Issuing the Regulation on Management, Use, and Operation to Ensure Traffic Safety on the Phap Van - Cau Giay Road
THE MINISTER OF TRANSPORTATION
WHEREAS, the Road Traffic Law dated June 29, 2001;
Pursuant to Decree No. 22/CP March 22, 1994 of the Government on the tasks, powers, responsibilities for state management, and organizational structure of the Ministry of Transport;
To manage, operate effectively, ensure traffic safety, and safety of the Phap Van - Cau Giay road infrastructure;
Based on the proposal of the Director of the Vietnam Highway Administration and the Head of the Legal Affairs and Transport Department,
DECISION:
Article 1. This Decision hereby promulgates the Regulation on Management, Use, and Operation to Ensure Traffic Safety on the Phap Van - Cau Giay Road.
Article 2. This Decision shall take effect fifteen days from the date of signature.
Article 3The Heads of the Ministry's Office, the Director of the Vietnam Highway Administration, the Heads of the Legal Affairs and Transport Department, the Heads of relevant agencies, and the Directors of the Departments of Transport and Public Works of Hanoi and Ha Tay are responsible for implementing this Decision./. (issued together with Decision number 2047/2002/This Regulation stipulates the management, use, and operation of the Phap Van - Cau Giay Road, guiding all entities participating in traffic, state management agencies, related units, and residents on both sides of the road to implement it, ensuring traffic safety, safety of the infrastructure, and effective exploitation of the infrastructure. The terms used in this Regulation shall be understood as follows:
PART I
REGULATION GENERAL PROVISIONS
Article 1. Land of the Phap Van - Cau Giay Road:
Article 2Is the land on which the road infrastructure is constructed including: roads, bridges, service roads, overpasses, intersections, and land within the fence;
1. 2. Safe lane of the Phap Van - Cau Giay Road: - Is the strip of land along both sides of the road to ensure traffic safety and protect the road infrastructure, limited by the boundary marker system; 3. Vehicle lane:
Is the part of the road used for the passage of motor vehicles; - Is the strip of land along both sides of the road to ensure traffic safety and protect the road infrastructure, limited by the boundary marker system; 4. Lane:
Is a portion of the vehicle lane divided longitudinally along the road with sufficient width for safe vehicle travel; subject, organization, unit under the People's Committee of the commune level 5. Merge and diverge lane: Is a lane designated for motor vehicles entering or exiting the Phap Van - Cau Giay Road;
Median strip: Is a part of the road dividing the roadway into separate lanes for each direction of travel;
7. Shoulder strip: Is a part of the road separating the lane for motor vehicles traveling on the Phap Van - Cau Giay Road from the service road and the safe lane of the road;
6. 8. Crossroad: Is a road intersecting the Phap Van - Cau Giay Road through an interconnected intersection or direct intersection;
9. Service road: Is a road running alongside both sides of the Phap Van - Cau Giay Road separated from the main road by guardrails and fences, intended for pedestrians, non-motorized vehicles, and slow-moving motor vehicles that need to travel parallel to the Phap Van - Cau Giay Road or have a need to reach crossroads under pedestrian bridges to cross the Phap Van - Cau Giay Road;
Pedestrian crossroad: Is a road for pedestrians, non-motorized vehicles, and small motor vehicles;
Overpass: Is a bridge over the Phap Van - Cau Giay Road at a higher level;
11. Pedestrian bridge:
10. Is a bridge on the Phap Van - Cau Giay Road crossing pedestrian crossroads. The Phap Van - Cau Giay Road is designed for high-speed traffic and therefore is only open to motor vehicles with a permitted speed of 60 km/h or more. Strictly prohibited are pedestrians, non-motorized vehicles, motorcycles with engine displacement of 50 cm³ or less, three-wheeled vehicles, farm trucks, and similar vehicles from using the Phap Van - Cau Giay Road. All vehicles entering or exiting the Phap Van - Cau Giay Road must quickly move into the merge and diverge lane to gradually increase or decrease their speed to ensure safe travel on the Phap Van - Cau Giay Road.
The safe lane of the Phap Van - Cau Giay Road is defined as follows: The width of the safe lane extends from the base of the service road embankment or the outer edge of the road infrastructure, intersection, or overpass, extending 20 meters on each side.
Article 3For structures that pose traffic safety risks such as explosive storage facilities, flammable materials, chemical substances, brick kilns, or similar facilities, in addition to the aforementioned distance, there must also be a safe distance according to the law.3 The width of the safe lane for bridges is regulated by the Road Traffic Law and the Government's Decree providing guidance.
It is strictly forbidden to extract materials or construct buildings not serving the management and safe operation of the Phap Van - Cau Giay Road within the traffic safety lane of the Phap Van - Cau Giay Road.
