CIRCULAR
Amending and supplementing some articles of Circular No. 01/2023/TT-BTP dated January 16, 2023 issued by the Minister of Justice on the reporting regime for the implementation of laws on administrative violations
Pursuant to the Law on Handling Administrative Violations No. 15/2012/QH13, amended and supplemented by Laws No. 54/2014/QH13, No. 18/2017/QH14, No. 67/2020/QH14, No. 09/2022/QH15, No. 11/2022/QH15, No. 56/2024/QH15, and No. 88/2025/QH15;
Pursuant to Decree No. 118/2021/NĐ-CP dated December 23, 2021 of the Government detailing certain provisions and implementing measures of the Law on Handling Administrative Violations, amended and supplemented by Decrees No. 68/2025/NĐ-CP and No. 190/2025/NĐ-CP;

The Minister of Justice issues this Circular amending and supplementing some articles of Circular No. 01/2023/TT-BTP dated January 16, 2023
of the Minister of Justice on the reporting regime for the implementation of laws on handling administrative violations.
Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019, issued by the Government, concerning the reporting system of state administrative agencies;
Pursuant to Decree No. 39/2025/NĐ-CP dated February 26, 2025 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;
||| The Minister of Justice issues this Circular amending and supplementing some articles of Circular No. 01/2023/TT-BTP dated January 16, 2023, issued by the Minister of Justice, regulating the system of reporting work on the enforcement of laws on handling administrative violations."
Article 1. Amending and supplementing Clause 2 of Article 1 "2. Scope of application
The reporting regime for the implementation of laws on handling administrative violations shall apply to Ministries, ministerial-level agencies; Supreme People's Court; State Audit Agency; People's Committees at all levels; specialized agencies under provincial People's Committees and central agencies organized vertically, including: People's Courts; State Audit Agency; Public Security; Border Guard; Coast Guard; Customs; Taxation; Civil Execution; National Treasury; State Bank Branches in regions; centralized statistical organizations; social insurance agencies and other central agencies organized vertically as prescribed by law."
Article 2. Amending and supplementing some points and clauses of Article 3
1. Amending and supplementing Point a of Clause 3 as follows:
"a) Heads of specialized agencies under provincial People's Committees and central agencies organized vertically located within the province, centrally-administered city, and People's Committees at the commune level shall report on the implementation of laws on handling administrative violations according to the requirements of their immediate superiors;"
2. Amending and supplementing Point b of Clause 3 as follows:
"b) Ministries, ministerial-level agencies, Supreme People's Court, State Audit Agency, and Chairmen of provincial People's Committees shall be responsible for sending reports to the Ministry of Justice no later than December 21 of each reporting period;"
Article 8. Responsibilities for Implementation
1. Ministries, ministerial-level agencies, Supreme People's Court, State Audit Agency, and People's Committees at all levels within their respective spheres of state management shall be responsible for guiding and urging subordinate agencies and units to prepare reports, promptly compiling them to send to the Ministry of Justice in accordance with the contents and deadlines stipulated in this Circular.
Article 3. Amending and supplementing Article 8
2. During the process of implementation, if there are difficulties or issues arise, relevant agencies, organizations, and individuals are requested to promptly reflect these to the Ministry of Justice for study and appropriate amendments and supplements.
Article 4. Replacing the model forms attached to the Circular
Replacing the outline template for the report on the implementation of laws on handling administrative violations, Form No. 01 on the summary table of data for the report on administrative violation penalties, and Form No. 02 on the summary table of data for the report on the application of administrative handling measures in the "Annex Model Outline for Reports and Summary Data Forms for the Implementation of Laws on Handling Administrative Violations" issued together with Circular No. 01/2023/TT-BTP with the corresponding templates for the report on the implementation of laws on handling administrative violations, Form No. 01 on the summary table of data for the report on administrative violation penalties, and Form No. 02 on the summary table of data for the report on the application of administrative handling measures issued together with this Circular.
2. Abolishing Circular No. 16/2018/TT-BTP dated December 14, 2018 of the Minister of Justice on the reporting system in managing the implementation of laws on handling administrative violations and monitoring the enforcement of laws.
2. Ministries, ministerial-level agencies, Supreme People's Court, State Audit Agency, and People's Committees at all levels shall be responsible for organizing the implementation of this Circular.
Article 5. Effective Date
1. This Circular takes effect from December 16, 2025.

1. The Minister of Justice shall be responsible for guiding and implementing this Circular.
