Announcing the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in Phan Rang Bay and under the management of the Nha Trang Maritime Port Office

Based on the Vietnam Maritime Code dated 25 the 11 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;15;

Based on Decree No. 12/2017/NĐ-CP dated 1October 0February 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Decree No. 58/2017/NĐ-CP dated 10 the 5 Article 2. The receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations shall be carried out in accordance with Decree No. 20/2008/NĐ-CP dated February 14, 2008 of the Government on the receipt, handling of reflections and petitions from individuals and organizations concerning administrative regulations (amended and supplemented by Decree No. 48/2013/NĐ-CP dated May 14, 2013 on amending and supplementing certain articles of decrees related to administrative procedure control and Decree No. 92/2017/NĐ-CP dated August 7, 2017 on amending and supplementing certain articles of decrees related to administrative procedure control).7 of the Government detailing certain provisions of the Vietnam Maritime Code regarding maritime activity management;

At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;

These regulations apply to organizations and individuals involved in the inspection, supervision, evaluation, and acceptance of quality of public services ensuring maritime safety. vtransport issues promulgates this Circular announcing the port waters within the jurisdiction of Khanh Hoa Province, port waters Ninh Thuan in the Phan Rang Bay area and under the management of the Nha Trang Maritime Port Office.

Article 1. Announcing the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area

1. The port waters of Khanh Hoa Province within the jurisdiction of Khanh Hoa Province include the following areas:

a) The port waters of Khanh Hoa Province in the Van Phong Bay area;

b) The port waters of Khanh Hoa Province in the Nha Trang Bay area;

c) The port waters of Khanh Hoa Province in the Cam Ranh Bay area;

d) The port waters of Khanh Hoa Province in the Truong Sa area.

2. The port waters of Ninh Thuan Province in the Phan Rang Bay area.

Article 2. Scope of the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area

The scope of the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area, measured according to the highest tidal level, is specified as follows:

1. Scope of the port waters of Khanh Hoa Province:

a) Scope of the port waters of Khanh Hoa Province in the Van Phong Bay area:

Seaward boundary: Limited by straight lines connecting the points in the following order: VP1, VP2, and VP3 with the following coordinates:

VP1: 12o33’36,0”N, 109o26’00,0”E (Ganh Cape - Southern tip of Hon Gom Peninsula);

VP2: 12o28’00,0”N, 109o26’00,0”E;

VP3: 12o24’00,0”N, 109o20’30,0”E (Bàn Thang Cape).

Landward boundary: From point VP1 (Ganh Cape) running along the western coast of the Hon Gom Peninsula northwards through Co Go Cape, Da Son Cape, and along the coastline to the northernmost point of Ben Goi Cove, then along the coastline of communes in Van Ninh District through Hon Giang Cape, Hon Khoi Cape to point VP3 (Bàn Thang Cape).

b) Scope of the port waters of Khanh Hoa Province in the Nha Trang Bay area:

Seaward boundary:

Limited by straight lines connecting the points in the following order: NT1, NT2, NT3, and NT4 with the following coordinates:

NT1: 12°14'11.3"N, 109°15'39.0"E (Ba Co Cape - Northern tip of Hon Tre Island);^°NT1: 12o08’14,0”N, 109o16’00,0”E (Ba Co Cape - Northern tip of Hon Tre Island);^°NT2: 12o08’14,0”N, 109o16’00,0”E;

NT2: 12^°NT3: 12o08’14,0”N, 109o13’42,0”E;^°NT4: 12o08’14,0”N, 109o13’04,0”E (Cut Chim Islet);

NT3: 12^°NT3: 12o08’14,0”N, 109o13’42,0”E;^°NT5: 12o08’14,0”N, 109o12’58,0”E (Truong Tay, Vinh Nguyen Ward).

NT4: 12^°Limited by straight lines connecting the points in the following order: NT5, NT6, and NT7 with the following coordinates:^°NT5: 12o09’17,0”N, 109o13’21,0”E;

Landward boundary: From point NT4 running along the coastline southwards to the Tac River area, then along the left bank of the Tac River to the safety zone downstream of the Binh Tan Bridge to point BT1 with the following coordinates: 12o12’27,9”N, 109o11’18,8”E (as per current regulations on road safety zones), then along the safety zone downstream of the Binh Tan Bridge to the right bank of the Tac River to point BT2 with the following coordinates: 12o12’18,4”N, 109o11’18,4”E, then along the riverbank towards the Tac River mouth, continuing along the coastline southwards to point NT5.

From point NT7, running along the western side of Hon Tre Island northwards, passing through Nam Cape, Lang Cape, and connecting with point NT1.

