Announcing the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in Phan Rang Bay and under the management of the Nha Trang Maritime Port Office
Based on the Vietnam Maritime Code dated 25 the 11 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;15;
Based on Decree No. 12/2017/NĐ-CP dated 1October 0February 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Decree No. 58/2017/NĐ-CP dated 10 the 5 Article 2. Article 1. Announcing the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area
1. The port waters of Khanh Hoa Province within the jurisdiction of Khanh Hoa Province include the following areas:
a) The port waters of Khanh Hoa Province in the Van Phong Bay area;
b) The port waters of Khanh Hoa Province in the Nha Trang Bay area;
c) The port waters of Khanh Hoa Province in the Cam Ranh Bay area;
d) The port waters of Khanh Hoa Province in the Truong Sa area.
2. The port waters of Ninh Thuan Province in the Phan Rang Bay area.
Article 2. Scope of the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area
The scope of the port waters within the jurisdiction of Khanh Hoa Province and the port waters of Ninh Thuan Province in the Phan Rang Bay area, measured according to the highest tidal level, is specified as follows:
1. Scope of the port waters of Khanh Hoa Province:
a) Scope of the port waters of Khanh Hoa Province in the Van Phong Bay area:
Seaward boundary: Limited by straight lines connecting the points in the following order: VP1, VP2, and VP3 with the following coordinates:
VP1: 12o33’36,0”N, 109o26’00,0”E (Ganh Cape - Southern tip of Hon Gom Peninsula);
VP2: 12o28’00,0”N, 109o26’00,0”E;
VP3: 12o24’00,0”N, 109o20’30,0”E (Bàn Thang Cape).
Landward boundary: From point VP1 (Ganh Cape) running along the western coast of the Hon Gom Peninsula northwards through Co Go Cape, Da Son Cape, and along the coastline to the northernmost point of Ben Goi Cove, then along the coastline of communes in Van Ninh District through Hon Giang Cape, Hon Khoi Cape to point VP3 (Bàn Thang Cape).

a) The maritime boundary: is limited by straight lines connecting the following points in sequence PR1, PR2, and PR3, with the following coordinates:
PR1: 11°07'19.0"N, 108°54'47.0"E (Hòn Đỏ Cape);°33°45,0′N, 109°07°42,0′E (Red Cape);
PR2: 11°29°09,0′N, 109°05°54,0′E;
PR3: 11°29°09,0′N, 109°00°48,0′E.
b) The boundary towards the mainland:
From point PR1, running along the coast of Phan Rang Bay southward to the area of the channel leading into Tri Hai Creek (channel into Ninh Chữ Port), following the left bank of Tri Hai Creek to the safety zone downstream of the Ninh Chữ road bridge at point NC1 with coordinates 11°35°33,40′N, 109°02°52,20′E (as currently defined for the safety zone of the road bridge), running along the safety zone downstream of the Ninh Chữ bridge to the right bank of Tri Hai Creek at point NC2 with coordinates 11°35°29,90′N, 109°02°48,20′E, following the coastline towards the entrance of Tri Hai Creek, continuing along the coastline to point SD1 with coordinates 11°32°16,10′N, 109°01°44,30′E (left bank of the Dinh River mouth).
From point SD1, crossing the Dinh River mouth towards the right bank and connecting to point SD2 with coordinates 11°32°05,0′N, 109°01°36,20′E (right bank of the Dinh River mouth). From point SD2, continuing along the coast of Phan Rang Bay southward to point PR3.
3. The boundaries of the coastal waters of Khánh Hòa Port located within Khánh Hòa Province and the boundaries of the coastal waters of Ninh Thuận Port in Phan Rang Bay as stipulated in Clauses 1 and 2 of this Article are determined on the Hydrographic Charts number I-1000-04 republished by the Vietnam People's Navy in 2001 and the Hydrographic Charts numbers: VN300021, VN4BN001, VN4NT001, VN300020, VN3KH001 published for the first time by the Southern Maritime Safety Assurance Corporation in 2016. The coordinates of the points specified in this Circular are applied according to the WGS 84 Coordinate System and converted to the VN-2000 Coordinate System in the Appendix attached hereto.
Article 3. Pilot reception and delivery zones, quarantine zones, anchorage areas, cargo transfer areas, storm shelters, water areas, and other related water zones
The Director of the Vietnam Maritime Administration shall organize the announcement of pilot transfer zones, quarantine zones, anchorage areas, transshipment areas, and storm shelters for vessels entering and leaving the coastal waters of Khánh Hòa Port and the coastal waters of Ninh Thuận Port in Phan Rang Bay and other water areas and sea zones as prescribed.
Article 4. Responsibilities of the Nha Trang Maritime Port Office
1. Perform the tasks and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities at Khánh Hòa Port, the coastal waters of Khánh Hòa Port, and the coastal waters of Ninh Thuận Port in Phan Rang Bay.
2. Based on actual conditions regarding weather, waves, wind, draft, vessel capacity, and cargo characteristics, designate specific positions for vessels to pick up and drop off pilots, undergo quarantine, anchor, transship, and avoid storms within the prescribed waters, ensuring maritime safety, maritime security, and prevention of environmental pollution.
Article 5. State Management Responsibilities for Maritime Affairs in the Sea Areas under Khánh Hòa Province and Ninh Thuận Province
Outside the waters of the ports specified in Article 2 of this Circular, the Nha Trang Marine Branch shall be responsible for state management of maritime safety, maritime security, and prevention of environmental pollution in the sea areas under Khánh Hòa Province and the sea areas under Ninh Thuận Province from the parallel 11 degrees 25 minutes 00 seconds North upwards to the northernmost part of Ninh Thuận Province.°25’00,0”N and beyond to the northernmost part of Ninh Thuận Province.
Article 6. Effectiveness
This Circular takes effect from August 1, 2019. The Circular No. 21/2014/TT-BGTVT dated June 4, 2014 issued by the Minister of Transport announcing the waters of ports within the jurisdiction of Khánh Hòa Province and Ninh Thuận Province and the area managed by the Nha Trang Marine Branch is hereby abolished.
Article 7. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of the Ministries' Departments, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Administration, the Directors of the Transportation Departments of Khánh Hòa Province and Ninh Thuận Province, the Directors of the Nha Trang Marine Branch and the Bình Thuận Marine Branch, the Heads of related agencies, organizations, and individuals are responsible for implementing this Circular./.
