Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Investment Law dated November 29, 2005;

Pursuant to Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones, and Decree No. 164/2013/NĐ-CP dated November 12, 2013 of the Government amending and supplementing certain articles of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones.

Pursuant to Decision No. 1531/QĐ-TTg dated August 30, 2013 of the Prime Minister approving the Scheme for "Review and Adjust the Planning for Development of Border Economic Zones in Vietnam until 2020 with Vision until 2030";

At the proposal of the Minister of Planning and Investment and the Chairman of the People's Committee of Cao Bang Province,

The Prime Minister promulgates this Decision on the establishment of the Border Economic Zone of Cao Bang Province.

Clause 4 of Article 6Establish the Border Economic Zone of Cao Bang Province.

Article 1. The Border Economic Zone of Cao Bang Province is a geographical area with defined boundaries within the national territory and sovereignty, having a separate economic space.

The Border Economic Zone of Cao Bang Province includes the areas (partially or entirely) of border communes from Duc Long commune of Thach An district to Can Nong commune of Thong Nong district, specifically as follows:

- Thach An district: Includes the entire area of Duc Long commune.

- Phuc Hoa district: Includes Ta Lung town, Hoa Thuan town, My Hung commune, Dai Son commune, Cach Linh commune, and the hamlets Tha Miang – Khuoi Rung, Khuoi Khuong, Khun Thua, Khun Ha of Trieu Au commune.

- Ha Lang district: Includes the communes Thi Hoa, Ly Quoc, Minh Long, the hamlets Ban Kua, Ban Thu, Na Thuong of Co Ngan commune; the hamlets Pac Lung, Coc Khot, Na Hoach, Ban Dou, Pac Kha of Thai Duc commune; the hamlets Ban Ca, Vac Nhang, Ban Khoong, Pac Ty, Thom Thay of Viet Chu commune; the hamlets Khi Rot, Lung Lac, Kien Phac of Quang Long commune; the hamlets Cuong – Bu – Man, Lung Nam of Dong Loan commune.

- Trung Khanh district: Includes the communes Ding Phong, Ngoc Khe, Ngoc Cong; the hamlets Lung Niep, Ban Gioc, Co Muong, Ban Mom, Hang Thoang – Doc Ma, Lung Phac, Na Deng – Lung Noi of Dam Thuy commune; the hamlets Lung Hoat, Dong Den of Chi Vien commune; the hamlets Lung Ri, Da Be of Phong Nam commune; the hamlets Lung Chuong, Lung Bang of Ngoc Chung commune; the hamlets Ranh Ran, Dong Nying, Lung Ran of Lang Yen commune.

- Tra Linh district: Includes Hung Quoc town; the hamlets Lung Lau, Binh Chinh On, Lung Nam, Cung Keo, Dong Cam, Lung Pau – Lung Thien of Tri Phuong commune; the hamlet Lung Muoi of Xuan Noi commune; the hamlets Thi Phong, Na Po of Quang Han commune; the hamlets Co To A – Co To B, Lung Tao of Co Muoi commune.

- Ha Quang district: Includes the communes Cai Vien, Truong Ha, Soc Ha; the hamlets Keo Sy, Lung Giong, Rang Dan of Tong Cot commune; the hamlets Nuom Va – Pac Tac of Noi Thon commune; the hamlet Nam Niep of Cai Vien commune; the hamlets Nhi Du, Pac Co, Pac Tem – Lung Rou of Van An commune; the hamlets Keo Que – Ang Bo, Nam San, Thieng Va, Lung Co of Lung Nam commune; the hamlets Cay Tac, Nam Rang of Keo Yen commune; the hamlet Ma Lip of Na Sac commune.

- Thong Nong district: Includes Vien Quang commune; the hamlets Na Thin, Na Ve, Na Lung of Can Yen commune; the hamlets Phia Rak, Lung Ri, Nam Dong, Na Teng of Can Nong commune.

The total natural area is 30,130.34 hectares, including 37 communes and 03 towns. The geographical boundary of the Border Economic Zone is determined as follows:

- North bordering Na Po, Ting Xi (Guangxi, China);

- East bordering Long Zhou, Daiding (Guangxi – China)

- South bordering Thach An district of Cao Bang;

- West bordering Bao Lac district of Cao Bang.

Article 2. The Border Economic Zone of Cao Bang shall be organized into a duty-free zone and functional zones such as: international border gate zone, industrial zones, financial center, urban area, administrative center, residential area, and other functional zones. The scale and location of each functional zone shall be determined in the general planning for construction and detailed planning of the Border Economic Zone of Cao Bang Province.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentActivities and mechanisms, policies for the Border Economic Zone of Cao Bang Province shall be implemented in accordance with the Investment Law and guiding documents for the implementation of the Investment Law, Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones, Decree No. 164/2013/NĐ-CP dated November 12, 2013 of the Government amending and supplementing certain articles of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones, Decision No. 72/2013/QĐ-TTg dated November 26, 2013 of the Prime Minister on financial mechanisms and policies for border economic zones, and other related documents.

Article 3. Implementation Provisions

Article 1. This Decision takes effect from May 1, 2014.

Abolish Decision No. 83/2002/QĐ-TTg dated June 26, 2002 of the Prime Minister on the scope of application of policies for border economic zones of Cao Bang Province.

Article 2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and the Chairman of the People's Committee of Cao Bang Province are responsible for implementing this Decision./.
