Article 1. Scope of Application |
This Decree details Articles 23, 28, and 33 of the Law on Emergency Situations regarding the regime and policies for organizations and individuals participating in emergency activities; preventive, response, and mitigation forces; and the responsibilities of state management over emergency situations. |

Chapter II
REGIME AND POLICIES FOR ORGANIZATIONS AND INDIVIDUALS PARTICIPATING IN ACTIVITIES DURING AN EMERGENCY SITUATION
Article 3. Wages, salaries, allowances, and support for individuals mobilized to perform tasks in an emergency situation according to the decision of a competent authority
1. For those receiving wages from state budget
a) Shall be paid their full salary by the organization where they work based on rank, grade, military rank, position; allowances for positions, seniority allowances, regional allowances and other allowances as prescribed by law throughout the period of performing tasks;
b) In addition to the items specified in paragraph 1 point a, shall receive hazardous allowance calculated according to the actual days worked during an emergency situation with the following rates:
Level 1: Equal to 0.2 times the daily wage base when working during an emergency situation.
Level 2: Equal to 0.3 times the daily wage base when working during an emergency situation with hazardous or harmful factors, or in areas affected by natural disasters, epidemics, severe disasters.
Level 3: Equal to 0.4 times the daily wage base when working during an emergency situation with particularly hazardous and harmful factors, posing a high risk to life and health;
c) Civil servants, public officials, workers performing overtime duties at the Emergency Command, Emergency Headquarters, or the Office of the Emergency Management shall be paid additional overtime wages in accordance with the provisions of the Government's Decree detailing and guiding certain articles of the Labor Law on working conditions, labor relations, and related laws.
2. For those not receiving wages from state budget
a) During the period mobilized to perform tasks in an emergency situation according to the decision of a competent authority, shall receive daily wage allowances, food allowance as for the militia mobilized to perform tasks according to the provisions of the Decree detailing certain articles of the Militia Self-Defense Law on organization and construction of forces and policies for the militia self-defense;
b) In case working at night (from 22:00 the previous day to 06:00 the next day), shall receive additional daily wage allowances not lower than 50% of the current daily wage allowance specified in point a of this paragraph;
c) In addition to the items specified in points a and b of this paragraph, shall receive additional daily wage allowances due to hazardous or harmful factors when performing tasks during an emergency situation calculated according to the actual days worked, with the following rates:
Level 1: Equal to 0.5 times the daily wage allowance prescribed in point a of this paragraph when working during an emergency situation.
Level 2: Equal to 0.7 times the daily wage allowance prescribed in point a of this paragraph when working with hazardous or harmful factors, or in areas affected by natural disasters, epidemics, severe disasters.
Level 3: Equal to 1.0 times the daily wage allowance prescribed in point a of this paragraph when working during an emergency situation with particularly hazardous and harmful factors, posing a high risk to life and health;
d) For workers at enterprises or organizations not receiving wages from state budget, during the period mobilized to perform tasks in an emergency situation according to the decision of a competent authority, shall be paid daily wage allowances, food allowance, and additional daily wage allowances as specified in paragraph 2; enterprises or organizations shall pay wages during the mobilization period no lower than the regional minimum wage prescribed by the Government at the time of performing tasks and such wages shall be included in production and business management costs.
3. Other support measures
a) Individuals mobilized to perform tasks in an emergency situation according to the decision of a competent authority as specified in paragraphs 1 and 2 Article, when working at a location far from their place of residence without the means to travel daily, shall be provided with accommodation, transportation, or reimbursement for one-way and return train tickets like civil servants and local government officials;
b) Individuals mobilized to perform tasks in an emergency situation according to the decision of a competent authority as specified in paragraph 1 Article when working overnight (from 22:00 the previous day to 06:00 the next day), shall receive additional food allowance calculated on a daily basis as follows:
Level 3: Equal to 0.4 times the daily wage base when performing duties in a state of emergency with special hazardous and dangerous factors, posing a high risk to life and health;
c) Civil servants, staff members, and workers who perform additional duty shifts at the Emergency Command, Emergency Headquarters, or the Permanent Office for the State of Emergency are entitled to overtime wages as provided by Government Decree detailing certain provisions of the Labor Code on working conditions, labor relations, and related laws.
