CIRCULAR

Provisions on Registration of Special-Purpose Motorcycles

Circular No. 22/2019/TT-BGTVT dated June 12, 2019, issued by the Minister of Transport regarding the registration of special-purpose motorcycles, which took effect from August 1, 2019, has been amended and supplemented by:

1. Circular No. 05/2023/TT-BGTVT dated April 27, 2023, issued by the Minister of Transport to amend and supplement certain articles of related circulars concerning road transport, road transport support services, vehicles, and drivers, which took effect from June 15, 2023.

2. Circular No. 05/2024/TT-BGTVT dated March 31, 2024, issued by the Minister of Transport to amend and supplement certain articles of related circulars concerning road transport, road transport support services, vehicles, and drivers, which will take effect from June 1, 2024.

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Science and Technology and the General Director of the Vietnam Highway Administration;

The Minister of Transport issues this Circular on the registration of special-purpose motorcycles[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the issuance, replacement, and revocation of the Certificate of Registration and license plates for special-purpose motorcycles.

Article 2. Applicability

1. This Circular applies to agencies, organizations, and individuals involved in the issuance, replacement, and revocation of the Certificate of Registration and license plates for special-purpose motorcycles according to the list at ANNEX 1 promulgated together with this Circular.

2. This Circular does not apply to the issuance, replacement, and revocation of the Certificate of Registration and license plates for special-purpose motorcycles used by the military and police for national defense and security purposes.

Article 3. Documents Determining Ownership of Special-Purpose Motorcycles

Documents determining ownership of special-purpose motorcycles include one of the following:

1. A purchase contract, gift agreement, or inheritance document as prescribed by law;

2. A sales invoice as prescribed by the Ministry of Finance;

3. An authorization document from the competent authority for vehicle liquidation as prescribed by law;

4. An agreement from the financial leasing party allowing the lessee of a special-purpose motorcycle to register ownership as prescribed by law;

5. A decision to accept aid from the competent authority as prescribed by law;

6. A decision to sell or dispose of state reserves from the competent authority as prescribed by law.

Article 4. Documents Determining the Origin of Special-Purpose Motorcycles

Documents determining the origin of special-purpose motorcycles include one of the following:

1. A quality inspection certificate upon factory release as prescribed by the Minister of Transport for domestically produced and assembled special-purpose motorcycles.

2. A certificate of technical safety and environmental protection quality for imported special-purpose motorcycles or a notification of exemption from technical safety and environmental protection quality inspection for imported special-purpose motorcycles as prescribed by the Minister of Transport for imported special-purpose motorcycles.

3. A certificate of quality for modified vehicles as prescribed by the Minister of Transport for special-purpose motorcycles that have undergone modification accompanied by the documents specified in Clause 1 or Clause 2 of this Article. In cases where the engine or frame is replaced, there must be a purchase contract for the replacement engine or frame as prescribed. If the replacement engine or frame comes from special-purpose motorcycles already registered, there must be a declaration of license plate recovery according to Form No. 1 of Appendix 2 promulgated together with this Circular.

4. For special-purpose motorcycles subject to confiscation and transfer to the state treasury:

a) A confiscation decision for transfer to the state treasury by the competent authority as prescribed by law;

b) A sales invoice for confiscated assets transferred to the state treasury issued by the Ministry of Finance (in cases of asset disposal through liquidation); a handover receipt for asset transfer (in cases of asset transfer through reallocation) as prescribed by law.

5. For special-purpose motorcycles with a decision on the handling of evidence:

a) A decision on the handling of evidence by the Investigative Agency, People's Procuratorate, or People's Court as prescribed by law;

b) A receipt for payment or a receipt for money or a handover record as prescribed by law (if the person is a victim).

Chapter II. ISSUANCE OF REGISTRATION CERTIFICATES FOR SPECIAL PURPOSE MOTORCYCLES

Article 5. Documents for registering special purpose motorcycles

1. The initial registration documents for special purpose motorcycles include:

a) A registration application form for special purpose motorcycles according to Appendix 2, Form No. 2 attached hereto;

b) The original document determining ownership of the special purpose motorcycle as prescribed in Article 3 of this Circular except in cases stipulated in Clause 3, Article 19 of this Circular;

c) The original document determining the origin of the special purpose motorcycle as prescribed in Article 4 of this Circular except in cases stipulated in Clause 3, Article 19 of this Circular.

