CIRCULAR

Regulations on forms of certificates and logbooks for technical safety and environmental protection issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels The Law on Inland Waterway Transport dated June 15, 2004, and

On the basis of The Maritime Code of Vietnam dated November 25, 2015;

On the basis of Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport; Law amending and supplementing certain articles of the Inland Waterway Transport Law dated June 17, 2014;

Decree No. The Minister of Transport issues this Circular regulating the forms of certificates and logbooks for technical safety and environmental protection issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.

At the proposal of the Director of the Legal Department and the Director of the Vietnam Ship Survey Bureau;

Article 1. This Circular regulates the forms of certificates and logbooks for technical safety and environmental protection issued to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. This Circular does not apply to ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels that are used for national defense, security purposes, and fishing vessels.

This Circular applies to organizations and individuals involved in activities related to design, manufacture, construction, repair, conversion, import, use, and implementation of quality control regarding technical safety, environmental protection, and labor safety for ships, floating docks, floating storage units, mobile platforms, inland waterway vessels, and industrial products used for inland waterway vessels.

Article 2. Applicability

Article 3. Forms of certificates and logbooks for technical safety and environmental protection issued to ships are specified in Appendix I attached to this Circular.

Article 3. Application of Law

In case the legal regulations cited in this Circular are amended, supplemented, or replaced, the corresponding amended, supplemented, or replaced legal regulations shall be applied.

Chapter II
CERTIFICATE AND LOGBOOK FORMS FOR TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION

Article 4. Certificate and logbook forms for technical safety and environmental protection according to Vietnamese laws

Article 5. Forms of certificates for technical safety and environmental protection issued to ships, floating storage units, and mobile platforms according to international conventions of the International Maritime Organization (IMO) and the International Labor Organization (ILO)

Point 2. Certificate and logbook forms for technical safety and environmental protection issued to floating docks, floating storage units, mobile platforms are specified in Appendix II attached to this Circular.

Point 3. Certificate and logbook forms for technical safety and environmental protection issued to inland waterway vessels are specified in Appendix III attached to this Circular.

Point 4. Certificate forms for industrial products used for inland waterway vessels are specified in Appendix IV attached to this Circular.

Clause 1. Certificates for technical safety and environmental protection issued according to international conventions of IMO and ILO of which Vietnam is a member shall apply the forms prescribed by these international conventions.

Clause 2. Certificates for technical safety and environmental protection issued according to international conventions of IMO and ILO of which Vietnam is not yet a member or where the conventions do not specify the form of the certificate, upon request of the shipowner, floating storage unit owner, or mobile platform owner to provide information to relevant authorities that the ship, floating storage unit, or mobile platform is compliant, shall apply the forms of certificates as prescribed in Appendix V attached to this Circular.

Temporary certificates or conditional certificates issued to ships, floating docks, floating storage units, and mobile platforms shall apply the corresponding forms set out in this Circular and add the words "Temporary" or "Conditional" to the certificate.

Article 6. Forms of temporary certificates or conditional certificates

Article 7. Forms of certificates and logbooks for technical safety and environmental protection issued by foreign inspection organizations authorized to issue such certificates to Vietnamese ships, floating storage units, and mobile platforms

Where foreign inspection organizations authorized to issue certificates and logbooks for technical safety and environmental protection to Vietnamese ships, floating storage units, and mobile platforms, shall apply the forms compiled by the foreign inspection organization according to the provisions of international conventions of IMO and ILO of which Vietnam is a member or apply the forms prescribed in this Circular.

Article 9. Repeal Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport stipulating the forms of certificates and logbooks for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels and Circular No. 41/2019/TT-BGTVT dated October 30, 2019 of the Minister of Transport amending and supplementing certain articles of Circular No. 25/2017/TT-BGTVT dated July 28, 2017 of the Minister of Transport stipulating the forms of certificates and logbooks for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels.

Article 8. Certificates and technical safety and environmental protection logs issued electronically

Certificates and technical safety and environmental protection logs issued electronically shall be implemented in accordance with the laws on electronic transactions and guidelines of the IMO and ILO.

Chapter III
IMPLEMENTING PROVISIONS

Article 9. Effective Date

1. This Circular takes effect from January 1, 2023.

Clause 3. Forms of certificates and logbooks for technical safety and environmental protection issued to ships, inland waterway vessels, and industrial products used for inland waterway vessels that have been issued according to Circular No. 25/2017/TT-BGTVT and Circular No. 41/2019/TT-BGTVT shall continue to be valid until the expiration date of those certificates and logbooks.

Heads of the Office of the Ministry, Heads of the Inspectorate of the Ministry, Heads of Departments, Directors of the Vietnam Inspection Bureau, Directors of the Vietnam Maritime Administration, Directors of the Vietnam Inland Waterways Administration, Heads of agencies and units under the Ministry of Transport, and organizations and individuals concerned are responsible for implementing this Circular./.
