to serve as accounting vouchers and payment instruments for banks and credit organizations

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Accounting and Statistics Ordinance dated May 10, 1988;
To meet the requirements of modernizing banking technology and credit organizations;
Considering the proposal of the Governor of the State Bank of Vietnam,

DECISION:

Article 1. Permit the use of information data on storage media such as magnetic tapes, disks, various types of payment cards (hereinafter referred to collectively as electronic vouchers) to serve as accounting vouchers and payment instruments for banks and credit organizations.

Article 2. Electronic vouchers must have all elements ensuring legal validity like paper accounting vouchers, with the signature and seal elements being encrypted with secret symbols, and must have security features to ensure safety during processing, transmission, and storage.

Article 3. Banks and credit organizations using electronic vouchers shall be responsible for:

Implementing the establishment, processing, and use of electronic vouchers for accounting entries and payments in accordance with the provisions of the Law.

Ensuring the confidentiality and preservation of information data on storage media regarding electronic vouchers during their use and storage.

Must equip technical means (including backup systems) to exploit, process, and use electronic vouchers; manage and strictly monitor to prevent and combat forms of exploitation: exploitation, intrusion, copying, theft, or use of electronic vouchers for actions contrary to the regulations on confidentiality, provision of banking data.

Article 4. When inspected or audited, banks and credit organizations must provide electronic vouchers and guide the use of related equipment for the inspection and audit requirements of competent authorities.

Article 5. Electronic vouchers used for accounting entries and payments must be printed out in the form of voucher lists, accounting reports for preservation and storage. Each printed voucher list, accounting report must be reviewed, confirmed, and stamped by the Chief Accountant, General Director, Director of the bank or credit organization (or authorized representative).

Electronic vouchers shall be stored according to the retention period for accounting records prescribed by the State.

Article 6. This Decision shall take effect fifteen days from the date of signature.

Article 7. The Governor of the State Bank of Vietnam shall be responsible for promulgating regulations on the establishment, processing, use, preservation, and storage of electronic vouchers and organizing the implementation of this Decision.

Article 8. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision./.
