CIRCULAR
Provisions on the provision, management, and use of data from vehicle telematics devices
Circular No. 09/2015/TT-BGTVT dated April 15, 2015, issued by the Minister of Transport, stipulating provisions on the provision, management, and use of data from vehicle telematics devices, which took effect from June 1, 2015, has been amended and supplemented by:
1. Circular No. 36/2020/TT-BGTVT dated December 24, 2020, issued by the Minister of Transport, amending and supplementing certain articles of circulars concerning periodic reporting systems in the road transport sector, which took effect from February 15, 2021.
2. Circular No. 05/2023/TT-BGTVT dated April 27, 2023, issued by the Minister of Transport, amending and supplementing certain articles of circulars related to the road transport sector, road transport support services, vehicles, and drivers, which took effect from June 15, 2023.
3. Circular No. 05/2024/TT-BGTVT dated March 31, 2024, issued by the Minister of Transport, amending and supplementing certain articles of circulars related to the road transport sector, road transport support services, vehicles, and drivers, which took effect from June 1, 2024.

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Based on Decree No. 86/2014/ND-CP dated September 10, 2014 of the Government on business operations and conditions for road passenger transport by road vehicles;
Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in state agency activities;
At the proposal of the Director of the Department of Science and Technology and the Director General of the Vietnam Highway Corporation,
The Minister of Transport issues this Circular stipulating provisions on the provision, management, and use of data from vehicle telematics devices[1].
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates provisions on the provision, management, and use of data from vehicle telematics devices hereinafter referred to collectively as telematics devices.
Article 2. Applicability
This Circular applies to transportation business units, passenger bus terminals, cargo terminals, service providers of telematics devices, and relevant agencies, organizations, and individuals involved in the provision, management, and use of data from vehicle telematics devices throughout the country.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Information system: is a set of hardware, software, and communication links used for collecting, managing, and exploiting data from telematics devices.
2. Data: is a structured set of information transmitted from telematics devices to the service server and from the service server to the Vietnam Highway Department.[2].
3. Service server: is the server of the transport unit or the telematics service provider responsible for receiving data transmitted from telematics devices and tasked with transmitting mandatory data to the Vietnam Highway Department.[3] a) Receive and manage IDP data updated from Departments of Transport to synchronize with the IDP management information system;
4. Telematics service provider (hereinafter referred to as the service provider): is the entity organizing the provision of services for managing, exploiting, consolidating, analyzing, and storing data from telematics devices according to contracts with transportation business units.
Chapter II. PROVISION, MANAGEMENT, AND USE OF DATA FROM VEHICLE TELEMETRICS DEVICES
Article 4. Provisions on data provision
1. Requirements for data provision: data provision is divided into two types, including identification data and telematics data.
a) Identification data includes: name of the transportation business unit; name of the Department of Transport (where the transportation business license was issued); vehicle registration number; vehicle load capacity (number of passengers or cargo weight allowed to participate in traffic); type of business. This identification data must be linked to telematics data.
b) Telematics data must continuously update information including: driver's license number; speed, time, coordinates of the vehicle.
2. Data from telematics devices must be transmitted to the service server at a frequency not exceeding once every 30 seconds when the vehicle is running and not more than once every 15 minutes when the vehicle is stationary (when the vehicle stops for rest during the journey, or waits at bus terminals for passengers on fixed routes).
3. Data must ensure completeness according to the structure specified in Appendix 1 of this Circular and must meet the following requirements:
a) Data from telematics devices must be transmitted to the Vietnam Highway Department server[4] within no more than 2 minutes from the time the service server receives the data;
b)[5] Data from telematics devices transmitted from the service server to the Vietnam Highway Department server must be in chronological order. Within no more than 3 days from the last day the Vietnam Highway Department server received data, if data transmission is interrupted, both old and current data should be sent simultaneously upon reconnection; for cases exceeding 3 days, the data transmitter shall notify the Vietnam Highway Department to arrange for data retransmission channels;
c)[6] The data transmission protocol is publicly announced by the Vietnam Highway Department on its official website.
