Regulations on the basis for implementing vocational training for vocational education teachers

for vocational education teachers

Based on the Vocational Education Law on November 27, 2014;

Based on the Education Law on June 14, 2019;

Based on Decree No. 14/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;

Based on Decree No. 15/2019/NĐ-CP dated February 1, 2019 of the Government detailing certain provisions and measures to implement the Vocational Education Law;

In accordance with the proposal of the General Department of Vocational Education;

The Minister of Labor - Invalids and Social Affairs issues this Circular stipulating the basis for implementing vocational training for vocational education teachers.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the bases that can carry out vocational training for vocational teachers at the primary, intermediate, and college levels.

2. This Circular applies to academies, research institutes, universities, colleges, and related agencies, organizations, and individuals.

Article 2. Training Program

1. The vocational training program for vocational teachers at the primary level shall be implemented in accordance with Circular No. 38/2017/TT-LDTBXH dated December 29, 2017 issued by the Minister of Labor - Invalids and Social Affairs stipulating the vocational training program for vocational teachers at the primary level; sample certificates, copies; management of blanks and vocational training certificates for primary-level vocational teachers.

2. The vocational training program for vocational teachers at the intermediate and college levels shall be implemented in accordance with Circular No. 28/2018/TT-LDTBXH dated December 25, 2018 issued by the Minister of Labor - Invalids and Social Affairs stipulating the vocational training program for vocational teachers at the intermediate and college levels; samples and regulations on management and issuance of vocational training certificates for intermediate and college-level vocational teachers.

Chapter II

REGULATIONS ON THE BASIS FOR IMPLEMENTING VOCATIONAL TRAINING FOR VOCATIONAL EDUCATION TEACHERS

PROFESSIONAL TEACHING FOR VOCATIONAL EDUCATION TEACHERS

Article 3. Provisions on the Competence and Experience of the Basis for Implementing Training

1. Having the function and task of training and retraining teachers.

2. Having a training program and materials developed, reviewed, and promulgated based on the vocational training program for vocational education teachers stipulated in Article 2 of this Circular.

3. Having sufficient material and equipment as prescribed in the training program stipulated in Article 2 of this Circular.

4. Having a teaching staff meeting the requirements stipulated in Article 4 of this Circular.

5. Having organized training and retraining for vocational education teachers for at least five years.

Article 4. Provisions on the Teaching Staff

1. Having enough teachers to teach, among which the number of permanent teachers must ensure at least 70% of the workload of the vocational training program for vocational education teachers.

2. The permanent teaching staff and invited teachers participating in teaching must have a master's degree or higher, a bachelor's degree in pedagogy or a vocational training certificate for college-level teachers or a certificate for retraining university and college teachers or equivalent, and at least five consecutive years of direct teaching at the college level or higher.

3. At least 30% of the permanent teaching staff must have a major in pedagogy, educational science, educational management, or educational psychology.

Chapter III

IMPLEMENTATION ORGANIZATION

Article 5. Responsibilities of the General Department of Vocational Education

1. Compile a list of academies, research institutes, universities, university-level institutions, and college-level institutions that have the need to organize vocational teacher training programs meeting the standards as prescribed in Chapter II of this Circular for submission to the Minister of Labor, Invalids, and Social Affairs for consideration and decision on assignment to implement vocational teacher training programs.

2. Publicly announce the list of institutions implementing vocational teacher training programs for vocational education teachers on the Ministry of Labor, Invalids, and Social Affairs' (General Department of Vocational Education) electronic information website according to regulations.

3. Annually compile the results of vocational teacher training and issuance of vocational teacher certificates by institutions assigned to implement vocational teacher training programs for vocational education teachers.

4. Organize inspections and checks on conditions meeting the standards and activities of vocational teacher training programs for vocational education teachers conducted by institutions implementing training as stipulated in this Circular.

Article 6. Responsibilities of Institutions Implementing Vocational Teacher Training Programs

1. Develop, review, and issue training programs and materials for vocational teacher training for vocational education teachers based on the vocational teacher training program prescribed in Article 2 of this Circular, ensuring suitability for each training target group; provide reference materials to support teaching and learning.

2. Develop plans and organize vocational teacher training programs for vocational education teachers for each participating group, ensuring compliance with current regulations.

3. Decide on the list of students admitted to the program; issue regulations on the management process of study, examination organization, assessment of learning outcomes, and recognition of learning achievements of students.

4. Collect, manage, and utilize training funds; issue vocational teacher certificates for vocational education teachers according to regulations.

5. Compile and submit reports on the results of vocational teacher training and issuance of vocational teacher certificates for vocational education teachers to the Ministry of Labor, Invalids, and Social Affairs (General Department of Vocational Education) before January 31 of the following year.

Article 7. Transitional Provisions

Within six months from the date this Circular takes effect, institutions already assigned by the Ministry of Labor, Invalids, and Social Affairs to pilot vocational teacher training programs for vocational education teachers may continue to carry out their training tasks.

Article 8. Effective Date

1. This Circular shall take effect from March 10, 2021.

2. During implementation, if there are any difficulties, please report them to the Ministry of Labor, Invalids, and Social Affairs for guidance.