2. Special purpose motorcycles temporarily imported and re-exported under foreign investment projects or ODA projects in Vietnam must be registered with a time-limited registration. The registration documents include:

a) A time-limited registration application form for special purpose motorcycles according to Appendix 2, Form No. 3 attached hereto;

b) Investment permit or Investment Registration Certificate (a copy and presentation of the original for verification or a certified copy);

c) The original document determining ownership of the special purpose motorcycle as prescribed in Article 3 of this Circular except in cases stipulated in Clause 3, Article 19 of this Circular;

d) The original document determining the origin of the special purpose motorcycle as prescribed in Article 4 of this Circular except in cases stipulated in Clause 3, Article 19 of this Circular.

3. Unregistered special purpose motorcycles must be temporarily registered when moving on public roads. The registration documents include:

a) A temporary registration application form for special purpose motorcycles according to Appendix 2, Form No. 4 attached hereto;

b) The document determining ownership of the special purpose motorcycle as prescribed in Article 3 of this Circular (a copy and presentation of the original for verification or a certified copy);

c) The document determining the origin of the special purpose motorcycle as prescribed in Article 4 of this Circular (a copy and presentation of the original for verification or a certified copy).

Article 6. Procedures for issuing initial registration certificates and time-limited registration certificates

1. The owner of the special purpose motorcycle prepares one set of documents as prescribed in Clause 1 and Clause 2, Article 5 of this Circular and submits it directly to the Department of Transport at the location where the owner has its main office or place of residence.

2. The Department of Transport receives and checks the contents of the documents and informs the owner within a maximum of one working day from the date of receipt of the documents.

a) In case the registration documents are incomplete as required, the Department of Transport guides the owner to supplement and complete them;

b) In case the registration documents are complete as required, the Department of Transport issues a notice for inspection according to Appendix 2, Form No. 5 issued together with this Circular. The inspection period for the special purpose motorcycle shall not exceed five days from the date of issuance of the notice.

For cases where the special purpose motorcycle is operating or parked outside the registration authority's jurisdiction, the Department of Transport accepts the documents with a letter requesting the Department of Transport where the special purpose motorcycle is located to inspect the vehicle, with the inspection period not exceeding five days from the date of receipt of the request letter.

4. The Department of Transport organizes the inspection of the special purpose motorcycle according to the time and place recorded in the notice, and the inspection of the special purpose motorcycle must be documented in an Inspection Record according to Appendix 2, Form No. 6 promulgated together with this Circular.

5. Within three working days from the end of the inspection or receipt of the inspection results for the case where the special purpose motorcycle is operating or parked outside the registration authority's jurisdiction: if the inspection results meet the requirements, the Department of Transport issues the Registration Certificate and license plate to the owner of the special purpose motorcycle and records it in the management register of special purpose motorcycles; if the inspection results do not meet the requirements, the Department of Transport notifies the owner and specifies the reasons.

6. The validity period of the time-limited registration certificate for special purpose motorcycles prescribed in Clause 2, Article 5 of this Circular is calculated from the date of registration to the expiration date of the Investment Permit or Investment Registration Certificate.

Article 7. Procedure for issuing temporary registration certificates

1. The owner of the special purpose motorcycle prepares one set of documents as prescribed in Clause 3 of Article 5 of this Circular and submitting directly to the nearest Department of Transport.

2. The Department of Transport receives and checks the contents of the documents and informs the owner within a maximum of one working day from the date of receipt of the documents.

a) In case the registration documents are incomplete as required, the Department of Transport guides the owner to supplement and complete them;

b) In cases where the application dossier is complete as prescribed, within three working days from the date of receiving a valid dossier, the Department of Transport shall issue a temporary registration certificate and record it in the motorcycle special-purpose vehicle registration management ledger. If not issued, a written response must be provided with clear reasons stated.

