee at the commune level shall be responsible for specifically defining the functions, tasks, and powers of the specialized departments in accordance with the guidance of the People's Committee at the provincial level to ensure management requirements, local characteristics, and criteria for establishing organizations as prescribed by law.

3. The Chairmen of the People's Committees at the provincial and commune levels shall be responsible for organizing the implementation of this Circular. During the implementation process, if there are difficulties or need for supplementation or amendment, the People's Committee at the provincial level and the Department of Agriculture and Environment shall compile and report to the Ministry of Agriculture and Environment (through the Cadre and Civil Servant Affairs Department) for consideration and resolution within their authority.