C12: 11o46’54,0”N, 109o12’00,0”E.^°Landward boundary: From point C12 running along the coastline northwards through Bai Tien Cape and Sup Cape, then along the coastline of Cam Ranh Bay southwards through Ong Ding Cape to the north of the bay, then along the safety zone of Long Ho Bridge to the midpoint of the safety zone of Long Ho Bridge and connecting with point C1.^°d) Scope of the port waters of Khanh Hoa Province in the Truong Sa area: Limited by straight lines connecting the points in the following order: TS1, TS2, TS3, TS4, and TS5 with the following coordinates:

TS1: 11o40’58,6”N, 112o11’01,5”E (Da Tay Island);^°TS2: 11o56’04,6”N, 112o20’55,5”E (Truong Sa Dong Island);^°TS3: 11o49’40,6”N, 112o35’49,5”E (Da Dong Island);

TS4: 11o44’58,6”N, 113o00’01,5”E (An Bang Island);^°TS5: 11o40’40,6”N, 111o40’13,5”E (Da Lat Island).^°2. Scope of the port waters of Ninh Thuan Province in the Phan Rang Bay area:

a) Seaward boundary: Limited by straight lines connecting the points in the following order: PR1, PR2, and PR3 with the following coordinates:^°PR1: 11o33’45,0”N, 109o07’42,0”E (Hòn Đỏ Cape);^°PR2: 11o29’09,0”N, 109o05’54,0”E;

PR3: 11o00’48,0”E.^°From point PR1 running along the coastline of Phan Rang Bay southwards to the area of the channel leading into Tri Hai Channel (channel leading to Ninh Chữ Port), then along the left bank of Tri Hai Channel to the safety zone downstream of the Ninh Chữ Road Bridge at point NC1 with the following coordinates: 11o35’33,40”N, 109o02’52,20”E (as per current regulations on road safety zones), then along the safety zone downstream of the Ninh Chữ Bridge to the right bank of Tri Hai Channel to point NC2 with the following coordinates: 11o35’29,90”N, 109o02’48,20”E, then along the riverbank towards the entrance of Tri Hai Channel, continuing along the coastline to point SD1 with the following coordinates: 11o32’16,10”N, 109o01’44,30”E (left bank of Dinh River mouth).^°From point SD1, crossing the Dinh River mouth towards the right bank and connecting with point SD2 with the following coordinates: 11o32’05,0”N, 109o01’36,20”E (right bank of Dinh River mouth). From point SD2, continuing along the coastline of Phan Rang Bay southwards to point PR3.

C7: 11°14,3’N, 109°12’13,5"E;^°C8: 11°51’40,2"N, 109°13’37,3"E;^°C9: 11°51’06,0"N, 109°13’16,0"E (Mũi Nam);

Ranh giới về phía đất liền: từ điểm C12 chạy dọc theo đường bờ biển lên phía Bắc qua mũi Bà Tiên và mũi Sộp, chạy theo đường bờ của vịnh Cam Ranh xuống phía Nam qua mũi Ông Định lên phía Bắc của vịnh đến hành lang an toàn cầu Long Hồ, chạy dọc hành lang an toàn cầu đến điểm giữa hành lang an toàn cầu Long Hồ và nối với điểm C1.^°d) Phạm vi vùng nước cảng biển Khánh Hòa tại Trường Sa: được giới hạn bởi các đoạn thẳng khép kín nối lần lượt các điểm TS1, TS2, TS3, TS4 và TS5 có tọa độ sau đây:^°50°58,6’N, 112°11’01,5"E (Đảo Đá Tây);

56°04,6’N, 112°20’55,5"E (Đảo Trường Sa Đông);^°49°40,6’N, 112°35’49,5"E (Đảo Đá Đông);^°44°58,6’N, 113°00’01,5"E (Đảo An Bang);

40°40,6’N, 111°40’13,5"E (Đảo Đá Lát).^°2. Phạm vi vùng nước cảng biển Ninh Thuận tại khu vực vịnh Phan Rang:^°a) Ranh giới về phía biển: được giới hạn bởi các đoạn thẳng nối lần lượt các điểm theo thứ tự PR1, PR2 và PR3, có tọa độ sau đây:

33°45,0’N, 109°07’42,0"E (Mũi Hòn Đỏ);^°29°09,0’N, 109°05’54,0"E;^°00°48,0’E.

Từ điểm PR1 chạy dọc theo đường bờ biển của vịnh Phan Rang xuống phía Nam đến khu vực cửa luồng vào lạch Tri Hải (luồng vào bến cảng Ninh Chữ), chạy theo đường bờ tả ngạn lạch Tri Hải đến hành lang an toàn phía hạ lưu cầu đường bộ Ninh Chữ tại điểm NC1 có tọa độ 11°35’33,40"N, 109°02’52,20"E (theo quy định hiện hành về hành lang an toàn đường bộ), chạy dọc hành lang an toàn phía hạ lưu cầu Ninh Chữ sang đến bờ hữu ngạn của lạch Tri Hải đến điểm NC2 có tọa độ 11°35’29,90"N, 109°02’48,20"E, chạy theo đường bờ về phía cửa lạch Tri Hải, tiếp tục chạy dọc theo đường bờ biển tới điểm SD1 có tọa độ 11°32’16,10"N, 109°01’44,30"E (phía bờ tả ngạn cửa sông Dinh).

Từ điểm SD1, chạy băng ngang cửa sông Dinh về phía bờ hữu ngạn và nối với điểm SD2 có tọa độ 11°32’05,0"N, 109°01’36,20"E (phía bờ hữu ngạn cửa sông Dinh). Từ điểm SD2, tiếp tục chạy dọc theo đường bờ biển của vịnh Phan Rang về phía Nam đến điểm PR3.