3. The temporary registration certificate has a validity period of twenty days from the date of issuance.

Chapter III. ISSUANCE OF REPLACEMENTS AND REISSUANCE OF REGISTRATION CERTIFICATES AND LICENSE PLATES FOR MOTORCYCLE SPECIAL-PURPOSE VEHICLES

Article 8. Application dossier for issuance of replacements and reissuance of registration certificates and license plates for motorcycle special-purpose vehicles

1. Application dossier for issuance of replacements for registration certificates and license plates

Owners of motorcycle special-purpose vehicles that have been modified, repainted, or whose owner-related information has changed (without changing ownership), and whose registration certificates or license plates are damaged must apply for replacement registration certificates and license plates. The replacement application dossier includes:

a) A form for applying for replacement of the registration certificate and license plate for motorcycle special-purpose vehicles according to Appendix 2, Form No. 8 attached hereto;

b) The original registration certificate for the motorcycle special-purpose vehicle already issued;

c) The original quality certification for the modified vehicle according to the regulations of the Ministry of Transport for modified vehicles;

d) Decisions or documents regarding changes issued by competent authorities for cases where the owner's related information has changed (a certified copy and presentation of the original for verification or a certified copy).

2. Application dossier for reissuance of registration certificates and license plates

Owners of motorcycle special-purpose vehicles who have lost their registration certificates or license plates must apply for reissuance of the registration certificates and license plates. The reissue application dossier includes: Appendix 2, Form No. 8 attached hereto;

a) A form for applying for reissuance of the registration certificate and license plate for motorcycle special-purpose vehicles according to Appendix 2, Form No. 17 issued together with this Circular for cases of lost registration certificates.

Article 9. Implementation procedure.

1. The owner of the special purpose motorcycle prepares one set of documents as prescribed in Article 8 of this Circular submit directly at the Department of Transport where the motorcycle special-purpose vehicle was registered.

2. The Department of Transport receives and checks the contents of the documents and informs the owner within a maximum of one working day from the date of receipt of the documents.

a) In cases where the application dossier is incomplete as prescribed, the Department of Transport shall guide the owner to supplement and perfect the dossier;

b) In cases where the application dossier is complete as prescribed: within no more than three working days, the Department of Transport shall issue a replacement registration certificate to the owner, collect and cut the upper right corner of the previously issued registration certificate; within no more than fifteen working days, the Department of Transport shall issue a replacement license plate according to the number already assigned to the owner, collecting the damaged license plate. For cases of modified motorcycle special-purpose vehicles, the provisions of Point b Clause 2, Clause 3, and Clause 4 Article 6 of this Circularshall apply. If not issued, a written response must be provided with clear reasons stated.

c) In cases of lost registration certificates: within two working days from the date of receipt of the dossier, the Department of Transport shall publish on its electronic information website within fifteen days. After the publication period, if no feedback related to disputes over the reissued registration of motorcycle special-purpose vehicles is received, within no more than three working days, the Department of Transport shall reissue the registration certificate for motorcycle special-purpose vehicles to the owner.

Chapter IV. TRANSFER AND MOVEMENT OF SPECIAL PURPOSE MOTORCYCLES

Article 10. Transfer of Ownership within the Same Province/City

Special purpose motorcycles purchased, given, gifted, or inherited within the same province/city must follow the procedures for transferring ownership as stipulated below:

1. The application for transferring ownership shall include:

a) A registration application form for special purpose motorcycles according to Appendix 2, Form No. 2 issued together with this Circular;

b) Original documents confirming ownership as prescribed in Article 3 of this Circular except in cases stipulated in Clause 3, Article 19 of this Circular;

c) Certificate of Registration of special purpose motorcycles already issued (a copy and presentation of the original for verification or a certified copy).

2. Procedures for Implementation

a) The owner of the special purpose motorcycle shall prepare one set of documents in accordance with Clause 1 of this Article and submit it directly to the Department of Transport where the special purpose motorcycle was registered;

b) The Department of Transport shall accept, review the documents, and notify the owner of the result within a maximum of one working day from the date of receipt of the documents.

