Directive No. 2-LS/CNR on the implementation of certain new policies in forest exploitation and harvesting design for the year 1992

DIRECTIVE

OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

REGARDING THE IMPLEMENTATION OF SOME NEW POLICIES

IN FOREST HARVESTING AND DESIGN FOR 1992

In recent years, the implementation of the policy "Restoring Order in Forest Harvesting" has shown positive changes and achieved certain results. Units and localities have recognized the urgent need for management and protection during annual forest harvesting - meeting timber demands while ensuring forest capital - The implementation of harvesting policies based on approved designs has been effective in production management as well as state administration.

To continue implementing this policy, the Ministry instructs units to immediately carry out the following tasks:

I. ON POLICIES AND MEASURES

1. In 1992, the Ministry will implement the policy of operating and utilizing forests under the standing tree system. Specifically, logging enterprises will be the owners and sell standing trees according to the volume specified for each tree, accurately as per the original design plan approved for each plot and compartment.

To implement this policy, units must have a strong and qualified design team to ensure the high accuracy of the harvesting design plans according to new requirements.

Regarding specific issues such as determining the price of standing trees, marking trees, forest handover, product handover, forestry inspection stamping, handover locations... further guiding documents will be issued.

2. Implementing the harvesting policy must go hand in hand with forest regeneration starting from 1992. Units must simultaneously develop both harvesting and regeneration plans and approve them at the same time to achieve forest production targets either in the year of harvesting or the following year.

Specifically as follows;

2.1. On the harvesting plan:

The annual harvesting plan of each unit is determined based on the results of the approved annual harvesting design plan.

2.2. On the forest regeneration plan:

The content of forest regeneration is implemented basically in accordance with the temporary regulations number 02-QĐ/KT dated January 2, 1988 (Temporary Regulations on Technical Measures for Forest Production).

Specifically as follows:

Plan for pre-harvest thinning and post-harvest clearing.

Plan for forest nurturing (including natural forests and planted forests).

Plan for enriching forests (including replanting and planting along trenches).

Encirclement and protection of forests.

Reforestation in areas cleared by harvesting (including seedling regeneration and coppice regeneration).

Thinning of sparse forests at maturity.

3. On related plans:

To implement the reform in planning work linked to the market, including linking processing and export targets with raw material sources based on allowable forest resources.

Units must base their processing and export plans on the harvesting product design table (Table 2) in accordance with the general principle of balancing domestic consumption needs, export demand, raw material sources, and processing capacity. The Ministry will review and approve exports based on data about forest resources from the approved harvesting design.

4. On Announcing Annual Harvesting Locations:

Following the Prime Minister's Directive, annual harvesting must be announced to legal authorities and public opinion regarding area, volume, and specific locations.

Units must strictly follow all design requirements as guided. If there is inaccuracy or lack of clarity regarding area and location of harvesting, the Ministry will not review and approve the harvesting design or issue an expansion permit.

II. ON THE DESIGN FOR HARVESTING IN 1992

To implement the above policies from 1992, the quality of harvesting design must be improved according to new requirements and attention must be paid to the following matters:

1. On the content of the design: Still carried out as per the guidance document for 1991 (Circular No. 579-LSCN dated April 13, 1990).

2. On harvesting locations: In addition to the summary data in the resource table (Table I) in columns 1, 2, 3, 4, detailed statistics of harvesting location names according to the prescribed code (plot name, encirclement name, sub-district name) as Appendix 1.

3. On transferring harvesting sites: To facilitate review and prevent repeated harvesting, site transfers must include the following documents:

Detailed statistical table of area, volume, location of harvesting... accurately and completely filled in as per Table I, accompanied by the original approved document for comparison.

For adjustments made at the end of the year, confirmation from the local forestry inspection office is required.

4. On classifying harvested volume by group and type: Previously, the Ministry only required classification up to eight wood groups. Now, to provide basis for bidding, units must, after classifying products by group, also separately identify the number of wood species and specific volumes within each group as per Appendix 2.

III. CONDITIONS REQUIRED WHEN APPROVING THE 1992 HARVESTING DESIGN
TO APPROVE THE 1992 HARVESTING DESIGN

To meet the new requirement that harvesting must be based on a design, i.e., all products from harvesting, processing, and exporting must be determined based on an approved harvesting design plan, in addition to the review contents already stipulated, when submitting to the Ministry for approval in 1992, the following documents must be provided:

1. The forest eligible for design must be a production forest.

2. There must be a subdivision plan for sub-districts according to the prescribed code.

3. There must be a simple forest adjustment plan.

4. Proof that the annual harvest volume falls within the allowable resource limit (forest capacity. Basis for determination is the 1989 resource data).

5. For planted forests, there must be a reforestation plan and a harvesting design plan for planted forests as prescribed. In cases involving village forests, the volume must be statistically recorded down to the village level with specific locations. For natural forests, there must be a plan for regeneration indicators as mentioned above.

6. Estimated orientation and quantification for processing and exporting.

Specifically:

Total wood harvested in the year (large wood, small wood, special wood, paper pulp wood... from natural forests and planted forests).

Total processed wood (including large wood, small wood, and specific products).

Total volume of wood requested for export (including total roundwood, finished timber products of various types, semi-finished wooden products, finished wood products of various types, exported flooring, veneer, strips...).

IV. ORGANIZATION OF FOREST HARVESTING FORCES

To implement standing tree harvesting, there will be changes in the organization of forest harvesting forces. The basic direction will be:

The Forest Farm is Party A, the forest harvesting force is outside the Forest Farm. The Forest Farm has the responsibility to design and sell standing trees by each "Cup" (harvesting plot, compartment).

The forest harvesting force is Party B, Party B purchases "Cups" from the Forest Farm and organizes the implementation of harvesting according to the design, following the procedures and regulations... and pays the cost of purchasing standing trees to the Forest Farm.

Upon receipt of this Directive, units are required to urgently implement to meet the schedule approved by the Ministry (see attached schedule).

If harvesting planted forests for export or large-scale harvesting, a separate table should be established and reviewed as a separate file.

Column 1: Harvesting unit: statistics from compartment units then consolidated at the Forest Farm level up to the entire Union or entire Department.

Column 3: Accurately record the compartment name/small area name. If there is no prescribed code, record the place name according to the local name corresponding to the area of the compartment and small area.

Column 4: Record the total number of plots per compartment unit then consolidate at the Forest Farm level up to the entire Union or entire Department.

Column 5: If columns 3 and 4 are fully and accurately recorded, this column can be omitted. If columns 3 and 4 do not meet the requirements, column 5 must be added.

Column 6: Note any exceptions (if any).

Horizontal column: The basic requirement is to statistically record the harvesting location down to the smallest business unit, which is the harvesting plot. However, in this comprehensive table (approved by the Ministry), only the consolidation to the compartment level at the Forest Farm, up to the entire Union or entire Department is required.

Implemented according to Regulation No. 3104/KH dated August 10, 1979 and guidance document No. 1826/CNR dated December 27, 1979. Specifically:

Common roundwood with a diameter of 25 cm or more (measured at the smaller end, excluding bark) and a length of 1 meter or more is considered large-sized wood.

Common roundwood with a diameter of 10-24 cm (measured at the smaller end, excluding bark) and a length of 1 meter or more is considered small-sized wood (including sharp branches and other small woods).
