DECREE OF THE MINISTER OF TRANSPORT TRAN QUANG HAI
Issuing regulations on quality inspection and technical safety
of various types of motor vehicles produced and assembled according to
design and bearing foreign brand names.
THE MINISTER OF TRANSPORTATION
Pursuant to Decree No. 272/CP dated March 22, 1994 of the Government stipulating tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;
Pursuant to Clause 3, Article 3 and Clause 4, Article 4 of Decree No. 86/CP dated December 8, 1995 of the Government stipulating division of responsibilities for state management over product quality;
Pursuant to Decision No. 75/TTg dated February 3, 1997 of the Prime Minister stipulating tasks, powers, and organizational structure of the Vietnam Vehicle Inspection Bureau;
Pursuant to Circular No. 1192/KCM-GTVT dated June 12, 1996 of the Ministry of Science, Technology and Environment and the Ministry of Transport guiding implementation of Decree No. 86/CP dated December 8, 1995 on division of responsibilities for state management over product quality;
Considering the proposal of the Director of the Department of Science and Technology, the Director of the Department of Legal Affairs - Transportation;
DECISION:
Article 1: Now hereby promulgates this Decision "Regulations on Quality Inspection and Technical Safety of Various Types of Motor Vehicles Produced and Assembled According to Design and Bearing Foreign Brand Names".
Article 2:This Decision takes effect 15 days from the date of signature and replaces Decision No. 1259/QD-KHKT-PCVT dated June 4, 1996 of the Minister of Transport.
Article 3:The Heads of the Ministry's Office, Directors of the Departments of Science and Technology, Legal Affairs - Transportation, Directors of the Vietnam Vehicle Inspection Bureau, Vietnam Highway Administration, Provincial and Municipal Departments of Transport and Public Works under the central government, and Heads of units concerned shall be responsible for implementing this Decision./.
REGULATIONS ON QUALITY INSPECTION OF VARIOUS TYPES OF MOTOR VEHICLES
HIGHWAY PRODUCED AND ASSEMBLED ACCORDING TO
FOREIGN BRAND NAMES

