DECISION OF THE PRIME MINISTER

Regarding the approval of the Master Plan for the Development of the Vietnam Seaport System

until 2010

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Considering the proposals of the Ministry of Transport (documents No. 145/KHĐT dated January 16, 1997, No. 680/KHĐT dated March 14, 1998, and No. 3007/GTVT-KHĐT dated September 3, 1999) and the comments of the State Investment Project Appraisal Council (documents No. 4848/HĐTĐ dated July 14, 1998, and No. 77/TĐNN dated July 24, 1999),

 

DECISION:

Article 1. Approve the Master Plan for the Development of the Vietnam Seaport System until 2010 with the main contents as follows:

1- Planning objectives:

- General objective: To serve as a basis for constructing and developing the Vietnam Seaport System according to an overall and unified plan on a national scale; to form infrastructure transportation hubs in various regions, especially in key economic zones; to create technical facilities for seaports to support economic development, while affirming the country's position and advantages in marine economy in the region and globally, and creating important economic exchange points between domestic and foreign entities.

- Specific objectives:

+ The Vietnam Seaport System will be planned for development to meet the requirements of industrialization and modernization of the country based on maritime scientific and technological progress regarding scale, equipment, production lines, management systems, so that the country can gradually integrate and compete effectively in port activities with other countries in the region and internationally.

+ The Vietnam Seaport System will ensure the passage of all sea-borne import and export goods according to the economic growth requirements of the country, expected to reach approximately 106 million tons/year by 2003 and approximately 200 million tons/year by 2010.

+ The Vietnam Seaport System will be planned for distribution across the entire country at locations with favorable conditions and demands for seaport construction, aiming to exploit natural advantages, utilize marine transport capabilities, serve economic regions and industrial zones, reduce investment and operational costs of ports.

2- Directions for planning the development of the Vietnam Seaport System:

- Renovate, upgrade, and modernize existing ports, utilizing natural conditions and existing facilities to invest rationally and operate the port system efficiently.

- Focus on building several comprehensive ports playing a leading role in key economic zones for large vessels (over 30,000 DWT), paying particular attention to specialized ports for containers, bulk cargo, liquid cargo, and international transshipment ports.

- Construct several key ports in localities after carefully considering investment effectiveness, appropriate functions, and scales matching the level of economic development and capital mobilization capacity.

- Alongside port development, it is necessary to develop maritime services and related infrastructure synchronously to enhance service capacity and investment efficiency of ports.

- In both the development and operation of seaports, it is essential to closely combine economic development requirements with national defense needs.

3- Overall planning for the development of the Vietnam Seaport System until 2010:

By 2010, the Vietnam Seaport System will consist of eight groups:

- Group 1: Northern Seaport Group, including seaports from Quang Ninh to Ninh Binh.

- Group 2: North Central Seaport Group, including seaports from Thanh Hoa to Ha Tinh.

- Group 3: Central Central Seaport Group, including seaports from Quang Binh to Quang Ngai.

- Group 4: South Central Seaport Group, comprising seaports from Binh Dinh to Binh Thuan.

- Group 5: Ho Chi Minh City - Dong Nai - Ba Ria - Vung Tau Seaport Group.

- Group 6: Mekong Delta Seaport Group.

- Group 7: Southwest Islands Seaport Group.

- Group 8: Con Dao Seaport Group.

Within each seaport group, there will be general-purpose ports and specialized ports (shore ports, floating ports, anchorage areas in maritime zones, and inland ports) with specific functions and tasks as proposed by the Ministry of Transport in document No. 680/KHĐT dated March 14, 1998.

The list of seaports included in the planning is attached as an appendix to this decision.

4-Potential ports:

The planning identifies a list of potential ports as those expected to develop mainly after 2010, requiring suitable land reserves for construction.

For potential ports, depending on demand and investment capability, the Ministry of Transport will study and submit to the Prime Minister for consideration and decision.

Article 2. Management of the Seaport System Planning

1- The Ministry of Transport, through the Vietnam Maritime Administration, is responsible before the Prime Minister for managing the approved planning of the seaport system.

2- Entrust the Ministry of Transport to decide specific adjustments for ports not contrary to the functions and scales of the groups in the approved planning.

- In cases where it is necessary to supplement or adjust the approved planning, the Vietnam Maritime Administration will study and report to the Minister of Transport for submission to the Prime Minister for consideration and decision.

3- Entrust the Ministry of Transport to establish and submit to the Prime Minister for approval detailed planning for Groups 1, 3, 5, and 6.

- Entrust the Ministry of Transport to approve detailed planning for the remaining groups.

4- Entrust the Ministry of Transport to establish a mechanism to generate investment capital for port development and port infrastructure, to be submitted to the Government for approval in the direction of state unified management of port infrastructure, enterprises leasing operations and paying fees to ensure revenue for investors in ports and state revenues to reinvest in developing the port system and port infrastructure according to the approved planning.

5- Entrust the People's Committees of provinces and centrally governed cities and the Land Administration General Department to strictly manage land funds in accordance with the law to meet the requirements for seaport construction in accordance with the planning.

6- Entrust the Ministry of Transport to coordinate with the People's Committees of provinces and centrally governed cities, and relevant ministries and sectors to organize the construction of transportation networks to ports: roads, railways, inland waterways, sea routes, in order to exploit port systems comprehensively and enhance the throughput capacity of seaports.

Article 3. Implement the planning

1- Entrust the Ministry of Transport, based on the approved Master Plan for the Development of Vietnam’s Port System until 2010, to direct the Vietnam Maritime Administration to develop investment plans for each period, in accordance with economic and social development requirements.

2- From now until 2003, focus investment primarily on the following ten key ports:

- Cái Lân General Cargo Port.

- Hai Phong General Cargo Port.

- Cuu Lo General Cargo Port.

- Da Nang General Cargo Port (Tien Sa - Song Hong).

- Dung Quat Industrial Zone Dedicated Port.

- Qui Nhon General Cargo Port.

- Nha Trang General Cargo Port.

- Thi Vai General Cargo Port.

- Sai Gon General Cargo Port.

- Can Tho General Cargo Port.

3- Sources of investment capital: Mobilize domestic and foreign capital sources including state budget funds, ODA loans, investments under joint venture contracts, BOT contracts, and other sources of capital.

Key ports will be prioritized for state funding to ensure the dominant role of the state in managing port system exploitation activities.

Allow relevant sectors, localities, and domestic enterprises to self-fund or form joint ventures with foreign entities to invest in other ports in accordance with the planning.

The procedures for port investment and construction shall be carried out in accordance with the Regulations on Maritime Activities at Seaports and Marine Areas in Vietnam issued together with Decree No. 13/CP dated February 25, 1994 of the Government, the Investment Management and Construction Regulations issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government, and other related regulations.

Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 5. The Ministers of relevant ministries, heads of agencies equivalent to ministries, government agencies related to this matter, Chairmen of the People's Committees of provinces and centrally governed cities, and the Director of the Vietnam Maritime Administration are responsible for implementing this Decision./.
