46/2002/QĐ-BGD&ĐT dated November 12, 2002, and No.

12/2004/QĐ-BGD&ĐT dated April 28, 2004

Pursuant to Government Decree No. 86/2002/NĐ-CP dated November 5, 2002, providing the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to the Education Law dated June 14, 2005;

Pursuant to Government Decree No. 85/2003/NĐ-CP dated July 18, 2003, providing the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Amending and supplementing certain provisions of the Examination Regulations for Graduation of Secondary Education Completion and High School Completion Supplementary Courses issued pursuant to Decision No. 18/2002/QĐ-BGD&ĐT dated April 8, 2002, and amended and supplemented by Decisions No. 46/2002/QĐ-BGD&ĐT dated November 12, 2002, and No. 12/2004/QĐ-BGD&ĐT dated April 28, 2004, of the Minister of Education and Training, as follows:

At the proposal of the Director of the Department of Testing and Quality Assurance,

DECISION:

Article 1. 1. Supplement Point c to Clause 1 of Article 6 as follows:

"c) Students who complete Grade 12 of high school in the same year as the supplementary high school graduation examination shall not be allowed to participate in that year's supplementary high school graduation examination."

2. Supplement the end of Article 9 with the following preferential treatment:

"Blind students are exempt from the graduation examination and their graduation classification will be based on the following criteria:

- Excellent grade:

+ In Grade 12, they must have been classified as having excellent academic performance and good conduct;

+ They are considered equivalent to graduating with an excellent grade, with an average score (AS) of 9.0 points across all subjects.

- Good grade:

+ In Grade 12, they must have been classified as having good or better academic performance and conduct;

+ They are considered equivalent to graduating with a good grade, with an AS of 7.0 points across all subjects.

- Average grade: all other cases.

Blind students who are exempt from the graduation examination may take the examination if they wish to achieve a higher AS."

"Article 14. Requirements for examination questions

3. Article 14 shall be amended and supplemented as follows:

1. The graduation examination questions must meet the following requirements:

a) The content of the questions must be within the current Grade 12 curriculum;

b) Assess basic knowledge, ability to apply knowledge, and understanding of practical skills of students;

c) Ensure scientific accuracy and pedagogical appropriateness;

d) Distinguish student proficiency levels;

đ) Be suitable for the time allocated for each subject;

e) The examination paper must clearly state the number of pages and include the word "END" at the conclusion of the paper;

g) Each examination paper is scored out of ten points. If the examination includes multiple questions, the points for each question must be clearly stated on the examination paper.

2. During each examination period, each subject has an official examination paper and a backup examination paper with equivalent requirements and content. Each examination paper comes with marking guidelines.

3. Examination papers and marking guidelines provided by the Ministry of Education and Training that have not yet been published are classified as top-secret documents according to the current regulations of the Prime Minister."

4. Supplement Clause 3 to Article 15 as follows:

"3) The duty of the examination question reviewer is to solve and evaluate the examination questions according to the requirements set forth in Article 14 and to bear personal responsibility for those evaluations."

5. Clause 5 of Article 34 is amended and supplemented as follows:

"5. Each examination paper, except those marked jointly, must be independently marked by two examiners, who record individual scores according to the code on the marking sheet. The first examiner, apart from drawing diagonal lines on blank sections, should not write anything on the examinee's answer sheet. Component scores, total score, and comments are recorded on the marking sheet. The second examiner must write his/her name in the designated box, mark component scores in red ink along the margin of the answer sheet next to the graded section. After both examiners have completed marking each paper, the team leader hands it back to them to reach consensus, then records the total score in both numerical and written form on the agreement record and on the answer sheet; fills in the required boxes with full names and signs together. The score of the examination paper is recorded in red ink. If there is a change in the score, the original score is crossed out, the new score is written in both numerical and written form, and both examiners sign to confirm the score change."

Remove the phrase "graduation supplementary secondary education examination" and abolish all contents related to the graduation supplementary secondary education examination stipulated in the Examination Regulations for Graduation of Secondary Education Completion and High School Completion Supplementary Courses issued pursuant to Decision No. 18/2002/QĐ-BGD&ĐT dated April 8, 2002, and amended and supplemented by Decisions No. 46/2002/QĐ-BGD&ĐT dated November 12, 2002, and No. 12/2004/QĐ-BGD&ĐT dated April 28, 2004, of the Minister of Education and Training.

Article 2. This Decision takes effect 15 days after its publication in the Official Gazette. All previous regulations contrary to this Decision are abolished.

Article 3. The Director of the Office, Heads of the Department of Organization and Cadres, the Department of Planning and Finance, the Inspectorate General, the Department of Continuing Education, the Director of the Testing and Quality Assurance Agency, the Heads of relevant units under the Ministry of Education and Training, Chairpersons of Provincial People's Committees, Directors of Departments of Education and Training, and the Director of the School Affairs Bureau - General Staff Department of the Ministry of National Defense are responsible for implementing this Decision./.