In cases where the documents are incomplete according to the regulations, the Department of Transport shall guide the owner to supplement and complete them;

In cases where the documents are complete according to the regulations, the Department of Transport shall proceed as prescribed in point b, Clause 2, Clause 3 of Article 6 of this Circular;

Within three working days from the end of the inspection: if the inspection results meet the requirements, the Department of Transport shall issue a new Certificate of Registration under the name of the new owner, retain the old license plate, cut the upper right corner of the old owner's Certificate of Registration, record it in the Register of Special Purpose Motorcycle Registrations, and provide a written response with reasons if not issued.

Article 11. Movement and Registration of Special Purpose Motorcycles to Different Provinces/Cities

Special purpose motorcycles purchased, given, gifted, or inherited in different provinces/cities must follow the procedures for movement and transfer of ownership as stipulated in Article 12 and Article 13 of this Circular. In cases where special purpose motorcycles are moved to different provinces/cities but the owner does not change, the provisions at point b, Clause 1 of Article 12 of this Circular need not be followed.

Article 12. Procedures for Moving Registration of Special Purpose Motorcycles

1. Documents for moving registration shall include:

a) Application for moving registration of special purpose motorcycles according to Form No. 9 of Appendix 2 issued together with this Circular;

b) Original documents confirming ownership as prescribed in Article 3 of this Circular except in cases stipulated in Clause 3, Article 19 of this Circular;

c) Certificate of Registration of special purpose motorcycles already issued (a copy and presentation of the original for verification or a certified copy).

2. Procedures for Implementation

a) The owner of the special purpose motorcycle shall prepare one set of documents in accordance with Clause 1 of this Article and submit it directly to the Department of Transport where the special purpose motorcycle was registered;

b) The Department of Transport shall accept, review the contents of the documents, and notify the owner of the result within a maximum of one working day from the date of receipt of the documents.

In cases where the documents are incomplete according to the regulations, the Department of Transport shall guide the owner to supplement and complete them;

In cases where the documents are complete according to the regulations, within no more than three working days, the Department of Transport shall issue a Movement Registration Certificate of Special Purpose Motorcycles according to Form No. 10 of Appendix 2 issued together with this Circular, reclaim the license plate, cut the upper right corner of the Certificate of Registration of the special purpose motorcycle, record it in the Register, and return the registration documents to the owner. In cases where it is not issued, a written response with reasons must be provided.

Article 13. Procedures for Registration of Special Purpose Motorcycles Transferred from Other Provinces/Cities

1. The registration documents include:

a) Application for registration of special purpose motorcycles according to the prescribed form at Form No. 2 of Appendix 2 attached hereto;

b) Original Movement Registration Certificate of special purpose motorcycles issued in accordance with Clause 2 of Article 12 of this Circular attached to the registration documents of the special purpose motorcycle.

2. Procedures for Implementation

a) The owner of the special purpose motorcycle shall prepare one set of documents in accordance with Clause 1 of this Article and submit it directly to the Department of Transport where the special purpose motorcycle has been transferred to;

b) The Department of Transport shall accept, review the contents of the documents, and notify the owner of the result within a maximum of one working day from the date of receipt of the documents.

In cases where the registration documents are incomplete according to the regulations, the Department of Transport shall guide the owner to supplement and complete them;

In cases where the registration documents are complete according to the regulations, the Department of Transport and the owner of the special purpose motorcycle shall proceed as prescribed in Point b Clause 2, Clause 3, and Clause 4 Article 6 of this Circularshall apply. If not issued, a written response must be provided with clear reasons stated.

Chapter V. RECOVERY OF REGISTRATION CERTIFICATES AND LICENSE PLATES

Article 14. Documents for Recovery of Registration Certificates and License Plates

1. The registration certificates and license plates shall be recovered in the following cases:

a) The specialized motor vehicle is damaged and cannot be used;

b) The specialized motor vehicle is lost and cannot be found;

c) The specialized motor vehicle is sold or re-exported abroad;

d) The competent authority discovers violations of regulations on issuing registration certificates and license plates and must proceed with the recovery procedures for the registration certificates and license plates.