4. The service server and the Vietnam Highway Department server[7] participating in the transmission and receipt of data from telematics devices must be synchronized with National Standard Time according to the NTP (Network Time Protocol) standard.
5. Provided data must be timely, accurate, and not altered or distorted before or during transmission.
Article 5. Provisions on Calculation Methods [8]
1. The calculation of kilometers driven, vehicle speed, continuous driving time, and daily working hours of drivers shall be conducted on the service server and the Vietnam Highway Administration's server. Data from faulty reports shall not be used for calculations. Detailed procedures for filtering noise before calculations are specified in Appendix 3 issued together with this Circular.
2. Calculation of Exceeding Speed Limit
a) The method for determining exceeding speed limit shall be carried out according to the provisions set forth in Appendix 2 issued together with this Circular;
b) Software on the server calculates exceeding speed based on the coordinates and direction of speed signs and speed-restricted zones announced by traffic management authorities. In cases where there is no data on the coordinates and direction of speed signs and speed-restricted zones announced by traffic management authorities, the calculation shall be based on the maximum permissible speed for motor vehicles outside densely populated areas, depending on the type of vehicle. If the maximum permissible speeds for different lanes of a road differ, the calculation shall be based on the highest permissible speed for the lane.
3. Calculation of Driving Time
a) The driving time of a driver is determined when the driver controls a vehicle participating in traffic (only counting the time when the vehicle is moving at a speed);
b) Exceeding continuous driving time is determined when the total driving time of a driver exceeds four hours without stopping for rest as prescribed in Clause 4, Article 11 of Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government on business operations and conditions for operating passenger and cargo transport services by road or without changing drivers;
c) Exceeding daily working time of a driver is determined when the total driving time of a driver in a day exceeds ten hours. A driver's working day is calculated from 00:00 to 24:00 hours;
d) The calculation method shall be carried out according to the provisions set forth in Appendix 6 issued together with this Circular.
4. Determination of Non-Data Transmission
Non-data transmission is determined when a vehicle moves its position relative to the recorded position at the start of non-transmission and there is no data during the movement between two positions. The calculation method shall be carried out according to the provisions set forth in Appendix 4 issued together with this Circular.
5. Calculation of Kilometers Driven shall be carried out according to the provisions set forth in Appendix 5 issued together with this Circular.
6. The value of the calculation result shall be rounded to two decimal places.
Article 6. Provisions on Exploitation and Use of Data [9]
1. Data exploitation from the vehicle tracking device shall be carried out in accordance with the laws on information technology application in state agency activities.
2. Information and data from the vehicle tracking device shall be exploited and used to serve the management of transportation activities by transport businesses; to serve the state management of transportation activities, traffic order and safety, public security, taxation, and anti-smuggling efforts.
3. Information and data in the database from the vehicle tracking device on the network shall be secured in accordance with the laws on information technology.
4. Publicly announce on the electronic information website of the Department of Transport the results of violations handled through the vehicle tracking device for vehicles and drivers licensed by the Department.
Chapter III. MANAGEMENT LEVELS AND RESPONSIBILITIES OF AUTHORITIES AND UNITS
Article 7. Management, exploitation, and utilization of data from vehicle tracking devices
1.[10] The Vietnam Road Administration manages the unified information system nationwide, compiles and analyzes according to input data indicators transmitted from service server machines to serve the management of transportation business activities, including:
a) Comprehensive and detailed reports on cases where vehicles exceed speed limits; comprehensive and detailed reports on cases where drivers continuously operate over 4 hours; comprehensive and detailed reports on cases where drivers work more than 10 hours in a day; comprehensive and detailed daily reports on cases where data transmission does not occur; comprehensive and detailed reports on cases where data transmission does not occur while the vehicle is moving; comprehensive and detailed reports on cases where full information is not transmitted as prescribed; detailed reports on abnormal data phenomena;
b) Comprehensive and detailed trip reports; comprehensive reports on transport means and units by type of business; detailed stopping and parking reports for transport means;
c) Comprehensive and detailed reports as stipulated in Articles 6, 7, 8, and 22 of Decree No. 10/2020/NĐ-CP dated January 17, 2020, of the Government regarding business operations and conditions for operating passenger and cargo transportation by road;
d) Displaying vehicle information on digital maps to serve online monitoring and information lookup.
