CIRCULAR

Issuing the Regulation on the Organization and Operation of Vocational Education and Continuing Education Centers

supporting the development of inclusive education

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Law on Persons with Disabilities dated June 17, 2010;

Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

At the proposal of the Director of the Department of Primary Education;

The Minister of Education and Training issues this Circular on the Regulation on the organization and operation of Inclusive Education Support Centers.

Article 1. This Circular annexes the Regulation on the organization and operation of Inclusive Education Support Centers.

Article 2. This Circular takes effect from February 20, 2023.

Repeals Circular No. 58/2012/TTLT-BGDĐT-BLDTBXH dated December 28, 2012, issued by the Ministers of Education and Training and Labor, Invalids and Social Affairs, concerning conditions and procedures for establishment, operation, suspension of operations, restructuring, and dissolution of Inclusive Education Support Centers.

Article 3. Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Education and Training, Directors of Inclusive Education Support Centers, and related organizations and individuals are responsible for implementing this Circular.

REGULATIONS

Organization and Operation of Inclusive Education Support Centers

(Annexed to Circular No. 20/2022/TT-BGDĐT

dated December 28, 2022, issued by the Minister of Education and Training)

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Regulation stipulates the organization and operation of Inclusive Education Support Centers, including: organizational structure; activities; teachers and staff; students and trainees; finance and assets; relationships between Inclusive Education Support Centers and other agencies and organizations.

Article 2. This Regulation applies to Inclusive Education Support Centers (hereinafter referred to as Centers) and related organizations and individuals.

Article 2. Interpretation of Terms

In this Regulation, the following terms shall be understood as follows:

Clause 1. Early detection is the activity of recognizing signs and signals of delays in developmental areas and senses of students to promptly intervene, support, and advise on appropriate educational methods.

Clause 2. Special skills are necessary skills to overcome functional impairments caused by disabilities, helping people with disabilities to be more convenient in learning, living, communicating, and integrating into society.

Clause 3. Individual education plan is a document containing information about: abilities and needs; personal characteristics; annual and semester goals; time, content, measures, and implementers; assessment results and adjustments post-assessment for learners.

Clause 4. Early educational intervention is the purposeful, planned, and methodical influence of educators to enhance the capabilities and meet the needs of children showing signs of impairment or functional decline, children with disabilities, aiming to prevent and reduce difficulties caused by disabilities, create opportunities for children to develop optimally without interrupting their development or deviating from it, and prepare children well for integration into inclusive environments.

Article 3. Legal status and types of Centers

Clause 1. Legal status of Centers

Point a. Centers are educational institutions within the national education system. Centers have legal personality, seals, and separate bank accounts;

Point b. Centers are managed by Departments of Education and Training.

Clause 2. Centers are organized into two types: public and private

Point a. Public Centers are funded by the State, ensuring operational conditions, and representing ownership;

Point b. Private Centers are funded by domestic or foreign investors, ensuring operational conditions.

Article 4. Naming Rules for the Center

1. The naming of Centers is regulated as follows:

a) The name of the Center: Support Center for Inclusive Education Development + specific name of the Center or place name;

b) The specific name of the Center must be clear, transparent, not causing misunderstanding; not leading to misinterpretation about the organization and activities of the Center; ensuring linguistic purity; not using inappropriate language or symbols that are inconsistent with historical traditions, culture, ethics, and local customs.

2. The name of the Center shall be recorded on the decision establishing the Center, the Center's seal, signboard, and transaction documents of the Center.

3. The signboard of the Center shall include the following contents:

a) Top left corner

First line: Provincial People's Committee (hereinafter referred to as the Provincial People's Committee) and the province name.

Second line: Department of Education and Training.

b) In the middle, record the name of the Center as prescribed in Clause 1 of this Article;

c) At the bottom, the address, telephone number, email, and website (if any) of the Center shall be recorded.

Article 5. Tasks of the Center

1. Assessing, determining capabilities and classifying educational needs for children showing signs of disability or functional decline, or disabled students to intervene early in education or advise on selecting appropriate educational methods for each individual.

2. Supporting inclusive education for disabled students.

3. Organizing teaching and education at preschool and general education levels for disabled students to enable them to participate in inclusive education or integrate into society.

4. Providing training and counseling for people with disabilities and organizations, units, and individuals in need regarding psychology, health, education, and vocational guidance.

5. Implementing democratic regulations within the Center.

6. Implementing information dissemination, reporting systems, and being accountable before competent authorities, students, trainees, and society.

