Circular No. 20/2023/TT-BYT abolishes certain legal regulatory documents issued by the Minister of Health.

CIRCULAR

ABOLISHING CERTAIN LEGAL REGULATORY DOCUMENTS ISSUED BY THE MINISTER OF HEALTH

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015 and the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Legal Regulatory Documents; and Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Enacting Legal Regulatory Documents;

Pursuant to Decree No. 95/2022/NĐ-CP dated November 15, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Department of Legal Affairs, the Director of the Department of Planning and Finance, the Director of the General Office of Infrastructure and Medical Equipment, the Director of the General Office of Science, Technology and Training, the Director of the General Office of Pharmaceutical Management, and the Director of the General Office of Traditional Medicine Management;

The Minister of Health issues this Circular to abolish certain legal regulatory documents issued by the Minister of Health.

Article 1. Abolish entirely five legal regulatory documents issued by the Minister of Health

1. Directive No. 06/2008/CT-BYT dated June 27, 2008 of the Minister of Health on enhancing the quality of health workforce training.

2. Decision No. 379/2002/QĐ-BYT dated February 8, 2002 of the Minister of Health on promulgating regulations on health statistics.

3. Circular No. 29/2014/TT-BYT dated August 14, 2014 of the Minister of Health stipulating forms and reporting systems for health statistics applicable to private healthcare facilities.

4. Circular No. 19/2015/TT-BYT dated July 15, 2015 of the Minister of Health on inspection, handling, review, and systematization of legal regulatory documents within the Ministry of Health's administrative management domain.

5. Circular No. 30/2015/TT-BYT dated October 12, 2015 of the Minister of Health on medical equipment importation.

Article 2. Abolish partially five legal regulatory documents issued by the Minister of Health

1. Articles 8, 12, 13, 14, 15, 16, and 17 of Circular No. 17/2001/TT-BYT dated August 1, 2001 of the Minister of Health guiding foreign enterprises' registration activities concerning drugs and drug raw materials in Vietnam.

2. Clause 5 Section II, Section III, Section IV, and Section V of Circular No. 10/2003/TT-BYT dated December 16, 2003 of the Minister of Health guiding foreign companies' registration activities concerning vaccines and medical products with Vietnam.

3. Content related to the importation of in vitro diagnostic reagents in Circular No. 47/2010/TT-BYT dated December 29, 2010 of the Minister of Health guiding export and import activities of medicines and direct contact medicine packaging.

4. Clause 4 Article 1 of Circular No. 47/2011/TT-BYT dated December 21, 2011 of the Minister of Health amending and supplementing certain articles of Circular No. 17/2001/TT-BYT dated August 1, 2001 of the Minister of Health guiding foreign enterprises' registration activities concerning drugs and drug raw materials in Vietnam and Circular No. 10/2003/TT-BYT dated December 16, 2003 of the Minister of Health guiding foreign companies' registration activities concerning vaccines and medical products with Vietnam.

Article 3. Effectiveness

This Circular takes effect from January 1, 2024.

Article 4. Responsibilities for Implementation

The Head of the Ministry’s Office, the Director of the Department of Legal Affairs, the Chief Inspector of the Ministry, the Directors, the Heads of Departments, General Offices, and General Bureaus under the Ministry of Health, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
