Article 1. Issued with this decision is the "Regulations on Registration of Inland Waterway Vessels".
Article 2. The Director of the Vietnam Inland Waterway Transport Administration shall guide the organization and implementation of this decision to ensure uniform management of vessel registration throughout the country.
Article 3. This decision takes effect from September 1, 1996. This decision replaces Decision No. 2491/QD-PC-VT dated December 8, 1993 of the Minister of Transportation promulgating the Regulations on Administrative Registration of River Ships.
Article 4. The Heads of the Ministry's Office, Directors of the Legal Department, Director of the Vietnam Inland Waterway Transport Administration, Directors of Provincial Departments of Transportation and Public Works, and organizations and individuals owning inland waterway vessels are responsible for implementing this decision.

REGULATIONS
REGISTRATION OF INLAND WATERWAY VESSELS
(Issued together with Decision No. 2056 dated August 6, 1996 of the Minister of Transportation)
Chapter 1:
GENERAL PROVISIONS
Article 1.
Article 1. These regulations stipulate the principles and organization of registration of inland waterway vessels in Vietnam.
Article 2. Inland waterway vessels owned by organizations and individuals of all economic sectors must be registered according to these regulations before being put into operation, except for the following types of inland waterway vessels:
a. Special-purpose vessels for security and defense purposes;
b. Fishing vessels;
c. Rafts and household watercraft.
Article 3. Sports vessels shall be registered according to separate provisions.
Article 4. Inland waterway vessels that have been registered under the Administrative Registration Regulations for River Ships No. 2491/QD-PC-VT dated December 8, 1993 of the Minister of Transportation, when their river navigation permits expire, must go through the procedure to change registration.
Article 2. The terms used in these regulations are understood as follows:
Article 1. Inland waterway vessels (hereinafter referred to as vessels) include:
a. Motorized or non-motorized boats and ships;
b. Rafts;
c. Floating structures used for transportation or business services on inland waterways.
Article 2. Household watercraft refers to vessels serving only individual or family needs, not participating in commercial transport, with a carrying capacity not exceeding 5 tons or engine power not exceeding 15 horsepower.
Article 3. Crew members are those working on vessels according to prescribed positions (excluding those working on household watercraft).
Article 3.
Article 1. Crew members working on vessels must be registered in the Crew Register and assigned positions appropriate to the type of vessel as specified by the Ministry of Transportation.
Article 2. The owner of the vessel is responsible for managing and operating the vessel in accordance with current regulations.
Article 3. The owner of the vessel must pay the registration fee for the vessel as stipulated by the State.
Article 4. The Vietnam Inland Waterway Transport Administration performs the function of state management over the registration of inland waterway vessels nationwide.
Chapter 2:
REGISTRATION OF VEHICLES
Article 5. The registration of vessels shall be carried out according to the following principles:
Article 1. Vessels can only be registered at the registration authority where the owner has its main office (if it is an organization) or place of permanent residence (if it is an individual).
Article 2. When transferring ownership, changing technical characteristics, or moving to another region, the vessel must be re-registered.
Article 6. When registering, the owner of the vessel must prepare the following documents:
1. Documents to be submitted:
a. Application for registration (according to the model).
b. Two photographs measuring 9x12 cm showing the full view of the vessel in a floating state from the starboard side.
Article 2. Documents to be submitted:
a. List of crew members (according to the model);
b. Permit for new construction (if the vessel requires a permit for new construction) or import permit (if the vessel is imported);
c. Certificate of technical safety of inland waterway vessels issued by the authorized vessel inspection agency;
d. Tax receipt for stamp duty.
Article 7. The procedure for re-registering vessels is as follows:
Article 1. Transfer of ownership:
In addition to the documents specified in Article 6 (except for the construction permit), the new owner of the vessel must submit the purchase and sale contract for the vessel.
Article 2. Transfer of registration area:
The owner of the vessel goes to the original registration authority to submit:
a. Application for transfer of registration area (according to the model).
b. Certificate of registration of inland waterway vessels.
The original registration authority will collect the above documents, remove the name from the vessel registration book, and issue a "Certificate of Transfer of Registration Area" to the owner of the vessel.
The owner of the vessel then goes to the new registration authority to complete the registration procedures. In addition to the documents specified in Article 6 (except for the construction permit and tax receipt for stamp duty), the owner of the vessel must submit the "Certificate of Transfer of Registration Area".
Article 3. Change of technical characteristics; the owner of the vessel must:
a. Submit the following documents:
- Application for re-registration (according to the model);
- Crew Register;
- Registration certificate of the inland waterway vessel;
b. Present the following documents:
- Certificate of technical safety of inland waterway vessels after changes in technical characteristics.
- List of crew members (if there are any changes).
Article 8. When changing registration, the owner of the vessel must prepare the following documents:
1. Documents to be submitted:
a. Certificate of registration of river ships;
b. Two photographs measuring 9x12 cm showing the full view of the vessel in a floating state from the starboard side.
a. Certificate of technical safety of inland waterway vessels;
Article 2. Documents to be submitted:
b. List of crew members.
Article 1. The registration authority is responsible for registering and issuing related certificates to the owner of the vessel within two days from the date of receiving the complete dossier.
Article 9.
Article 2. If the vessel does not meet the conditions for registration, the registration authority must immediately inform the owner of the vessel.
Article 3. After entering the registration book, the registration authority will issue the following documents to the owner of the vessel:
a. Certificate of registration of inland waterway vessels;
b. Crew Register;
c. Registration number of the vessel.
The name of the vessel is set by the owner of the vessel but must be approved by the registration authority.
Article 10. In cases where the vessel does not have a specific name, the registration number of the vessel will be its name.
Article 1. Remove the registration name of the vessel in the following cases:
Article 11.
a. The vessel is destroyed or missing.
b. The vessel is scrapped.
b. Means of liquidation.
2. The vehicle owner must notify the registration authority to remove the name from the registry book and recover the file.
Article 12.
1. The Department of Transport and the Department of Transport and Public Works shall carry out the registration of vehicles belonging to various economic sectors located in their respective localities. 2. The registration authority under the Department of Transport and the Department of Transport and Public Works shall have the following tasks and powers:
a. Establishing and managing the registration files for vehicles.
b. Issuing certificates of registration for vehicles;
c. Collecting registration fees as prescribed by the State;
d. Reporting on vehicle registrations periodically according to the model prescribed by the Vietnam Inland Waterways Administration.
Article 13. Organizations and individuals who violate the regulations on the registration of inland waterway vessels shall be subject to administrative penalties in accordance with the principles set forth in the Ordinance on Handling Administrative Violations issued on July 6, 1995, and Chapter VII of Decree No. 40/CP dated July 5, 1996, of the Government on ensuring traffic order and safety on inland waterways.