7. Implementation of other tasks as prescribed by law.

Article 6. Authority of the Center

1. Implementing autonomy rights as prescribed by law and certain specific provisions as follows:

a) Determining the mission, vision, strategy, and development plans of the Center;

b) Deciding on the establishment of organizational structure according to the approved Center establishment project by the competent authority;

c) Planning, training, and developing the management staff, teachers, and employees of the Center;

d) Receiving and disbursing financial resources, investing in developing conditions to ensure educational quality as prescribed by law;

đ) Admitting students and managing students, trainees; developing the Center’s educational program; organizing the compilation, selection of learning materials, teaching aids, and learning resources as prescribed by law;

e) Cooperating with domestic and foreign organizations and individuals to mobilize professional or financial resources to support the implementation of the Center's tasks as prescribed by law.

2. Using and managing the management staff, teachers, and employees; organizing for teachers to update knowledge and improve professional competence.

3. Enjoying policies as prescribed by law on encouraging socialization in assistance to people with disabilities in the field of education.

4. Other authorities as prescribed by law.

 

Chapter II

ORGANIZATIONAL STRUCTURE OF THE CENTER

 

Article 7. Organizational Structure of the Center

The organizational structure of the Center includes: director, deputy director; functional/departments (or specialized teams, administrative/office teams); classrooms (if any); Party organization and mass organizations (if any); competition council, disciplinary council, advisory council (if any).

Article 8. Director of the Center

1. The Director of the Center is the person directly managing and operating the organizational structure and is responsible before superior management agencies and the law.

The Director of the Department of Education and Training appoints the Director of public centers and recognizes the Director of private centers.

2. The Director of the Center must meet the following criteria:

a) Having sufficient health, good political qualities and morals;

b) Hold a bachelor's degree or higher in the field of Educational Science and Teacher Education, in cases where they have not graduated from the Special Education major, they must also hold a certificate in integrated education management or a teaching certificate in integrated education or a special education vocational certificate as prescribed by the Ministry of Education and Training;

c) Have at least five years of work experience in the field of education and training.

3. The term of office for the Director of the Center is five years.

4. Duties and powers of the Director of the Center

a) Building and approving strategies and development plans for the Center;

b) Develop annual plans and organize their implementation: support plans for inclusive education; early detection and intervention education plans, classification of educational needs; Center education plans; report and evaluate the results of implementation to competent authorities;

 c) Draft job position proposals for approval by competent authorities; manage, utilize, and develop the cadre of managers, teachers, staff, and workers according to the provisions of the law. Organize teacher, staff, and worker evaluations according to the regulations;

d) Decide on the establishment, merger, division, dissolution of Center organizations: appoint, dismiss, and remove from office the heads of Center organizations;

e) Develop and implement the Center’s education plan. Use textbooks, implement local educational content according to the decision of the provincial People's Committee. Implement management, utilization, and selection of reference publications used in educational institutions according to the regulations of the Minister of Education and Training;

f) Organize and direct the creation of a healthy and safe teaching environment in the Center;

g) Participate in specialized activities at the unit; self-study and self-improve to enhance professional and managerial capabilities. Attend political, professional, and managerial training courses;

h) Implement democratic regulations in the Center; implement state policies and systems for managers, teachers, staff, students, and learners in the Center according to the provisions of the law;

i) Sign contracts with other educational institutions, production, business, and service establishments in educational activities according to the provisions of the law;

k) Manage and admit students to study at the Center; permit students to transfer to other educational institutions; approve student assessment results, class promotion lists, and retention; organize examinations to recognize completion and issue certificates to learners according to the regulations;

l) Decide on rewards and disciplinary actions for managers, teachers, staff, and learners within the scope of authority delegated for management;

m) Manage physical facilities, assets, finance, and organize the effective exploitation and use of mobilized resources to serve the educational and training activities of the Center according to the provisions of the law;

n) Implement information, reporting systems, and accept supervision, inspection, and auditing according to the provisions of the law;

o) Annually report on the performance of tasks and powers to the direct management agency;

p) Enjoy allowances and preferential policies according to the provisions of the law;

q) Other tasks and powers as prescribed by law.

Article 9. Deputy Director of the Center

1. The Deputy Director of the Center assists the Director in managing and operating the Center's activities. The number of Deputy Directors of the Center is specified in the Project to Establish the Center, which has been approved by the competent authority.

