OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
CHAIRMAN OF THE VIETNAMESE DEMOCRATIC REPUBLIC GOVERNMENT
Pursuant to Decree No. 63 dated November 22, 1945 on the organization of people's administration and administrative committees at all levels, and subsequent decrees amending and supplementing it;
Pursuant to Decree No. 77 dated December 21, 1945 on the organization of people's administration and administrative committees in towns and cities;
Pursuant to Decree No. 126 dated July 19, 1946 on the procedures for establishing administrative units or modifying their boundaries;
Considering the current situation;
At the request of the Minister of Home Affairs,
After consultation between the Standing Committee of the National Assembly and the Council of Ministers;
ISSUES THE DECREE:
Article 1
During the resistance period, the procedures for establishing resistance administrative units or modifying their boundaries shall be as follows:
Article 2
The establishment of counties, provinces, cities, or modification of their boundaries shall be determined by a decree based on the proposal of the Ministry of Interior, the Ministry of Defense, and the General Command of the National Army and People's Militia of Vietnam, after considering the report of the Administrative Committee of the Region and the opinions of the Administrative Committee of the Province and the Provincial People's Council.
Article 3
The establishment of communes or towns, or modification of their boundaries shall be determined by a resolution of the Regional Administrative Committee based on the proposal of the Provincial Administrative Committee and the opinions of the Provincial People's Council.
Article 4
The establishment of resistance regions or modification of their boundaries shall be determined by a decree based on the proposal of the Inter-Ministerial Council, after approval by the Council of Ministers and agreement by the Standing Committee of the National Assembly.
Article 5
Any provisions or regulations contrary to this decree shall be temporarily suspended from implementation.
Article 6
Ministers shall implement this decree accordingly.
