CIRCULAR

Regulations on the implementation of national defense and military work at ministries, sectors, and localities.

Based on the National Defense Law 2005;

Pursuant to the Law on Militia and Self-Defense Forces 2009;

Pursuant to the Law on National Defense and Security Education of 2013;

Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Based on Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on national defense work at ministries, ministerial-level agencies, government agencies, and localities;

CONSIDERING the proposal of the General Staff;

The Minister of National Defense issues this Circular regulating the implementation of national defense and military work at ministries, sectors, and localities.

Article 1. Scope of Regulation

This Circular regulates the implementation of national defense and military work at ministries, sectors, and localities.

Article 2. Applicability

1. Ministries, ministerial-level agencies, government agencies, Central Party Committees, the Central Inspection Committee, the Central Office of the Communist Party of Vietnam, the Office of the President, the Office of the National Assembly, the Supreme People's Procuracy, the Supreme People's Court, the State Audit Agency, central agencies of political-social organizations, state-owned economic groups, and state-owned corporations established by the Prime Minister's decision (hereinafter referred to collectively as ministries and sectors).

2. People's Committees of provinces and centrally governed cities (hereinafter referred to collectively as provincial level); People's Committees of districts, towns, and provincial cities (hereinafter referred to collectively as district level); People's Committees of communes, wards, and towns (hereinafter referred to collectively as commune level).

3. Military regions, military corps, Border Guard Command, Coast Guard Command, arms services, military units, agencies, and units under the Ministry of National Defense (hereinafter referred to collectively as agencies and units).

4. Hanoi Capital Command, Ho Chi Minh City Command, Provincial Military Commands, District Military Headquarters (hereinafter referred to collectively as local military agencies), Provincial Border Guard Commands, Coast Guard Zone Commands, Central Military Headquarters of ministries and sectors, Military Headquarters of agencies and organizations at the grassroots level, and Commune Military Headquarters.

Article 3. Implementation of Propaganda and Deployment of Party Directives, Resolutions, State Policies, and Laws on National Defense and Military Work

1. Ministries, sectors, and localities shall be responsible for disseminating the Party's guidelines and policies, state laws, decisions of the Prime Minister, regulations and guidance from the Ministry of National Defense, local military agencies where they are stationed, related agencies and organizations, directives and resolutions of their respective party committees regarding national defense and military work; closely integrating national defense and security with economic and social development, and national defense and security with foreign relations to relevant agencies, organizations, and individuals under their jurisdiction.

2. Local military agencies, Central Military Headquarters of ministries and sectors, Commune Military Headquarters, Military Headquarters of agencies and organizations at the grassroots level, and self-defense unit commanders (where there is no Military Headquarters) shall take the lead and coordinate with related agencies and organizations to advise the party committee, administration, and heads of agencies and organizations at the same level to issue guiding and directing documents on national defense and military work within their authority.

Article 4. National Defense and Security Education

1. Central ministries, sectors, and localities shall cooperate with the Ministry of National Defense and related agencies and organizations to implement national defense and security education (NDSE) in accordance with the National Defense and Security Education Law and implementing documents.

2. People's Committees at all levels shall cooperate with the Ministry of National Defense and related agencies and organizations to direct NDSE work in their localities, regularly improve the structure of the NDSE Council at their level as prescribed, and issue operational rules and plans.

3. The Ministry of Education and Training shall take the lead and cooperate with the Ministry of National Defense and related agencies and organizations to direct NDSE work in educational institutions in accordance with the law; train and develop NDSE teachers and lecturers as prescribed by the Prime Minister's Decision.

4. The Ministry of Labor, Invalids and Social Affairs shall take the lead and cooperate with the Ministry of National Defense and related agencies and organizations to direct NDSE work in vocational secondary schools and vocational colleges in accordance with the law.

5. The Ministry of Information and Communications shall take the lead and cooperate with the Ministry of National Defense and related agencies and organizations to direct propaganda and dissemination of knowledge on national defense and security to the entire population.

Article 5. Building local armed forces and implementing conscription, recruitment, and calling up citizens for military service

Local military agencies, Military Command Boards of central ministries and sectors, Military Command Boards of communes, Military Command Boards of organizations at the grassroots level, and self-defense unit commanders (where there is no Military Command Board) shall take the lead and coordinate with relevant agencies and organizations to assist party committees, authorities, and heads of agencies and organizations at the same level in guiding and organizing the implementation of the following contents:

1. Building local military agencies and commune-level Military Command Boards strong in all aspects; improving the Military Command Boards of central ministries and sectors, Military Command Boards of organizations at the grassroots level, and the cadre team responsible for and concurrently performing national defense and military work; enhancing the quality and effectiveness of advisory services to party committees, authorities, and heads of agencies and organizations at the same level in fulfilling national defense and military tasks.

2. Improving the quality of training and instructing cadres engaged in national defense and military work at ministries and sectors, and the overall quality of civilian self-defense forces (CSDF); prioritizing the political quality of CSDF, especially in key areas concerning national defense and security, borders, seas, and islands.

3. Reforming training, exercises, and drills to enhance the combat readiness of local troops, CSDF, and reserve mobilization forces (RMF) according to prescribed content and programs.

4. Continuing to implement the "Project for Training Cadres for Commune-Level Military Command Boards at College and University Level in Basic Military Studies" as decided by Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister, ensuring quality and effectiveness.