The Director of the Department of Education and Training appoints the Deputy Director of public centers and recognizes the Deputy Director of private centers.

2. The Deputy Director of the Center must meet the following criteria:

a) Having sufficient health, good political qualities and morals;

b) Hold a bachelor's degree or higher in the field of Educational Sciences and Teacher Training, or in cases where they have not graduated from a special education program, they must hold a certificate in inclusive education management, a teaching certificate in inclusive education, or a special education certificate as prescribed by the Ministry of Education and Training;

c) Have at least three years of work experience in the field of education and training.

3. The term of office for the Deputy Director of the Center is five years.

4. Duties and powers of the Deputy Director of the Center.

a) Assist the Director of the Center in managing and operating the Center's activities according to the assigned tasks or delegated management; directly oversee certain areas of work as assigned by the Director and handle tasks assigned by the Director;

b) Participate in professional training courses; enjoy allowances and preferential policies as stipulated by law;

c) When handling tasks assigned by the Director, the Deputy Director of the Center is responsible before the Director and the law for the results of the assigned tasks.

Article 10. Functional/Professional Units

The functional/professional units of the Center are established by the Director of the Center based on the assigned functions and tasks, ensuring compliance with current regulations and ensuring the effectiveness of the organizational structure.

Article 11. Councils within the Center

  1. Competition and Award Council

The Competition and Award Council is established at the beginning of each academic year to assist the Director in organizing competition movements and recommending award lists for staff, teachers, employees, students, and other learners in the Center. The Competition and Award Council is established and chaired by the Director. Members of the Competition and Award Council include: the Secretary (if any), a representative of a Deputy Director (if any), heads or deputies of some functional/professional units, and representatives of teachers and employees.

2. The Disciplinary Council

a) The Disciplinary Council is established to review or revoke disciplinary actions against students (from middle school level upwards) or other learners of the Center on a case-by-case basis. The Disciplinary Council is established and chaired by the Director. Members of the Disciplinary Council include: the Secretary (if any), a representative of a Deputy Director (if any), heads or deputies of some functional/professional units, teachers whose students or other learners have violated rules, experienced educators, and the head of the Parent-Teacher Association of the Center (for students studying at the Center);

b) The Disciplinary Council for Staff, Teachers, and Employees is established to review and recommend disciplinary actions against staff, teachers, and employees on a case-by-case basis. The establishment, composition, and operation of the Disciplinary Council for Staff, Teachers, and Employees are carried out in accordance with the provisions of the law.

3. Advisory Council

Advisory Councils are established by the Director of the Center. The functions, duties, powers, duration of operation, number, and composition of members of the Advisory Councils are decided by the Director of the Center.

Article 12. Political and social organizations and mass organizations within the Center

1. The Communist Party of Vietnam organization within the Center shall be established and operate according to the Party Charter of the Communist Party of Vietnam within the framework of the Constitution and laws.

2. Mass organizations within the Center shall be established and operate according to their charters and legal regulations, with the responsibility to contribute to effectively implementing the tasks of the Center.

Chapter III

ACTIVITIES OF THE CENTER

Article 13. Early detection, classification of educational needs, and early educational intervention

1. The Center organizes early detection through evaluation and classification of educational needs, thereby providing counseling or developing plans for early educational intervention for children showing signs of disability or functional decline, and students with disabilities.

2. The Center organizes early educational intervention for children showing signs of disability or functional decline, and students with disabilities according to the plan that has been developed.

3. Annually, the Center develops a plan for early detection, classification of educational needs, and early educational intervention on the assigned area, submitting it for approval by the Department of Education and Training for public centers, and reporting to the Department of Education and Training for private centers to implement.

Article 14. Support for inclusive education

1. The Center implements activities to support inclusive education at the request of the Department of Education and Training, educational institutions under the Department of Education and Training, and social assistance facilities within the assigned area:

a) Supporting the development of individual education plans for students with disabilities;

b) Supporting students with disabilities in integrated learning and developing specific skills and life skills appropriate to their abilities and needs;

c) Advising and supporting teachers in caring for and educating students with disabilities;

d) Participating in mobilizing students with disabilities to attend school;

e) Supporting and advising educational institutions, families, and communities on knowledge and skills for caring for and educating students with disabilities.

2. The Center develops a support plan for inclusive education in the assigned area, commensurate with the Center's capacity, submitting it for approval by the Department of Education and Training for public centers, and reporting to the Department of Education and Training for private centers to implement.

