Guidelines on Special Management Regime for Provincial, Municipal, District, County, and City Touring Propaganda Teams

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;

Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

The Ministry of Finance and the Ministry of Culture, Sports and Tourism jointly issue guidelines on special management regime for provincial, municipal, district, county, and city touring propaganda teams as follows:

Article 1. Scope and Applicability

1. Scope of Application: Activities of provincial, municipal, district, county, and city touring propaganda.

2. Subjects of Application: Propagandists within and outside the establishment of provincial, municipal, district, county, and city touring propaganda teams.

Article 2. Functions, Tasks, and Activity Standards of Touring Propaganda Teams

1. Functions and Tasks: Touring Propaganda Teams at the provincial and municipal levels are functional departments (Touring Propaganda Teams of provinces and centrally-administered municipalities), while those at the district, county, and city levels are specialized technical units (Touring Propaganda Teams of districts, counties, and cities) under public service institutions as prescribed in Circular No. 03/2009/TT-BVHTTDL dated August 28, 2009 of the Ministry of Culture, Sports and Tourism on the functions, tasks, powers, and organizational structure of Cultural Centers of provinces and centrally-administered municipalities; and Circular No. 01/2010/TT-BVHTTDL dated February 26, 2010 of the Ministry of Culture, Sports and Tourism promulgating regulations on organization and operation of organizations engaged in cultural, sports, and tourism activities at the district, county, and city levels.

2. Activity Standards:

The People's Committee of provinces and centrally-administered municipalities shall submit to the People's Council at the same level for decision on activity standards based on the proposal of the Director of the Department of Culture, Sports and Tourism, in accordance with actual conditions in the locality. Specific activity standards in each province may be lower or higher, but the increase or decrease shall not exceed 20% of the framework of activity standards prescribed in this Circular.

Article 3. Sources of Funding for Touring Propaganda Teams

1. State budget (cultural and information services) according to the current budget classification of the State Budget Law.

2. Legal sponsorship and aid from domestic and foreign organizations and individuals.

3. Socialized resources and other lawful revenues.

Article 4. Special Expenditure Items and Levels for Touring Propaganda Teams

The expenditure of touring propaganda teams (salary; contractual labor remuneration; allowances; social insurance, health insurance, trade union fees; professional activity expenses; travel expenses; conference and seminar costs; procurement of materials, equipment, and working tools; electricity, water, telephone, office supplies expenses; training and upgrading political and professional competence expenses; regular skill competition expenses; professional expenses, makeup, costumes, props, editing, illustration, and creation expenses serving performances; medical kit expenses when traveling for mobile work and other expenses) shall be implemented according to the current regulations applicable to public service institutions.

This Circular provides guidance on special expenditure items and levels (training and performance subsidies) for touring propaganda teams as follows:

1. Propagandists within the establishment of touring propaganda teams shall enjoy performance subsidy and training subsidy as prescribed in this Circular. The specific levels of performance subsidy and training subsidy in each province shall be decided by the Chairman of the People's Committee of provinces and centrally-administered municipalities upon submission to the People's Council at the same level based on the proposal of the Director of the Department of Culture, Sports and Tourism and the Director of the Department of Finance, in accordance with the budget capacity and actual conditions. The specific levels in each province may be lower or higher than the levels prescribed in this Circular. The higher level shall not exceed 20% more than the framework of performance subsidy and training subsidy prescribed below:

a) Training subsidy for new programs: The maximum subsidy for one session of training a new program is not more than 40,000 VND per person. The maximum number of sessions for a new program is 10 sessions.

b) Performance allowance within the mobile performance program:

- The maximum subsidy for one session of mobile performance for main roles is not more than 65,000 VND per person. The number of propagandists playing main roles in mobile performances is decided by the Director of Cultural Centers at the provincial, municipal, district, county, and city levels.

- The maximum subsidy for one session of mobile performance for other roles is not more than 50,000 VND per person.

2. Propagandists outside the establishment (those who have been recruited by the unit) participating in training new programs and mobile performances according to agreements with the Director of Cultural Centers at the provincial, municipal, district, county, and city levels shall also enjoy the training and performance subsidy as prescribed above, in addition to their contractual pay (if any).

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The preparation of budgets, allocation, management, utilization, settlement, and finalization of accounts for touring propaganda teams shall be carried out in accordance with the current provisions of the State Budget Law and guiding documents implementing the State Budget Law.

2. For members of mass art teams at the provincial, municipal, district, county, and city levels when practicing, participating in competitions, or performing political tasks according to approved plans, the People's Committees of provinces and centrally-administered municipalities shall submit to the People's Councils at the same level for consideration and decision to apply a maximum subsidy for training and performance twice the level prescribed in this Circular.

3. This Circular takes effect from February 5, 2012, and replaces Circular No. 98/2005/TTLT/BTC-BVHTT dated November 10, 2005 of the Joint Ministries of Finance and Culture, Sports, and Information on financial management regimes for provincial, municipal, district, county, and city touring information teams.

4. During the implementation process, if there are difficulties or obstacles, localities and mobile propaganda teams shall report to the relevant ministries for timely coordination and resolution./.
