LAW ; VIOLATION ADJUSTMENT APPLICATION 1. THIS DECREE REGULATES THE FUNCTIONS, DUTIES, AND LIMITATIONS OF NATIONAL UNIVERSITIES. a) Providing testimonies and expert opinions for the case for which they have been summoned; LIMITATION UNIVERSITY NATIONAL BASED and ON 2. THIS DECREE APPLIES TO NATIONAL UNIVERSITIES, ORGANIZATIONS, AND INDIVIDUALS RELATED TO THE MANAGEMENT AND OPERATIONS OF NATIONAL UNIVERSITIES.
Article 1. POSITION FUNCTION 1. NATIONAL UNIVERSITIES ARE PUBLIC HIGHER EDUCATION INSTITUTIONS MANAGED BY THE MINISTRY OF EDUCATION AND TRAINING, HAVE LEGAL PERSONALITY, SEPARATE ACCOUNTS, AND USE STAMPS WITH THE NATIONAL EMBLEM. 2. NATIONAL UNIVERSITIES HAVE THE FUNCTION OF TRAINING ALL LEVELS OF HIGHER EDUCATION, SCIENTIFIC RESEARCH, AND TECHNOLOGY TRANSFER ACROSS MULTIPLE FIELDS AT A HIGH QUALITY; THEY LEAD IN CERTAIN FIELDS WITH HIGH RANKINGS BOTH DOMESTICALLY AND INTERNATIONALLY. and 3. NATIONAL UNIVERSITIES ARE SUBJECT TO STATE MANAGEMENT BY THE MINISTRY OF EDUCATION AND TRAINING, THE MINISTRY OF SCIENCE AND TECHNOLOGY, OTHER MINISTRIES AND SECTORS, AND PEOPLE'S COMMITTEES AT ALL LEVELS WHERE NATIONAL UNIVERSITIES ARE LOCATED, WITHIN THE SCOPE OF THEIR FUNCTIONS AS PROVIDED BY THE GOVERNMENT AND IN COMPLIANCE WITH LAWS. of persons DUTY OF NATIONAL
NATIONAL UNIVERSITIES HAVE DUTIES AND LIMITATIONS AS PROVIDED FOR IN THE HIGHER EDUCATION LAW, THE LAW AMENDING AND SUPPLEMENTING SOME PROVISIONS OF THE HIGHER EDUCATION LAW, OTHER PROVISIONS OF LAWS, AND THIS DECREE AS FOLLOWS:
1. ON ORGANIZATION STRUCTURE AND PERSONNEL
Article 2. a) MANAGE THE ORGANIZATION STRUCTURE AND PERSONNEL OF NATIONAL UNIVERSITIES IN ACCORDANCE WITH LAWS AND THE REGULATIONS ON THE ORGANIZATION AND OPERATIONS OF NATIONAL UNIVERSITIES AND AFFILIATED HIGHER EDUCATION INSTITUTIONS; b) IMPLEMENT PERSONNEL PROCEDURES TO REPORT TO THE MINISTER OF EDUCATION AND TRAINING TO NOMINATE, REMOVED THE CHAIRMAN OF THE NATIONAL UNIVERSITY COUNCIL, THE DIRECTOR OF THE NATIONAL UNIVERSITY, AND THE DEPUTY DIRECTOR OF THE NATIONAL UNIVERSITY AS PROVIDED BY THE PARTY AND RELEVANT LAWS; and LIMITATION c) SUBMIT TO THE MINISTER OF EDUCATION AND TRAINING FOR APPROVAL OF THE NATIONAL UNIVERSITY COUNCIL AS PROVIDED BY THE PARTY AND RELEVANT LAWS;
d) DECIDE AND REPORT TO THE PRIME MINISTER AND THE MINISTER OF EDUCATION AND TRAINING ON THE ADDITION OR REPLACEMENT OF MEMBERS OF THE NATIONAL UNIVERSITY COUNCIL (EXCEPT IN CASES INVOLVING MEMBERS AS PROVIDED IN POINT B OF THIS CLAUSE);