2. The recovery documents include:

a) The application form for recovering the registration certificate of the specialized motor vehicle according to Form No. 1 of Appendix 2 attached hereto;

Clause 2 of Article 14

Article 14. Procedure for Implementation

1. The owner of the special purpose motorcycle prepares one set of documents as prescribed in and submit directly at the Department of Transport where the registration was made. 2. The Department of Transport will accept the documents, recover the registration certificate and license plate, record in the Register of Specialized Motor Vehicle Registrations, and return the registration documents to the owner within no more than two working days from the date of receiving the documents.

3. In case the competent authority discovers violations of regulations on issuing registration certificates and license plates as stipulated in Point d, Clause 1 of this Article, the Department of Transport will issue a decision to recover the issued registration certificates and license plates and publish it on the Department's electronic information website.

Chapter VI. CODES, REGISTRATION CERTIFICATES, AND LICENSE PLATES

Article 16. Registration Codes

The registration code for specialized motor vehicles in each province and centrally governed city is uniformly defined according to the registration code for mechanical vehicles participating in road traffic at

Article 18. Cases of Replacing Engine Numbers and Frame Numbers

1. Cases of replacing engine numbers and frame numbers

a) Replacement when there is no engine number or frame number on the file and during actual inspection of the specialized motor vehicle according to the method prescribed in

b) Replacement of engine numbers and frame numbers in cases where they are faded but match the engine numbers and frame numbers recorded in the file of the specialized motor vehicle. Appendix 4 attached hereto;

2. The Department of Transport will replace engine numbers and frame numbers in the cases specified in Clause 1 of this Article and record in the Inspection Report of Specialized Motor Vehicles according to

If the Department of Transport is requested to cooperate in inspections, replacement will be done according to the frame number and engine number provided by the Department of Transport handling the registration issuance procedures. Article 19. Handling Difficulties and Arising Cases

1. In cases where the owner of a specialized motor vehicle loses the registration documents

a) The owner shall prepare the Application for Registration of Specialized Motor Vehicles according to

of this Circular along with a copy of the lost documents certified by the issuing authority and a public notice according to Form No. 2 of Appendix 2 Point b, Clause 2 of Article 8 of this Circular and submit directly to the Department of Transport where the owner has registered their main office or place of residence. b) Within two working days from the date of receiving complete documents as prescribed, the Department of Transport will post on its electronic information website within fifteen days. After the deadline, if no feedback related to disputes over the specialized motor vehicle requesting registration is received, the Department of Transport will proceed according to

2. In cases arising from relocation or transfer of registration Point b Clause 2, Clause 3, and Clause 4 Article 6 of this Circular.

a) For specialized motor vehicles that have been relocated and registered but the owner has not processed registration at the destination and has sold them to others, the Department of Transport at the buyer's location will accept the documents and process the issuance of registration according to

a) For specialized motor vehicles that have moved to registration but whose owners have not yet completed the registration procedures at the new location before reselling them to others, the Department of Transport where the buyer is located shall accept the application and process the registration according to the provisions at Article 13 of this Circular;

b) After issuing the registration certificate, the Department of Transport where the registration was issued shall send a notification to the Department of Transport at the place of transfer to adjust in the Register of Special Purpose Vehicle Registration Management.

3. If multiple vehicles share one document prescribed in Article 3, Clause 4, Clause 5 of Article 4 of this Circular then organizations and individuals must submit the original and copies for each vehicle to the Department of Transport where the registration is made (except for temporary registrations prescribed in Clause 3 of Article 5 of this Circular). The Department of Transport where the registration is made is responsible for confirming in writing with the organization or individual registering that it is holding the original.

Chapter VIII. IMPLEMENTATION

Article 20. Vietnam Road Administration [2]

1. Manage the issuance, replacement, and revocation of registration certificates and license plates for special purpose vehicles nationwide.

2. Manage the issuance of blank forms for registration certificates for special purpose vehicles, license plates, and sets of engine number and frame number stickers to ensure uniformity nationwide.

3. Inspect Departments of Transport on their implementation of the provisions of this Circular.

Article 21. Departments of Transport

1. Implement the issuance, replacement, and revocation of registration certificates and license plates for special purpose vehicles according to the provisions of this Circular in localities.