Article 15. Teaching and educational activities at the Center

1. Students are organized into classes. Each class shall not exceed 12 students. Class placement for students is based on determining their ability, needs, and educational outcomes from the previous academic year (if applicable).

2. The Center organizes teaching and education according to the Center’s educational plan:

a) The Center’s educational plan is an organizational plan for specialized education for students with disabilities.

b) The Center’s educational plan is developed based on implementing preschool education programs and general education programs issued by the Minister of Education and Training, and special skill education content suitable to the needs and abilities of students with disabilities; the Center Director approves it, reports to the Department of Education and Training and other relevant management agencies as prescribed to implement.

3. Special skill education content is organized for at least 5 lessons (learning activities) per week, tailored to the needs and abilities of each student. Based on the educational needs of the students, the Center may arrange additional hours for educational support/personal intervention.

4. Students studying at the Center have their individual educational plans for each academic year designed and implemented by teachers in collaboration with parents/legal guardians. Based on these individual educational plans, teachers design and carry out lesson plans and assessments in accordance with current regulations of corresponding educational levels.

Article 16. Enrolling Students with Disabilities to Study at the Center

1. Annually, the Center shall develop a plan for enrolling students with disabilities to organize teaching and education activities at the Center, submit it to the Department of Education and Training for approval. The Center shall publicly disclose the enrollment plan and organize the enrollment of students with disabilities to study at the Center in accordance with regulations.

2. The Director of the Center shall be responsible for ensuring transparency, fairness, and objectivity in the enrollment process in accordance with the provisions of the law.

3. Report to the Department of Education and Training on the results of the enrollment in accordance with regulations.

Article 17. Implementing Activities Assigned by the Department of Education and Training

1. Annually, the Center shall compile data on people with disabilities within the age range for schooling in its jurisdiction.

2. Mobilize and support people with disabilities outside schools to access education in its jurisdiction.

3. Implement other related educational activities for people with disabilities when requested by the Department of Education and Training.

Article 18. Organizing Other Activities

1. Develop and train skills for children showing signs of disability or functional decline, and children with disabilities before primary school age.

2. Rehabilitation to meet the educational needs of people with disabilities at home and in the community.

3. Train specific skills to meet the educational needs of people with disabilities.

4. Vocational guidance, introduction, and job support for people with disabilities.

5. Organize participation of people with disabilities in social activities in the community.

6. Provide necessary support services for people with disabilities and other learners related to people with disabilities.

Article 19. Documents of the Center

1. The documents of the Center's activity plans and organized activities include:

a) Plan for early detection, classification of educational needs, and early educational intervention;

b) Plan for supporting inclusive education for students with disabilities;

c) Educational plan of the Center;

d) Documents organizing activities according to the plans mentioned in points a, b, and c of this Clause and other activities (if any).

2. The documents managing teaching and educational activities of the Center shall comply with the record requirements stipulated in the School Regulations corresponding to the level of education.

3. The educational documents for students with disabilities include:

a) For students with disabilities studying at the Center: confirmation of disability level, other confirming documents (if any); individual education plan of the student and related documents;

b) For students undergoing early educational intervention: teacher's early educational intervention tracking book (if any).

4. The storage of educational management documents of the Center shall be carried out in accordance with the provisions of the law.

Article 20. Inspection and Evaluation of Educational Results

The Center shall be responsible for conducting inspections and evaluations of the learning outcomes of students studying at the Center in accordance with their individual education plans and the regulations issued by the Minister of Education and Training.

Article 21. Ensuring Educational Quality

The Center shall be responsible for maintaining conditions to ensure educational quality in accordance with regulations, including implementing the following specific activities:

1. Develop a quality assurance plan, development goals for each phase and academic year, and disclose them to Center members and relevant parties for implementation and monitoring.

2. Conduct reviews and self-evaluations of the implementation of legal regulations and the results of implementing phase plans and academic year plans. Maintain quality assurance conditions, have improvement plans to enhance educational quality.

3. Report the implementation results to the direct educational management agency for guidance, direction, inspection, and supervision.

Article 22. International Cooperation

The Center shall implement various forms and activities of international cooperation aimed at enhancing the quality of education, meeting the learning needs of students, and being consistent with the actual requirements and conditions of the Center in accordance with the provisions of the law.

Chapter IV

TEACHERS, STAFF AND STUDENTS

Article 23. Teachers

The standard training qualification for teachers: having a bachelor's degree or higher in Special Education or meeting the teacher training standards for preschool and general education, along with a certificate in special education pedagogy or a certificate in inclusive education pedagogy as prescribed by the Ministry of Education and Training.