Article 4The scope of the cleared and compensated safe lane: Is the actual area on both sides of the road that has been compensated and marked with boundary markers for land clearance.
It is strictly forbidden to build crossroads or pedestrian crossroads at the same level as the Phap Van - Cau Giay Road. Industrial zones, export processing zones, residential areas, and service areas (collectively referred to as industrial zones), including internal roads and service roads of industrial zones, must be located outside the defined safe lane. Access roads to industrial zones can only connect to existing crossroads outside the scope of the intersection. If the industrial zone is far from the existing crossroads, the Project Management Board of the industrial zone must submit the access road design to the Ministry of Transport for approval, connecting to the Phap Van - Cau Giay Road via a different-level intersection. The design must be contracted with the Transportation Engineering Design Corporation (TEDI) to study and design to ensure safety during operation and be consistent with the scale of the Phap Van - Cau Giay Road. The construction cost of the crossroad is the responsibility of the Project Management Board of the industrial zone.
PROVISIONS ON THE USE OF THE PHAP VAN - CAU GIAY ROAD
Provisions on the use of the Phap Van - Cau Giay Road.
1. All types of vehicles traveling on the Phap Van - Cau Giay Road must stay within the designated lanes (between two lane markings) without allowing the wheels to cross the lane markings except when overtaking or turning at permitted locations. The lane closest to the median strip is reserved for small cars traveling at speeds between 80 km/h and 100 km/h.
Article 5In rainy or slippery conditions, the maximum speed should not exceed 80 km/h. Strictly prohibited are vehicles exceeding the manufacturer's permitted speed. Vehicles must travel at the designated speed and only reduce speed where speed limit signs are posted.
Article 6. The construction of level crossings and residential roads at the same level as the Phap Van - Cau Giay railway is strictly prohibited. Industrial zones, export processing zones, residential areas, and service areas (collectively referred to as industrial zones), including internal roads and the collection system within these zones, must be located outside the safety corridor as defined in Article 4.
Access roads to industrial zones may only connect to existing level crossings outside the scope of the traffic intersection.
In cases where industrial zones are far from existing level crossings, the Project Management Board for the industrial zone must submit to the Ministry of Transport for approval of access roads connecting to the Phap Van - Cau Giay railway from the time the project is initiated, and such connections must be made through grade-separated intersections. The design must be contracted with the Vietnam Transportation Engineering and Design Corporation (TEDI) to study and design to ensure operational safety and compatibility with the scale of the Phap Van - Cau Giay railway. The cost of constructing the level crossing shall be the responsibility of the Project Management Board for the industrial zone. REGULATIONS ON THE USE OF THE PHAP VAN - CUA GIAY RAILWAY
PART II
Regulations on the use of the Phap Van - Cua Giay railway.
, Clause 1, Clause 2 Article 7a of this Regulation.1. All types of vehicles traveling on the Phap Van - Cua Giay railway must stay within designated lanes (between two lane markings) and must not cross over lane markings except when overtaking or turning at
permitted locations. The lane closest to the central median is reserved for small cars traveling at speeds between 80 km/h and km/h.

2. It is strictly prohibited for vehicles to stop or park on the road obstructing traffic. Passenger-carrying vehicles and cargo-carrying vehicles shall not stop or park to pick up or drop off passengers or load or unload goods outside designated areas.
Vehicles of units managing and repairing the Pháp Vân - Cầu Giẽ Road that need to stop or park for maintenance or repair work must do so neatly and with complete warning signals and barriers placed according to the regulations of the Road Traffic Signal Code (22TCN-287-01), and have someone supervising and directing traffic.
3. The auxiliary road is reserved for pedestrians and non-motorized vehicles to access residential crossings or travel along the route. It is strictly prohibited for motorized vehicles or specialized motorcycles to stop or park obstructing traffic.
No gathering of people or parking of vehicles within the area under the residential bridge.
No drying of straw or any other objects on the surface of the Pháp Vân - Cầu Giẽ Road, auxiliary road, guardrails, or median strips.
Dumping of materials, waste, oil, or grease on the surface of the Pháp Vân - Cầu Giẽ Road is strictly prohibited. Cargo owners and drivers of vehicles transporting such items must secure and cover them carefully and be responsible for promptly cleaning up any spilled materials on the road.
Grazing of cattle, buffalo, or other livestock on the shoulders or sidewalks of the Pháp Vân - Cầu Giẽ Road is prohibited. When moving animals, they must be led by a person and kept close to the outer edge of the auxiliary road.
4. It is not allowed to use the median strip, separation, guardrails, crash barriers, light poles, signposts, or markers for advertising or displaying goods that detract from aesthetics and road safety.