2. Those not receiving state budgetary wages
a) During the period when they are mobilized to perform duties in a state of emergency pursuant to a decision by an authorized body, they shall receive daily wage compensation and food allowances as provided for conscripts who are mobilized to perform duties according to the provisions of the Decree detailing certain provisions of the Law on Self-Defense Militia regarding organization and construction of forces and policies and benefits for self-defense militiamen;
b) In the event of performing duties at night (from 22:00 of the previous day to 06:00 of the following day), they shall receive additional daily wage compensation not lower than 50% of the current daily wage compensation provided for in point a of this clause;
c) In addition to the provisions set forth in points a and b of this clause, they shall receive additional daily wage compensation due to hazardous and dangerous factors when performing duties in a state of emergency on a per actual duty day basis, with the following levels:
Level 1: Equal to 0.5 times the daily wage compensation provided for in point a of this clause when performing duties in a state of emergency.
Level 2: Equal to 0.7 times the daily wage compensation provided for in point a of this clause when performing duties with hazardous and dangerous factors or working in an area affected by natural disasters, epidemics, or severe disasters.
Level 3: Equal to 1.0 times the daily wage compensation provided for in point a of this clause when performing duties in a state of emergency with special hazardous and dangerous factors, posing a high risk to life and health;
d) For workers employed by enterprises or organizations not receiving state budgetary wages, during the period when they are mobilized to perform duties in a state of emergency pursuant to a decision by an authorized body, the mobilizing agency shall pay daily wage compensation, food allowances, and additional daily wage compensation as provided for in paragraph 2 of this Article; the enterprise or organization shall pay wages during the time of mobilization not lower than the regional minimum wage stipulated by the Government at the time of performing the task, which will be counted as part of production and business management costs.
3. Entrustment to the Ministers in charge of relevant sectors to specify the degree of hazardousness, danger, or particularly dangerous conditions when working in a state of emergency where the law has not yet provided for such specifications; the determination of additional hazardous and dangerous allowances as provided in paragraph 1 point b and paragraph 2 point c of this Article shall be decided by the person authorized to mobilize based on legal provisions, sector-specific regulations, nature of the task, area, risk level, and specified in the mobilization order.
4. Other support measures
a) Persons who are mobilized to perform duties in a state of emergency pursuant to decisions by an authorized body as provided in paragraphs 1 and 2 of this Article at locations far from their place of residence, where daily commuting is not possible, shall be provided with accommodation and rest places, support for transportation means, or reimbursement of travel expenses equivalent to those for commune-level cadres;
b) Persons who are mobilized to perform duties in a state of emergency pursuant to decisions by an authorized body as provided in paragraph 1 of this Article when performing night duty (from 22:00 of the previous day to 06:00 of the following morning) shall receive additional food allowances on a per-day basis as follows:
Level 1: For continuous duty with a duration from 02 hours to less than 04 hours, personnel of the People's Army of Vietnam who are enlisted soldiers or infantry soldiers shall be entitled to an additional meal allowance equivalent to 0.5 times the basic daily meal allowance for officers and enlisted soldiers in the People's Army of Vietnam.
Level 2: For continuous duty with a duration of 04 hours or more, personnel of the People's Army of Vietnam who are enlisted soldiers or infantry soldiers shall be entitled to an additional meal allowance equivalent to 1.0 times the basic daily meal allowance for officers and enlisted soldiers in the People's Army of Vietnam.
Paragraph 5: The expenses for implementing the salary, wage, allowances, and support system for persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by this Article shall be borne by the national budget; the level that requisitions shall ensure payment.
Paragraph 6: The payment of salary, wages, allowances, and support for persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by this Article shall be carried out transparently, openly, in accordance with the actual time spent on performing duties; in case one person is eligible for multiple levels of allowances and subsidies, the highest level applicable shall be applied.