2. Manage registration files

Store and manage initial registration files, limited-term registration files, temporary registration files, replacement and reissue files, revocation files of registration certificates and license plates; files for transferring ownership, transferring registration and license plates, and other related documents concerning the issuance, replacement, and revocation of registration certificates and license plates;

3. Collect, remit, and use fees and charges for the issuance of special purpose vehicle registration certificates according to regulations of the Ministry of Finance.

4. Report to the Vietnam Road Administration[3] on the demand for blank forms for registration certificates for special purpose vehicles and license plates according to Form No. 15 of Appendix 2 promulgated together with this Circular.

5. Carry out inspections of special purpose vehicles when requested to cooperate by other Departments of Transport.

6. Before January 15th each year, report on the issuance of registration certificates and license plates according to Form No. 16 of Appendix 2 issued together with this Circular to the Vietnam Road Administration[4].

Article 22. Owners of special purpose vehicles

1. Strictly comply with all legal provisions regarding the registration of special purpose vehicles.

2. When directly handling registration procedures with the registration authority, the owner of the special purpose vehicle must present a valid identity card, citizen identification card, or passport for verification; in cases where the person is not the owner, the authorized representative must have a power of attorney from the owner in accordance with the law; representatives of organizations must have an introduction letter from the organization.

3.[5] When owners of special purpose vehicles handle the following procedures: Initial issuance of registration certificates and license plates for special purpose vehicles; issuance of limited-term registration certificates and license plates for special purpose vehicles; reissuance and replacement of registration certificates with accompanying license plates; reissuance and replacement of registration certificates without accompanying license plates; issuance of temporary registration certificates with accompanying license plates; renumbering of chassis and engine numbers, they are responsible for completing the payment of fees before receiving the administrative procedure results.

Chapter IX. EFFECTIVENESS AND RESPONSIBILITY FOR IMPLEMENTATION[6]

Article 23. Effectiveness of Implementation

1. This Circular takes effect from August 1, 2019.

2. This Circular replaces Circular No. 20/2010/TT-BGTVT dated July 30, 2010, of the Minister of Transport on the issuance, replacement, and revocation of registration certificates and license plates for special purpose vehicles participating in road traffic and Circular No. 59/2011/TT-BGTVT dated December 5, 2011, of the Minister of Transport amending certain provisions of Circular No. 20/2010/TT-BGTVT dated July 30, 2010, of the Minister of Transport on the issuance, replacement, and revocation of registration certificates and license plates for special purpose vehicles participating in road traffic.

Article 24. Responsibility for Implementation

The Director of the Office of the Ministry, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Road Administration[7], Directors of Departments of Transport, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.

APPENDIX 1. LIST OF SPECIAL PURPOSE VEHICLES

(Issued together with Circular No. 22/2019/TT-BGTVT dated June 12, 2019, of the Minister of Transport)

I. Construction Vehicles

1. Earthmoving Equipment:

a) Excavators:

- Wheeled excavators,

- Crawler excavators,

- Hybrid excavators;

b) Bulldozers:

- Wheeled bulldozers,

- Crawler bulldozers,

- Hybrid bulldozers;

c) Scrapers; d) Graders;

đ) Rollers:

- Wheeled rollers,

- Steel drum rollers,

- Hybrid rollers.

2. Road Surface Construction Equipment:

a) Material Spreaders;

b) Road Base Construction Equipment;

c) Cement Concrete Road Surface Construction Equipment;

Pursuant to Decree No. 65/2016/ND-CP dated 01 July 2016 of the Government stipulating business conditions for automobile driving training services and driving examination services; Decree No. 138/2018/ND-CP dated 08 October 2018 of the Government amending and supplementing some articles of Decree No. 65/2016/ND-CP dated 01 July 2016 of the Government stipulating business conditions for automobile driving training services and driving examination services; Decree No. 70/2022/ND-CP dated 27 September 2022 of the Government amending and supplementing some articles of Decrees relating to business activities in the road sector;

The Minister of Transport issues this Circular amending and supplementing certain articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers.”

