CIRCULAR
Amending certain Articles of Circular No. 25/2011/TT-BLDTBXH dated September 26, 2011 of the Ministry of Labor, Invalids and Social Affairs guiding salary classification for college vocational graduates, intermediate vocational graduates, and primary vocational graduates working in enterprisesPursuant to Decree No. 114/2002/NĐ-CP dated December 31, 2002 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on wages;The Minister of Labor, Invalids and Social Affairs issues this Circular amending certain Articles of Circular No. 25/2011/TT-BLDTBXH dated September 26, 2011 of the Ministry of Labor, Invalids and Social Affairs guiding salary classification for college vocational graduates, intermediate vocational graduates, and primary vocational graduates working in enterprises,

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Article 1. Amend Point a and Point b, Clause 1, Article 3 of Circular No. 25/2011/TT-BLDTBXH dated September 26, 2011 of the Ministry of Labor, Invalids and Social Affairs guiding salary classification for college vocational graduates, intermediate vocational graduates, and primary vocational graduates working in enterprises
Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and wage system and the allowance regime in state-owned enterprises;
At the proposal of the Director of the Department of Labor and Wages;
"a) For college vocational graduates:

- Performing work corresponding to the position of assistant officer or technical assistant shall be classified at Level 2 of the assistant officer or technical assistant position according to the salary scale for specialized and professional staff.

- Performing work corresponding to the position of clerical staff shall be classified at Level 3 of the clerical staff position; performing work corresponding to the position of service staff shall be classified at Level 4 of the service staff position according to the salary scale for administrative and service staff.

- Performing work corresponding to the positions of workers and direct production and business personnel in mechanical engineering, electrical, electronics-computer science; basic construction; metallurgy, chemical, geology, basic surveying; open-pit mining; underground mining and oil and gas industries shall be classified at Level 4 in the seven-level or six-level salary scale of the relevant industry or group of industries. Performing work corresponding to the positions of workers and direct production and business personnel in other industries or groups of industries shall be classified at Level 3 in the seven-level or six-level salary scale of the relevant industry or group of industries.

- Performing work corresponding to the positions of workers and direct production and business personnel with three levels or more in the salary scale for workers and direct production and business personnel shall be classified at Level 2 of the relevant position according to the corresponding salary scale.

- Performing work corresponding to the positions of workers and direct production and business personnel with two levels in the salary scale for workers and direct production and business personnel shall be classified at Level 1 of the relevant position according to the corresponding salary scale.

b) For intermediate vocational graduates:

- Performing work corresponding to the position of assistant officer or technical assistant shall be classified at Level 1 of the assistant officer or technical assistant position according to the salary scale for specialized and professional staff.

- Performing work corresponding to the position of clerical staff shall be classified at Level 2 of the clerical staff position; performing work corresponding to the position of service staff shall be classified at Level 3 of the service staff position according to the salary scale for administrative and service staff.

- Performing work corresponding to the positions of workers and direct production and business personnel in mechanical engineering, electrical, electronics-computer science; basic construction; metallurgy, chemical, geology, basic surveying; open-pit mining; underground mining and oil and gas industries shall be classified at Level 3 in the seven-level or six-level salary scale of the relevant industry or group of industries. Performing work corresponding to the positions of workers and direct production and business personnel in other industries or groups of industries shall be classified at Level 2 in the seven-level or six-level salary scale of the relevant industry or group of industries.

- Performing work corresponding to the positions of workers and direct production and business personnel in the salary scale for workers and direct production and business personnel shall be classified at Level 1 of the relevant position according to the corresponding salary scale."

1. This Circular takes effect from October 15, 2012.

2. College vocational graduates and intermediate vocational graduates performing work corresponding to the positions of clerical staff, service staff, and workers and direct production and business personnel in mechanical engineering, electrical, electronics-computer science; basic construction; metallurgy, chemical, geology, basic surveying; open-pit mining; underground mining and oil and gas industries who have been classified according to the provisions of Circular No. 25/2011/TT-BLDTBXH dated September 26, 2011 of the Ministry of Labor, Invalids and Social Affairs shall implement the reclassification of salaries in accordance with the provisions of this Circular.

Article 2. Implementation clause

3. In the course of implementation, if there are difficulties, enterprises, agencies, and units are requested to report to the Ministry of Labor, Invalids and Social Affairs for timely guidance and supplementation./.

2. Persons who have graduated from vocational college or intermediate vocational school working in the positions of clerical staff, service staff, and directly producing or trading workers in the mechanical engineering, electricity, electronics-computer science; basic construction; metallurgy, chemical, geological, basic surveying; open-pit mining; underground mining and oil and gas industries, who have been classified according to the provisions of Circular No. 25/2011/TT-BLDTBXH dated September 26, 2011 of the Ministry of Labor - War Invalids and Social Affairs, shall be reclassified according to the provisions of this Circular.

3. In the course of implementation, if there are any difficulties, enterprises, agencies, and units are requested to report to the Ministry of Labor - War Invalids and Social Affairs for timely guidance and supplementation./.