Article 4. Conditions, levels of entitlement, procedures, and authorities responsible for ensuring funding for medical examination and treatment for persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by this Article who do not participate in health insurance or social security
Paragraph 1: Conditions, levels of entitlement, procedures, and authorities responsible for ensuring funding for medical examination and treatment for persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by this Article who are not participating in health insurance if they fall ill, suffer an accident, or sustain injuries shall be the same as those for civilian militia members mobilized to perform tasks according to the provisions of the Decree detailing certain articles of the Law on Civil Defense Militia regarding organization and construction of forces and policies and benefits for civil defense militia.
Paragraph 2: Conditions, levels of entitlement, procedures, and authorities responsible for ensuring funding, policies, and benefits for persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by this Article who are not participating in social security if they suffer an accident or die shall be the same as those for civilian militia members mobilized to perform tasks according to the provisions of the Decree detailing certain articles of the Law on Civil Defense Militia regarding organization and construction of forces and policies and benefits for civil defense militia.
Article 5. Compensation, subsidies, rewards, and other support for persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by this Article
Paragraph 1: Persons mobilized or requisitioned to perform tasks under a state of emergency shall be compensated for the loss or damage to their lawful property caused directly by the performance of duties in accordance with the law.
Paragraph 2: In case of reduced work capacity or complete loss of work capacity due to accidents, illness arising during the performance of duties, they may be considered for a one-time subsidy or monthly subsidy according to the provisions of the law; support for retraining and career transition appropriate to their remaining work capacity.
Paragraph 3: Persons who have performed their tasks with outstanding results and achieved special achievements in a state of emergency shall be considered for rewards in accordance with the provisions of the law on commendation and reward.
Paragraph 4: The State encourages domestic and foreign agencies, organizations, and individuals to participate in support and contribute resources to improve the material and spiritual life of persons mobilized or requisitioned to perform tasks under a state of emergency as provided for by the law.
Article 6. Policy for Subjects Participating in, Cooperating with, Collaborating with, and Supporting Emergency Response Activities
1. Rewards
Where a subject participates, cooperates, collaborates, or supports emergency response activities and achieves notable results, they may be considered for rewards according to the provisions of laws on merit awards.
2. Compensation for Property Losses for Subjects
a) A subject that suffers lawful property damage due to directly executing tasks as required by an authorized agency during an emergency situation may be considered for compensation or support in accordance with legal provisions; such compensation shall be based on the actual value of loss confirmed by all parties.
b) Property losses compensated include: Damaged, lost, or irreparably unusable property; costs of repairing and restoring property to enable its use;
c) The amount of compensation is determined based on the actual value at the time of the loss; in cases where restoration is impossible, compensation shall be made according to residual value or an appropriate replacement value as stipulated by law;
d) Funding for compensation is provided from state budget sources or from international organizations, individuals, and other legal financial sources as prescribed by law.
3. Restoration of Honor and Dignity for Individuals, Reputation for Subjects
a) An individual who suffers damage to their honor and dignity, or an entity that suffers reputational harm due to errors by an authorized agency or false information during emergency response activities may have their honor and reputation restored;
b) Restoration of honor and dignity is carried out in accordance with legal provisions;
c) Entities, individuals, or subjects causing damage to the honor, dignity, or reputation of others must bear responsibility for apologizing, correcting misinformation, and compensating for any losses as prescribed by law.
4. Policies and Benefits for Individuals Suffering Death, Injury, or Health Damage
a) An individual who participates, cooperates, collaborates, or supports emergency response activities and suffers injury or health damage may receive benefits according to legal provisions;
b) In cases of injury or health damage, timely medical examination, treatment, rehabilitation, and healthcare are provided; impairment in work capacity is assessed; one-time or monthly compensation based on the degree of work capacity impairment as prescribed by law is granted;
c) Where an individual dies during emergency response activities or due to direct consequences of task execution, their family members may receive benefits, support, and preferential treatment according to legal provisions;
d) If eligible for recognition as a revolutionary beneficiary, they may be considered and processed for benefits under the laws on preferential treatment for revolutionary beneficiaries.