2.[11] Implement the reception, compilation, and analysis of data transmitted from service servers according to the indicators specified in Clause 1 of Article 7 of this Circular. Issue warnings on the Vietnam Road Administration's information system for data exploitation units to be aware of cases where data is not received for 30 minutes or longer, or network or server issues of the Vietnam Road Administration.
3. Passenger bus terminals and freight terminals shall be provided with login accounts to access the Vietnam Road Administration’s database[12] to serve the management of vehicles operating at the terminal.
4.[13] (Repealed).
Article 8. Responsibilities of the Vietnam Road Administration
1. Invest in and construct information systems, manage, upgrade, maintain hardware, software, and data transmission lines of the information system, exploit and utilize data from vehicle tracking devices.
2. Develop software to receive, compile, and analyze data transmitted from transport business units and service providers according to the models prescribed in Appendices 3 to 21 of this Circular. Issue warnings on the Vietnam Road Administration's information system[15] for data exploitation units to be aware of cases where data is not received for 30 minutes or longer, or network or server issues of the Vietnam Road Administration[16].
3. Ensure the continuity and accuracy of information and data from vehicle tracking devices on the information system when providing to exploiting units and state management agencies with authority upon request; bear responsibility for the accuracy and truthfulness of the provided information and data.
4. Provide data transmission accounts to authorized transport units or service monitoring units; login accounts to the Vietnam Road Administration's information system[17] for units according to the management, exploitation, and utilization provisions stipulated in Article 7 of this Circular.
5. Provide specific guidance to transport business units and service providers on the methods and procedures for transmitting data to the Vietnam Road Administration[18].
6.[19] Exploit and utilize data from vehicle tracking devices on the Vietnam Road Administration's information system when conducting inspections and checks at localities or upon written requests from competent authorities.
7. Guide the use, update, exploitation, and management of information systems from vehicle tracking devices for provincial Department of Transport.
8. Assign staff to monitor and operate the information system, ensuring continuous operation during the exploitation and utilization of data from vehicle tracking devices.
9.[20] Store data reports on the Vietnam Road Administration
information system for a minimum of two years.
10.[21] Compile results of handling through data from vehicle tracking devices of provincial Departments of Transport.
11. Handle or propose competent authorities to handle responsibilities of provincial Departments of Transport, transport business units, and related individuals and organizations as prescribed.
12. Publish data on coordinates and dimensions of speed signs and areas with speed restrictions on national highways and expressways.
13.[22] (Repealed).
Article 9. Responsibilities of the Department of Transport
1. Assign staff to monitor, exploit, and utilize data from vehicle tracking devices on the Vietnam Road Administration's information system[23]of transport business units in the locality to serve transportation management, including:
a) Managing, inspecting, and supervising transportation activities;
b)[24] Exploiting and utilizing data on the Vietnam Road Administration's information system to monitor, correct, and handle violations in transportation activities by transport business units, vehicles, and drivers in the locality.
c) Evaluation work of transport business units in the locality in complying with transportation management regulations;
d) Investigation and resolution of traffic accidents by competent authorities upon request.
2. Check, update, and verify information to ensure the accuracy of data transmitted from transport business units and service providers to the Vietnam Road Administration[25] for exploiting and utilizing data from vehicle tracking devices, including: name of the provincial Department of Transport; name of the transport business unit; vehicle registration number; vehicle gross weight (number of passengers or cargo volume allowed to participate in traffic); type of business of transport business units and the number of transport vehicles required to install vehicle tracking devices.
3.[26] Secure login names and passwords, and data information on the Vietnam Road Administration's system according to regulations. In case of a need for replacement or additional issuance, a written request must be sent to the Vietnam Road Administration.
