CIRCULAR
JOINT MINISTRY OF FISHERIES - FOOD STAPLES DECREE NO. 2-LBTT/TS/LT DATED MARCH 27, 1984 REGULATING THE SUPPLY OF FOOD STAPLES TO FISHERMEN IN ACCORDANCE WITH RESOLUTION NO. 187-HĐBT OF THE STATE COUNCIL ON ENFORCING THE TWO-WAY ECONOMIC CONTRACT SYSTEM MORE STRONGLY
In the past year, the supply of food staples to the fisheries sector of the people (collective and individual) pursuant to Joint Ministry of Fisheries - Food Staples Circular No. 1-TS-LT/TT dated June 15, 1982, has initially shown positive changes, bringing about practical economic benefits. However, in some places and at certain times, the supply of food staples was not timely and did not adequately meet the needs for fish procurement work, or there were many food staples sold but insufficient fish purchased.
To improve the management of the fisheries food staple fund according to Resolution No. 187-HĐBT dated November 22, 1982 of the State Council on enforcing the two-way economic contract system more strongly, the joint ministries stipulate the supply of food staples to fishermen as follows:
A. GENERAL PRINCIPLES
1. The State shall supply food staples to fishermen who have economic relations with the State through the implementation of two-way economic contracts and only supply to areas engaged in fishing that do not produce food staples or are short of food staples.
2. The State shall supply food staples at new directive prices based on the amount of product sold to the State (at directive prices) according to the quota of food staple supply in exchange for fish procurement set by the Ministry of Fisheries (after consultation and agreement with the Ministry of Food Staples). For products procured through other methods, the State will not use food staples for exchange but may sell food staples at commercial trade prices depending on the ability, up to a maximum not exceeding the consumption needs of the workers and their families.
3. Each year, the Ministry of Fisheries shall be responsible for preparing the plan for the fisheries food staple fund and submitting it to the Ministry of Food Staples for approval by the State Council. Based on the food staple quota index announced by the Ministry of Food Staples, the Ministry of Fisheries shall manage this plan and distribute it to the provinces. At the local level, the Fisheries Department together with the Food Staples Department shall be responsible for managing the food staple fund and issuing distribution vouchers to production units (collective and individual). The food staples sector shall be responsible for supplying production units according to the plan and distribution vouchers issued by the fisheries sector. Quarterly and annually, the provincial fisheries sectors shall settle accounts with the food staples sector regarding the quantity of products purchased (at directive prices) and the amount of food staples supplied. By the end of the year, if production units purchase more food staples than the amount of products sold to the State according to the exchange quota, they must pay the difference at commercial trade prices.
B. MANAGEMENT AND SUPPLY OF FOOD STAPLES FOR FISHERIES
I. BASIS FOR DETERMINING THE NEED FOR FOOD STAPLES
FOR PRODUCTION UNITS.
1. Direct fishing labor based on the staffing standards of the fishing vessel unit established in Circular No. 557-HS/LĐTL dated March 2, 1979 of the Ministry of Fisheries to determine the total number of necessary workers. Standard: 21 kg/month.
2. Indirect labor including managers, accountants... not exceeding 7% of the total direct fishing labor. Standard: 13 kg/month.
3. Service labor includes those repairing boats, providing materials, kindergarten teachers, babysitters... serving within the cooperative society not exceeding 10% of the total direct fishing labor. The food staple standard for these individuals applies the same as the state enterprise worker standard of the same profession.
4. Dependents of the above workers include those under working age still attending general education, elderly and weak individuals unable to work. The number of dependents is based on the actual situation of the locality but should not exceed 2 dependents per worker. Average standard: 10 kg/month.
Thus, the total food staples of the four categories above (1 + 2 + 3 + 4) constitute the overall food staple requirement for the entire production unit.
II. METHODS OF SUPPLYING FOOD STAPLES
1. Based on the procurement plan of each unit and the food staple supply quota, the local fisheries procurement agency shall enter into two-way economic contracts with each production unit. Clearly defining the quantity and type of seafood sold to the State and the amount of food staples supplied by the State. The total amount of food staples supplied shall not exceed the determined need.
2. Individual fishermen selling seafood to the State at directive prices shall also be exchanged for food staples according to the quota like cooperatives in the locality.
3. Provinces purchasing processed products must convert them to fresh seafood according to the current regulations of the Ministry of Fisheries and also be exchanged according to the quota.
4. During off-season months, upon request from the fisheries sector, the food staples sector will sell advance provisional supplies. During the fishing season, fishermen must sell seafood to the State to repay the provisional advance. At the end of the year, if production units still owe food staples, they must settle the balance with the food staples sector at commercial trade prices.
5. Units breeding or catching freshwater aquatic products, selling products to the State according to two-way economic contracts (with directive prices), shall be supplied food staples according to quotas prescribed by the Provincial People's Committee. This amount of food staples is included in the quota allocated by the Ministry of Fisheries and the Ministry of Food Staples.
6. When purchasing food staples, production units must present the food staple distribution voucher issued by the Fisheries Company (or the Fisheries Station authorized) clearly stating the quantity and type of seafood purchased expressed in value at directive prices and the amount of food staples supplied (sample attached).
7. Supplying food staples to other groups:
a) For war invalids, families of martyrs, and those who have made contributions to the revolution, cooperatives must create favorable conditions for them to find employment and receive food staple distribution. If production is difficult and cannot provide enough products to sell to the State, thus food staples cannot meet basic needs, they will be additionally supplied by the State according to the general policy.
b) Cooperatives and production teams specializing in transportation, boat repair, seafood processing, and state subcontracting... shall be supplied food staples according to the current regulations specific to their professions.
8. Production units encountering natural disasters and therefore unable to fulfill seafood sales contracts shall submit requests to the Fisheries Office or Department for resolution by the People's Committee using the local relief fund.
C. IMPLEMENTATION ORGANIZATION:
1. The People's Committees of provinces, cities, and centrally governed municipalities shall have plans to widely publicize and disseminate among fishermen, and direct relevant sectors (Planning Commission, finance, banking...) to coordinate synchronously with the Fisheries and Food Departments to effectively implement this Circular.
2. The Fisheries and Food Departments of provinces, cities, and centrally governed municipalities shall prepare sufficient food supplies and develop unified plans for implementation.
This Circular takes effect from the date of signature. All previous regulations contrary to this document are hereby abolished.
In the process of implementation, if difficulties arise, they must be reported to the two Ministries for resolution.