Chapter III
PREVENTIVE FORCES, RESPONSE, AND MITIGATION OF EMERGENCY SITUATIONS
Article 7. Core Forces
1. Main Force of the People's Army, Local Defense Force, Self-Defense Militia; emergency response forces in the northern region, central region, and southern region under the Ministry of National Defense.
2. Public Security Forces, local security and order protection forces.
3. Specialized search and rescue forces for air and maritime operations, and specialized forces under the Ministry of Construction.
4. Meteorological and hydrological monitoring forces, climate change, geological disaster, and water resources management forces; forest protection forces; plant and animal quarantine forces; fisheries and marine law enforcement forces under the Ministry of Agriculture and Environment.
5. Medical forces; emergency response vanguard forces for natural disasters; specialized centers and stations for search and rescue operations, and other specialized forces with functions and tasks to prevent, respond to, and mitigate the consequences of incidents and disasters managed by central and local authorities.
Article 8. Emergency Response Team
1. The Emergency Response Team is established by the Minister and the Chairpersons of lower-level People's Committees from civilian defense forces responsible or兼任的人员在紧急状态宣布前,根据其权限建立,并以兼职模式运作以应对和缓解紧急情况。
2. The tasks of the Emergency Response Team
a) Collect information on incidents and disasters in the assigned area; promptly identify, report to competent authorities; be ready to mobilize forces and equipment for response, mitigation, and prevention of disaster spread; provide initial first aid, emergency medical support for injured persons;
b) Organize training and exercises to respond to and mitigate emergencies;
c) Coordinate with other forces to implement the order to declare and lift the state of emergency and perform other tasks as directed by competent authorities.
Article 9. Special Propaganda Work Team
1. Based on actual circumstances, the Chairperson of the People's Committee at the provincial level decides to establish a special propaganda work team from forces under their jurisdiction; the special propaganda work team dissolves when the state of emergency is lifted.
2. The tasks of the Special Propaganda Work Team
a) Promote, mobilize, and guide the public to comply with the order declaring the state of emergency; measures taken by competent authorities in the area placed under a state of emergency;
b) Monitor the situation in the area placed under a state of emergency, provide accurate information, combat false news, contribute to social stability; disseminate instructions, directives, and command from competent authorities to the public;
c) Coordinate with other forces to implement the order declaring the state of emergency and perform other tasks as directed by competent authorities;
d) Cooperate with information and communication agencies and local governments to provide accurate and timely official information to the people; guide public opinion, combat false information that distorts reality and causes social unrest;
e) Mobilize the public to comply with evacuation, distancing, quarantine, relief, and mitigation of consequences during a state of emergency; promote and instruct disaster prevention, response, and self-protection skills for the public.
Article 10. Special Patrol Team
1. Based on the actual situation, the People's Committee of a province decides to establish a special patrol team from the People's Public Security Force, the People's Armed Forces, the Militia and Self-defense Force, and other forces participating in security and order protection at the grassroots level where an emergency status is declared; the special patrol team shall dissolve itself when the emergency status is lifted.
In case of a national defense emergency, the special patrol team operates in accordance with the provisions on the state of emergency in national defense.
2. The mission of the special patrol team
To patrol, inspect, and control matters related to the enforcement of measures applied in the area where an emergency status is declared in accordance with legal provisions.
Article 11. Widespread Forces
1. Widespread forces are composed of all citizens participating to carry out response and disaster relief tasks during an emergency state.
2. The mission of the widespread forces
a) Participate in rescue operations, evacuation of civilians, ensuring safety of human lives and property of the State and civilians in areas under an emergency status;
b) Participate in response and disaster relief efforts in areas under an emergency status;
c) Support supply of logistics, medical services, food, and other essential activities;
d) Perform other tasks as required by competent authorities.
3. Organization of widespread forces
a) The mobilization of widespread forces is decided by state organs with authority in accordance with legal provisions, which must be consistent with the actual situation and each targeted group;
b) Mobilization decisions must clearly specify the scope, target, mission, duration, and applicable policies and regulations;
c) Citizens, organizations, and enterprises have a duty to comply with mobilization decisions unless otherwise provided by law;
d) Widespread forces may be organized into teams, squads, or groups.