2. Duties of teachers

a) Implement early detection, classification of educational needs, and early intervention;

b) Support inclusive education;

c) Conduct teaching and education for disabled students at the Center in accordance with objectives, content, programs, and plans;

d) Participate in professional activities;

đ) Be responsible for the quality and effectiveness of education, suitable to the specific objects and conditions of the Center;

e) Carry out decisions of the Center Director; be subject to inspection by educational management levels as prescribed; comply with the Center's internal regulations and this Charter's provisions;

g) Adhere to the Code of Ethics for Teachers as prescribed by the Ministry of Education and Training;

h) Actively and proactively enhance professional and vocational skills; conduct self-assessment according to the professional standards for teachers as prescribed.

3. Rights of teachers

a) Participate in training and upgrading courses on professional and vocational matters to improve qualifications;

b) Enjoy all material and spiritual benefits, health care, and salary and allowances as prescribed for teachers in schools and classes for people with disabilities;

c) Be provided with conditions to fulfill teaching duties and participate in other professional activities of the Center; attend meetings for commendation, rewards, disciplinary actions, and issues related to assigned tasks.

Article 24. Staff

1. Occupational Title Standards and Standard Training Qualifications

Occupational title standards and standard training qualifications for staff: library, equipment; information technology; accounting; cashier; clerical; healthcare; disability education support; administrative affairs are applied according to current regulations corresponding to those for staff in public general education institutions.

2. Catering staff for the Center's boarding students, cleaning and security staff: The Center Director may enter into contracts in accordance with the law to perform tasks upon permission from competent authorities.

3. Duties of staff

a) Fulfill assigned tasks according to plans, contracts, and the Center Director's allocation;

b) Implement professional rules and comply with the Center's internal regulations;

c) Comply with labor safety regulations;

d) Cultivate ethics, maintain personal and Center reputation and prestige; unite and assist colleagues;

đ) Study culture and upgrade to improve professional and vocational quality;

e) Fulfill civic duties, legal provisions, and Center regulations.

4. Rights of staff

a) Participate in professional and vocational upgrading according to unit, Center, and educational management level plans;

b) Enjoy all material and spiritual benefits, health care; receive salary and allowances as prescribed for school staff in schools/classes for people with disabilities;

c) Be provided with conditions to fulfill assigned tasks and participate in other appropriate Center activities; attend meetings for commendation, rewards, disciplinary actions, and issues related to assigned tasks.

Article 25. Students

1. The students of the Center are early intervention pupils according to approved plans, disabled pupils studying at the Center through specialized education methods, and trainees participating in a training program offered by the Center.

2. Responsibilities of the students

a) Fulfill all requirements for study and practice as stipulated by the Center;

b) Adhere fully to the internal regulations of the Center and this Regulation; maintain and protect the property of the Center;

c) Respect management staff, teachers, and employees of the Center; exhibit behavior and language appropriate to community morals and culture; dress neatly and appropriately for their age, conducive to learning and activities at the Center.

3. Rights of the students

a) Be respected and treated equally; be provided with full information about their studies and training;

b) Choose suitable content and forms of study that match their conditions and abilities and those of the Center; be facilitated to continue receiving support when transitioning between educational institutions;

c) Have their legitimate rights protected directly or through their lawful representatives; participate in contributing opinions on matters related to teaching and educational activities of the Center.

Chapter V

FINANCE AND ASSETS

Article 26. Finance and Sources of Finance of the Center

1. Finance

a) For public centers: implement financial income and expenditure according to the State Budget Law and other state financial management regulations;

b) For private centers: independently set tuition fees and other service charges to cover costs while publicly disclosing finances in accordance with the law.

2. Sources of finance of the Center

a) Funding from the state budget as prescribed;

b) Revenue from activities supporting inclusive education development, counseling services, career guidance related to inclusive education support, transfer services, and other tasks within the assigned functions and responsibilities of the Center as stipulated by law;

c) Assistance, sponsorship, support, and gifts from organizations and individuals both domestically and internationally as prescribed by law;

d) Other lawful sources of revenue.

Article 27. Management and Use of Assets and Finance

1. The assets of the Center are invested in, supplied, managed, and utilized in accordance with current laws.

2. All members of the Center have the responsibility to maintain and protect the Center's assets. Annually, the Center must organize an inventory and re-evaluate the value of its assets and implement reporting procedures as prescribed by law.

