THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS
Pursuant to the Law on Vietnamese Workers Going to Work Abroad Under Contracts dated November 29, 2006;
Pursuant to Decree No. 126/2007/ND-CP dated August 1, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Vietnamese Workers Going to Work Abroad under Contract dated November 29, 2006;
Pursuant to Decree No. 29/2003/ND-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
On the proposal of the Director of the Overseas Labor Management Department,
DECISION:
Article 1. Attached hereto is the model certificate for necessary knowledge training to be issued to workers who have completed the necessary knowledge training course, hereinafter referred to as the model certificate.
1. The model certificate shall be uniformly applied throughout the country.
2. The model certificate is specified as follows:
a) Size: 10.5 cm x 15 cm;
b) The back of the certificate is white. The front of the certificate contains uniform content according to the Model Certificate issued together with this Decision, the phrase "CERTIFICATE OF NECESSARY KNOWLEDGE TRAINING" in blue, and other contents in black;
c) The logo of the enterprise or organization (if any) may be printed in the upper left corner of the certificate, above the name of the enterprise or organization;
d) The certificate of necessary knowledge training, hereinafter referred to as the certificate, shall be printed on certificate paper.
3. Enterprises, public institutions, organizations, and individuals investing abroad that send Vietnamese workers to work abroad shall register the Model Certificate with the Overseas Labor Management Department.
Article 2. The heads of enterprises, public institutions, organizations, and individuals investing abroad that send Vietnamese workers to work abroad shall be responsible for organizing the printing and managing the certificate blanks.
Article 3. The head of the necessary knowledge training program for workers before going to work abroad shall be responsible for:
1. Issuing certificates to workers meeting the following conditions:
a) Having participated in at least 80% of the training course time as prescribed;
b) Passing the final examination with satisfactory results.
2. Recording all information accurately in the certificate.
3. Maintaining a record of certificate management and issuance.
4. Implementing the recovery of certificates in the following cases:
a) Certificates issued to persons not meeting the conditions set out in point 1 of this Article;
b) Certificates issued by persons without authority;
c) Certificates that have been erased or altered.
5. Regularly reporting to the heads of enterprises, organizations, and individuals investing abroad that send Vietnamese workers to work abroad on the results of necessary knowledge training and certificate issuance for workers before going to work abroad.
Article 4. Implementation
1. The Overseas Labor Management Department shall be responsible for guiding, inspecting, and auditing the issuance of necessary knowledge training certificates nationwide.
2. Provincial Departments of Labor - Invalids and Social Affairs shall be responsible for inspecting and auditing the issuance of necessary knowledge training certificates by units engaged in sending workers to work abroad registered in their respective areas.
Article 5. This Decision shall take effect fifteen (15) days from the date of publication in the Official Gazette.
Article 6. The Heads of the Office of the Ministry, the Director of the Overseas Labor Management Department, the Directors of Provincial Departments of Labor - Invalids and Social Affairs, the Directors of State-owned enterprises and public institutions, organizations, and individuals investing abroad that send Vietnamese workers to work abroad, and the Heads of related units shall be responsible for implementing this Decision./.