4. Management, command, and utilization of widespread forces
a) Widespread forces are directly managed, commanded, and utilized by local authorities; management, command, and utilization must ensure the intended purpose, mission accomplishment, safety, and effectiveness;
b) Widespread forces shall not be used for activities contrary to law or outside the area under an emergency status;
c) When the emergency status is lifted, widespread forces are dissolved.
5. Rights and obligations of participants in widespread forces
a) Ensured safety, provided with necessary information and guidance to perform tasks during an emergency state;
b) Enjoy benefits and policies as stipulated in Chapter II of this Decree;
c) Obligated to comply with orders, instructions, commands, and coordination from competent authorities; adhere to safety and discipline regulations while performing tasks during an emergency state.
Chapter IV
STATE MANAGEMENT RESPONSIBILITY FOR EMERGENCY SITUATIONS
Article 12. Ministry of Defense
1. Is the principal authority responsible for managing national emergency situations; coordinates with the Prime Minister to propose decisions on declaring and lifting an emergency status in national defense, disaster emergencies caused by earthquakes, tsunamis, oil spills, or multiple types of disasters occurring simultaneously.
2. Directs relevant forces to cooperate closely with localities in preventive measures, response, and relief efforts during an emergency state; participates in production, supply of equipment, materials, and assistance to civilians in areas under an emergency status.
3. Coordinates and collaborates with ministries and agencies at the central level to adjust and supplement operating regulations for the National Civil Defense Command Center to ensure compliance with legal provisions on emergency situations.
4. Manages and operates the Office of the National Civil Defense Command Center as a specialized agency assisting the Ministry of Defense, National Civil Defense Command Center, and National Emergency Status Command in performing tasks related to emergency situations in accordance with legal provisions.
5. Coordinates and collaborates with central ministries and agencies to review regulatory documents, propose amendments or supplements ensuring compliance with the Law on Emergency Situations; organizes inspections of the implementation of regulations on emergency situations.
6. Issues and supplies national reserve materials promptly and fully in accordance with legal provisions for preventive measures, response, and relief efforts during an emergency state.
7. Cooperates with the Ministry of Foreign Affairs and relevant central ministries and agencies to submit proposals to the Government and Prime Minister regarding participation in international organizations, signing or joining international treaties, and conducting international activities related to emergency situations.
Article 13. Ministry of Public Security
1. Shall be in charge of drafting proposals for the Prime Minister to request competent authorities to decide on declaring and lifting a state of emergency concerning national security, public order, and social safety; a state of emergency due to major fires in urban areas, industrial zones, residential areas, or cyber security incidents.
2. Shall issue regulations within its authority or submit them for issuance by competent authorities and direct their implementation regarding legal provisions on ensuring public security, public order, and social safety during a state of emergency.
3. Shall be in charge of coordinating with relevant central ministries and local governments to develop plans and schemes and organize the execution of tasks related to safeguarding national security, maintaining public order, and ensuring social safety in areas placed under a state of emergency.
4. Shall direct relevant forces to closely cooperate with related forces and localities in preventive measures, response, and mitigation efforts during a state of emergency; participate in production, supply of equipment and materials, and relief for the people in affected areas.
5. Shall promptly and fully issue national reserve supplies as prescribed by law to support preventive, responsive, and mitigative actions during a state of emergency.
Article 14. Ministry of Health
1. Shall be in charge of drafting proposals for the Prime Minister to request competent authorities to declare and lift an emergency due to dangerous infectious diseases; announce and inform about the disease situation, its impact level, and preventive measures against the disease.
2. Shall issue regulations within its authority or submit them for issuance by competent authorities and direct their implementation regarding health-related legal provisions in areas under a state of emergency.
3. Shall be in charge of coordinating with the Ministry of National Defense and the Ministry of Public Security to prepare forces and mobile equipment ready to reinforce localities if an emergency due to infectious diseases exceeds the local control capacity; implement measures to enhance healthcare system capabilities, ensuring readiness for emergencies.
4. Shall be in charge of coordinating with central ministries and local governments to mobilize public and private health systems and social resources for preventive work, diagnosis, treatment, investment in medical facilities and equipment, and response actions during a state of emergency.