3. Annually, the Center has the responsibility to publicly disclose its financial income and expenditure and management in accordance with the law.

Article 28. Physical Facilities, Educational Equipment, and Library

1. Infrastructure

a) The Center has physical facilities meeting teaching and learning requirements as prescribed, suitable for disabled pupils; has special skill training rooms; has dormitory areas suitable for disabled pupils if the Center has boarding pupils.

Construction projects serving disabled pupils' learning must comply with technical standards and norms as prescribed by the Construction Law;

b) The Center is responsible for developing specific plans and timelines to submit to competent authorities for approval to enhance investment in physical facilities;

c) The Center is responsible for managing and using physical facilities efficiently, avoiding waste; regularly planning renovations and upgrades of physical facilities as prescribed; absolutely not putting into use facilities past their useful life without renovation or repair to ensure safety.

2. Educational Equipment

a) The Center is equipped with educational equipment, toys, and materials (hereinafter referred to as educational equipment) like general primary and preschool education institutions, suitable for disabled pupils; organizing effective management and use of educational equipment in teaching and education as prescribed by the Ministry of Education and Training;

b) The Center may propose and purchase special educational equipment suitable for disabled pupils, serving learning and teaching as prescribed by the state;

3. Library

a) The Center's library is organized and operated based on the preschool and general education library standards issued by the Minister of Education and Training, suitable for disabled pupils;

b) The Center's library is arranged and laid out safely, scientifically, and conveniently for disabled pupils;

c) Encourage socialization in library development.

 

Chapter VI

RELATIONSHIP BETWEEN THE CENTER AND OTHER AUTHORITIES,

ORGANIZATIONS

 

Article 29. Relations between the Center and educational facilities with integrated students, social assistance facilities

The Center cooperates with educational facilities having integrated students and social assistance facilities to organize activities supporting integrated education based on the integrated education support plan approved by the Department of Education and Training or the competent authority.

Article 30. Relations between the Center and political-social organizations, occupational associations, and social organizations at the local level

1. The Center collaborates with political-social organizations, occupational associations, and local social organizations to implement programs and activities aimed at supporting and creating favorable conditions for learners.

2. Encourage organizations and individuals to invest in material infrastructure and teaching equipment; support the educational activities of the Center.

Article 31. Relations between the Center and the families of students

Advise, support, and coordinate with the families of students in their education.

Maintain regular contact with the families of students, exchanging information about the academic performance and discipline of students.

Chapter VII

RESPONSIBILITIES OF AUTHORITIES AND ORGANIZATIONS

Article 32. Responsibilities of the Provincial People's Committee

1. Direct the Department of Education and Training to take the lead, coordinating with relevant departments and agencies to guide, inspect, and supervise the organization and operation of Centers within their jurisdiction.

2. Direct the People's Committee at the district level to cooperate with the Department of Education and Training to guide, inspect, and supervise the organization and operation of Centers within their jurisdiction.

3. Approve the staffing plan, allocate positions and budget for hiring teachers and staff; provide material infrastructure for public Centers.

Article 33. Responsibilities of the Department of Education and Training

1. Manage and direct the activities of Centers within their jurisdiction.

2. Take the lead in coordinating with relevant departments and agencies to organize inspections and supervision of the activities of Centers within their jurisdiction; promptly correct and handle violations when they occur.

3. Publicize the list of Centers within their jurisdiction, including establishment time and permitted operating locations on the Department of Education and Training’s website for learners and society to participate in oversight.

4. At the beginning of each school year, the Department of Education and Training requires the District Education and Training Departments and affiliated educational facilities, and social assistance facilities to report or compile the need for integrated education support to be sent to the Center so that the Center can base its integrated education support plan.

5. Annually approve the Center’s plan within the delegated authority; inspect and evaluate the operational situation of Centers within their jurisdiction and report to the provincial People's Committee.

Article 34. Responsibilities of District Education and Training Departments assigned to oversee Centers

1. Annually report the need for integrated education support to the Department of Education and Training so that the Center can base its integrated education support plan.

2. Implement management over the organization of teaching and education for disabled students (if applicable) at preschool, primary, and lower secondary levels of Centers located within their jurisdiction.

Article 35. Responsibilities of the Center

1. Strictly implement the provisions of this Regulation and relevant laws.

2. Annually organize an evaluation of the Center’s activities and report to the Department of Education and Training.