4. Require business units under local management to address violations committed by drivers; monitor and urge these units to report on the results of handling such violations.
5. Handle or propose competent authorities to handle the responsibility of transportation business units within their jurisdiction as prescribed.
6. Address the responsibility of individuals and organizations related to the provision, management, and use of data from vehicle tracking devices in management, monitoring, exploitation, and utilization of vehicle tracking device data.
7. Publish data on the coordinates and direction of speed limit signs and restricted speed zones on local managed routes on the Department of Transport's electronic information website.
8.[27] Implement reporting procedures as follows:
a) Report name: Report on the results of handling violations by the locality and transportation business units.
b) Content required for reporting: Report on the results of handling violations by the locality and transportation business units.
c) Reporting entities: Departments of Transport, Construction Departments of provinces and centrally-administered cities.
d) Receiving agency: Vietnam Highway Corporation.[28].
đ) Method of sending and receiving reports: Reports shall be presented in either paper form or electronic form. Reports shall be sent to the receiving agency through one of the following methods: direct submission, postal service, fax, email system, or other methods as prescribed by law.
e) Frequency of reporting: Monthly.
g) Deadline for submitting reports: Before the fifth day of the month following the reporting period.
h) Data verification period: From the first day to the last day of the reporting month.
i) Report data template: As specified in Appendix 23 of this Circular.
9.[29] Notify Vietnam Highway Corporation of any abnormal data or situations requiring rechecking of information during the exploitation and use of data on the system.
Article 10. Responsibilities of Transportation Business Units
1. Invest in and maintain hardware, software, and data transmission lines at the unit to ensure compatibility with the data reception software of Vietnam Highway Corporation.[30].
2.[31] Accurately and fully transmit data as stipulated in Clause 1, Article 4 of this Circular to Vietnam Highway Corporation. Provide access passwords to the database and exploitation software, decryption algorithms when requested by authorized agencies if there is encoded information in the unit's database.
3. Ensure objectivity, accuracy, and timeliness in providing data, without altering or distorting data transmitted to Vietnam Highway Corporation.[32].
4. Assign staff to monitor and exploit data on the exploitation software from vehicle tracking devices to support the unit's management and operational activities; verify the accuracy of information regarding vehicle license plates, vehicle load capacity (number of passengers or cargo weight allowed to participate in traffic), type of transportation business, driver's full name, driver's license number under the unit's management.
5. Systematically store mandatory information for a minimum period of one year.
6. Ensure data security and confidentiality for the information system from vehicle tracking devices at the unit and on the Vietnam Highway Corporation's information system.[33].
7.[34] Address the responsibility of managing, monitoring, exploiting, and using data for individuals and departments within the unit.
8. The transportation business unit shall directly implement or entrust a service provider to perform through a legally binding contract the provisions set out in Clauses 1, 2, 3, 5, and Clause 6 of this Article.
9.[35] (Repealed)
Article 11. Responsibilities of passenger bus terminal and cargo terminal business units
1. Extract data from the vehicle tracking devices of transport businesses operating at the terminal on the information system of the Vietnam Highway Administration[36] to serve the work of monitoring, supervising, and managing the activities of vehicles at the terminal.
2. Check on the information system of the Vietnam Highway Administration[37] to ensure complete vehicle data. For vehicles without information on the Vietnam Highway Administration's information system[38] the terminal business unit must request the driver to confirm and compile a report to be submitted to the Department of Transport of the locality where the transport business is registered within no more than five working days from the date the driver confirms the absence of data on the Vietnam Highway Administration's information system[39].
3. Safeguard login names and passwords for accessing the information system, extract and use data from vehicle tracking devices on the Vietnam Highway Administration's information system[40].
Article 12. Responsibilities of service providers
1. Invest in and maintain equipment and software for providing and transmitting data in accordance with the signed contracts with transport businesses to ensure compatibility with the data receiving software of the Vietnam Highway Administration[41].