5. Shall be in charge of coordinating with the Ministry of Finance and relevant agencies to review and propose appropriate support policies and ensure protective equipment for personnel involved in emergency responses, medical staff, nurses, technicians, healthcare workers; military, police, grassroots cadres, and volunteer teams; organize urgent social assistance programs for local residents affected by an emergency.
6. Shall promptly and fully issue national reserve supplies as prescribed by law to support preventive, responsive, and mitigative actions during a state of emergency.
Article 15. Ministry of Construction
1. Shall be in charge of coordinating with relevant central ministries to draft proposals for the Prime Minister to request competent authorities to declare and lift an emergency due to major construction collapses or severe air or maritime accidents.
2. Shall implement plans and schemes for force and equipment utilization; command specialized search and rescue teams under the ministry; direct and guide localities in organizing transportation, evacuation of people and vehicles to safe areas, logistical support, and casualty transfer during a state of emergency.
3. Shall direct and guide specialized air and maritime search and rescue forces and enterprises under the Ministry of Construction to respond to emergencies.
4. Shall direct coastal, terrestrial satellite, and Cospas-Sarsat satellite communication stations to promptly provide relevant information on air or maritime accidents to competent authorities.
5. Shall promptly and fully issue national reserve supplies as prescribed by law to support preventive, responsive, and mitigative actions during a state of emergency.
Article 16. Ministry of Agriculture and Environment
1. Shall be in charge, coordinate with relevant central ministries and agencies to advise the Prime Minister to request competent authorities to decide on declaring or lifting a state of emergency due to natural disasters, environmental hazards, animal diseases, plant pests.
2. Shall forecast, issue timely weather, hydrological, and oceanographic forecasts for the area placed under a state of emergency to the Government, the Prime Minister, the National Civil Defense Command, central ministries and agencies, and relevant localities.
3. Shall direct, guide, mobilize specialized forces in meteorology, hydrology, climate change, geological disasters, water resources; forestry inspection forces; plant quarantine forces; aquatic product and fisheries inspection forces under the Ministry of Agriculture and Environment to implement preventive measures, response actions, and mitigation efforts according to their assigned functions and areas of state management.
4. Shall be in charge, coordinate with relevant localities to ensure hygiene and environmental conditions in the area placed under a state of emergency; guide the handling and transportation of waste generated during a state of emergency.
5. Shall promptly and fully issue national reserve goods according to legal provisions to support preventive measures, response actions, and post-disaster recovery efforts during a state of emergency.
6. Shall coordinate with the Ministry of Construction, the Ministry of Industry and Trade, the Ministry of Finance, relevant localities to ensure favorable conditions for agricultural product production and consumption in areas affected by a state of emergency.
Article 17. Ministry of Science and Technology
1. Shall be in charge, advise the Prime Minister to request competent authorities to declare or lift a state of emergency due to radiation and nuclear incidents.
2. Shall organize forces, provide advice, and support central ministries and agencies as well as localities in responding to radiation and nuclear incidents during a state of emergency.
3. Shall be in charge, coordinate with relevant central ministries and localities to ensure information for the guidance, command, and control of the Government and the Prime Minister during a state of emergency.
4. Shall strengthen research efforts, implement research programs, and scientific technology tasks serving response measures during a state of emergency; advise on mobilizing scientists and experts to propose solutions for responding to emergencies.
Article 18. Ministry of Industry and Trade
1. Shall be in charge, coordinate with relevant central ministries and agencies to advise the Prime Minister to request competent authorities to declare or lift a state of emergency due to hazardous chemicals and toxic chemicals; organize forces for responding to incidents at nuclear power plants under its jurisdiction during a state of emergency.
2. Shall strictly manage production, extraction of electricity, coal, oil, natural gas, new energy sources, renewable energy, other minerals, toxic chemicals, industrial explosives to ensure technical safety in their exploitation and processing; import and export of hazardous and toxic chemicals.
