DECISION
Approving the Plan for Protecting Buoy Stations for Storm Warning at Sea

PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Decree No. 24/CP dated March 19, 1997 of the Government detailing the implementation of the Ordinance on Exploitation and Protection of Hydro-Meteorological Works, and Decree No. 14/1998/NĐ-CP dated March 6, 1998 of the Government on State Asset Management;
Considering the proposal of the General Director of the National Hydro-Meteorological Service at Report No. 813/KTTV-VP dated September 24, 1999 and the opinions of relevant ministries and sectors,
DECISION:
Article 1. Approves the Plan for Protecting Buoy Stations for Storm Warning at Sea with the following main contents:
1. General Provisions.
The buoy station system for storm warning located in Vietnam's sea area is an important system of equipment that the State has invested in to enhance forecasting, warning of storms, and basic hydro-meteorological surveys of the sea, serving national security tasks, preventing and mitigating damage caused by natural disasters, and exploiting marine resources.
The National Hydro-Meteorological Service shall directly be responsible for operating, managing, and primarily protecting the buoy station system.
Ensuring the safety of the buoy station system is the responsibility of all levels, ministries, sectors, and localities related to this matter.
2. Measures for protecting buoy stations.
a) Technical measures:
Buoy stations must be placed in areas facing wind and storms and should be situated in positions conducive to ensuring their safety and continuous operation.
Installation of buoy stations must comply fully with designs approved by competent authorities.
During operation, all technical maintenance standards must be strictly followed to ensure continuous and accurate functioning of the buoy stations.
b) Propaganda and education measures:
Utilize information dissemination methods to clarify the benefits of buoy stations for storm warning at sea, thereby educating and encouraging maritime forces and coastal residents to participate in protecting these stations.
c) Administrative and economic measures:
Enter into responsibility contracts or economic contracts with agencies, localities, and military units having the functions and conditions to protect buoy stations for storm warning at sea.
3. Implementation Organization
Ministries, sectors, and localities shall coordinate in protecting buoy stations for storm warning at sea based on the functions and tasks assigned by the Prime Minister.
Article 2. Responsibilities of ministries, sectors, and localities regarding the protection of buoy stations.
1. National Hydro-Meteorological Service.
a) Lead and organize the implementation of technical and economic measures to protect buoy stations, cooperate with mass media agencies, relevant sectors, and localities to implement propaganda and education measures, raising public awareness and responsibility in protecting buoy stations.
b) Provide relevant ministries (Defense, Public Security, Transport, Fisheries, and People's Committees of localities) with notifications concerning the operational status of buoy stations, including their location, operational mode (including cases of damage or drifting), technical characteristics, identification features, safe sea area limits, and other noteworthy features.
c) Coordinate with the Ministry of Public Security and related agencies to investigate and resolve incidents related to damage or loss of buoy stations.
2. Ministry of Defense, Ministry of Public Security
a) When patrolling the sea, forces under the Ministry of Defense and Ministry of Public Security have the responsibility to monitor the position and external condition of buoy stations, promptly informing the National Hydro-Meteorological Service of relevant information to jointly protect the stations.
b) Based on current regulations, forces under the Ministry of Defense and Ministry of Public Security shall facilitate the activities of National Hydro-Meteorological Service personnel and means on the sea for surveying, installation, management, and inspection of buoy stations for storm warning at sea.
c) Promptly support forces and means in searching for and rescuing buoy stations when accidents occur, upon request from the National Hydro-Meteorological Service.
3. Ministry of Transport, Ministry of Fisheries
a) Organize the publication of Maritime Notices and disseminate information about the operation of buoy stations to Vietnamese and foreign vessels based on information provided by the National Hydro-Meteorological Service.
b) Require vessels to take immediate action to prevent any harmful acts against buoy stations when operating at sea. If they discover drifting, damage, or non-compliance with published characteristics, they must promptly inform the National Hydro-Meteorological Service to address the issue and provide information for reissuing Maritime Notices.
c) Closely coordinate with the National Hydro-Meteorological Service and relevant ministries, sectors, and localities in searching for and rescuing buoy stations.
4. Vietnam Television, Voice of Vietnam Radio, central and local radio stations and newspapers
Cooperate with the National Hydro-Meteorological Service, relevant ministries, sectors, and localities to implement propaganda and education measures, enhancing public awareness and responsibility in protecting buoy stations.
5. Ministry of Foreign Affairs, Government Border Committee
Cooperate with the National Hydro-Meteorological Service to handle international relations matters related to buoy stations.
6. Ministry of Planning and Investment, Ministry of Finance
Examine and balance funds for implementing protective measures for buoy stations according to current regulations.
7. People's Committees of coastal provinces and cities
a) Cooperate with the National Hydro-Meteorological Service to disseminate information about the purpose, significance, and importance of buoy stations in preventing storms and exploiting marine resources to subordinate organizations, agencies, and fishermen.
b) Facilitate the activities of National Hydro-Meteorological Service personnel and other ministries' personnel related to buoy stations within the province.
c) Cooperate with the National Hydro-Meteorological Service and relevant ministries and sectors in searching for and rescuing buoy stations.
Article 3. Awards and disciplinary actions
Organizations and individuals who excel in fulfilling the task of protecting buoy stations for storm warning at sea shall be rewarded according to the general reward system of the State.
Organizations and individuals who fail to fulfill their assigned responsibilities properly or engage in harmful actions against buoy stations for storm warning at sea shall be disciplined, administratively punished, or criminally prosecuted according to the provisions of the law depending on the severity of the violation.
Article 4. Implementation Provisions
This Decision takes effect from the date of signature.
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central government directly related shall be responsible for implementing this Decision.