2. Ensure objectivity, accuracy, and timeliness in providing data, not to alter or distort any information or data transmitted to the Vietnam Highway Administration[42]; ensure the safety and confidentiality of data provided by transport businesses
3. Provide timely and accurate information and data from vehicle tracking devices to competent state management agencies when requested; bear responsibility for the accuracy and honesty of the provided and transmitted information and data to the Vietnam Highway Administration[43].
4. Develop software for extracting data from vehicle tracking devices in accordance with National Technical Regulation QCVN 31:2014/BGTVT - National Technical Regulation on Vehicle Tracking Devices for transport businesses to exploit and manage their vehicles
5. Have plans to ensure replacement when the device installed on the transport vehicle is damaged or under repair to ensure uninterrupted data for the vehicle during the entire transportation process (except when the vehicle is in operation but has not yet completed its journey)
6. Have the responsibility to warn devices that do not transmit data on the software for extracting data from vehicle tracking devices
7.[44] Provide database access passwords and decryption algorithms in cases where encrypted information exists in the database upon request by authorized agencies
Chapter IV. EFFECTIVE DATE AND IMPLEMENTATION
Article 13. Effective Date[45]
This Circular takes effect from June 1, 2015, and replaces Circular No. 23/2013/TT-BGTVT dated August 26, 2013, issued by the Minister of Transport regarding the provision, management, and use of data from vehicle tracking devices of automobiles
Article 14. Implementation[46]
manages the unified issuance of IDPs nationwide and has the following responsibilities:[47] shall be responsible for implementing and guiding related units to implement this Circular
2. The Director of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments, Vietnam Highway Administration[48], Directors of Provincial and Municipal Transport Departments under the Central Government, Heads of relevant agencies, organizations, and individuals are responsible for enforcing this Circular./.

I. Abbreviated Terms:
- N: Is the sequence number of the report from the vehicle tracking device.
- V[N]: Instantaneous speed (km/h).
- Vlimit[N]: Maximum allowable speed (km/h).
- Vtb[N]: Average speed (km/h).
- Vss[N]: Speed for comparison with Vlimit[N] to determine violation (km/h).
- Vvipham[N]: Excessive speed (km/h).

After filtering out invalid reports as described in Appendix VI of this Circular, the calculation of excessive speed shall be performed.
a) Calculate the time interval compared to the previous report (Ttb[N]), depending on this time interval, the average speed and distance will be calculated as follows:
- Ttb[N] > 60 seconds: Do not calculate excessive speed and will record data transmission violations.
- 10 seconds < Ttb[N] <= 60 seconds: Calculate distance based on the coordinates of two consecutive reports. Calculate speed = min (((Dtb[N] / Ttb[N]) *3600); (Dtb[N] / Ttb[N]) *3600));
- Ttb[N] <= 10 seconds: Calculate distance = Vtb[N] * Ttb[N]. Calculate speed: Vtb[N] = (V[N]+ V[N-1])/2.
b) Calculate comparative speed (Vss[N]): Vss[N] = Vtb[N] -3
The speed error currently applied in the system for all devices is -3 km/h.
c) Calculate excessive speed
- Start calculating speed violation at the moment Vss[N] > Vlimit[N] until the end of the violation Vss[N] <= Vlimit[N] (measured in seconds). If Vss[N] > Vlimit[N] is maintained continuously for 20 seconds or more, it will be recorded as a speeding violation.
- V (VND/year): is the total investment capital allocated annually for the usable area of social housing for rent, ensuring the preservation of capital, calculated according to the following formula:vipham[N] = Vss[N] – Vlimit[N]
Use the highest excessive speed and the corresponding maximum allowable speed to determine the level of violation according to the range (under 5 km/h, from 5 km/h to under 10 km/h, from 10 km/h to 20 km/h, over 20 km/h to 35 km/h, over 35 km/h).

