OF THE MINISTRY OF LABOR AND SOCIAL AFFAIRS NUMBER 2/TBXH
JANUARY 22, 1983 GUIDELINES FOR IMPLEMENTING THE DECISION
NUMBER 9/HĐBT DATE JANUARY 19, 1983 OF THE STATE COUNCIL

Pursuant to Decision No. 9-HĐBT dated January 19, 1983 of the State Council on temporary allowances for state workers, officials, retired military personnel, those who have ceased work due to loss of working capacity, and severely disabled war invalids, the Ministry of Labor and Social Affairs provides guidance as follows:

1. Recipients of the allowance levels:

a) State workers, officials, and retired military personnel (including those retired under Circular No. 11-NV dated September 20, 1966 of the Ministry of Home Affairs (now the Ministry of Labor and Social Affairs) and severely disabled war invalids including grades 1, special grade against the French, and grades 6, 7, 8/8 (currently residing at stations, camps, or at home) shall be granted a temporary allowance of 30 dong/month.

b) State workers, officials, and military personnel who have ceased work due to loss of working capacity (including loss of working capacity due to illness, or from labor accidents grade 6 or higher, occupational diseases grade 5 or higher, and war invalids grade 5/8 residing at stations, camps, or at home), and state workers and officials who have ceased work due to old age and are receiving benefits according to Decisions No. 206-CP dated May 30, 1978 and No. 174-CP dated June 4, 1980 of the Council of Ministers shall be granted a temporary allowance of 20 dong/month.

c) The aforementioned temporary allowances shall be implemented from January 1, 1983. Those individuals who were employed and received a temporary allowance (50 dong/month) according to Decision No. 8-HĐBT dated January 19, 1983 of the State Council, their one-time benefit or initial benefit upon retirement, cessation of work due to loss of working capacity, or death shall also include this temporary allowance.

2. Procedures for payment of benefits:

a) Regarding the initial benefit:

For those who ceased work from February 1, 1983 and have been issued a benefit book but whose initial benefit did not include the temporary allowance of 50 dong/month according to Decision No. 8-HĐBT, the social affairs office where they reside shall pay out.

b) Regarding monthly benefits:

The Department of Labor and Social Affairs shall guide the district, county, and city social affairs offices to prepare three copies of lists of individuals entitled to this temporary allowance for the Department to review and sign as the basis for issuing payment orders for the savings fund to pay out in the first and second quarters of 1983 (paid quarterly in full) according to the format of payment order 2-TRC, 3-TRC; simultaneously, the Department shall adjust the increase on form 10-TRC so that starting from the third quarter of 1983, recipients of this benefit will be paid monthly.

After the Department has completed its review and signature, these lists shall be handed over to the policy department, accounting finance department of the Department, and the district, county, and city social affairs offices each holding one copy as the basis to ensure full payment of this benefit to the recipients.