đ) ISSUE REGULATIONS ON THE WORKING SYSTEM OF TEACHERS AND RESEARCHERS IN ACCORDANCE WITH LAWS APPLICABLE IN NATIONAL UNIVERSITIES TO ATTRACT AND DEVELOP HIGH-QUALITY HUMAN RESOURCES DOMESTICALLY AND INTERNATIONALLY;
e) DECIDE TO ENTER INTO LABOR CONTRACTS WITH TEACHERS, SCIENTISTS, AND EXPERTS WITH REPUTATION BOTH DOMESTICALLY AND INTERNATIONALLY IN ACCORDANCE WITH LAWS TO MEET TEACHING AND SCIENTIFIC RESEARCH NEEDS;
Article 3. g) DECIDE TO ASSIGN EMPLOYEES OF NATIONAL UNIVERSITIES TO MANAGE AND OPERATE ENTERPRISES UNDER THE NATIONAL UNIVERSITY IN ACCORDANCE WITH LAWS. BASED and ON THE 2. ON EDUCATION ACTIVITIES 2025; BASED ON THE EDUCATION LAW dated June 14, 2019; national BASED ON THE
a) DEVELOP AND IMPROVE THE QUALITY OF HIGHER EDUCATION TO TRAIN HIGH-LEVEL HUMAN RESOURCES TO MEET THE REQUIREMENTS OF ECONOMIC AND SOCIAL DEVELOPMENT, NATIONAL DEFENSE, SECURITY, AND INTERNATIONAL INTEGRATION; PROMOTE INTERNATIONAL COOPERATION AND INTEGRATION TO DEVELOP VIETNAMESE HIGHER EDUCATION TO THE LEVEL OF THE REGION AND THE WORLD;
b) DEVELOP REGULATIONS ON TRAINING ALL LEVELS OF HIGHER EDUCATION, REPORT TO THE MINISTER OF EDUCATION AND TRAINING FOR ISSUANCE IN ACCORDANCE WITH THE HIGHER EDUCATION LAW AND RELEVANT LAWS;
c) DEVELOP AND IMPLEMENT PRACTICAL, SPECIALIZED, AND TALENT PROGRAMS AT ALL TRAINING LEVELS TO DISCOVER, TRAIN, AND DEVELOP SCIENTIFIC AND TECHNICAL TALENTS; IMPLEMENT TRAINING PROGRAMS THAT HAVE BEEN IMPLEMENTED DOMESTICALLY ABROAD THROUGH INTERNATIONAL COOPERATIVE AND LINKAGE PROGRAMS IN ACCORDANCE WITH LAWS.
3. ON SCIENTIFIC AND TECHNOLOGICAL ACTIVITIES AND INNOVATION
a) RESEARCH AND PROVIDE SCIENTIFIC BASIS TO CONTRIBUTE TO BUILDING GUIDELINES, POLICIES, STRATEGIES, PLANS FOR NATIONAL ECONOMIC AND SOCIAL DEVELOPMENT, NATIONAL DEFENSE, SECURITY, AND INTERNATIONAL INTEGRATION;
b) ORGANIZE SCIENTIFIC AND TECHNOLOGICAL ACTIVITIES IN SOCIAL SCIENCES, NATURAL SCIENCES, ENGINEERING, AND TECHNOLOGY ACROSS INTERDISCIPLINARY FIELDS TO PROMOTE THE DEVELOPMENT OF SCIENCE, TECHNOLOGY, AND INNOVATION IN REGIONS, TRAINING HIGH-QUALITY HUMAN RESOURCES, DEVELOPING SCIENTIFIC AND TECHNICAL TALENTS, CONTRIBUTING TO ECONOMIC AND SOCIAL DEVELOPMENT;
c) PROPOSE AND IMPLEMENT NATIONAL AND MINISTERIAL SCIENTIFIC AND TECHNOLOGICAL PROGRAMS WHEN APPROVED BY AUTHORIZED AUTHORITIES;
d) DEVELOP AND ORGANIZE INTERNATIONAL AND DOMESTIC SCIENTIFIC AND TECHNOLOGICAL COOPERATION PROGRAMS ON INNOVATION AND ENTREPRENEURSHIP.