5. Registering and managing sources for enlistment, citizens within the age range for compulsory military service; implementing annual conscription and military recruitment as stipulated by law.

6. Strengthening guidance on the implementation of laws regarding CSDF, Regulations on Combat Advisory Work for CSDF; promoting models of organization, training, and activities of CSDF, Military Command Boards of central ministries and sectors, and Military Command Boards of organizations at the grassroots level; directing provinces to implement projects on organizing CSDF as prescribed by law.

7. Directing CSDF to operate in accordance with their functions, tasks, and legal regulations; closely coordinating with police, border guards, navy, coast guard, forestry protection, fishery inspection, and other forces in carrying out tasks to protect borders, seas, and islands, maintaining political security and social order and safety, and participating in civil defense; promptly addressing situations arising at the grassroots level.

8. Implementing national defense and military mobilization work as prescribed by law; directing registration, management, training, exercises, and inspections of readiness for mobilization and combat in RMF units as stipulated; implementing payment of responsibility allowances to reservists who have been assigned and appointed to command positions in RMF units in various localities.

Article 6. Closely Combining the Fulfillment of Political Tasks, Economic, Cultural, Social Development, and Foreign Relations with Strengthening National Defense and Security

1. Ministries, sectors, and localities shall combine the fulfillment of political tasks, economic development, cultural, social development, and foreign relations with the strengthening and enhancement of national defense and security, particularly in key areas concerning national defense and security, borders, seas, and islands, Northwest, Central Highlands, and Southwest regions.

2. Ministries, sectors, and localities shall strictly implement Decision No. 13/2012/QĐ-TTg dated February 23, 2012 of the Prime Minister on the Regulation on Combining Economy-Society with National Defense in the Defense Region and Decision No. 17/2012/QĐ-TTg dated March 26, 2012 of the Prime Minister on the Regulation on Activities of Forces in the Defense Region, ensuring that structural economic adjustments and planning revisions are aligned with gradually completing the military posture in the defense region of each locality.

3. Ministries and sectors shall continue to develop plans to ensure the first year's war needs (Plan B) as instructed by Directive No. 12/2008/CT-TTg dated March 26, 2008 of the Prime Minister; coordinating with provincial People's Committees to direct and guide subordinate agencies and units to effectively perform national defense and military work within their jurisdiction; participating in building, operating, and exercising regional defense areas (RDA), civil defense, and village-level combat-policing activities in localities.

4. Military Regions and localities shall organize RDA exercises and direct village-level combat-policing exercises in line with local conditions, ensuring practicality and effectiveness; directing reviews and adjustments of combat documents for RDAs, plans for constructing, mobilizing, and receiving RMF, plans for mobilizing RMF when not yet at a partial mobilization level as prescribed by Decree No. 25/1998/NĐ-CP dated May 5, 1998 of the Government, industrial mobilization plans, plans for mobilizing and receiving civilian manpower, vessels, and means to participate in protecting maritime sovereignty in line with circumstances and tasks.

5. Commanders of Military Regions and Border Guard Force shall direct and guide Military Command Boards and Border Guard Command Boards under their authority to advise party committees and authorities at the same level in synchronously conducting national defense diplomacy and people-to-people diplomacy activities.

Article 7. Implementation of state management in national defense

1. Annually, the Ministry of National Defense shall take the lead and coordinate with relevant agencies and organizations to develop plans for inspecting the work of military-civilian defense education and training (GDQPAN), combining inspections of the work of militia and self-defense forces (DQTV) and national defense and military affairs for provincial-level, military region, and central ministry and agency Military-Civilian Defense Education and Training Councils, submit them for approval by the Chairman of the Central Military-Civilian Defense Education and Training Council, and organize their implementation.

2. Annually, the General Staff shall take the lead and coordinate with relevant agencies and organizations to develop plans for inspecting national defense and military affairs at the provincial level and central ministries and agencies, submit them for approval by the Minister of National Defense, and organize their implementation. The Inspectorate of the Ministry of National Defense shall develop plans and organize inspections of national defense work for ministries, agencies, and localities.

3. Military regions, ministries, agencies, and localities shall organize inspections and checks on agencies and units under their jurisdiction regarding the implementation of national defense, military, militia and self-defense force, and Military-Civilian Defense Education and Training work, and report the results to the Ministry of National Defense (through the Militia and Self-Defense Forces Department - the permanent office for national defense work).

4. Ministries, agencies, localities, and military agencies shall implement briefing systems, reports on inspections, checks, mid-term reviews, and final summaries of national defense work, militia and self-defense force work, and Military-Civilian Defense Education and Training work as prescribed.

Article 8. Ensuring the budget for national defense and military affairs

Ministries, agencies, and localities shall prepare budgets, execute, and settle accounts for the budget ensuring national defense work, militia and self-defense force work, and Military-Civilian Defense Education and Training work in accordance with the provisions of the law.

Article 9. Effectiveness and Responsibility for Enforcement

1. This Circular takes effect from February 15, 2015, and abolishes Circular No. 223/2013/TT-BQP dated December 23, 2013, issued by the Minister of National Defense guiding the implementation of national defense work in ministries, agencies, and localities in 2014.

2. Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities, and heads of related agencies and units have the responsibility to implement this Circular./.