TS1: 08°51'02.3"N, 112°10'55.0"E (Da Tay Island);^°50°58,6′N, 112^°11°01,5′E (Island Tây Rock);

TS2: 08^°56°04,6′N, 112^°20°55,5′E (Island Đông Trường Sa);

TS3: 08^°49°40,6′N, 112^°35°49,5′E (Island Đông Rock);

TS4: 07^°44°58,6′N, 113^°00°01,5′E (Island An Bang);

TS5: 08^°40°40,6′N, 111^°40°13,5′E (Island Lát Rock).

2. The scope of the Ninh Thuận coastal port waters in the Phan Rang Bay area:

a) The maritime boundary: is limited by straight lines connecting the following points in sequence PR1, PR2, and PR3, with the following coordinates:

PR1: 11°07'19.0"N, 108°54'47.0"E (Hòn Đỏ Cape);^°33°45,0′N, 109^°07°42,0′E (Red Cape);

PR2: 11^°29°09,0′N, 109^°05°54,0′E;

PR3: 11^°29°09,0′N, 109^°00°48,0′E.

b) The boundary towards the mainland:

From point PR1, running along the coast of Phan Rang Bay southward to the area of the channel leading into Tri Hai Creek (channel into Ninh Chữ Port), following the left bank of Tri Hai Creek to the safety zone downstream of the Ninh Chữ road bridge at point NC1 with coordinates 11^°35°33,40′N, 109^°02°52,20′E (as currently defined for the safety zone of the road bridge), running along the safety zone downstream of the Ninh Chữ bridge to the right bank of Tri Hai Creek at point NC2 with coordinates 11^°35°29,90′N, 109^°02°48,20′E, following the coastline towards the entrance of Tri Hai Creek, continuing along the coastline to point SD1 with coordinates 11^°32°16,10′N, 109^°01°44,30′E (left bank of the Dinh River mouth).

From point SD1, crossing the Dinh River mouth towards the right bank and connecting to point SD2 with coordinates 11^°32°05,0′N, 109^°01°36,20′E (right bank of the Dinh River mouth). From point SD2, continuing along the coast of Phan Rang Bay southward to point PR3.

3. The boundaries of the coastal waters of Khánh Hòa Port located within Khánh Hòa Province and the boundaries of the coastal waters of Ninh Thuận Port in Phan Rang Bay as stipulated in Clauses 1 and 2 of this Article are determined on the Hydrographic Charts number I-1000-04 republished by the Vietnam People's Navy in 2001 and the Hydrographic Charts numbers: VN300021, VN4BN001, VN4NT001, VN300020, VN3KH001 published for the first time by the Southern Maritime Safety Assurance Corporation in 2016. The coordinates of the points specified in this Circular are applied according to the WGS 84 Coordinate System and converted to the VN-2000 Coordinate System in the Appendix attached hereto.

Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones

The Director of the Vietnam Maritime Administration shall organize the announcement of pilot transfer zones, quarantine zones, anchorage areas, transshipment areas, and storm shelters for vessels entering and leaving the coastal waters of Khánh Hòa Port and the coastal waters of Ninh Thuận Port in Phan Rang Bay and other water areas and sea zones as prescribed.

Article 4. Responsibilities of the Nha Trang Maritime Port Office

1. Perform the tasks and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities at Khánh Hòa Port, the coastal waters of Khánh Hòa Port, and the coastal waters of Ninh Thuận Port in Phan Rang Bay.

2. Based on actual conditions regarding weather, waves, wind, draft, vessel capacity, and cargo characteristics, designate specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transship, and avoid storms within the prescribed waters, ensuring maritime safety, maritime security, and prevention of environmental pollution.

Article 5. State Management Responsibilities for Maritime Affairs in the Sea Areas under Khánh Hòa Province and Ninh Thuận Province

Outside the waters of the ports specified in Article 2 of this Circular, the Nha Trang Marine Branch shall be responsible for state management of maritime safety, maritime security, and prevention of environmental pollution in the sea areas under Khánh Hòa Province and the sea areas under Ninh Thuận Province from the parallel 11 degrees 25 minutes 00 seconds North upwards to the northernmost part of Ninh Thuận Province.^°25’00,0”N and beyond to the northernmost part of Ninh Thuận Province.

Article 6. Effectiveness

This Circular takes effect from August 1, 2019. The Circular No. 21/2014/TT-BGTVT dated June 4, 2014 issued by the Minister of Transport announcing the waters of ports within the jurisdiction of Khánh Hòa Province and Ninh Thuận Province and the area managed by the Nha Trang Marine Branch is hereby abolished.

Article 7. Implementation Organization

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of the Ministries' Departments, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Administration, the Directors of the Transportation Departments of Khánh Hòa Province and Ninh Thuận Province, the Directors of the Nha Trang Marine Branch and the Bình Thuận Marine Branch, the Heads of related agencies, organizations, and individuals are responsible for implementing this Circular./.