GENERAL PROVISIONS
Production and assembly of motor vehicles (MV) as provided herein means using all new parts, assemblies, and systems at 100% imported or domestically produced sources to produce and assemble MVs according to design and bearing foreign brand names, in compliance with current regulations.
Terms used in these regulations are understood as follows:
Motor vehicles (MV) include types of vehicles defined in TCVN 6211:1996 "Road Traffic Vehicles - Type - Terminology and Definitions".
Assembly is understood as: vehicle body or cargo box or specialized equipment installed on the vehicle.
System is understood as: power transmission system, motion system, suspension system, braking system, steering system, electrical system, lighting and signaling devices.
Product is understood as: parts, assemblies, systems, and MVs produced and assembled at production facilities.
Same type products are: products having the same industrial property owner, same design, same technical specifications, same identification code (excluding characters indicating steering wheel position, place of manufacture).
Industrial property owner is understood as stipulated in Article 33, Chapter 4 of Decree No. 63/CP dated October 24, 1996 of the Government detailing industrial property rights.
Scope of application
These regulations apply to the production and assembly of MVs mentioned in Section 1.1, including the production of parts, assemblies, and systems for assembling such MVs.
These regulations do not apply to MVs produced and assembled for military purposes of the Ministry of National Defense and for ensuring social security and public order of the Ministry of Public Security.
Production facility:
A production facility is a foreign-invested enterprise with a production and assembly license for MVs or a domestic enterprise with legal personality registered to operate in the production and assembly of MVs in accordance with current laws, equipped with sufficient material and technical conditions to ensure product quality during production and assembly.
Quality management authority:
The Vietnam Vehicle Inspection Bureau is the specialized state agency for quality management (hereinafter referred to as the Quality Management Authority) organizing and conducting quality and technical safety inspections for the products specified in these regulations.
REGULATIONS ON TECHNICAL FILES OF PRODUCTS TECHNICAL FILES
Technical files.
Technical files of parts, assemblies, and systems include:
Technical drawings, specifications, and quality and technical safety standards accompanying product design and manufacturing standards;
Description of technological solutions to ensure product quality;
Description of symbols used on the product;
Test reports of the production facility for the product;
Copies of quality certificates (if any) distinguished for the following cases:
Written confirmation of the foreign industrial property owner of the product regarding equivalent quality compared to the original prototype of the same type for products manufactured using technology transferred from abroad;
Quality certificates issued by authorized agencies of the exporting country for imported products.
Technical files of MVs include:
Overall drawings, photographs of the product model, technical performance specifications, and quality and technical safety standards accompanying product design and manufacturing standards;
Quality certificates of related assemblies and systems concerning technical safety of the vehicle;
Description of technological solutions to ensure product quality during production and assembly;
Registration form, description of methods and positions for chassis number and engine number stamping;
Technical documentation introducing features and technical characteristics of the product for operation and use;
Results of quality inspection by the production facility for sample products at production and assembly stages;
Copies of quality and technical safety certificates of the vehicle issued by the competent state authority of the product's place of origin.
The document confirming the quality of the means by the foreign industrial property owner shall be equivalent to the original product model.
Inspection of documentation:
Documentation inspection is conducted by the Quality Control Authority. It involves checking and comparing the technical features of the products with current standards and regulations to ensure that the produced and assembled products meet quality requirements, are suitable for infrastructure conditions, and guarantee traffic safety.
The result of the documentation inspection must be notified within fifteen days from the date of receiving valid documentation. In cases where the inspection period needs to be extended due to additional or amended documentation requests, the Quality Control Authority must notify the production facility in writing.
PROVISIONS ON PRODUCTION AND ASSEMBLY
Production and assembly of products must be carried out strictly according to the technical documentation that has been inspected and must satisfy the quality and technical safety requirements.
The production facility is responsible for establishing technological processes, quality control procedures, and equipping necessary testing equipment for each production stage as required. These devices must be tested and calibrated in accordance with current regulations.
For products of the same type that have been certified for quality, the production facility is responsible for maintaining the product quality in accordance with the certified criteria and must bear responsibility for the quality of its products.
PROVISIONS ON QUALITY AND TECHNICAL SAFETY INSPECTION
Quality and technical safety inspection:
Quality and technical safety inspection involves testing, evaluating the quality of components, assemblies, systems, and the entire vehicle produced and assembled according to technical documentation, current quality, technical safety, and environmental protection standards.
The inspection is carried out through sample product testing methods. Sample products used for quality certification must match the type, technical specifications, and origin as specified in Clause 2.
Based on the testing method according to current standards, the Quality Control Authority specifies the number of samples to be tested.
After the sample product passes the standard, the Quality Control Authority issues a Quality Certificate for that type of product, in accordance with one of the models provided in Appendix 1 of this regulation.
For products that are components, assemblies, or systems related to the technical safety of vehicles and have one of the quality certificates mentioned in Clause 2.1.1 of this regulation, the Quality Control Authority may exempt them from inspection.
Quality inspection and certification of products are carried out within fifteen days after the technical documentation has been inspected. If the time needs to be extended due to completing the sample product, the Quality Control Authority must notify the production facility in writing.
For products of the same type that have been issued a quality certificate by the Quality Control Authority, if the production facility meets the conditions stipulated in Clause 4.1.7., it will be authorized in writing by the Quality Control Authority to self-inspect and issue a quality test certificate for each subsequent product according to Clause 4.1.8. and bear responsibility for the quality of its products.
Conditions for the production facility to be authorized to inspect the quality of mass-produced products are as follows:
Meeting the technical infrastructure and equipment conditions set forth in Clauses 1.4. and 3. of this regulation;
Having technicians who perform product quality inspections and are certified by the foreign manufacturer or the Quality Control Authority with appropriate quality inspection qualifications for the type of product being produced or assembled.
The Quality Control Authority conducts inspections and authorizes in writing the production facilities meeting the above conditions.
The quality test certificate for finished products is established according to the models provided in Appendix 2.
Finished product certificates issued according to Model 2a are distributed and managed by the production facility for assemblies and systems.
Finished product certificates issued according to Model 2b are uniformly issued, managed, and guided for use by the Quality Control Authority for motor vehicles.
The person signing the quality test certificate for finished products must be the director of the production facility or someone authorized in writing by the director, and approved by the Quality Control Authority .
Technical documentation for products:
The production facility is responsible for providing the following technical documentation for each finished product:
For assemblies and systems:
The quality test certificate for finished products as stipulated in Clause 4.1.8.;
Product technical specifications and features.
For motor vehicles:
The quality test certificate for finished products as stipulated in Clause 4.1.8;
Technical documentation introducing features and technical characteristics of the product for operation and use;
Product warranty certificate.

4.1.7. Conditions for the production facility to be authorized to inspect the quality of mass-produced products are as follows:
Meeting the technical infrastructure and equipment conditions set forth in Clauses 1.4. and 3. of this regulation;
Having technicians who perform product quality inspections and are certified by the foreign manufacturer or the Quality Control Authority with appropriate quality inspection qualifications for the type of product being produced or assembled.
The Quality Control Authority conducts inspections and authorizes in writing the production facilities meeting the above conditions.

Technical documentation for products;
The production facility is responsible for providing the following technical documentation for each finished product:
For assemblies and systems:
The quality test certificate for finished products as stipulated in Clause 4.1.8;
Product technical specifications and features.
For motor vehicles:
The quality test certificate for finished products as stipulated in Clause 4.1.8;
Technical documentation introducing features and technical characteristics of the product for operation and use;
Product warranty certificate.
The quality test certificate for finished motor vehicles produced and assembled as stipulated in Clause 4.2.2. above is used for registration procedures.
OTHER PROVISIONS
Every six months, the Quality Control Authority compiles the implementation status of product quality inspection work and reports to the Ministry of Transport (through the Science and Technology Department) and informs the Vietnam Highway Administration.
Quality inspection records must be stored at the Quality Control Authority and at the production facility for at least five years.
After granting authorization, the Regulatory Agency has the duty to inspect production facilities in ensuring the quality of produced and assembled products. In case of discovering violations related to product quality assurance by production facilities, the Regulatory Agency may revoke the Quality Inspection Authorization Certificate.
The Regulatory Agency is permitted to collect fees related to the inspection and certification of product quality according to current regulations.
Product quality certificates, factory release quality inspection reports, and quality inspection permission labels issued for products specified in Section 1.3. before this Decision takes effect shall remain valid for use.
Based on its functions and responsibilities, the Regulatory Agency is responsible for providing specific guidance on the implementation of this regulation./.