Circular No. 05/2024/TT-BGTVT amending and supplementing certain articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, based on the following grounds:

“On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 65/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for operating automobile driving training services and driving examination services; Decree No. 138/2018/NĐ-CP dated October 8, 2018 of the Government amending and supplementing certain articles of Decree No. 65/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for operating automobile driving training services and driving examination services; Decree No. 70/2022/NĐ-CP dated September 27, 2022 of the Government amending and supplementing certain articles of decrees relating to business activities in the road sector;

Pursuant to Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government stipulating business and operating conditions for road transport by motor vehicles; Decree No. 47/2022/NĐ-CP dated July 19, 2022 of the Government amending and supplementing certain articles of Decree No. 10/2020/NĐ-CP dated January 17, 2020 of the Government stipulating business and operating conditions for road transport by motor vehicles;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the request of the Director of the Transport Department and the Director General of the Vietnam Highway Administration,

The Minister of Transport issues this Circular amending and supplementing certain articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers.”

[2] The phrase "Vietnam Highway Administration" is replaced by the phrase "Vietnam Road Administration" pursuant to Clause 1 Article 14 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, effective from June 15, 2023

[4] The phrase "Vietnam Highway Administration" is replaced by the phrase "Vietnam Road Administration" pursuant to Clause 1 Article 14 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, effective from June 15, 2023

[5] This clause is added pursuant to Clause 1 Article 5 of Circular No. 05/2024/TT-BGTVT amending and supplementing certain articles of related Circulars concerning road transport, supporting road transport services, vehicles, and drivers, effective from June 1, 2024.

[6] Article 24 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain provisions related to road transport, road transport support services, vehicles, and drivers, which takes effect from June 15, 2023, is stipulated as follows:

“Article 24. Implementation Provisions

1. This Circular takes effect from June 15, 2023.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of the Vietnam Road Administration Bureau, the Directors of Provincial Departments of Transport, and the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./”.

Article 6 of Circular No. 05/2024/TT-BGTVT amending and supplementing certain provisions related to road transport, road transport support services, vehicles, and drivers, which takes effect from June 1, 2024, is stipulated as follows:

“Article 6. Implementation Provisions

1. This Circular takes effect from June 1, 2024.

2. This Circular abolishes: Appendix 24 of Circular No. 38/2019/TT-BGTVT dated October 8, 2019, issued by the Minister of Transport, amending and supplementing certain provisions of Circular No. 12/2017/TT-BGTVT dated April 15, 2017, issued by the Minister of Transport, concerning the training, examination, and issuance of motor vehicle driver’s licenses.

3. Transitional Provisions

a) For training courses that have enrolled students before the date this Circular takes effect, training institutions continue to organize training according to the provisions of Circular No. 12/2017/TT-BGTVT (amended and supplemented by Circulars No. 38/2019/TT-BGTVT, No. 01/2021/TT-BGTVT, No. 04/2022/TT-BGTVT, and No. 05/2023/TT-BGTVT).

b) Individuals who were absent or failed in examinations to obtain a driver’s license before the date this Circular takes effect, but register for a driving test after the date this Circular takes effect, shall be reviewed and tested according to the provisions of this Circular.

c) Individuals studying to upgrade their driver’s license who have already learned fire prevention, firefighting, and rescue skills in a course leading to obtaining their current driver’s license shall retain their results (no need to retake the course).

d) In cases where the competent authority cannot perform electronic identity verification of organizations or citizens due to errors in the Electronic Identity and Authentication System, organizations and individuals must present one of the following valid documents: a copy of the business registration certificate, a copy of the citizen identification card, a copy of the national identity card, or a copy of the passport when performing administrative procedures.

4. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Road Administration Bureau, the Directors of Provincial Departments of Transport and Construction, and the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./”

[7] The phrase "Director General of the Vietnam Road Administration" is replaced by the phrase "Director of the Vietnam Road Administration" pursuant to Clause 2, Article 14 of Circular No. 05/2023/TT-BGTVT amending and supplementing certain provisions related to road transport, road transport support services, vehicles, and drivers, which takes effect from June 15, 2023.
