DECREE OF THE MINISTRY OF LABOR
DEFINING THE TASKS AND POWERS OF THE DEPARTMENTS AND BUREAUX OF LABOR
THE MINISTER OF LABOR
Pursuant to Decree No. 226/SL dated November 28, 1946, organizing the Ministry of Labor in the current Government;
Pursuant to Decree No. 29/SL dated March 12, 1947, regulating the worker system throughout Vietnam;
Pursuant to Decree No. 169/SL dated April 14, 1948, reorganizing labor agencies;
DECREE:
Article 1. - The Department of Labor in the Anti-French Resistance Zone has the following tasks:
Within the Anti-French Resistance Zone
- Supervising the implementation of labor laws and workers' regulations,
- Proposing reforms to labor laws,
- Resolving and mediating disputes between employers and workers,
- Directing and supervising labor agencies and dependent personnel,
- Collecting data on labor conditions (employment, living conditions of workers, struggles, demands, production, etc...),
- Organizing employment for families of soldier workers and specialized workers leaving enemy-controlled areas,
- Mobilizing manpower for production sectors,
- Collecting data, researching living costs to submit to the Minimum Wage Council and Maximum Worker Price Council,
- Assisting the Anti-French Resistance Committee in the zone with professional matters, issuing resolutions on all labor issues that do not conflict with directives from the Ministry and implementing such resolutions.
- Implementing plans and directives of the Ministry in enemy-controlled areas.
Article 2. - The Bureau of Labor has the following tasks:
Within the province
- Supervising the implementation of labor laws,
- Mediating disputes arising between employers and workers,
- Mobilizing manpower for production sectors,
- Organizing competitions, encouraging, rewarding, and motivating workers to actively produce,
- Implementing directives from superiors regarding workers in temporarily enemy-controlled areas.
Where there is no Bureau of Labor, a member of the Provincial Anti-French Resistance Administrative Committee will be responsible for labor affairs and perform the duties of a provincial Bureau of Labor.
The labor-responsible member will be appointed by the Minister of Labor's decree upon the recommendation of the Provincial Anti-French Resistance Administrative Committee.
Article 3. - The control and communication between labor departments and bureaus with equivalent administrative resistance committees, during peacetime or when war disrupts contact with superiors, shall follow the general format established for Anti-French Resistance Administrative Committees and specialized departments.
Article 4. - Before assuming their duties, directors, bureau chiefs, or administrative resistance committee members responsible for labor, who are authorized by the Ministry to supervise the implementation of labor laws, must swear not to disclose manufacturing secrets and professional organization methods they become aware of while performing their duties.
The Director of the Department of Labor will swear before the Chairman of the Anti-French Resistance Administrative Committee in the zone, while bureau chiefs and administrative resistance committee members responsible for labor will swear before the Chairman of the Provincial Anti-French Resistance Administrative Committee.
Article 5. - Expenditures of the departments, bureaus, and administrative resistance committee members responsible for labor will be included in the Ministry of Labor's budget.
Article 6. - The Chief of the Office of the Ministry of Labor, Directors, Bureau Chiefs, and administrative resistance committee members responsible for labor, are entrusted with enforcing this decree./.