Appendix 3[51]
FILTERING AND NOISE REMOVAL OF NOTICES PRIOR TO CALCULATION
(Annexed to Circular No. 09/2015/TT-BGTVT dated April 15, 2015, issued by the Minister of Transport)
The servers of transportation business units or service providers and the servers of the Vietnam Highway Administration will perform noise filtering and removal on received notices before incorporating them into calculations, including:
1. Notices with invalid time stamps
o Time sent into the future
o The time stamp of a subsequent notice is earlier than that of a previous notice
2. Notices with invalid coordinates
o Longitude or latitude = 0

In cases where units use engine on/off status for vehicle movement calculation, attention should be given to situations where the vehicle is off but still reports speed > 3 km/h.
4. Exception handling cases
- Other exceptions arising during data processing will be continuously updated. The Vietnam Highway Administration provides specific handling solutions for these cases on its website and notifies units to implement consistent handling methods.

METHOD FOR CALCULATING WITHOUT DATA TRANSMISSION

1. Regarding data transmission frequency:
To ensure accuracy and ease of calculation, it is recommended that units transmit data at a frequency ≤ 10s/notice
2. Data transmission in the event of a lost signal:
a) As soon as the device regains signal, the data transmission unit shall transmit current and past data from the time of signal loss to the time of signal recovery as stipulated
Additional data transmission will be conducted through a separate channel, monthly supplementary data must be completed before the 4th of the following month. After receiving data at the times of previous signal losses, the system will recalculate all parameters
b) Transmit current data to serve real-time display of vehicle position on the monitoring screen
c) Data from the time of signal loss to the present time is transmitted in chronological order to serve the prescribed calculation
3. Detailed calculation of each non-data transmission violation
a) A non-data transmission violation is determined when the vehicle moves to a new position compared to the recorded position at the start of data cessation and there is no data during the movement between two positions. Specifically, Ttb[N] > 120s and Dtb[N] > 500m
b) Or based on toll station data collected to compare with existing system data
4. Vehicles not transmitting data on a daily basis
Vehicles not transmitting data on a daily basis are considered to have transmitted zero notices to the system N=0, or have transmitted data but the information in the transmitted notices is unusable (faulty notices)

CALCULATION METHOD FOR DRIVING TIME

1. Driving time:
a) The start of driving time is determined when there are two consecutive reports with V[N] > 3 km/h.
b) The end of driving time occurs when:
- Stopping or parking time >= 15 minutes (applicable to fixed route vehicles, contractual vehicles, tourist vehicles, cargo transport vehicles, inter-provincial buses); >= 5 minutes (applicable to intra-provincial buses, taxis).
- Change of driver recorded by the device.
2. Calculation of continuous driving time violations:
a) Continuous driving time violation is identified when the driving time of a person exceeds 4 hours without stopping or parking for >= 15 minutes (applicable to fixed route vehicles, contractual vehicles, tourist vehicles, inter-provincial buses, and cargo transport vehicles); >= 5 minutes (applicable to intra-provincial buses, taxis) or without changing drivers.
Supplement algorithm: For units that have engine on/off data as a calculation condition, if the vehicle continues moving but there is no data, the continuous driving time is still calculated.
b) Driving time violation within a day is identified when the total driving time of a person in a day exceeds 10 hours.
3. Stopping and parking time:
It starts when two consecutive reports have V[N] ≤ 3 km/h and V[N-1] ≤ 3 km/h and ends when two consecutive reports have V[N] > 3 km/h and V[N-1] > 3 km/h.