3. Shall be in charge, coordinate with relevant central ministries and agencies to develop a national energy reserve plan serving defense, security, economic-social activities, combining the implementation of tasks during a state of emergency; implement measures to stabilize prices and ensure essential goods for the population in areas placed under a state of emergency.
4. Shall direct efforts to ensure supplies, raw materials, and energy to meet the needs for restoring production, business operations, and economic-social development; promptly and fully issue national reserve goods according to legal provisions to support preventive measures, response actions, and post-disaster recovery efforts during a state of emergency.
5. In case of a state of emergency, shall be in charge, coordinate with relevant agencies to propose competent authorities to resolve difficulties and obstacles related to mechanisms, policies, procedures for investment, funding sources, or other issues concerning important industrial projects; provide maximum support to factories to maintain and resume production.
Article 19. Ministry of Culture, Sports and Tourism
1. To advise the Prime Minister to direct central ministries, sectors, and localities on comprehensive measures ensuring the safety of cultural, sports, and tourism facilities affected by disasters or wars.
2. To cooperate with central and local news agencies in disseminating information regarding the Proclamation and lifting of a state of emergency issued by the President.
3. To direct organs and organizations under its jurisdiction to temporarily suspend cultural, informational, sports, and tourism events during a state of emergency or to propose competent authorities to do so.
4. To take the lead in cooperation with the Ministry of Public Security, the Ministry of Agriculture and Environment, and other relevant central ministries and localities on developing and implementing measures to maintain order and social safety, as well as environmental protection during sports activities and festivals.
Article 20. Ministry of Finance
1. To compile and report to competent authorities for decision-making: Allocating funds for preventive, response, and recovery tasks in a state of emergency according to the provisions of the National Budget Law, Public Investment Law, and related laws.
2. To promptly issue and supply national reserves as required by law to support preventive, response, and recovery efforts during a state of emergency.
3. To propose competent authorities for budget allocation from the national budget and other lawful resources in accordance with relevant laws; to adjust or reduce funds for other expenditure tasks to ensure funding for disaster prevention, response, and recovery work during a state of emergency.
Article 21. Ministry of Home Affairs
1. To advise the Government and the Prime Minister on launching competitive campaigns in responding to and recovering from emergencies, restoring production and business activities, stabilizing people's lives, and promoting economic and social development.
2. To cooperate with ministries, sectors, and localities in proposing timely rewards for collective bodies and individuals who have performed well during the emergency state and in economic recovery efforts.
3. To take the lead in cooperation with relevant agencies on ensuring measures for workers and employers; to propose solutions for restoring the labor market in areas placed under a state of emergency.
Article 22. Ministry of Education and Training
1. To take the lead in advising the Government and the Prime Minister on organizing and adjusting educational and training activities in areas placed under a state of emergency; to guide the implementation of appropriate teaching and training methods to ensure the right to education as stipulated by law.
2. To take the lead in cooperation with the Ministry of National Defense, the Ministry of Public Security, the Ministry of Health, and other relevant central ministries and localities on implementing measures to ensure safety for students, teachers, and educational institutions; to direct preventive, response, and recovery efforts against incidents or risks arising during emergency educational activities.
3. To cooperate with central and local authorities in mobilizing, allocating, and utilizing educational facilities and equipment to meet the needs of emergency response according to decisions by competent authorities; to organize inspections and supervision of the implementation of education and training provisions during a state of emergency.
Article 23. Ministry of Foreign Affairs
1. Shall be in charge and coordinate with relevant central ministries and agencies to advise the President and the Prime Minister to request foreign countries, international organizations, and individuals to provide resources for prevention, response, and coordination in implementing measures to mitigate the consequences.
2. Shall coordinate with the Ministry of Justice, relevant central ministries and agencies to promptly inform member states of the International Covenant on Civil and Political Rights (ICCPR) about the declaration, publication, and lifting of a state of emergency in Vietnam.
3. Shall coordinate with relevant central ministries and agencies, provincial people's committees to advise the Prime Minister on receiving, coordinating foreign assistance resources for relief, support, dispatching Vietnamese forces and equipment abroad to participate in response, mitigation efforts, humanitarian aid, and disaster relief operations.