5. Selling or trading goods within the guardrails is strictly prohibited.
Article 8Provisions for crossing the road.
1. It is strictly prohibited for pedestrians to climb over guardrails, walls, median strips, or cross the Pháp Vân - Cầu Giẽ Road. Pedestrians may only cross the Pháp Vân - Cầu Giẽ Road at pedestrian underpasses or overpasses.
2. Vehicles permitted to travel on the Pháp Vân - Cầu Giẽ Road may only turn around at specified locations and are strictly prohibited from crossing the median strip to turn around. at traffic intersections. When turning, vehicles must quickly move out of the main lane into the exit or merge lane, reduce speed simultaneously, and ensure absolute safety for other vehicles on the road.

Article 9. Within the safe traffic corridor, in addition to complying with the provisions of Article 4 and Article 6, the following provisions must also be adhered to:
1. No parking lots, markets, housing, service facilities, or other construction projects may be organized;
2. No advertising signs, especially illuminated ones, may be erected if their content does not serve the purpose of road safety;
3. Structures built beyond the land acquisition boundary that have not been demolished must not be expanded or constructed further and must be removed immediately upon request by competent state authorities;
4. No waste or materials affecting drainage and environmental sanitation may be dumped;
5. No unauthorized excavation or material extraction may occur within the safe corridor of the road;
6. Strictly prohibited is any encroachment on the safe corridor of the Pháp Vân - Cầu Giẽ Road or re-encroachment on the cleared land area under any form.
Article 10. Regulations on protecting the Pháp Vân - Cầu Giẽ Road infrastructure.
1. Any act causing loss or damage to the Pháp Vân - Cầu Giẽ Road infrastructure is strictly prohibited.
2. Unauthorized excavation, filling of embankments, removal of barriers, or similar actions to create paths through the median strip are strictly prohibited.
Acts of encroachment, theft, dismantling, or moving road infrastructure on the Pháp Vân - Cầu Giẽ Road that endanger traffic safety, shorten the lifespan of the infrastructure, or limit its operational efficiency will be subject to administrative penalties or criminal prosecution depending on the severity, as prescribed by law.
CHAPTER III
MANAGEMENT RESPONSIBILITIES
Article 11To facilitate management and sustainable exploitation, the Ministry of Transport has assigned the specialized state management agency, the Vietnam Highway Administration, to manage and exploit the Pháp Vân - Cầu Giẽ Road. The Vietnam Highway Administration is responsible for directing and urging the Highway Management Zone II and Highway Maintenance and Repair Company 236 to properly carry out regular maintenance of the Pháp Vân - Cầu Giẽ Road. At the same time, it coordinates with the Highway Police Corps, the Traffic Safety Committee, and the Department of Transport and Public Works of Hanoi City, the Department of Transport of Ha Tay Province, and local authorities where the road passes to effectively implement the Road Traffic Law and related laws concerning road traffic safety and the content of this Regulation.
Article 12Highway Management Zone II and Highway Maintenance and Repair Company 236, as direct managers of the Pháp Vân - Cầu Giẽ Road, are responsible for:
1. Managing the system of bridges, roads, and traffic safety equipment implemented in the project well;
2. Regularly repairing and maintaining the technical condition of bridges, roads, and traffic safety equipment to ensure safety for the operation of people and vehicles on the road;

Article 13The Highway Traffic Inspectorate of Highway Management Zone II together with the direct management unit of the Phap Van - Cau Gie Expressway shall be responsible for coordinating with traffic police forces, military forces, and local authorities in organizing, controlling, directing traffic, and protecting the Phap Van - Cau Gie Expressway; detecting and handling violations related to traffic order and safety according to their functions and tasks prescribed in the Road Traffic Law, Decrees, Circulars, and other guiding documents accompanying the Road Traffic Law.
At the same time, the Traffic Inspectorate and the direct management unit of the Phap Van - Cau Gie Expressway shall cooperate with local authorities to promote, mobilize, and educate local residents along both sides of the road to comply with the "Regulation on Management, Use, and Exploitation to Ensure Traffic Safety on the Phap Van - Cau Gie Expressway." The direct management unit of the Phap Van - Cau Gie Expressway shall complete the system of boundary markers, land clearance markers, and hand them over to local authorities as a basis for protection, as well as for inspecting and urging the protection of the safe zone and environmental landscape of the Phap Van - Cau Gie Expressway in accordance with regulations.
PART IV
REWARD AND VIOLATION HANDLING
Article 14organizations, individuals who have achievements in managing, protecting transportation works, ensuring traffic safety on the Phap Van - Cau Gie Expressway shall be rewarded according to state regulations.
Article 15. Credit organizations on individuals who commit acts violating the provisions of this Regulation shall be dealt with according to the law./.