[40] the phrase "Vietnam Highway Administration" shall be replaced with the phrase "Vietnam Road Administration" as provided for in Point a Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain articles of circulars related to road transport, supporting road transport services, vehicles, and drivers, which takes effect from June 15, 2023;
[41] the phrase "Vietnam Highway Administration" shall be replaced with the phrase "Vietnam Road Administration" as provided for in Point a Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain articles of circulars related to road transport, supporting road transport services, vehicles, and drivers, which takes effect from June 15, 2023;
[42] the phrase "Vietnam Highway Administration" shall be replaced with the phrase "Vietnam Road Administration" as provided for in Point a Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain articles of circulars related to road transport, supporting road transport services, vehicles, and drivers, which takes effect from June 15, 2023;
[43] the phrase "Vietnam Highway Administration" shall be replaced with the phrase "Vietnam Road Administration" as provided for in Point a Clause 1 Article 9 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain articles of circulars related to road transport, supporting road transport services, vehicles, and drivers, which takes effect from June 15, 2023;
[44] This paragraph is added pursuant to Clause 8, Article 2 of Circular No. 05/2024/TT-BGTVT amending and supplementing certain articles of related circulars concerning road transport, road transport support services, vehicles, and drivers, which takes effect from June 1, 2024.
[45] Article 10 of Circular No. 36/2020/TT-BGTVT amending and supplementing certain articles of circulars stipulating periodic reporting systems in the field of roads, which takes effect from February 15, 2021, provides as follows:
“Article 10. Effective Date
1. This circular takes effect from February 15, 2021.
2. The Director of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Highway Administration, the Directors of Provincial and Central City Transport Departments, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this circular./”
Article 6 of Circular No. 05/2024/TT-BGTVT amending and supplementing certain articles of related circulars concerning road transport, road transport support services, vehicles, and drivers, which takes effect from June 1, 2024, provides as follows:
“Article 6. Implementation Provisions
1. This circular takes effect from June 1, 2024.
2. This circular abolishes Appendix 24 of Circular No. 38/2019/TT-BGTVT dated October 8, 2019, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport, stipulating the training, examination, and issuance of motor vehicle driver's licenses.
3. Transitional Provisions
a) For training courses that have been enrolled before the effective date of this circular, training institutions shall continue to organize training according to the provisions of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Circular No. 38/2019/TT-BGTVT, Circular No. 01/2021/TT-BGTVT, Circular No. 04/2022/TT-BGTVT, and Circular No. 05/2023/TT-BGTVT).
b) Persons who were absent or failed examinations to obtain driver's licenses before the effective date of this circular but register for driving license examinations after the effective date of this circular shall be reviewed and examined according to the provisions of this circular.
c) Persons studying to upgrade their driver's licenses who have already learned fire prevention, firefighting, and rescue skills in the current training course to obtain their driver's licenses shall retain their results (no need to retake the course).
d) In cases where the competent authority cannot perform electronic identity verification of organizations or citizens due to errors in the electronic identity and authentication system, organizations and individuals must present one of the following valid documents: a copy of the business registration certificate, a copy of the citizen identification card, a copy of the identity card, or a copy of the passport when performing administrative procedures.
4. The Director of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Highway Administration, the Directors of Provincial and Central City Transport Departments and Construction Departments, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this circular./”
[46] article 24 of circular number 05/2023/TT-BGTVT amending and supplementing certain articles related to the road transport sector, road transport support services, vehicles and drivers, shall take effect from June 15, 2023, is stipulated as follows:
“article 24. implementation provisions
1. this circular takes effect from June 15, 2023.
2. the director of the ministry's office, the director of the ministry's inspectorate, department heads, the director of the Vietnam Road Administration, directors of provincial transportation departments, heads of agencies, organizations, and individuals concerned are responsible for implementing this circular./”.

[48] the phrase "Director General of the Vietnam Road Administration" shall be replaced with the phrase "Director of the Vietnam Road Administration" pursuant to clause 2, article 9 of circular number 05/2023/TT-BGTVT amending and supplementing certain articles related to the road transport sector, road transport support services, vehicles and drivers, which shall take effect from June 15, 2023.
[49] this annex is replaced pursuant to clause 9, article 2 of circular number 05/2024/TT-BGTVT amending and supplementing certain articles related to the road transport sector, road transport support services, vehicles and drivers, which shall take effect from June 1, 2024.
[50] this annex is replaced pursuant to clause 9, article 2 of circular number 05/2024/TT-BGTVT amending and supplementing certain articles related to the road transport sector, road transport support services, vehicles and drivers, which shall take effect from June 1, 2024.