Article 24. Ministry of Justice
Shall be in charge and coordinate with the Ministry of Foreign Affairs to notify member states of the International Covenant on Civil and Political Rights (ICCPR) and relevant international organizations about the declaration, publication, and lifting of a state of emergency in Vietnam in accordance with domestic law and international treaties.
Article 25. Ministry of Ethnic Affairs and Religion
1. Within its functions and responsibilities, shall be in charge and coordinate with lower-level people's committees to organize publicity and mobilization for ethnic minorities and religious communities to comply with and participate in the implementation of state policies on prevention, response, and mitigation during a state of emergency.
2. Shall coordinate with the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, and relevant central ministries and local authorities to implement measures ensuring security, order, social safety, and environmental protection for religious activities involving large gatherings in areas placed under a state of emergency.
3. Shall be in charge and coordinate with the Ministry of Home Affairs and relevant central and local authorities to study, propose, and implement policies supporting and safeguarding social welfare for ethnic minorities and regions with concentrated religious communities affected by a state of emergency in accordance with domestic law.
Article 26. State Bank of Vietnam
Shall be in charge and direct the credit system to implement credit policies as prescribed by law to support agencies, organizations, enterprises, and individuals affected during a state of emergency.
Article 27. Other Ministries and Equivalent Authorities
1. Within its functions, responsibilities, and authority, shall implement response and mitigation measures during a state of emergency in accordance with decisions by the competent authority; proactively adjust plans and programs to prioritize tasks during a state of emergency.
2. Shall be in charge or coordinate with relevant central ministries and local authorities to develop and implement contingency plans for mobilizing forces, equipment, materials, and resources under its jurisdiction to participate in response and mitigation efforts during a state of emergency; ensure effective use and proper purpose.
3. Shall guide, inspect, and urge the implementation of measures within its sector or field of management; promptly summarize difficulties and obstacles exceeding authority that need resolution and report to the Prime Minister for consideration and instructions.
4. Within its functions, responsibilities, and authority, shall coordinate with central and local media agencies in organizing timely, accurate, and comprehensive information dissemination about the state of emergency, government policies, and directives from competent authorities; contribute to public opinion guidance, stability of thoughts, and life for the people.
Article 28. Local Government Authorities at All Levels
1. The Chairman of the People's Committee of a Province
a) Coordinate with relevant central ministries and agencies to advise the Prime Minister on requesting competent authorities to declare or lift a state of emergency; develop and implement plans and strategies for responding to and mitigating the consequences during a state of emergency;
b) Based on local conditions, decide to apply measures provided for in a state of emergency; urgent measures as stipulated by law or exceeding his authority when absolutely necessary for national interests, ethnic welfare, disaster prevention and control, disease prevention and control, ensuring the lives and property of the people; promptly report to the Party's competent authorities and the Prime Minister within the shortest possible time;
c) Organize emergency response forces; develop plans for responding to disasters, complex security and order issues in areas placed under a state of emergency;
d) Implement procurement of materials and equipment needed for emergency response and mitigation efforts, ensuring transparency, accountability, and strictness to prevent corruption, waste, and malpractice;
e) Direct the organization of communication and publicity campaigns to ensure that agencies, organizations, and individuals strictly comply with regulations during a state of emergency; severely handle any violations of law;
f) Promptly encourage and reward groups and individuals who have made significant contributions during a state of emergency;
h) Based on the situation of damage and rescue needs, propose policies to support localities in stabilizing people's lives in areas placed under a state of emergency for approval by competent authorities.
2. The Chairman of the People's Committee of a Commune
a) Within his scope of duties and authority, decide on the application of civil defense measures provided for in Article 25, Paragraph 1 of the Civil Defense Law;
b) Command local forces to respond to emergencies related to disasters.
Chapter V
CONDITIONS FOR IMPLEMENTATION
Article 29. Effective Date
This Decree takes effect from July 13, 2026.
Article 30. Implementation Responsibility
The Minister, Heads of agencies at the same level, heads of relevant agencies, chairmen of people's committees at all levels, and related organizations and individuals shall be responsible for implementing this Decree./.
