GUIDANCE ON SUPPLEMENTARY RETIREMENT CONDITIONS.
On December 29, 1987, the Council of Ministers issued Decision No. 227-HĐBT on the reorganization and reduction of staff in administrative and public service agencies. Clause 5 of Decision No. 227-HĐBT stipulates: "Regarding retirement benefits, they shall be implemented according to current regulations. For cadres, workers, and civil servants who are weak in health and have limited capacity, if their age for retirement is still lacking not more than five years, they will also be considered for retirement without medical examination."
The Ministry of Labor, Invalids, and Social Affairs provides specific guidance as follows:
1. The subjects applying the provisions of Clause 5 of Decision No. 227-HĐBT are cadres, workers, and civil servants within the state's establishment in administrative and public service agencies, and those working indirectly in production units (including defense personnel and police workers) who are weak in health and have limited capacity, and who have worked the required time as stipulated in Decree No. 236-HĐBT dated September 18, 1985 of the Council of Ministers, namely men aged 55 and women aged 50, can retire and receive retirement pay without medical examination.
2. Those individuals belonging to the above category, if during their work period they have engaged in particularly arduous or particularly hazardous jobs, or in arduous or hazardous jobs, or worked in areas with many difficulties and hardships, or served in the military before transferring to another sector, will still be eligible for early retirement according to Point 1 of Circular No. 48-TBXH dated September 30, 1985 and Directive No. 9-TBXH dated September 1, 1986 of the Ministry of Invalids and Social Affairs guiding the implementation of Decree No. 236-HĐBT, and will further reduce their retirement age by five years without medical examination.
3. The file of cadres, workers, and civil servants retiring and receiving retirement pay according to this Circular must clearly state: "Based on Decision No. 227-HĐBT dated December 29, 1987 of the Council of Ministers" for easy tracking and summarizing the situation.
4. The conditions for retirement and receipt of retirement pay for state workers (those not applying the provisions of Point 5 of Decision No. 227-HĐBT) and armed forces personnel continue to be implemented according to the provisions of Decree No. 236-HĐBT dated September 18, 1985 of the Council of Ministers and current regulations.
This Circular takes effect from January 1, 1988./.
