Decision No. 193/QD-TTg on resolving issues related to the raw material area project for the Kon Tum pulp and paper factory

 DECISION OF THE PRIME MINISTER

Regarding the resolution of issues related to the raw material area project for the Kon Tum pulp and paper factory

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Tourism Law dated June 14, 2005;

Based on the Land Law dated November 26, 2003;

Pursuant to Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on Managing Investment Projects for Construction Works;

Considering the proposal of the Ministry of Agriculture and Rural Development (Letter No. 3169/CV-BNN-LN dated December 24, 2004),

DECISION:

Article 1. The Vietnam Paper Joint Stock Corporation is permitted to continue borrowing funds to invest in caring for, managing, protecting, and preventing forest fires on 17,000 hectares of planted forest areas and new planting areas up to the end of 2004 according to the plan approved by competent authorities.

The loan mechanism shall be implemented in accordance with Decision No. 1070/QĐ-TTg dated August 20, 2001 of the Prime Minister approving the feasibility study for the investment construction of the Kon Tum raw material forest area project from 2000 to 2010.

Article 2. Direct the Ministry of Industry to instruct the Vietnam Paper Joint Stock Corporation:

1. To develop an effective exploitation and utilization plan for 17,000 hectares of planted forest areas and new planting areas up to the end of 2004 according to the plan approved by competent authorities.

2. To coordinate with the People's Committee of Kon Tum Province to plan and identify a portion of the necessary land within the area already planned for the raw material project of the Kon Tum pulp and paper factory that has not yet been afforested (approximately 41,000 hectares); assign the Vietnam Paper Joint Stock Corporation to continue afforestation to implement the conversion of planted forest areas under the project in accordance with the newly approved plan.

Article 3. Assign the People's Committee of Kon Tum Province to manage the remaining land area, prioritizing the following uses:

1. Providing agricultural and residential land to poor ethnic minority groups with difficult living conditions in areas previously planned for planting raw material trees for paper production according to Decision No. 134/2004/QĐ-TTg dated July 20, 2004 of the Prime Minister.

2. Developing projects to encourage various economic sectors to participate in planting productive forests or suitable industrial crops in line with the socio-economic development planning of Kon Tum Province.

Article 4. This Decision takes effect fifteen days after the date of signature.

The Ministers of Planning and Investment, Finance, Agriculture and Rural Development, Industry, Natural Resources and Environment, Science and Technology, the Governor of the State Bank of Vietnam, the Heads of ministries equivalent to ministries, agencies directly under the Government, and the Chairman of the People's Committee of Kon Tum Province are responsible for implementing this Decision.
