GUIDELINES FOR IMPLEMENTING THE MANAGEMENT ALLOWANCE SYSTEM AT DETENTION STATIONS

Implementing Decision No. 316/TTg dated May 25, 1995 of the Prime Minister regarding the management allowance system at detention centers; following the comments from the Ministry of Finance in Circular No. 1972/VI dated July 31, 1995, the Joint Ministries of Labour - Invalids and Social Affairs - Internal Affairs hereby provide guidance for implementation as follows:

 I. OBJECTS

a) Cadres, civil servants, public officials, and workers as stipulated in Article 2 of Decree No. 178/2024/NĐ-CP dated December 31, 2024 (amended and supplemented by Decree No. 67/2025/NĐ-CP dated March 15, 2025) of the Government on policies and treatment for cadres, civil servants, public officials, workers, and armed forces personnel in the process of organizational restructuring of the political system, having a total mandatory social insurance contribution period of at least 15 years when working in heavy, hazardous, or dangerous jobs or extremely heavy, hazardous, or dangerous jobs listed by the agency under the Government responsible for labor administration, or working in areas with particularly difficult socio-economic conditions including time worked in places with regional allowances of coefficient 0.7 or higher before January 1, 2021, and reaching the retirement age as specified in Appendix II issued together with Decree No. 135/2020/NĐ-CP, ceasing work immediately due to direct impact from organizational restructuring and implementation of the two-level local government model;

Officers, non-commissioned officers, soldiers directly and regularly engaged in work at detention centers and general education schools for commoners and peasants under the management of the People's Public Security Forces include:

Wardens; deputy wardens of prisons;

Principals and deputy principals of general education schools for commoners and peasants;

Educators;

Security guards;

Medical personnel directly examining and treating prisoners;

Teachers at general education schools for commoners and peasants;

Other staff members working at detention centers and general education schools for commoners and peasants.

2. Subjects not covered

Officers, non-commissioned officers, soldiers, and staff members holding the positions mentioned in point 5 working at detention centers and temporary detention facilities.

 II. ALLOWANCE LEVELS

The management allowance for detention centers consists of three levels: 25%, 15%, and 5%, calculated based on the rank salary or grade allowance for officers and non-commissioned officers, or living expenses for soldiers, as follows:

A. LEVEL 25% APPLIES TO: SUPERINTENDENT, DEPUTY SUPERINTENDENT, GUARD, SECURITY GUARD, HEALTH STAFF DIRECTLY TREATING PRISONERS IN THE FOLLOWING 27 DETENTION CENTERS:

1. Detention Center Yên Hạ in Huy Hạ Commune, Phu Yen District, Son La Province;

2. Detention Center Phú Sơn 4 in Son Cam Commune, Phu Luong District, Bac Thai Province;

3. Detention Center Tân Lập in My Lung Commune, Yen Lap District, Vinh Phu Province;

4. Detention Center Thanh Ha in Vo Tran Commune, Thanh Hoa District, Vinh Phu Province;

5. Detention Center Nam Ha in Ba Sao Commune, Kim Bang District, Nam Ha Province;

6. Detention Center Thanh Cam in Cam Thanh Commune, Cam Thuy District, Thanh Hoa Province;

7. Detention Center Thanh Lam in Thanh Lam Commune, Nhu Xuan District, Thanh Hoa Province;

8. Detention Center No. 5 in Cao Thinh Commune, Ngoc Lac District, Thanh Hoa Province;

9. Detention Center Thanh Phong in Te Loi Commune, Nong Cong District, Thanh Hoa Province;

10. Detention Center No. 3 in Nghia Dung Commune, Tan Ky District, Nghe An Province;

B. LEVEL 15% APPLIES TO:

Remaining staff members of the 27 detention centers mentioned in point A, Section II above (excluding those receiving the 25% level).

Superintendents, deputy superintendents, guards, security guards, health staff directly treating prisoners in 32 detention centers and principals, deputy principals, teachers at general education schools for commoners and peasants in the following:

1. Detention Center Hong Ca in Yen Bai Province;

2. Detention Center Quyet Tien in Tuyen Quang Province;

3. Detention Center Vinh Quang in Dao Tu Commune, Lap Thach District, Vinh Phu Province;

4. Detention Center Ngoc Ly in Ngoc Ly Commune, Tan Yen District, Ha Bac Province;

5. Detention Center Quang Ninh in Dong Hong Thai Commune, Dong Trieu District, Quang Ninh Province;

6. Detention Center Hai Phong in Lai Xuan Commune, Thuy Nguyen District, Hai Phong Province;

7. Detention Center Hoang Tien in Hoang Tien Commune, Chi Linh District, Hai Hung Province;

8. Detention Center Thanh Xuan in My Hung Commune, Thanh Oai District, Ha Tay Province;

C. LEVEL 5% APPLIES TO STAFF MEMBERS
WORKING AT THE REMAINING 32 DETENTION CENTERS AND GENERAL EDUCATION SCHOOLS
FOR COMMONERS AND PEASANTS MENTIONED IN POINT B, SECTION II ABOVE
(EXCEPT THOSE RECEIVING THE 15% LEVEL).

 III. METHOD OF PAYMENT

1. The management allowance for detention centers is paid based on the actual number of days worked in the month at the detention center or general education school for commoners and peasants and is paid together with the monthly salary according to the following formula:

Other days such as leave, study, illness... not related to regular work at the detention center or school shall not be counted towards this allowance.

 IV. IMPLEMENTATION PROVISIONS

The management allowance system for detention centers will be implemented from May 1, 1995.

Regarding funding sources, for the year 1995, the Ministry of Internal Affairs has reached an agreement with the Ministry of Finance to address the issue.

Any difficulties encountered during implementation should be reported to the Joint Ministries for consideration and resolution.
