RESOLUTION
On the investment policy to supplement the charter capital for the period 2024-2026 of the Parent Company - Vietnam National Highway Investment and Development Corporation; some urgent mechanisms and solutions necessary for implementing the project to renovate, repair, upgrade, and construct the Office Building of the President's Office at 2 Le Thach Street, Hoan Kiem District, Hanoi City

On the basis of The Constitution of the Socialist Republic of Vietnam;
On the basis of The State Budget Law No. 83/2015/QH13, which has been amended and supplemented by Law No. 59/2020/QH14 and Law No. 56/2024/QH15;
On the basis of Law on Management and Use of State Capital for Production and Business Investment in Enterprises No. 69/2014/QH13;
On the basis of Public Investment Law No. 58/2024/QH15;
Pursuant to Resolution No. Decision No. 63/2022/QH15 dated June 16, 2022, Third Session, Fifteenth National Assembly;
Based on the consideration of Proposal No. 50/TTr-CP dated January 24, 2025, Proposal No. 103/TTr-CP dated February 15, 2025, of the Government; Report No. 2819/BC-UBTCNS15 dated February 17, 2025, of the Committee on Finance and Budget; Proposal No. 03/TTr-CP dated February 7, 2025, of the Government; Report No. 175/BC-UBTCNS15-m dated February 15, 2025, of the Committee on Finance and Budget; Report No. 1198/BC-UBTVQH15 dated February 19, 2025, of the Standing Committee of the National Assembly, and the opinions of National Assembly deputies,
RESOLUTION:
Article 1
1. Agree to the investment policy to supplement the charter capital for the Parent Company - Vietnam National Highway Investment and Development Corporation for the period 2024-2026 with a total amount of VND 38,251 billion (Thirty-eight thousand, two hundred fifty-one billion dong) from the Enterprise Development Fund worth VND 1,562 billion (One thousand, five hundred sixty-two billion dong) and the state budget allocated to the Ministry of Transport for investment in five highway projects managed by the Vietnam National Highway Investment and Development Corporation and already disbursed, totaling VND 36,689 billion (Thirty-six thousand, six hundred eighty-nine billion dong).
2. Direct the Government to instruct relevant agencies to promptly organize the implementation and complete the procedures for supplementing the charter capital for the period 2024-2026 for the Parent Company - Vietnam National Highway Investment and Development Corporation; ensure effective management and use of capital and assets formed from the supplemented charter capital according to regulations without loss of state capital and assets; complete related legal provisions within their authority; address issues regarding management, use, accounting, and capital preservation and development when supplementing the charter capital for the Parent Company - Vietnam National Highway Investment and Development Corporation from this source.
3. The State Audit Agency shall conduct audits within its scope of duties and report to the National Assembly at the October 2027 session on the implementation of this Resolution.
Article 2
1. Permit the implementation of some urgent mechanisms and solutions necessary for the implementation of the Project to renovate, repair, upgrade, and construct the Office Building of the President's Office at 2 Le Thach Street, Hoan Kiem District, Hanoi City, as proposed by the Government in Proposal No. 03/TTr-CP dated February 7, 2025.
2. Direct the Government to organize the implementation of the Project to ensure progress, quality, economy, and effectiveness, and prevent corruption, waste, and misuse of state funds.
Article 3
1. This Resolution takes effect from the date it is adopted by the National Assembly.
2. The Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly, Delegations of National Assembly Members, National Assembly deputies, and the Vietnam Fatherland Front within their respective duties and powers, shall supervise the implementation of this Resolution.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, Fifteenth Session, Ninth Extraordinary Meeting, on February 19, 2025.