4. ON FINANCIAL AND ASSET MANAGEMENT
a) NATIONAL UNIVERSITIES ARE PRIMARY BUDGET UNITS ASSIGNED BUDGETS BY THE PRIME MINISTER; UNIFORMLY MANAGE THE ALLOCATION AND ASSIGNMENT OF BUDGETS TO AFFILIATED UNITS, SUBORDINATE UNITS, AND RESPONSIBLE FOR THE ACCOUNTING AND SETTLEMENT OF BUDGETS OF NATIONAL UNIVERSITIES IN ACCORDANCE WITH CURRENT LAWS ON STATE BUDGETS;
b) MANAGE, OPERATE, AND AUDIT FINANCES AND ASSETS UNIFORMLY WITHIN NATIONAL UNIVERSITIES IN ACCORDANCE WITH LAWS ON STATE BUDGETS, LAWS ON THE MANAGEMENT AND USE OF PUBLIC ASSETS, AND RELEVANT LAWS;
c) APPROVE SELF-GOVERNANCE FINANCIAL PLANS OF AFFILIATED UNITS, SUBORDINATE UNITS, AND DIRECTLY SUBORDINATE UNITS IN ACCORDANCE WITH THE GOVERNMENT'S MECHANISMS FOR SELF-GOVERNANCE OF PUBLIC INSTITUTIONS;
d) DETERMINE TUITION FEES IN NATIONAL UNIVERSITIES IN ACCORDANCE WITH GOVERNMENT REGULATIONS.
3. Regarding scientific research, technology, and innovation
a) Conducting studies to provide scientific grounds contributing to the formulation of orientations, policies, strategies, and plans for national economic and social development, ensuring national defense, security, and international integration;
b) Organizing scientific and technological activities in interdisciplinary fields such as social sciences, humanities, natural sciences, engineering, and technology, promoting regional scientific, technological, and innovative development linked with high-quality human resource training, nurturing scientific and technological talents, and contributing to economic and social development;
c) Proposing and implementing national-level and ministry-level science and technology programs upon approval by competent authorities;
d) Building and organizing domestic and international cooperation programs in scientific research and technology concerning innovation and creative entrepreneurship activities;
4. Regarding finance and assets
a) The National University is a first-tier budget entity assigned a state budget under the Prime Minister's decision; it uniformly manages the allocation and assignment of state budget funds to its constituent units and subordinate units, and is responsible for accounting and finalizing the state budget of the National University according to current laws on state budget management;
b) Managing, operating, and inspecting financial and asset matters uniformly within the National University in accordance with laws on state budget management, laws on the management and utilization of public assets, and related laws;
c) Approving the self-financing schemes of constituent units and subordinate units of the National University in accordance with the Government's regulations on the mechanism for autonomous financial management of public service units;
d) Determining tuition fees within the National University in accordance with the Government's regulations;
đ) Manage, operate, utilize, and share financial resources, human resources, infrastructure, and other resources assigned within the national university to ensure organic integration, synchronization, and effectiveness; mobilize social resources to build the national university into a research-oriented higher education institution with regional and international standards.
5. Other tasks and authorities
a) Be responsible for reporting to the Government, the Prime Minister, ministries, sectors, students, and society on the activities of the national university within the scope of its functions, tasks, and granted authorities.
b) Work directly with ministries, ministerial-level agencies, government agencies, provincial People's Committees, and centrally-run city People's Committees to address issues related to the national university. When necessary, the national university reports to the Prime Minister on issues related to its operations and development; implement the provision of information and reports to serve the inspection and audit activities of relevant ministries, sectors, and provincial People's Committees where the national university, member units, subordinate units, and affiliated units are located according to the provisions of the law.
c) Be prioritized by the State for investment and development to fulfill national strategic tasks and regional development tasks of the country.
d) Carry out other tasks and authorities assigned by the Government, the Prime Minister, and relevant ministries and sectors.
Article 4. eff in force ect ADJUSTMENT
1. This Decree takes effect from September 1, 2025.
2. This Decree replaces Decree No. 186/2013/NĐ-CP dated November 17, 2013 of the Government on national universities.
Article 5. res NATIONAL ect ADJUSTMENT
Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees, Chairpersons of centrally-run city People's Committees, national universities, and related organizations and individuals are responsible for implementing this Decree./.
