Regulations on the application of tariff quotas for the importation of tobacco products and chicken eggs originating from member countries of the Eurasian Economic Union in 2020, 2021, and 2022
Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;

Article 1. Commodity codes and quantities of tariff quotas for 2020, 2021, and 2022 for goods subject to tariff quotas as stipulated in this Circular shall be implemented according to the Appendix attached hereto.
Article 2. Imported goods must have a Certificate of Origin issued by the competent authority of the member countries of the Eurasian Economic Union (referred to as Form EAV) in accordance with current regulations. Article 4. Object and method of allocation of tariff quotas for importation
Article 1. Scope of Regulation
Clause 1. Tariff quotas for the importation of tobacco products shall be allocated to traders holding a cigarette production license issued by the Ministry of Industry and Trade and having a need to use imported tobacco products for cigarette production.
Article 2. Applicability
Clause 3. The method of allocating tariff quotas for the importation of tobacco products and chicken eggs shall be carried out in accordance with Circular No. 12/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management.
Article 3. Goods and Quantity of Tariff Quotas for Importation
Clause 4. The quantity of imported tobacco products and chicken eggs shall be deducted from the tariff quota for importation granted by the Ministry of Industry and Trade.
Article 5. Import duty rates
Import duty rates within and outside tariff quotas for the importation of tobacco products and chicken eggs from member countries of the Eurasian Economic Union shall be implemented in accordance with the regulations of the Government.
This Circular takes effect from October 15, 2020 until December 31, 2022./.
2. QUOTA DUTY IMPORT LIMITS FOR POULTRY EGGS SHALL BE ALLOCATED TO TRADERS WITH IMPORT REQUIREMENTS.
3. The method for allocating import tariff quotas for tobacco leaves and poultry eggs shall be implemented in accordance with Circular No. 12/2018/TT-BCT dated June 15, 2018, issued by the Minister of Industry and Trade detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018, promulgated by the Government detailing certain provisions of the Law on Foreign Trade Management.
4. The quantity of imported tobacco leaves and poultry eggs shall be deducted from the import tariff quotas allocated by the Ministry of Industry and Trade.
Article 5. Import Tariff Rates
The import tariff rates within and outside the import tariff quotas for tobacco leaves and poultry eggs imported from member countries of the Eurasian Economic Union shall be implemented in accordance with the regulations of the Government.
Article 6. Effectiveness
This Circular takes effect from October 15, 2020 to December 31, 2022./.
